Abstract

Marriage Dispensation is an attempt by the prospective bride and groom to obtain a decision from the court to enter into a marriage for underage couples. Applications for marriage dispensation have increased since the COVID-19 pandemic hit Indonesia. This research focuses on analysing the factors behind the increase in requests for marriage dispensation and seeking efforts to overcome the increase in requests for dispensation. The research method used is field research with a qualitative approach. Data collection techniques were collected through observation and interviews with judges from the Padangsidimpuan Religious Court and the Pengabungan Religious Court. Interviews were also conducted with the Padangsidimpuan and Mandailing Natal Women's Empowerment and Child Protection Services and the people of Padangsidimpuan and Mandailing Natal, who submitted requests for dispensation from marriage. The results of this study indicate that the reasons for the prospective bride and groom applying for dispensation include juvenile delinquency (free sex), pregnancy out of wedlock, arranged marriages, low economy, and encouragement of traditional traditions (marlojong). Efforts were made to address the increase in requests for marital dispensation by strengthening the role and cooperation between the Religious Courts, the Women's Empowerment and Child Protection Service (DP3A), and the community (family)..

Abstract

This study discusses the importance of implementing a sustainable business model in accordance with the principles of Islamic economic law in the modern era. The main issues raised are the increasing violations of business ethics due to unfair competition and lack of attention to social and environmental sustainability in business activities. The formulation of the problem in this study includes how a sustainable business model can be implemented in accordance with Islamic principles to overcome these challenges. The purpose of the study is to provide guidance on the implementation of Islamic business ethics as a foundation in building a sustainable business model that is able to answer global needs. The research method used is a literature study with a qualitative approach, relying on secondary data from various literature sources related to the digital economy and Islamic business ethics. The results of the study indicate that a sustainable business model can be implemented by strengthening the principles of justice, transparency, and avoiding practices that violate Islamic law such as usury, maysir, and gharar. In addition, the triple bottom line approach (profit, people, planet) integrated with Islamic values is able to create economic, social, and environmental sustainability. This article emphasizes the importance of compliance with Islamic principles and the role of supervisory institutions in ensuring ethical and just business sustainability.

Abstract

Digitalisasi peradilan melalui penerapan e-Court dan e-Litigasi merupakan bagian dari transformasi sistem peradilan di Indonesia, termasuk di lingkungan Peradilan Agama yang memiliki kewenangan absolut dalam penyelesaian sengketa ekonomi syariah. Penelitian ini bertujuan untuk menganalisis tantangan dan peluang digitalisasi Peradilan Agama dalam penyelesaian sengketa ekonomi syariah pasca implementasi e-Court dan e-Litigasi, ditinjau dari perspektif teori hukum dan hukum Islam. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris dengan pendekatan perundang-undangan, konseptual, dan kasus. Data diperoleh melalui studi kepustakaan serta dokumentasi laporan resmi dan putusan Pengadilan Agama terkait sengketa ekonomi syariah. Hasil penelitian menunjukkan bahwa secara normatif, implementasi e-Court dan e-Litigasi telah memberikan landasan hukum yang kuat dalam mewujudkan asas peradilan yang sederhana, cepat, dan biaya ringan. Namun, dalam praktiknya masih ditemukan berbagai tantangan, seperti keterbatasan literasi digital para pihak, kesiapan sumber daya manusia aparatur peradilan, kendala infrastruktur teknologi, serta belum optimalnya adaptasi hukum acara peradilan agama terhadap mekanisme persidangan elektronik, khususnya pada tahap pembuktian perkara ekonomi syariah yang kompleks. Di sisi lain, digitalisasi Peradilan Agama memiliki peluang besar dalam meningkatkan akses keadilan, efisiensi penyelesaian perkara, dan perlindungan hak-hak ekonomi para pihak. Dari perspektif fiqh qaḍā’ dan maqāṣid al-syarī‘ah, digitalisasi peradilan dapat diterima sepanjang tetap menjamin keadilan substantif dan kemaslahatan. Oleh karena itu, penguatan regulasi teknis, peningkatan literasi digital, dan pengembangan pedoman e-Litigasi yang berorientasi syariah menjadi kunci optimalisasi digitalisasi Peradilan Agama.

Abstract

Community Service Based on Religious Moderation is carried out as a tolerant attitude, an embodiment of religious moderation which is actualized through the Religious Moderation Village (KMB), carrying out dialogue between religious believers as a form of harmony and tolerance. As well as literacy materials to minimize conflict between religious communities. South Sibolga has a diverse population, 67.15% Muslim, 29.23% Protestant, 3.04% Catholic and 0.65% Buddhist. This service uses the Participatory Action Research (PAR) method including planning, implementation and discovery of field facts. The results of the Service show an increase in the understanding of religious moderation in the South Sibolga community from 55% to *)% based on the results of questionnaire data that was distributed before and after the activity was carried out.

Abstract

There is a negative stigma which assumes that Islam does not respect the position of women, limits its freedom is unjust and makes women a second-class human being under the control of men. These reasons make this writing is interested.Departing from that thought, they also considered that Islam wash the main obstacle to the strunggle for gender aquality.The purpose of this study is to uncover the core problem of gender aquality in an islamic perspective.This research wash conducted using islami study methods and approaches.The position of woman in islam has the same rights and obligation as men, althought there are somethings that woman cannot do and men can do, and vice versa.As for what distinguishes the degree between men and women is the level of piety.Islam has far raised the status of women and it can be said that in other religions there is nothing like and even exceeding the privileges of women other than in Islam.

Abstract

International humanitarian law (IHL) has an important role in providing protection for individuals involved in humanitarian assistance, especially humanitarian workers operating in conflict zones. Humanitarian workers are often targeted in armed conflicts, which threatens their safety in carrying out their humanitarian duties. This research aims to explore how IHL can provide legal protection for humanitarian workers, both in the context of international law and practice in the field. Drawing on the Geneva Conventions and Additional Protocols, as well as international court decisions, this article analyzes the challenges facing humanitarian workers in conflict zones and the legal steps that can be taken to improve their protection. The findings of this research show that despite clear protections in international law, effective implementation is often hampered by legal violations occurring on the ground, lack of law enforcement, and uncertainty about the status of humanitarian workers. Therefore, strengthening international cooperation, increasing awareness of humanitarian law, and stricter law enforcement mechanisms are urgently needed to protect humanitarian workers in conflict zones.

Abstract

Penelitian ini bertujuan untuk menganalisis penggunaan QRIS (Quick Response Code Indonesian Standard) dalam transaksi oleh Usaha Mikro, Kecil, dan Menengah (UMKM) ditinjau dari prespektif Hukum Ekonomi Syariah. Perkembangan teknologi digital di masa kini QRIS menjadi metode yang semakin diminati karena kemudahan dan efisiensinya serta berbagai manfaat lainnya. Namun, masih terdapat pertanyaan terkait kesesuaian penggunaannya dengan prinsip-prinsip syariah, khususnya dalam praktik pelaku UMKM. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi pustaka dan observasi lapangan terhadap beberapa pelaku UMKM di Kota Padangsidimpuan. Hasil penelitian menunjukkan bahwa penggunaan QRIS secara umum telah memenuhi prinsip keadilan dan kemaslahatan dalam Islam, namun masih perlu edukasi mengenai akad yang sesuai serta perlindungan konsumen secara syariah. Penelitian ini memberikan kontribusi bagi penguatan transaksi digital yang sejalan dengan nilai-nilai ekonomi Islam.

The Nigerian Hajj Commission (NAHCON) plays a pivotal role in ensuring seamless pilgrim experiences. However, persistent challenges in governance, transparency, and service delivery underscore the need for transformative reforms. This study leverages existing literature, policy documents, and international best practices to develop a strategic framework for NAHCON’s excellence in Hajj management, aligning with the United Nations’ Sustainable Development Goals (SDGs). A comprehensive review of NAHCON’s mandate, structure, and operations identifies governance gaps, transparency bottlenecks, and service delivery inefficiencies. Comparative case studies of leading Hajj management authorities (e.g., Saudi Arabia’s Hajj Ministry, Malaysia’s Tabung Haji) inform the development of a tailored strategic framework that integrates: Enhanced Governance Structures: Board restructuring and professionalization, Transparency Mechanisms: Real-time reporting and e-governance platforms, Pilgrim-Centric Services: Customized packages and digitalized processes. The framework is designed to boost NAHCON’s institutional capacity, improve pilgrim satisfaction, and position Nigeria as a leader in global Hajj management. Policymakers, Hajj authorities, and development partners will find this research instrumental in shaping inclusive, accountable, and efficient Hajj systems.

Abstract

The attempt to end the life of a person suffering from an incurable disease is called euthanasia. He will be relieved from suffering through the euthanasia process. This research aims to analyze the practice of euthanasia in the context of applicable law in Indonesia as well as reviewing its compatibility with the principles of Islamic law. This type of research is library research. The results show that in Indonesia, euthanasia is illegal and cannot be performed. Both positive law and the medical code of ethics prohibit euthanasia. According to Islamic law, active euthanasia is haram and can be punished by Allah with the punishment of hell for those who do it. The attempt to end the life of a person suffering from an incurable disease is called euthanasia. He will be relieved from suffering through the process of euthanasia. In Indonesia, euthanasia is illegal and cannot be performed. Both positive law and the medical code of ethics prohibit euthanasia. In Islamic law, it is explained that euthanasia.
