Abstract

E-commerce creates a new dynamic in trade, connecting consumers with businesses from various regions and countries. However, consumers often face risks such as fraud, lack of transparency in transactions, and concerns regarding personal data protection, especially amid rising privacy violations. Existing regulations often struggle to fully address the complexities of these issues. This study employs a qualitative method with a normative juridical approach. The data source used in this research is secondary data. The primary legal foundations of this study are Law No. 8 of 1999 on Consumer Protection and Law No. 19 of 2016, which amends Law No. 11 of 2008 on Information and Electronic Transactions. This research identifies consumer rights, business obligations, and legal responsibilities inherent in electronic transactions. Although these laws provide a clear legal framework, there is a weakness in extending protection to businesses based outside the country, leaving consumers vulnerable to fraud. This study recommends the development of more comprehensive policies to enhance consumer protection, including regulations capable of addressing the challenges of globalization in e-commerce.

Abstract

This study aims to analyze and understand the problem of corruption in government procurement of goods and services in Indonesia. Corruption in this sector has become a serious issue, considering its detrimental impact on state finances and the people's economy. The research method used is normative juridical, with a statutory approach that refers to applicable regulations. The results of the study indicate that the factors that influence corruption include weak planning and budgeting processes, lack of transparency and accountability, and inadequate law enforcement. In addition, overlapping authorities and high procurement costs also contribute to corrupt practices. This study concludes that to overcome the problem of corruption in government procurement of goods and services, a comprehensive reform of the procurement system is needed, including increasing transparency, accountability, and public participation. In addition, strengthening law enforcement and implementing stricter sanctions against perpetrators of corruption are very important to create a conducive climate for clean and efficient procurement. The recommendations resulting from this study are expected to be a reference for policy makers in creating a procurement system that is more transparent, accountable, and free from corruption, collusion, and nepotism (KKN).

Abstract

Penelitian ini membahas problematika penerapan hukuman mati di Indonesia dengan menyoroti aspek hukum pidana serta dampak sosial-kulturalnya. Tujuan utama penelitian ini adalah untuk mengkaji konsistensi sistem peradilan dalam menjatuhkan vonis mati, persepsi masyarakat terhadap hukuman tersebut, serta posisi Indonesia dalam konteks hak asasi manusia internasional. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi literatur, yang menganalisis berbagai sumber sekunder seperti peraturan perundang-undangan, artikel ilmiah, putusan pengadilan, dan laporan lembaga HAM. Hasil penelitian menunjukkan bahwa penerapan hukuman mati di Indonesia sering tidak konsisten dan dipengaruhi oleh tekanan sosial maupun politik. Selain itu, persepsi publik terhadap hukuman mati dibentuk oleh konstruksi budaya dan agama, serta diperkuat oleh framing media. Di sisi lain, Indonesia mengalami dilema antara mempertahankan kedaulatan hukum nasional dan memenuhi komitmen terhadap standar HAM global. Penelitian ini merekomendasikan perlunya reformasi hukum pidana yang lebih akuntabel dan edukasi publik yang menekankan pentingnya prinsip keadilan substantif. Dengan demikian, hukuman mati dapat dievaluasi secara kritis dalam kerangka negara hukum yang beradab.

Abstract

Business cooperation agreements are a form of contractual that is increasingly used in modern business practices, even though it is not explicitly regulated in the Civil Code and is classified as an innominate agreement. This study aims to analyze the validity and form of legal protection in business cooperation agreements based on normative juridical approaches. The main focus of the research is on the fulfillment of the legal requirements of the agreement (Article 1320 of the Civil Code), the principle of freedom of contract (Article 1338), and the potential violation of the principle of business competition as regulated in Law No. 5 of 1999. The results of the study show that although freedom of contract provides flexibility for the parties, the substance of the agreement must still meet the standards of fairness and compliance with positive laws. An imbalance in the relationship between the parties involved as well as unilateral clauses can create legal risks and contractual unfairness. Therefore, it is important to apply the principles of good faith, clarity of clauses, and adaptive dispute resolution mechanisms. This study recommends strengthening the contract structure based on the principles of fairness and dual compliance with civil law and business competition law as an effort to realize legal, fair, and competitive cooperation in the eyes of the law.
