Abstract

Penelitian ini mengkaji banyaknya produk makanan dan minuman UMKM Desa Ketitanglor yang belum memiliki label halal. Fokus utama penelitian ini bertujuan untuk menganalisis perlindungan konsumen muslim terhadap produk makanan tanpa label halal. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif. Sumber data pada penelitian ini adalah wawancara dengan pelaku UMKM. Hasil penelitian ini menunjukkan bahwa perlindungan konsumen oleh pelaku UMKM Desa Ketitanglor tidak sepenuhnya dapat teralisasikan dengan maksimal mengingat masih adanya pelaku usaha yang tidak mencantumkan label halal yang benar dan jelas pada produknya. Selain itu pelaku usaha UMKM di Desa Ketitanglor tidak sepenuhnya memenuhi asas-asas perlindungan konsumen dan hak-hak konsumennya. Dampak yang dirasakan bagi pelaku yang tidak mencantumkan label halal yaitu resiko pidana 2 tahun dan denda 2 milyar rupiah, sedangkan bagi konsumen adalah banyak konsumen yang merasa khawatir dengan beredarnya produk makanan dan minuman tanpa label halal yang memiliki kemungkinan dapat menyebabkan gangguan kesehatan. Selain haknya tidak terpenuhi, para konsumen juga merasa kesulitan membedakan produk tersebut halal atau tidak.

Abstract

Laju perkembangan zaman, membawa dampak perkembangan cara dan jenis kegiatan jual beli di tengah-tengah masyarakat. Salah satunya, transaksi jual beli yang dipraktekkan oleh Kafe Ujung Senja Batang, yang menggunakan system voucer sebagai media tukar dalam transaksi jual beli makanan dan minuman. Metode ini tidak lazim digunakan oleh masyarakat setempat, untuk itu diperlukan kajian untuk meninjau keabsahan akad pada jual beli yang dilakukan dengan system tukar voucer. Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan praktik jual beli dengan system tukar voucer di Kafe Ujung Senja Batang dan untuk mengetahui keabsahan akad yang digunakan dalam praktik jual beli dengan system tukar voucer. Metode penelitian ini adalah deduktif analitis, dengan jenis penelitian normatif empiris. Hasil penelitian bahwa praktik jual beli yang dilakukan di Kafe Ujung Senja Batang adalah dengan mewajibkan pengunjung untuk menukarkan uang rupiahnya dengan voucer bernominal sama, yaitu senilai Rp. 30.000, Rp 50.000, dan Rp 100.000, sebagai alat tukar dalam transaksi jual beli makanan dan minuman di dalam area Kafe. Praktek ini adalah sah dan dibolehkan karena terdapat sebagian pengunjung yang meridhoi terhadap ketentuan transaksi yang dilakukan. Namun, ada pula transaksi yang hukumnya fasid atau rusak dikarenakan tidak memenuhi salah satu syarat dalam jual beli yaitu syarat nilai tukar pengganti barang yang menyebabkan adanya keterpaksaan dan kerugian pada sebagaian lain pengunjung.Kata Kunci: Jual Beli, Sistem Tukar Voucer, Hukum Islam

Abstract

Penelitian ini bertujuan untuk menganalisis bai’ al-wafa dan klausul buyback emas dalam budaya transaksi masyarakat Muslim di Kadipaten, Pekalongan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum empiris-sosiologis, dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Sumber data dalam penelitian ini adalah data empiris dari hasil wawancara dengan masyarakat adat, dan data sekunder yang didapatkan dari dokumen terkait dengan penelitian. Data tersebut dianalisis dengan metode analisis deskriptif kualitatif. Hasil penelitian menunjukkan bahwa transaksi jual beli emas yang melibatkan klausul buy back dalam budaya transaksi masyarakat adat, sering kali tidak disepakati secara rinci mengenai harga dan waktu pembelian kembali, sehingga menimbulkan ketidakjelasan (gharar). Perjanjian buy back sering dilakukan tanpa mencantumkan batas waktu, sehingga belum sepenuhnya sesuai dengan Pasal 1519 dan 1532 KUHPerdata, yang mengatur pengembalian harga dan penggantian biaya. Perjanjian lisan jual beli emas dengan klausul buy back sah menurut hukum, namun lemah dalam pembuktian dan kepastian hukum. Ketidakjelasan mekanisme buy back dapat merugikan salah satu pihak. Kontribusi penelitian ini terletak pada penguatan teori kepastian hukum, dengan menunjukkan bahwa ketidakjelasan dalam perjanjian lisan—khususnya dalam klausul buy back—berimplikasi terhadap lemahnya jaminan kepastian hukum dan perlindungan hak para pihak, baik dalam perspektif hukum positif maupun hukum Islam. Kontribusi penelitian ini terletak pada penguatan teori kepastian hukum dan memberikan landasan evaluatif bagi penyelarasan praktik lokal dengan prinsip-prinsip hukum positif dan hukum Islam.

Abstract

Copyright, as part of intellectual property rights, has become a growing issue in Islamic law, especially regarding its ownership classification. While positive law recognizes copyright as an economic right that can be transferred and inherited, Islamic law presents differing views on whether it falls under huquq al-adabiyah (moral rights) or huquq al-mãliyah (economic rights with material value). This debate arises from the traditional Islamic view of ownership, which emphasizes tangible assets. With the rise of creative industries and technological advancements, there is an urgent need to reconstruct copyright as huquq al-mãliyah to ensure proper legal protection. Within the framework of maqasid al-shariah, acknowledging copyright as an economic right aims to safeguard individual ownership, prevent exploitation, and promote innovation. This study employs a qualitative method with a normative juridical approach, examining classical and contemporary fiqh literature alongside copyright regulations in Muslim-majority countries. The analysis applies inductive-deductive and comparative techniques between Islamic and positive law. Findings show that copyright meets the criteria of huquq al-mãliyah due to its economic value, transferability, and inheritability. Islamic legal sources—including the Qur’an, Hadith, and scholarly interpretations—support its recognition. This reconstruction offers significant implications for strengthening copyright protection within Islamic legal frameworks and developing shariah-compliant regulations suited to modern economic contexts.

Abstract

This study analyzes the legal compliance of cooperatives in implementing sharia financing and the role of the Sharia Supervisory Board (DPS) in maintaining compliance with sharia principles, as well as the obstacles faced. This research is an empirical juridical research that reviews the implementation of the Regulation of the Minister of Cooperatives and Small and Medium Enterprises Number 16/Per/M.KUKM/IX/2015 and DSN-MUI Fatwa No. PER-01/DSN-MUI/X/2017. The approach used is a legislative approach. The data in this study was analyzed using a qualitative descriptive method. The results of the study show that the main obstacle faced is the problem of liquidity, especially when there is a massive withdrawal of funds ahead of the holiday, as well as the low understanding of members on the principle of muamalah. Cooperative compliance with related regulations is supervised by DPS and reported to DSN-MUI. However, supervision and education still need to be improved. It is necessary to strengthen liquidity reserves, improve fund disbursement procedures, and continuous training for DPS and cooperative members to improve Islamic financial literacy and the effectiveness of cooperative operational supervision. This research contributes to strengthening the understanding of cooperative law compliance and the strategic role of the Sharia Supervisory Board (DPS) in maintaining sharia compliance and cooperative operational stability, as well as providing practical recommendations for strengthening supervision and education of cooperative members.

Abstract

People with disabilities still do not get the same opportunities and special treatment according to the conditions experienced. Although the state guarantees equal rights for all citizens, its implementation for persons with disabilities is still not optimal, creating a gap between normative regulations and social reality. This research aims to analyze the issue through the perspective of social fiqh, which is the paradigm of Islamic law that emphasizes justice, empathy, and social inclusion, using a qualitative approach with a literature study design. Data was collected from academic works, official documents, and relevant policies, then analyzed by content analysis techniques through the systematic review method. The focus of the analysis is directed at mapping the principles of social fiqh that can be operationalized in answering the problem of marginalization of persons with disabilities. The results of the study show that the six main principles of social fiqh, namely al-'adālah (justice), at-tawādhu' (empathy), al-muwāsathah (social inclusion), ihyā' al-maṣāliḥ (empowerment), ḥifẓ al-nafs (care of the soul and mental health), and ta'līm wa tasyjīr (education and opportunity), not only provides theological legitimacy for the protection of the rights of persons with disabilities, but can also be used as a practical framework to encourage inclusive policies, economic empowerment, and adaptive access to education. The findings of this research can be an input for the government as a policy maker to formulate regulations that are more equitable for people with disabilities so that they can fulfill their social rights. In addition, it can be an input to the general public to be fair, empathetic and provide opportunities for socialization for people with disabilities so that they get equality and treatment as their conditions.

Abstract

The green economy program is one of the flagship programs rolled out by the Indonesian government and global countries, in order to realize sustainable world development. The concept of green economy or sustainable economy that prioritizes environmentally friendly economic activities is actually not new in Islamic civilization. This research aims to describe the principles and practices of sustainable economics in Islamic civilization. The method used in this study is a literature method using a historical approach and descriptive data analysis. The results of the study show that the principle of sustainable economy in Islamic civilization is based on the basic principle of muamalah, namely justice and the achievement of maslahah. The sustainable economic practice during the Islamic civilization was carried out by integrating human obligations as khalifatullah fil 'ardh. Islamic economic activities prioritize the protection of animals and the environment, revive dead land, and prioritize the common good.

Abstract

Inclusive economic development is a constitutional mandate aimed at achieving economic democracy, social justice, and public welfare. However, these goals are often hindered by structural barriers and dominant perspectives that marginalize vulnerable groups. This article analyzes how structural and epistemic injustices shape inclusive development in Indonesia through the lens of the Islamic economic paradigm. Using a qualitative-descriptive approach grounded in policy documents, legal texts, and critical literature, this study employs thematic analysis. The findings show that development policies tend to prioritize elite capital accumulation and large-scale projects, while neglecting the voices and local knowledge of marginalized communities. By integrating the ethical values of ‘adl, maṣlaḥah, and ta‘āwun, with epistemological critique, this article argues that genuine inclusivity requires not only institutional reform or Islamic philanthropy, but also participatory governance and the rethinking of dominant perspectives. Keywords: inclusive development; epistemic injustice; islamic economic paradigm; structural injustice   Abstrak Pembangunan ekonomi inklusif merupakan amanat konstitusi untuk mewujudkan demokrasi ekonomi, keadilan sosial, dan kesejahteraan masyarakat. Namun, praktik pembangunan kerap dibatasi oleh struktur dan cara pandang dominan yang meminggirkan kelompok rentan. Artikel ini menganalisis ketidakadilan struktural dan epistemik dalam pembangunan inklusif di Indonesia melalui paradigma ekonomi Islam. Dengan pendekatan kualitatif-deskriptif dan analisis tematik terhadap dokumen kebijakan, teks hukum, dan literatur kritis, penelitian menunjukkan bahwa kebijakan pembangunan masih berorientasi pada kepentingan elite dan proyek berskala besar, serta mengabaikan suara kelompok rentan. Dengan mengintegrasikan nilai-nilai adl, maṣlaḥah, dan ta‘āwun, artikel ini menegaskan bahwa inklusivitas sejati menuntut reformasi kelembagaan, tata kelola partisipatif, serta peninjauan ulang cara berpikir dominan. Abstract

The gender roles played by husbands and wives have considerable impacts on the stability of marriage. However, marital instability can lead to divorce. Egalitarian (nontraditional) gender roles cause negative effects on marital stability. This research tried to reveal the perception of married couples in Java about their gender roles, whether egalitarian or traditional. This study found the fact that in general, husband and wife who become respondents tend to choose egalitarian (non-traditional) gender roles, even though in three aspects they still adhere to the patriarchal (traditional) gender role, most of them reject the concept of: (a) household leadership based on agreement (not on sex); (b) the possibility of providing cost of living from wife to husband; and (c) household expenses are shared responsibility. Moreover, the egalitarian gender perception of the respondents has negative impact on marital stability. Fortunately the impact is not significant.
