Abstract

This study investigates the influence of international human rights advocacy on state practices in Indonesia and Malaysia. The research uses a mixed methods approach, combining quantitative analysis of human rights indicators and qualitative analysis of case studies and interviews. The findings show successes and challenges in the relationship between advocacy efforts and state behavior in both countries. The quantitative analysis shows improvements in certain areas, such as gender equality in Indonesia and legislative reform in Malaysia, while challenges remain in terms of freedom of expression, religious freedom, and minority rights. The qualitative analysis provides deeper insights, highlighting the important role of advocacy in raising awareness, promoting accountability, and pressuring governments to address human rights violations. However, barriers to effective implementation exist due to political resistance and societal divisions. A comparative analysis between Indonesia and Malaysia shows similarities and differences, with Indonesia showing a greater response to reform and Malaysia showing resistance that limits freedoms. This research contributes to the field by emphasizing the need for context-specific analysis and tailored approaches to address human rights challenges.

Abstract

This research will use the writings of two contemporary Islamic legal experts, Nasr Hamid Abu Zayd and Muhammad Syahrur, to delve into the idea of gender equity in Islamic inheritance and wills. This research uses a philosophical and analytical approach to clarify how the two thinkers reach a more egalitarian and gender-neutral understanding of religious texts concerning inheritance law. The analytical descriptive approaches are used to describe and investigate Islamic legal ideas and positive law enforcement mechanisms relevant to gender issues and inheritance. The research shows that both experts believe that ijtihad and adapting Islamic law to contemporary society are crucial to achieving gender equality and justice. There is mounting evidence, including this research, that Islamic inheritance law may need a reevaluation in view of advances in gender equality and other notions of inclusive social justice

Abstract

E-commerce creates a new dynamic in trade, connecting consumers with businesses from various regions and countries. However, consumers often face risks such as fraud, lack of transparency in transactions, and concerns regarding personal data protection, especially amid rising privacy violations. Existing regulations often struggle to fully address the complexities of these issues. This study employs a qualitative method with a normative juridical approach. The data source used in this research is secondary data. The primary legal foundations of this study are Law No. 8 of 1999 on Consumer Protection and Law No. 19 of 2016, which amends Law No. 11 of 2008 on Information and Electronic Transactions. This research identifies consumer rights, business obligations, and legal responsibilities inherent in electronic transactions. Although these laws provide a clear legal framework, there is a weakness in extending protection to businesses based outside the country, leaving consumers vulnerable to fraud. This study recommends the development of more comprehensive policies to enhance consumer protection, including regulations capable of addressing the challenges of globalization in e-commerce.
