Abstract

Pengadaan barang dan jasa di lembaga pemerintahan seyogyanya dilakukan berdasarkan analisakebutuhan dari setiap instansi pemerintahan, dan dilakukan berdasarkan peraturan perundang-undangan.Pengadaan barang dan jasa yang kini dilaksanakan oleh Unit Layanan Pengadaan disetiap instansi dandilakukan melalui Layanan Pengadaan Secara Elektronik (LPSE), ternyata belum dapat menghadang perilakukorupsi, kolusi dan nepotisme dari berbagai pihak, baik dari panitia pengadaan maupun pihak rekanan. Tulisanini mencoba melihat beberapa aspek pidana dari berbagai sudut pandang sekaligus menemukan upaya solusiperspektif analisis preventif.Kata Kunci : Tindak Pidana, Korupsi, Pengadaan Barang dan Jasa

Abstract

Abstract: The provision of legal aid to date is still not fully felt for the poor, especially the legal and justice aspects. The issuance of Law Number 16 Year 2011 on Legal Aid or so-called UUBH becomes an important breakthrough in constitutional development post-reformasi law. This paper focuses on the provision of legal aid by the Legal Aid Post (Posbakum) in the Religious Court of Bengkulu City. This research is a qualitative research with interview to get data. The results showed that the implementation of legal services through Posbakum in Religious Courts of Bengkulu City has been going well. Although in the implementation of legal services is still constrained by the human resources (HR) in Posbakum, but if dihat from the administrative process and the impact of legal aid services, the overall implementation of legal services through Posbakum in the Court of Religion has been running well according to achievements based on legislation

Abstract

The use of the death penalty in criminal law to achieve the aims of criminal law has sparked much controversy among criminal law professionals. The advantages and disadvantages of adopting death punishment to meet the aims of criminal law, such as providing a sense of security, justice, and so on. In the hierarchy of rules and regulations in Indonesia, the 1945 Constitution is the highest source of legislation. Article 28 (a) of the Indonesian constitution guarantees the right to life and provides that everyone has the right to survive and defend his or her life and existence. As a result, the right to life is a constitutional guarantee. Thus the right to life is a constitutional right. The United Nations also issued a guide entitled Safeguards Guaranteeing Protection of the Rights of Those Facing the Death Penalty through UN Economic and Social Council Resolution 1984/50, dated 25 May 1984. This guide clarifies discussions on the practice of the death penalty under the International Covenant on Civil and Political Rights.

Abstract

This study aims to examine the determinants of behavioral intention among online zakat service users in Indonesia by extending the Technology Acceptance Model (TAM) with the variables of trust and security, and by interpreting the results through the lens of Indonesian local culture. The rapid digitalization of religious philanthropy in Indonesia has expanded the use of online zakat platforms, yet adoption remains uneven and is shaped by concerns that go beyond the classical TAM. Data was collected through an online survey distributed to 120 respondents who were selected by purposive sampling from among users of online zakat platforms. The data were analyzed using Partial Least Squares Structural Equation Modelling (PLS-SEM) with reliability, convergent and discriminant validity, and common method bias diagnostics. The results indicate that perceived usefulness, security, and behavioral intention significantly affect adoption, while perceived ease of use shows an unexpected negative effect and trust shows only a marginal effect. The model explains 38.2 per cent of variance in behavioral intentions. Read against Indonesian patterns of collectivism, religious authority, and gotong royong, the findings suggest that users’ priorities tangible benefits and transactional security over interface simplicity, and they call on zakat institutions to combine platform usefulness and data protection with ulama-led and community-based trust-building strategies to widen digital zakat adoption in Indonesia.

Abstract

This study aims to analyze how a local living law intervenes with fiqh al-munākaḥāt while turning it into a living practice, either in enforcing or diminishing the ideal concept of the latter. Piil Pesenggiri, a form of local wisdom within the Lampung community, shapes and structures how local Muslim practice their religion in term of wedding and marriage. However, its position aligning with fiqh al-munākaḥāt in solving the daily family problem of local Muslim was not clear enough. This study employs a socio-legal approach using qualitative methods. Data were collected through fieldwork, in-depth interviews with purposively selected informants, customary leaders, religious figures, and married couples across Central Lampung, South Lampung, and Pringsewu. The data were analyzed using the living law framework, specifically how Piil Pesenggiri as a normative ‘inner order’ negotiates with formal fiqh doctrines, which reconstruct the daily practice of Islamic family law. The results show that when it comes to planning weddings and leading a married life, Piil Pesenggiri either upholds or downplays Islamic rule. The way Lampung people implement Islamic law in their families—from the idea of qiwāmah, or family division of labour, to family conflict resolution, to a number of wedding provisions—makes this negotiation very clear.

Abstract

In the direction of state policy, religious moderation has been contained in the National Medium-Term Development Plan (RPJMN) for 2022-2024. The Ministry of Religion is one of the institutions explicitly given by the state to carry out government affairs in the field of religion, especially in strengthening religious moderation. This paper aims to analyze the indicators in implementing the strategy to strengthen the policy direction of religious moderation in the ministry of religion. The method uses library research based on analysis from various reference sources, both books and online journals. This paper concludes that strategies to strengthen the direction of religious moderation are grouped into four indicators: 1). national commitment; 2). Tolerance; 3) non-violence; 4) acceptance of local culture. This paper also shows that the strategy of strengthening moderation requires the participation of all parties. In this case, social agents, community leaders, and religious leaders are expected to play an active role in a moderate attitude toward religion
