Abstract

Advances in science and technology affect people's lifestyles, including the field of muamalah. Cryptocurrency is used as a means of investment and payment transactions in the modern era. The need for ijtihad to address the presence of digital currencies in Islamic law because it is a new problem and there is a discourse of contemporary Indonesian scholars who approve and prohibit it. The research aims to uncover and find legal solutions of the use of Cryptocurrency as an investment and payment tool. The research method uses descriptive-qualitative literature studies. The results of the study found that the use of Cryptocurrency as an investment tool prohibited because there is a vagueness of the object, has no asset guarantee and high elements of gharar. While its function as a medium of exchange in the digital era in Islamic law is not prohibited on the condition that the transaction has agreed and understood each other's mechanisms and there is legality from the government.Kemajuan sains dan teknologi mempengaruhi gaya hidup masyarakat tak terkecuali bidang muamalah. Temuan Cryptocurrency digunakan sebagai alat investasi dan transaksi pembayaran di era modern. Perlunya ijtihad menyikapi kehadiran mata uang digital dalam hukum Islam karena termasuk persoalan baru dan terjadi diskursus ulama kontemporer Indonesia yang menyetujui dan melarangnya. Penelitian bertujuan untuk mengungkap dan menemukan solusi hukum dari penggunaan Cryptocurrency sebagai alat investasi dan pembayaran. Metode penelitian menggunakan studi literature yang bersifat deskriptif-kualitatif. Hasil penelitian menemukan bahwa penggunaan Cryptocurrency sebagai alat investasi tidak boleh digunakan, sebab ada ketidakjelasan objeknya, tidak punya jaminan aset serta tinggi unsur gharar-nya. Sedangkan fungsinya sebagai alat tukar di era digital dalam hukum Islam tidak dilarang dengan syarat yang bertransaksi itu telah sepakat dan saling memahami mekanismenya serta ada legalitas dari pemerintahan.

Abstract

As a book containing miracles, in literature, the miracles of the Quran have been proven by ʻĀʼisha Bint al-Shāṭiʼ through her theory i‘jāz lughawī. She showed the importance of the correct method of interpretation of the Qurʼan from aspects of tarāduf (synonym). However, despite following the rule of "there is no word that has the same meaning (tarāduf) in the Quran" as commonly known in the theory of iʻjāz al-qur’ān (the inimitability of the Qurʼān), her thoughts on tarāduf and their implications for the istinbāṭ (inference) of Islamic law are still unclear. Hence, this article discusses the relation and influence of ʻĀʼisha Bint al-Shāṭiʼs thoughts related to verses of laws. By studying the book of al-I’jāz al-Bayānī lil Qur`ān wa Masā’il Ibn al-Azraq and other relevance sources, this article concludes that ʻĀʼisha Bint al-Shāṭiʼs thoughts related to verses of law are still abstract and difficult to be applied, hence it does not give a significant influence on the strengthening of Islamic legal propositions.

Abstract

The work challenges of developed countries, such as; (Indonesia) are characterised by the demands of professionalism in fierce work competition. There is a need for a new approach to the terminology of Quran-based professionalism to give maximum results to Muslims who reflect religious aspects. This research aims to understand the interpretation of the Quranic verses related to work professionalism and elaborate its meaning and to find out the opportunities for Quran-based work professionalism terminology to be applied to work demands in the modern era. The research method uses literature study with a qualitative-descriptive approach through thematic interpretation model. The results of the study found; that the terminology of professionalism can be combined with `ahsanu 'amalan and `atqana in the verse which indicates grade and quality in accordance with the field of expertise accompanied by aspects of piety. Known professionalism can be developed into religious-professionalism. It is undeniable that the modern world requires workers to adapt to the changes of the industrial revolution 4.0. The aspect of religiosity is really likely to improve the quality of international work professionalism.

Abstract

Peraturan Menteri Agama RI No. 33 tahun 2016 tentang Perubahan Gelar akademik di Perguruan Tinggi Keagamaan Islam, khususnya gelar akademik sarjana Fakultas Syariah yang berubah dari Sarjana Hukum Islam (SHI) menjadi Sarjana Hukum (SH) dianggap dapat menghapus dikotomi dan diskriminasi lulusan hal kesempatan kerja. Tujuan penelitian ini untuk mengetahui persepsi pengguna yaitu Pengadilan agama terhadap lulusan Fakultas Syariah IAIN Bukittinggi, dan respon Pengadilan Negeri terhadap perubahan gelar akdemik lulusan syariah. Penelitian ini juga akan mengungkap tentang strategi yang dilakukan Fakultas Syariah dalam menyikapi perubahan gelar tersebut. Metode yang digunakan untuk mengumpulkan data adalah wawancara dan observasi pada kedua lembaga peradilan tersebut. Hasil penelitian mengungkap bahwa pihak Pengadilan agama menilai alumni Fakultas Syariah telah kompeten untuk menjadi Hakim dan setuju dengan perubahan gelar akademik lulusan Fakultas Syariah. Selanjutnya pihak Pengadilan Negeri memberikan respon positif terhadap perubahan gelar akademik tersebut, asal diikuti dengan peningkatan kemampuan dan kecakapan dari mahasiswa. Strategi Fakultas Syariah IAIN Bukittinggi adalah melakukan kembali peninjauan kurikulum secara perodik untuk penyesuaian dengan perubahan yang terjadi sebagai bentuk respon dari pengguna. Kementerian Agama RI dan Perguruan Tinggi Agama Islam perlu proaktif untuk mensosialisasikan regulasi ini sehingga menjadi fungsional dan aplikatif

Abstract

Tujuan penelitian ini untuk mengetahui sejauh apa kesan dehumanisasi yang timbulkan dalam penerapan hukuman mati pada pengedar narkotika dan untuk mengetahui respons hukum Islam menyikapi penerapan hukuman mati bagi pengedar narkotika secara humanis. Metode penelitian hukum ini bersifat normatif dengan pendekatan studi literature dengan analisis data kualitatif dari data primer dan sekunder yang bersifat induktif. Hasil penelitian menyimpulkan,  pertama, bahwa kesan dehumanisasi didasari pada dampak sejarah eksekusi mati yang kelam dari masa ke masa, kemunculan gerakan-gerakan penegak Hak Asasi Manusia yang semakin marak di beberapa negara, implementasi aturan-aturan berskala internasional yang melarang hukuman mati, bentuk penolakan grasi dan berbagai bentuk perbuatan pengedaran  yang digeneralisir hukumannya. Kedua, secara makna tekstual ayat al-Qur`ān untuk pengedar narkotika dapat dikategorikan sebagai makna fasādan fī al-ardhi dalam ranah hukuman ta’zīr yang masih terbuka hak grasi dan penuntutan keringanan hukuman di pengadilan. Namun secara kontektual dikategorikan hukumannya secara beragam dan fleksibel, sebagai ḥirābah (perampokan), al-baghyu dan peminum khamar (syirb al-khamr). Sebagai solusi hukum alternatif diharapkan dapat mencerminkan penerapan hukuman yang humanis bagi pengedar narkotika.

Abstract

Qiyâs in Islamic law has progressed considerably that made it seems not as simple as the first form. It started from rustic concept of al-Syafi’i that identified only ‘illat (reason) that contained in text, it was progressed forward by al-Ghazali, al-Syarthibiy, and so forth. Every scholar in ushul fiqh had each learning processes, corrections, describing, improving, and reconstructing new formulas about qiyâs. If it is compared with same concept in positive law, there is a formula called Law Analogy. Basically, there are no different concept between law analogy and qiyâs. Yet, qiyâs has more detail explanation and complicated. Qiyâs has four steps in indentifying problem that analogy does not have. This paper maintained that concept of analogy in positive law is as simple as the first formula of qiyâs when it introduced as Islamic legal discovery method. Konsep qiyās dalam hukum Islam telah mengalami perkembangan panjang yang mengantarkan terwujudnya tampilan yang tidak sederhana lagi. Berawal dari konsep sederhana dari al-Syafi’i, dengan ciri fundamental identifikasi ‘illat semata yang tercakup dalam nash, ia telah terolah dengan sangat maju di tangan al-Ghazali, al-Syathibi dan seterusnya. Setiap ahli ushul fiqih (mutaakhirin) melalui proses pembelajaran dan koreksi, mencoba menampilkan, menambahkan, dan merekonstruksi rumusan yang baru tentang qiyās. Jika dibandingkan dengan konsep serupa dalam hukum positif maka di sana terdapat konsep analogi. Pada prinsipnya konsep ini sama dengan qiyās, namun detail-detail pembahasan qiyās lebih rumit dan bertele-tele. Langkah penerapan qiyās yang meliputi empat tahap identifikasi masalah tidak nampak dalam konsep analogi. Dengan demikian tulisan ini mempertahankan bahwa konsep analogi dalam hukum positif sesederhana ketika konsep qiyās ini pertama sekali diintrodusir sebagai metode penemuan hukum dalam hukum Islam. Sehingga konsep analogi dalam hukum positif bisa dikatakan baru sejajar dengan qiyās konsepsi awal.

Abstract

Renewal of Islamic thought could not be done, if the hesitant and stiff attitude of thinking still exist on the scholars and Muslims. In contrast, progressive and dynamic attitude is very important, but caution remains a necessity. Moreover, reformation efforts demanded the authorities to be open minded in creating new law and freely performing istinbath and istidlāl in representing the substantive meaning of syara'. Studies on the progressive dimension of Islam is now starting to promoted flarely with two basic consciousness: 1) as a positive response to the world pressures that seen Islam as a religion that always slow respond to the pace of the times so that there are very strong boundary between the Islamic world and the western world. 2) as a strategy to fight extreme thoughts which always blamed on Islam with the empowerment of progressive elements in the Muslim community and bridge the gap between the Islamic world and the western world. These two things become the urgency of scientific study and progressive dissemination of Islam. Ibn Hazm (4th century H) thought which is textual turned out to provide great opportunities and high motivation to carry the issues of modernity. Despite a lot of criticism and negative judge of Ibn Hazm ijtihad because of the political, social and culture influence in his time, some even claim that fiqh Zhāhiriyyah often can not adapt to the times. it was found the thought that can be compromised to meet the needs of modernity in an effort to redefine the concept of Islamic marriage in Indonesia.

Abstract

The development of a hajj fund that is so great has the potential to be used in supporting the implementation of a better quality Hajj through effective, efficient, transparent, accountable, and in accordance with the provisions of legislation. The strategy that has been taken by the Ministry of Religion to optimize the management of the Hajj fund so that its benefits can be used to improve the quality of Hajj implementation is by developing these funds through investment. But in fact, the dynamics that occur are in the BPIH deposit. When the funds are managed which constitute funds deposited by prospective pilgrims to the government (Ministry of Religion or BPKH) to finance the implementation of their pilgrimage, problems arise regarding the appropriate contract formulation to be used, whether wakalah contract, mudlarabah (profit sharing), or altogether no longer need a contract, because the government acts as a statutory power for prospective pilgrims, as consideration of the decision of the Constitutional Court (MK).

Abstract

Diverse views among Indonesian Islamic mass organizations’ figures over the existence of the Republic of Indonesia and obedience issue to the government became a topic of discussion, particularly when the government’s decision about religious issues differs from that of organization. This study aimed to find out in depth about views on ulī al-amr among figures from some Indonesian Islamic mass organizations and the issue of obedience to it within a democratic state system. This research is descriptive qualitative, using focused interviews in data collection. It is inductive in nature, which aims at developing process-oriented theories or values and data. The findings of the research showed that the representative figures recognize the Indonesian government as ulī al-amr, including ahlu al-bayt Indonesia, who prefer not to use the term because it is related to the requirement of chastity (‘ismah). This recognition implied an obligation to obey the Indonesian government, even though it is run by a democratic system, not Islam. As for matters related to specific religious regulations, such as determining the beginning of Ramadan, Shawwal, etc., differences from the government are not deemed as deviating from ulī al-amr, considering the democratic nature of the state, in which it provides opportunities to be diverse and recognizes those differences.
