Abstract

Penulisan jurnal ini membahas tentang Analisis Yuridis Terhadap Sengketa Lahan sebagai Alasan Pembenar terhadap Kejahatan Lingkungan berupa Kealpaan atas Lahan Garapan Perkebunan Bersertifikat: Studi Kasus Putusan Bebas PT Gandaerah Hendana (Anak Usaha Samsung). Penelitian ini bertujuan untuk memahami dan menganalisis terkait analisis yuridis terhadap sengketa lahan sebagai alasan pembenar terhadap kejahatan lingkungan. Dalam penulisan jurnal ini menggunakan metode penelitian pendekatan kepustakaan yang mengambil dasar dari perundang-undangan yang berlaku di Indonesia dan menggunakan Metode deskriptif analisis, yaitu dengan menganalisa permasalahan yang ada serta analisis yuridis Terhadap Sengketa Lahan sebagai Alasan Pembenar terhadap Kejahatan Lingkungan berupa Kealpaan atas Lahan Garapan Perkebunan Bersertifikat. Analisis yuridis Terhadap Sengketa Lahan sebagai Alasan Pembenar terhadap Kejahatan Lingkungan berupa Kealpaan atas Lahan Garapan Perkebunan Bersertifikat: Studi Kasus Putusan Bebas PT Gandaerah Hendana (Anak Usaha Samsung) ditegaskan dalam Asas dan tujuan dari pengelolaan perkebunan diatur didalam ketentuan Pasal 2 j.o 3 Undang- Undang Nomor 39 Tahun 2014 Tentang Perkebunan.

Abstract

This socio-legal study analyzes the dual role of social media in Indonesia's criminal justice system from 2019 to 2024 through thematic analysis of 15 viral legal cases. The research demonstrates that while social media enhances transparency and accelerates investigations in 80% of cases examined, it simultaneously erodes fundamental due process principles in 53% of cases through trial by social media and digital vigilantism. The phenomenon of "no viral no justice" reveals a critical institutional failure, where law enforcement agencies have externalized case prioritization functions to digital virality metrics rather than maintaining equal application of law. The study introduces the concept of "justice outsourcing" to explain how public pressure forces hasty responses that may compromise the presumption of innocence and equality before the law. Through analysis of secondary data including regulatory frameworks, institutional reports, and verified digital documentation, this research identifies a central tension between substantive justice demands and procedural integrity. The findings reveal that law enforcement responses, while demonstrating adaptability, often sacrifice careful investigation protocols for rapid public satisfaction. The study proposes a collaborative governance model involving law enforcement, digital forensic specialists, and independent fact-checking communities, alongside regulatory updates to the Criminal Procedure Code (KUHAP) and the Information and Electronic Transactions Law (UU ITE), to mitigate disinformation risks while protecting suspect rights and maintaining due process standards in the digital public sphere.

Abstract

This research analyzes the legal policy and validity of appointing former directors of bankrupt companies to the boards of State-Owned Enterprises (SOEs) under the principles of Good Corporate Governance (GCG). Utilizing a normative legal research method with statutory and case study approaches, the study specifically examines the appointment of Sigit Winarto as Director of PT JIEP following the bankruptcy of PT Istaka Karya. The findings demonstrate that such an appointment explicitly violates Article 93 of the Company Law in conjunction with Article 15 of the SOE Law, as it transpired within the mandatory five-year prohibition period without valid judicial rehabilitation. Consequently, the appointment is void ab initio due to substantive legal defects and contravenes the GCG principles of responsibility and accountability. Therefore, rigorous enforcement of administrative sanctions against the appointing authorities is imperative to safeguard the integrity of state asset management and to ensure legal certainty and public trust in the professionalism of SOE governance in Indonesia.

Abstract

Radicalism is an internal threat to a country, because it triggers acts of terrorism, so it is necessary to instil a sense of nationalism in every family, because radicalism has the impact of national disintegration. This research uses a normative juridical approach method with descriptive analytical analysis of legal materials. The results of this study found that radicalism can be spread through social media massively, because Radicalism can appear unlimited in space and time. Therefore, efforts that can be made to reduce radicalism in the family, by introducing science properly and correctly, understanding science properly and correctly, minimising social inequality, maintaining unity and integrity, supporting peace actions, playing an active role in reporting radicalism and terrorism, increasing understanding of living together, filtering the information obtained.

Abstract

This article analyzes the state's responsibility in fulfilling human rights from a legal philosophy perspective, which raises the main issue of the imbalance between the ideal justice in the constitution and its reality. This study aims to determine the causes of the fulfillment of human rights in Indonesia, which is still limited to formalities even though the regulations are clear, and how legal philosophy can provide a basis for evaluating this situation. The research method used is normative-philosophical, with conceptual, legislative, and historical approaches, as well as qualitative-prescriptive analysis of Aristotle's theory of justice, Kant's deontological ethics, legal positivism, and the values of social justice in Pancasila and the 1945 Constitution. The results of the study show that overly dominant legal positivism has resulted in the fulfillment of human rights often stopping at legality on paper rather than real justice. The state has also not been optimal in carrying out its ethical function of fulfilling, protecting, and respecting human rights through distributive, corrective, and affirmative policies. There is an urgent need to integrate moral values, governance ethics, and social justice principles in the interpretation and implementation of public policy. These results emphasize the need for a more ethical, responsive, and substantive justice-oriented legal paradigm shift so that the fulfillment of human rights in Indonesia can be truly meaningful and in line with the mandate of the constitution.

Abstract

The philosophical legal approach is a method of legal analysis that focuses on the values, morals, and objectives of law. In the context of resolving Sharia economic disputes, this approach is crucial for understanding the philosophical basis of Islamic law and its application within the Indonesian national legal system. This study aims to describe how a philosophical legal approach can be used to analyze and develop a model for resolving Sharia economic disputes in accordance with the principles of substantive justice and the maqasid al-syarī'ah (objectives of sharia). The method used in this study is a juridical-philosophical approach with qualitative analysis. The results of the study indicate that a philosophical legal approach can strengthen the integration between Sharia law and positive law in resolving Sharia economic disputes, particularly in the context of religious courts and Sharia arbitration. This approach prioritizes a balance between legal certainty, expediency, and spiritual justice, which are the spirit of the Islamic legal system.
