Abstract

 Perkembangan teknologi khususnya internet telah mempermudah masyarakat untuk mengakses dan mendistribusikan informasi. Namun, kegiatan seperti copy-cut-paste (menyalin-memotong-menempel), menyunting (editing) ataupun berbagi dokumen (file sharing) justru menimbulkan hal kontradiktif terhadap hukum hak cipta. Berdasarkan hal tersebut tahun 2002 sebuah organisasi nirlaba membuat inovasi dan terobosan yang memungkinkan berbagi dan menggunakan kreativitas dan pengetahuan melalui alat hukum gratis. Metode penelitian yang digunakan dalam tulisan ini adalah metode penelitian yuridis normatif dengan fokus pada pendekatan perundang-undangan dan analisis konten. Berdasarkan analisis pembahasan creative commons bukanlah alternatif dari hukum hak cipta, melainkan bekerja berdampingan dan mampu membuat pencipta/pemegang hak cipta memodifikasi haknya ke dalam keadaan yang paling sesuai dengan kebutuhan. Lisensi creative commons di Indonesia penggunaannya dimungkinkan menurut Pasal 9 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Lalu pemegang hak berdasarkan Pasal 81 UU Hak Cipta, dapat mengumumkan dan/atau berhak memberikan lisensi kepada pihak lain berdasarkan perjanjian lisensi untuk melaksanakan perbuatan sebagaimana dimaksud dalam Pasal 9 ayat (1), memperbanyak ciptaannya/produk hak terkaitnya dengan persyaratan tertentu. Selanjutnya berdasarkan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik Pasal 1 ayat (5), kegiatan yang dilaksanakan oleh creative commons adalah kegiatan penyelenggaran sistem elektronik.Kata Kunci: Creative Commons; Hak Cipta; Lisensi. The development of technology, especially the internet, has made it easier for people to access and distribute information.  However, activities such as copy-cut-paste, editing or file sharing may actually harm the copyright law.  Based on that, in 2002, a non-profit organization made a breakthrough innovation where it is possible to share and use creativity and knowledge through free legal tools. The research method used in this paper is a normative juridical research method with a focus on the statutory approach and content analysis. Based on the analysis of the discussion, creative commons is not an alternative to copyright law, but rather work side by side and is able to make the creator/copyright holder to modify their rights in the most appropriate circumstances.  The use of creative commons licenses in Indonesia is possible according to Article 9 paragraph (1) of Law Number 28 of 2014 concerning Copyright. Furthermore, the rights holder, based on Article 81 of the Copyright Law, able to announce and/or has the right to grant license to other parties based on the license agreement to carry out the action referred to in Article 9 paragraph (1), reproduce their rightful works/products with certain conditions. Furthermore, based on Law Number 11 of 2008 concerning Electronic Information and Transactions Article 1 paragraph (5), the activities carried out by the creative commons are the activities of organizing an electronic system. Abstract

Hasil penelitian menunjukkan bahwa  koperasi syariah memiliki potensi dan peranan yang sangat besar dalam upaya mendukung pemberdayaan UKM di Bandar Lampung, hal ini terlihat dari data laporan pembiayaan UKM di lokasi penelitian sebelum dan sesudah mendapatkan pembiyaan dari Koperasi Syariah BTM yang juga membantu pengembangan UKM dan praktek pemberdayaan UKM yang dilakukan oleh Koperasi Syariah BTM Bandar Lampung yang memberikan pembiayaan jasa layanan kepada masyarakat yaitu program kredit usaha dengan nisbah bagi hasil yang disepakati 30:70 dengan marjin 18% pertahun. Peranan Koperasi Syariah BTM Lampung dalam pemberdayaan UKM menurut perspektif ekonomi Islam yaitu koperasi syariah berdasarkan al-Quran dan as-Sunah yaitu: Saling tolong menolong (ta’wun) dan saling menguatkan (tafakul) yang didasarkan pada al-Quran surat al-Maidah (5) ayat 2. Koperasi syariah BTM Bandar Lampung juga menjunjung tinggi keadilan serta menolak setiap bentuk ribawi dan pemusatan sumber dana ekonomi pada segelintir orang atau sekelompok orang saja. Hal ini di dasarkan pada al-Quran surat al-Rum ayat 39.

Abstract

The growth of various business sectors in Indonesia has shown quite rapid development, both in the industrial and service sectors, so that in turn competition will emerge that should be seen as positive, where with the competition itself, business actors will compete to continue to improve their products or services generated so that businesses continue to innovate and strive to provide the best products or services for consumers. According to the results of research that business competition according to Islamic economic law is permissible competition, as long as business competition is carried out in a healthy manner, but if the business competition is monopolistic in order to take advantage, then the Islamic economy prohibits it. This is because Islamic economics provides a line that business competition must be conducted fairly (fair play) with the principles of honesty (honesty), openness (transparentcy), and justice (justice). Meanwhile according to Law No. 5 of 1999, business competition is permissible competition, however if competition between business actors in carrying out production and or marketing activities of goods and or services carried out in a manner that is dishonest or against the law or inhibits business competition, according to the provisions of Article 17 paragraph (1) Law No. 5 of 1999, such business competition is prohibited.

Abstract

This study aims to analyze the marketing strategy of Labuhan Jukung tourism beach Pesisir Barat Regency and its impact on people's welfare in the perspective of Islamic economics. The results of the study show that the marketing strategy carried out by the manager of Labuhan Jukung Tourism Beach in the Pesisir Barat Regency is by collaborating with parties involved in tourism marketing. The manager implements 4 marketing strategies, that is product strategy, price strategy, promotion strategy and distribution strategy. The impact of this marketing strategy is the increasing public welfare in the Labuhan Jukung Tourism beach. Islamic economics sees that the marketing strategy of Labuhan Jukung Tourism Beach is in accordance with Islamic economic principles. This can be seen from the 4 strategies carried out, that is product strategy, place strategy, price strategy, and promotion strategy, there are no practices that violate Islamic economic principles.

Abstract

The purpose of this study is to analyze the consumerism culture of urban communities based on the Islamic economic perspective. This research is a descriptive study with a qualitative approach, which uses data reduction, data display, and concluding. The data collection methods were divided into two types, the library method, and the field method. The love of property is being experienced by some urban communities in the city of Bandar Lampung. According to the results of research and studies conducted by the writers, consumption can be defined as the use of goods or services to meet all human needs. The level of consumption that occurs in urban communities in Bandar Lampung can be defined as tahsiniyah, hajiyah, dharuriyah, and hajiyah. The consumerism culture has flourished in the majority of Bandar Lampung citizens.

Abstract

Zakat memiliki peran penting dalam kaitannya dengan pemberdayaan masyarakat, dan mengandung hikmah yang besar dan mulia, tidak hanya bagi orang yang berzakat, dan penerimannya, namun juga bagi masyarakat sekitar secara keseluruhan. Berdasarkan hal tersebut, tujuan penelitian ini adalah untuk menelaah lebih dalam tentang pemberian modal usaha melalui pendayagunaan zakat produktif oleh Baznas Provinsi Lampung dan DPU-DT Cabang Lampung melalui berbagai program yang solutif untuk masyarakat dhuafa. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan menggunakan data kepustakaan dan data lapangan. Pengumpulan data lapangan menggunakan metode interview, observasi dan dokumentasi. Metode analisis data yang digunakan deskriptif komparatif analitik dengan membandingkan dua lembaga, pengambilan kesimpulan menggunakan kerangka berfikir induktif dan deduktif. Hasil penelitian ini yaitu pemberian modal usaha melalui pendayagunaan zakat produktif oleh Baznas dilaksanakan dengan menerapkan program Bina Ekonomi Terpadu. Ide dasar pendayagunaan tersebut adalah ketika menolong mustahiq maka jangan diberi “ikan”, namun diberi “kail”. Sedangkan Laznas DPU-DT melaksankan pendayagunaan zakat melalui Program Microfinance Syari’ah Berbasis Masyarakat (Misykat). Program ini bersifat produktif bukan charity, dengan menggunakan pola 2-2-1 dalam perguliran dana dan adanya sistem tanggung renteng. Program pendayagunaan zakat secara produktif tidak dilarang oleh Islam, sebab kemaslahatan yang dicapai dari program yang ada sesuai dengan tujuan ketetapan hukum Islam itu sendiri.

Abstract

The leader is a key component of the government system. Referring to the Prophet Muhammad and his companions' leadership attributes as described in many literatures, a leader must be a Muslim who is istiqamah (consistent), trustworthy, honest, and fair. Another issue comes when the leader is not Muslim but has a trustworthy, honest, and fair character in carrying out his leadership responsibilities. This article tries to give answers to these issues through many sources of literature, particularly leadership for the Indonesian Muslim community, which has a Muslim population of 231.06 million (86.7 percent) (according to The Royal Islamic Strategic Studies Center/RISSC). According to the findings of this study, the leader serves as a substitute for the Prophet in world and state affairs. As a result, the legislation enabling non-Muslims to handle Muslim affairs is prohibited, because non-Muslim leaders will be unable to implement it for the Muslim community. His leadership will put his group's interests over the Muslim group's. Although scholars disagree in their opinions on non-Muslim leaders, some scholars restrict the selection of non-Muslim leaders since they share beliefs with helpers and leaders. Some other scholars agree that non-Muslim leaders can exist in Muslim-majority territories because they no longer fit the contemporary context.

Abstract

Textile and industry fashion is one of the largest economic sectors in Indonesia, supported by increasingpublic interest in fashion products at home and abroad and the circulation of trends that are increasingly dynamicevery year. The increasingly diverse segmentation of textile and fashion products also supports the acceleration of theeconomy and creative industries in Indonesia. With the development of the textile and fashion industries, the presenceof waste in the manufacturing process is unavoidable. Therefore, the objectives of this research can be formulated,namely to find out the analysis of the effect of Zero Waste Fashion on the environment and business development,whether it is able to fix all existing problems, especially to minimize waste on the environment and also assist in thebusiness development process. This research is a type of qualitative descriptive research. This research was con�ducted at Yasmin Wiwid’s home industryEcoprint Sustainable FashionPesawaran Regency, by collecting and study�ing data obtained from observations and interviews with data triangulation so as to obtain a research objective to beachieved. Based on the analysis of existing facts and data, the authors conclude that the implementation of Zero WasteFashion is capable of having a positive impact on the environment and a positive effect on the business developmentprocess as seen from various assessment parameters and success indicators used and in accordance with the prin�ciples existing in Islamic business ethics and also some existing theoretical assumptions such as Theory of PlannedBehavior, Environmental Awareness Purchase Intention Model and Biocentric Theory.

Abstract

Work ethic is a person's attitude and view at work, sourced from self-quality, realized based on values ​​and implemented in activities at work. A work ethic based on Islamic values ​​will form a Muslim full of responsibility and hard work in carrying out his duties at work. At a practical level, an understanding of the Islamic work ethic will have a major impact on work. The results of this study indicate that in general the understanding of the Islamic work ethic of the employees of UIN Raden Intan Lampung and IAIN Metro is in accordance with the theory of Islamic work ethic. However, in practice not all employees carry out an Islamic work ethic which includes work to seek sustenance, work is worship, work professionally, work hard, respect time (discipline), uphold honesty. According to the Islamic perspective, work is part of fulfilling the needs of life which are divided into primary, secondary and tertiary needs. These three needs are very important for the running of human life in general and humans in particular. If it does not work, then humans will naturally experience difficulties which will eventually fall into sin.

Abstract

This study aims to determine the influence of online customer ratings, prices and service quality on customer loyalty in Maxim online transportation in Bandar Lampung and to determine the influence of online customer ratings, prices and service quality on customer loyalty in Maxim online transportation from an Islamic business perspective. This study uses quantitative methods and data collection using questionnaires. The population in this study were Maxim users in Bandar Lampung, with a sample of 96 respondents obtained through purposive sampling techniques. Data was processed using SmartPLS version 4. The results of this study are that Online Customer Rating does not have a significant effect on Customer Loyalty. This can be seen from the original sample value, namely the original sample is 0.146, the t-statistic is 1.166 <1.96 and the p-values ​​are 0.123> 0.05. Furthermore, Price has a positive and significant effect on Customer Loyalty. This can be seen from the original sample value, namely the original sample is 0.482, the t-statistic value is 2.816> 1.96 and the p-values ​​are 0.002 <0.05. Furthermore, Service Quality has a positive and significant effect on Customer Loyalty. This can be seen from the original sample value, namely the original sample is 0.300, the t-statistic value is 2.262> 1.96 and the p-values ​​are 0.013 <0.05. In the perspective of Islamic business on Online Customer Rating, Price and Service Quality affect Customer Loyalty. This is explained by the value of the Customer Loyalty determination coefficient from an Islamic business perspective of 0.659 or 65.9% and the remainder, namely 34.1%, is explained by other constructs or influences outside the research conducted.
