Abstract

Perbankan syariah memiliki fungsi yang sangat strategis dalam system perekonomian nasional,selain fungsi intermediasi perbankan syariah juga memiliki fungsi sosial. Sehingga menarik untuk diteliti mengenai peranan perbankan syariah dalam pengelolaan wakaf uang di Indonesia. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif. Peranan perbankan syariah dalam pengelolaan wakaf uang di Indonesia berdasarkan Undang-Undang No. 41 Tahun 2004 Tentang Wakaf dan peraturan pelaksanaannya adalah sebagai Lembaga Keuangan Syariah Penerima Wakaf Uang yang menerbitkan sertifikat wakaf uang, serta menempatkan wakaf uang tersebut di dalam produk penerimaan dana dengan akad titipan (wadi’ah) atas nama Nazhir dan dapat mengelola dana tersebut sampai nazhir menentukan lain.

Abstract

The banking industry is often perceived as the heart and driving force of a country's economy. Given its strategic position, the role of banking as an intermediary institution in collecting and distributing funds to the public for financing economic sector activities is crucial. Based on field practices, debtors often refuse to make payments or settle the credit, which impacts one of the banking health factors, namely the non-performing loan percentage. Legal staffing is essentially a method for resolving credit with a collectibility of 5 and credits that have been written off (Write-Off). The legal staffing method emphasizes resolution principles through non-litigation mechanisms (out-of-court dispute resolution), focusing on the effectiveness and efficiency of case resolution.

Abstract

The freedom to choose forum institutions and legal options in resolving business disputes is a freedom to contract exercised by national and international business actors, likewise in settling Islamic economic business disputes. This freedom of contract is recognized both in the principles of international trade law and Islamic law. The present development of sharia business transactions at the national and international levels does not rule out the possibility of disputes in its implementation. The consistency of implementing Islamic economics also concerns the choice of Islamic law, which is used as a choice of law for international business actors in case of a dispute between them. Studying how specific Islamic law can be applied to each country's national law is interesting. This article will discuss how Islamic law can be chosen to settle international business disputes using a normative juridical approach. Choice of law is the law the parties choose to resolve disputes between them, which can be expressed in their business contracts. The choice of law chosen by these parties in the settlement of international business disputes will also be closely related to the principles of Private International Law in harmonizing with the provisions of the National Law of each country. There needs to be mutual agreement from both countries, as well as international forums or institutions, especially international trade institutions, to support the recognition of the application of Islamic legal principles in resolving international business disputes through international agreements both bilaterally and multilaterally.

Abstract

The globalization of trade has elevated Islamic halal standards within the domain of international economic law. While halal certification is rooted in Sharia, World Trade Organization (WTO) law is governed by secular principles, including non-discrimination, Most-Favored Nation (MFN) treatment, and national treatment. This article conducts a comparative legal analysis of the potential tensions and compatibilities between these normative systems. Drawing on doctrinal and comparative methods, it examines how halal regulations in Muslim-majority and non-Muslim countries interact with WTO rules, particularly the SPS Agreement, TBT Agreement, and GATT 1994. The study argues that halal requirements, while potentially constituting non-tariff barriers, can be justified under WTO exceptions when aligned with legitimate objectives such as public morals and consumer protection. It also highlights the risk of discriminatory treatment when certification is applied selectively or instrumentally. The paper concludes with normative recommendations to reconcile Sharia-based halal frameworks with global trade norms, emphasizing mutual recognition, standard harmonization, and dialogue between religious and secular legal systems.
