Abstract

This study examines the implementation of the principle of non-discrimination under Law Number 13 of 2003 on Manpower at PT. Trio Motor in Kuala Kurun, Gunung Mas Regency. The research is motivated by the existence of company policies prohibiting married couples from working in the same unit and the dismissal of female employees after marriage, which potentially contradict the principle of equal treatment in employment relations. The purpose of this study is to analyze the implementation of the principle of non-discrimination in company practices and to assess its conformity with Indonesian labor law and ILO Convention Number 111 of 1958. This research employs an empirical juridical method by combining statutory analysis with field research through interviews, observations, and literature studies. The data obtained are analyzed using a descriptive qualitative approach to evaluate the implementation of Articles 5, 6, and 153 paragraph (1) of Law Number 13 of 2003 on Manpower. The findings show that the implementation of the non-discrimination principle at PT. Trio Motor is still not optimal, as company policies prioritize professionalism and conflict prevention over equal treatment for workers. Consequently, a gap remains between normative legal provisions and employment practices.

Abstract

The research focuses on the judge’s legal reasoning in the Central Jakarta Commercial Court ruling No. 92/Pdt.Sus-HKI/Hak Cipta/2024/PN Niaga Jkt.Pst regarding song copyright infringement. The purpose is to examine the basis of the judge's consideration in determining compensation and assess the accuracy of the legal basis used based on the principle of legal certainty. Normative juridical methods underpin this study, combining legislative, case, and conceptual approaches. The findings uncover that judges seek to safeguard the economic rights of creators; however, the legal foundation applied is not entirely appropriate, as it reflects a conflation of criminal and civil norms. In addition, the determination of compensation is not explained in detail and has not taken into account the royalty standards set by the LMKN. The study shed light that the decision reflects an inconsistency in the application of copyright law by combining civil and criminal legal norms in determining compensation, thereby weakening legal certainty and creating ambiguity in the legal basis for resolving song copyright infringement disputes.

Abstract

This study examines unfair business competition between modern retail stores and traditional markets in Palangka Raya City due to non-compliance with minimum distance regulations under Regional Regulation No. 17 of 2014. Using an empirical, and regulatory analysis. The results show that the rapid expansion of modern retail outlets often violates zoning requirements, causing financial losses and business closures among traditional traders, alongside weak local government supervision. Consistent regulatory enforcement is required to ensure fairness and sustainable local economic development.

Abstract

Intellectual Property Rights (IPR) protection in Indonesia, as regulated in Law No. 28 of 2014 concerning Copyright and Law No. 20 of 2016 concerning Trademarks and Geographical Indications, is a fundamental basis in ensuring legal certainty for creators and business actors. However, in reality, legal disharmony often occurs when an object has a dual function as both a work of art and a commercial distinguishing mark (trademark). This normative conflict is triggered by a conflict of registration principles, namely the declarative principle of copyright versus the constitutive principle (first-to-file) of trademark rights, which often leads to overlapping protection claims. This study aims to analyze the resolution of legal disharmony between copyright and trademark rights over the same object by referring to Decision Number 40/Pdt.Sus-Hak Cipta/2024/PN.Niaga.Jkt.Pst. The research method used is normative juridical with a statute approach and a case approach. The results of the analysis show that the Panel of Judges resolved the disharmony by applying the originality test as a benchmark. The findings of the study confirm that when an object has been registered and used as a trademark first, the subsequent registration of that object as copyright is considered to not meet the criteria of originality. Harmonization of protection can be achieved through the synchronization of originality testing.

Abstract

The Sarjana Penggerak Pembangunan Indonesia (SPPI) Program deploys university graduates as Heads of the Nutrition Fulfillment Service Units (SPPG) to support the "Golden Indonesia 2045" vision. However, delays in salary payments have impacted their welfare and the quality of services provided. This empirical legal research conducted at the SPPG in Palangka Raya City indicates that these delays are caused by administrative factors, budgetary constraints, regulatory issues and coordination challenges. Legal protection for these graduates can be implemented through both preventive and repressive measures.
