Abstract

Perkembangan teknologi informasi pada awal abad dua puluh satu ini telah menyebabkan terjadinya hubungan dunia tanpa batas. Salah satu produk dari meningkatnya intensitas teknologi informasi adalah perdagangan elektronik (e-commerce) yang kemudian juga diterapkan pada transaksi bisnis internasional. Hal ini tentunya telah mengubah paradigma sistem perdagangan di dunia yang sebelumnya serba konvensional menjadi non-konvensional. Konflik dan sengketa dalam transkasi bisnis internasional yang menggunakan e-commerce bukanlah suatu hal yang baru. Namun, mengingat sengketa yang akan diselesaikan tersebut akan melibatkan beberapa negara, maka timbul beberapa permasalahan faktual. Adapun permasalahan yang akan diteliti adalah terkait dengan hukum apakah yang berlaku dalam penyelesaian sengketa transaksi bisnis internasional yang menggunakan e-commerce. Berdasarkan hasil temuan, maka dapat disimpulkan bahwa hukum yang berlaku adalah hukum yang dipilih oleh para pihak (pilihan hukum) sebagaimana yang diatur dalam kontrak elektronik internasional yang mereka buat. Pilihan hukum tersebut dapat dilakukan secara tegas ataupun secara diam-diam. Penerapan metode hukum yang berlaku ini diatur dalam ketentuan Pasal 7 Konvensi Hague dan Pasal 3 ayat (1) Konvensi Roma yang mengatur hal serupa. Namun bila tidak diatur, maka hukum yang berlaku adalah hukum yang mengacu pada hukum penjual, yang didasarkan atas the Most Characteristic Connection Theory (asas Hukum Perdata Internasional) sebagaimana yang diatur dalam Pasal 8 Konvensi Hague serta Pasal 4 ayat (l) dan (2) Konvensi Roma. Abstract: In the last 2lst century, the development of information technology has caused the borderless world connection. One of that product is electronic commerce (e-commerce) which also applied in international bussiness transaction (international trading transaction). Consequently, it has changed trading system in the world, where is adhered conventional before to non-conventional trading now. Conflict and bussiness dispute also occured in international trading transaction which used e-commerce. But, we must remember that the dispute of it will be involving some countries in the world. So that is why it can rise some factual problems in that implementation. Therefore, the problem which will researched in this paper are: what is the applicable law that applied in the resolution of international trading which used e-commerce and what is the qualified .forum that applied in the resolution of international trading which used e-conmmerce. Based on the result, the conclusions are: the applicable law in this dispute resolution is the law which choosed by the parties (the choice of law) in their electronic international contract. In practically, it is not only the clearly choice of law but also imlply choice of law. Application of the method applicable law is regulated in the provisions of Article 7 and Hague Convention Article 3 (1) of the RomeConvention. But if not regulated, the applicable law is the law of the seller, which is based on the Most Characteristic Connection Theory (Principle of International Law), as stipulated in Article 8 of Hague Convention and Article 4 paragraph (1) and (2) of the Rome Convention. Abstract

This study comparatively analyzes refugee management models in Indonesia, Malaysia, and Thailand—three key ASEAN frontline states that have not ratified the 1951 Refugee Convention. It investigates how this humanitarian issue has been securitized and integrated into their national security frameworks. Refugee movements, dominated by populations like the Rohingya, have evolved from a humanitarian crisis into a regional security challenge involving sovereignty, border control, human smuggling, and domestic social cohesion risks. Due to the lack of a binding international legal structure, these countries rely on ad hoc and discretionary approaches, dictated by internal political and geopolitical calculations. Using a qualitative-comparative methodology based on securitization theory, the research reveals significant variation in implementation. Indonesia attempts to balance humanitarian efforts (via IOM/UNHCR) with sovereignty concerns, viewing management as an issue of maritime security and public order. Conversely, Malaysia demonstrates the highest level of securitization, explicitly linking refugees to immigration violations and economic/health threats, with harsh law enforcement as the primary measure. Thailand employs a 'pragmatic border control' model, treating refugees as a short-term immigration matter susceptible to domestic military and political interests. This demonstrates a dominant security logic prioritizing national interests and rationalizing the rejection of non-refoulement. The main conclusion is that the failure to establish a binding regional burden-sharing mechanism encourages states to shift responsibility to the security domain, exacerbating refugee vulnerability and empowering smugglers. An urgent ASEAN policy shift toward a legal-institutional protection framework is required.

Abstract

Climate change has become a major driver of cross-border displacement, creating the phenomenon of climate refugees. Although the 1951 Refugee Convention does not explicitly recognize this category, the reality of climate-induced displacement demands legal and policy responses from states, including Indonesia. As a transit country, Indonesia lacks a national legal framework specifically addressing the status and protection of climate refugees, and in practice, protection relies on the United Nations High Commissioner for Refugees through the single submission scheme, the only system for refugee identification and registration in the country. This reliance exposes a regulatory vacuum and legal vulnerabilities related to state sovereignty. This paper examines Indonesia’s response, highlighting the importance of updating national regulations and strengthening coordination with UNHCR to provide inclusive, human rights-based protection for climate refugees.

Abstract

Indonesia's geographical location at the intersection of two continents and oceans makes it a strategic consideration in assessing maritime development potential. To achieve maritime security resilience oriented toward the management and efficiency of maritime resources, the existence of law enforcement and legal substance in maritime zones is necessary to formulate legal certainty. The parent legal provisions governing maritime zone provisions and management rests on Law Number 17 of 1985, which ratified UNCLOS 1982, with its 320 articles and 9 annex. Among the various maritime zone provisions, there is the term "contiguous zone," which is a special jurisdiction extending 24 miles from the regulated sea baseline and serves as the basis for Immigration, Customs, Fiscal, and Sanitary Affairs to conduct supervision related to its legal provisions. However, the regulation of contiguous zones or maritime area specifications has not been accommodated in Law Number 6 of 2011 concerning Immigration as a form of active supervisory function, while Law Number 17 of 2006 concerning Customs has long accommodated provisions providing concrete supervision. This paper aims to analyze the harmonization of legislation, historical, and empirical aspects related to legal considerations regarding the formulation of articles regulating the locus of jurisdiction for maritime immigration supervision, thereby providing an ideal legal formulation within the framework of academic studies. The research method used in this paper is a normative-empirical one. The theory in this study applies Lawrence Friedman's legal system theory as an analytical tools. The results also indicate the legal impacts that lead to downstream problems related to immigration violations in maritime zones due to the lack of zoning regulations. Therefore, constructive legal and policy formulations are needed to serve as a fundamental foundation for projecting a comprehensive immigration oversight mechanism in Indonesia's maritime zones.
