Abstract

This study aims to generate theoretical ideas about religious practices within the tradition of local wisdom. The fact that the Malay Batubara community continues to perform a healing ritual known as ubat-ubat serves as the foundation of this research. In addition to Islam, elements of Hinduism and Buddhism can also be found in these healing rituals, reflecting a form of religious syncretism. The purpose of this study is to explain why the community continues to practice this ritual from the perspective of Surah Al-Baqarah, Verse 165. A qualitative method involving observation and interviews was used to collect data. The findings indicate that the Malay Batubara community performs the ubat-ubat ritual to avoid misfortune and express gratitude to the Creator, who has provided sustenance to His servants through objects and nature. Whether conducted individually or collectively, this ritual reflects the love for Allah, as stated in Surah Al-Baqarah, Verse 165, which serves as the foundation for strengthening the devotion of believers. The author hopes that this religious tradition does not become mystical or negatively impact the community in the future, whether in terms of education, economy, or religion, despite this ceremony being held annually.

Abstract

Tulisan ini menganalisis pemberdayaan Usaha Mikro, Kecil, dan Menengah (UMKM) kuliner dalam rantai pasok program makan bergizi gratis melalui perspektif hukum ekonomi syariah. Program pemerintah yang bertujuan menyediakan nutrisi bagi kelompok rentan memiliki potensi besar untuk memberdayakan UMKM lokal sebagai mitra pasokan. Namun, implementasinya perlu dikaji agar selaras dengan prinsip-prinsip syariah. Penelitian menggunakan metode kualitatif dengan pendekatan deskriptif-analitis, mengumpulkan data melalui studi literatur terhadap sumber hukum Islam dan dokumen kebijakan terkait. Hasil penelitian menunjukkan bahwa integrasi UMKM kuliner dalam rantai pasok program ini sejalan dengan maqashid syariah, khususnya dalam menjaga harta (hifzh al-mal) dan keturunan (hifzh al-nasl) melalui peningkatan ekonomi dan gizi. Prinsip keadilan (‘adl), transparansi, dan bebas dari unsur riba, gharar, serta maysir harus menjadi landasan dalam mekanisme pengadaan, pembayaran, dan kerja sama. Skema bagi hasil (musyarakah/mudharabah) atau jual beli yang amanah dapat menjadi model yang lebih berkeadilan dibandingkan skema utang-piutang berbunga. Penelitian ini menyimpulkan bahwa pemberdayaan UMKM kuliner dalam program makan bergizi gratis tidak hanya mendukung tujuan sosial-ekonomi, tetapi juga dapat dioptimalkan dengan kerangka hukum ekonomi syariah untuk memastikan kemaslahatan, keberlanjutan, dan keadilan bagi seluruh pemangku kepentingan, serta merekomendasikan penyusunan pedoman khusus yang mengakomodasi prinsip syariah dalam pengadaan pemerintah untuk UMKM.

Abstract

This paper explains that Islamic courts have a central role in upholding the law based on the principles of justice and benefit in accordance with sharia teachings. This study aims to examine the application of Maqasid Syariah the main objectives of sharia, which include the protection of religion, life, intellect, descendants, and property in the judicial process, in order to achieve a balance between al-‘adl (justice) and al-maslahah (benefit). The research method used is a literature study with a normative-juridical approach, involving an analysis of classical and contemporary Islamic legal sources, as well as a review of relevant judicial decisions. The results of the study indicate that the integration of Maqasid Syariah in judicial practice can maintain the relevance of law to social dynamics, while ensuring that the principle of justice remains the primary foundation. Achieving this balance requires an active role of judges in interpreting sharia arguments comprehensively and contextually, so that legal decisions are not only normatively valid but also beneficial for the welfare of the community

Abstract

Mandailing Natal Regency is recognized as a "santri city" in Indonesia. However, in practice, violations of family law provisions persist within the community. Furthermore, there is widespread skepticism regarding the authority of renewed Islamic Law in Indonesia compared to the classical fiqh rulings traditionally taught in Islamic boarding schools (pesantren). This study employs a descriptive qualitative approach through field research. Primary data were collected via direct interviews and questionnaires. The research focuses on analyzing fiqh instruction in Salafiyah-style Pesantren, examining the madhhab (school of thought) paradigms of teachers and students, and assessing their responses to the reforms in Indonesian Islamic Family Law. The findings conclude that the teaching method in Salafiyah-style pesantren in Mandailing Natal utilizes a classical system centered on the Shafi’iyyah madhhab-oriented kitab kuning (classical texts). The adherence to a madhhab among teachers and students is notably high. In contrast, the response to reforms in Islamic Family Law is relatively low. This is attributed to the strong consistency in madhhab adherence within the Salafiyah pesantren environment, resulting in a limited relevance and responsiveness to such legal reforms.

Abstract

This study examines in depth the role and position of grandchildren in Islamic inheritance law in Indonesia, particularly in relation to Article 185 of the Compilation of Islamic Law (KHI), which regulates substitute heirs. Although the debate regarding this article has been widely discussed in previous research, most studies do not identify in detail the theoretical and practical gaps that arise in the application of Article 185 of the KHI, especially related to the influence of Hazairin's thinking and differences in interpretation in the field. This study aims to fill this gap by analyzing the history, formulation, and implementation of the provisions regarding substitute heirs in the KHI, as well as the contribution of Hazairin's theory to changes in the inheritance system in Indonesia. The method used is library research with a descriptive qualitative approach, which analyzes primary legal sources in the form of relevant legal texts, as well as secondary literature including books, scientific articles, and related journals, with technique content analysis to explore the meaning and implications of the provisions of Article 185 of the KHI and Hazairin's theory, as well as a comparative analysis to assess the suitability between theory, practice, and classical Islamic inheritance law. The results of the study indicate that Article 185 of the KHI which regulates substitute heirs has three main views, namely rejecting, accepting, and accepting with conditions for revision. This study contributes to understanding the theoretical and practical dimensions of the provisions of substitute heirs, as well as their implications for the formation of a more inclusive and equitable inheritance system in Indonesia. The practical implication is the need to revise the wording of Article 185 of the KHI to ensure consistency and fairness in its implementation, thereby providing better legal protection for heirs, especially grandchildren who have lost their parents.
