Abstract

People who experience physical limitations, such as not being able to see or walk, having below-average general intelligence, or being mentally retarded for a long time are called people with disabilities. Disabled individuals, both young and old, face so many difficulties that hinder their development and well-being, that it is very difficult for them to maximize their abilities and achievements. Regulation No. 18 of 2016 on Persons with Disabilities is one of many laws that have been enacted in an effort to obtain rights and stop the prejudice towards people with impairments. The study's main focus is on the legal protection against discrimination against individuals with disabilities provided by Law No. 18 of 2016 concerning Persons with Disabilities, as well as the rights to be free from discrimination against them. Normative juridical research methodology is used. Studies show that inclusive education provided by governments can help people with disabilities understand their right not to be discriminated against.

Abstract

Pengabdian ini bermaksud untuk mendapatkan pemahaman bagaimana kekerasan dan pelecehan anak dan upaya pencegahannya yang dilaksanakan di Fakultas Hukum, Universitas Tjut Nyak Dhien Medan. Kegiatan pengabdian dilakukan dengan metode yuridis normatif menggunakan pendekatan seminar, wacana, dan tanya jawab mengenai kekerasan dan pelecehan terhadap anak dan bagaimana upaya pencegahannya dari sudut pandang ilmu hukum yang melibatkan dosen fakultas hukum dan mahasiswa sebagai peserta kegiatan pengabdian ini. Diskusi dalam kegiatan ini adalah menganalisis unsur-unsur yang menyebabkan terjadinya kekerasan dan pelecehan terhadap anak, serta kebijakan hukum pidana dalam menanggulangi kekerasan anak dan serta perlindungan hukum terhadap korban. Berdasarkan hasil kegiatan menunjukkan bahwa upaya penanganan kekerasan, pelecehan pada anak dapat dilakukan sesuai prosedur baku mulai dari pengaduan masyarakat, dukungan untuk korban, penanganan kasus, penjemputan sementara, mediasi, penanganan korban dan kegiatan evaluasi yang diberikan terhadap korban pelecehan belum berjalan efektif, sehingga diperlukan kesadaran sosial, upaya untuk menghentikan pelecehan seksual terhadap anak-anak adalah dengan adanya peran keluarga dan masyarakat dalam mendidik dan mengawasi anak di bawah umur.

Abstract

Evidence is needed in cases of ordinary and severe investigative persecution. Law No. 8 of 1981 regulates the intended evidence. The court usually asks the defendant or suspect to explain his actions to the victim when proving the attempted goods. However, in reality, all those who are unlikely to commit crimes are brought to justice, including human beings, whether it is life or death. Proof of letters requested with the help of a doctor as an expert is one of the most important evidences in situations of persecution with visum et repertum, the medical results examined can be documented in writing in the form of a certificate, as well as an expert witness as a doctor. This research method is normative research, the meaning of law is considered either as mentioned in law books or as a standard that is a standard for the behavior of people who are considered reasonable. If visum et repertum does not align using the data provided by the defendant, the statement may be revoked, and visum et repertum has the ability to be examined again if the defendant does give a false confession

Abstract

In Indonesia, there are 2 (two) ways to resolve disputes between business actors and consumers, namely by litigation and non-litigation. Dispute resolution process dispute resolution process through court channels or what is also called litigation will take a relatively long time. relatively long time. Meanwhile, on the contrary, settlement through non-litigation litigation, namely through one of the quasi-judicial institutions, namely the Consumer Dispute Settlement Body, which is mandated by Law Number 8 Year 1999 on Consumer Protection. 1999 on Consumer Protection. The research results show that settlement of consumer disputes through the Consumer Dispute Settlement Body (BPSK) can be considered ineffective. This is evidenced by the fact that there are still many parties who do not agree with BPSK's decision. This is also supported by several obstacles contained in it.

Abstract

Background: Mayoritas penjual makanan dan minuman tidak menyadari pentingnya sertifikat untuk memenuhi standar kehalalan barang yang dijual untuk menjaga pelanggan dalam aktivitas mereka. Kegiatan penyuluhan dan sosialiasi ini bertujuan untuk mengetahui pentingnya sertifikat halal sebagai upaya perlindungan konsumen dalam membuat keputusan tentang makanan dan minuman. Metode: Kegiatan ini dilakukan melalui seminar, diskusi dan tanya jawab terhadap hak dan kewajiban pelanggan dan pelaku bisnis serta Undang-Undang Nomor 8 Tahun 1999 dan Nomor 33 Tahun 2014 tentang jaminan produk halal. Hasil: Implikasi dari hasil kegiatan pengabdian ini dibuat untuk melindungi pelanggan dari makanan tidak memiliki sertifikat halal. Pemerintah membentuk organisasi yang bertanggung jawab untuk memastikan bahwa produk yang dipasarkan halal, mengeluarkan hukum yang mengatur labelisasi dan sertifikasi halal, melarang sosialisasi, himbauan, atau penarikan barang yang melanggar peraturan labelisasi halal, membentuk organisasi yang mengawasi produk halal, mendirikan organisasi pemeriksa halal, membentuk audit halal, dan membentuk lembaga pengawasan halal. Kesimpulan: Pedagang maupun konsumen belum menerapkan dan belum memahami pentingnya sertifikat halal sebagai standar kehalalan produk untuk melindungi pelanggan.

Abstract

The demand for finance rises in tandem with the expansion of development activities, and the majority of the money required to satisfy these needs may be acquired through borrowing and borrowing activities, one of which is through financial institutions' services. This study aims to determine the status of the debtor transferred in accordance with the terms of the agreement, ac-cording to the fiduciary guarantee object. and to find out about the credit settlement attempts that the debtor made. Normative juridical research methodology is employed in the scientific study of fiduciary guarantee law. The study's findings indicate that in order to ascertain the legal standing of the fiduciary guarantee object that the debtor transferred, registration is necessary. This gives the creditor legal certainty regarding the fiduciary guarantee object's legal position, and negotiations with the debtor and other parties who consent to the transfer of the fiduciary guarantee object are used to carry out credit settlement activities. The result shows that because the fiduciary guarantee object transmitted by the debtor only registers a portion of the fiduciary promise, it has a weak legal standing, allowing the debtor to transfer the unregistered fiduciary guarantee object. In an attempt to replace the collateral that was transferred to a third party with an item that belongs to the debtor and has a value equal to the transferred collateral, creditors have applied dispute resolution through a non-litigation settlement method that involves negotiation and mediation between the parties.

Abstract

Artificial intelligence (AI) has developed rapidly in recent years, making judgments and executing tasks in ways comparable to decisions made by the human brain. These technological advances allow AI to replace or complement human work in various fields, but they also raise complex legal questions regarding accountability for the actions it performs. This study employs a normative juridical research methodology, which emphasizes the analysis of laws and regulations, concepts, principles, and legal theories, using literature as the primary data source. The findings show that AI, despite its advanced capabilities, remains a legal object rather than a legal subject. In accordance with Government Regulation No. 71 of 2019 on the Implementation of Electronic Systems and Transactions in Indonesia, AI cannot be considered a legal entity with independent rights and obligations. Consequently, AI cannot be held legally accountable for its actions, as it operates under human creation, programming, and direction. Responsibility for any consequences arising from the use of AI lies with the individuals or institutions that develop, operate, and control it. This study highlights the importance of establishing a clear legal framework to regulate AI applications, ensuring that technological innovation aligns with legal certainty and accountability. It concludes that while AI may imitate human decision-making, it lacks autonomy in the legal sense and therefore cannot bear responsibility under positive law.

Abstract

This study examines the transformation of Indonesian civil procedural law in responding to the growing use of electronic contracts and digital evidence in the era of electronic commerce. Although electronic contracts have been formally recognized under Law Number 11 of 2008 on Electronic Information and Transactions and its amendment, Law Number 19 of 2016, their application in civil dispute resolution continues to raise legal uncertainty, particularly in relation to evidentiary standards. This research employs a normative juridical method using statutory, conceptual, and analytical approaches to analyze the conformity of electronic contracts with the requirements of contract validity under Article 1320 of the Civil Code and their position within the evidentiary system governed by Article 1866 of the Civil Code. The findings demonstrate that electronic contracts possess evidentiary value equivalent to written documents, provided that electronic information and documents are accessible, readable, verifiable, and their authenticity and integrity are ensured through lawful electronic systems, digital signatures, and digital forensic verification. Furthermore, electronic evidence is affirmed as an extension of written evidence within civil procedural law, thereby strengthening legal certainty in civil disputes arising from digital transactions. The novelty of this research lies in its confirmation that the theory of civil procedural evidence accommodates electronic contracts as legally valid proof comparable to conventional written evidence, as long as both formal and substantive legal requirements are fulfilled. Accordingly, this study underscores the urgency of harmonizing civil procedural law with technological developments to enhance legal certainty, evidentiary reliability, and justice in Indonesia’s digital transaction framework.

Abstract

The withdrawal of the fiduciary guarantee will be affected if the credit agreement's fiduciary guarantee object is destroyed or lost. The purpose of this research is to ascertain the legal implications of fiduciary pledges in credit agreements being lost by taking into account the position of creditors in such a scenario. The issues brought up, examined, and clarified in this study are centered on the application of rules or norms in positive law as it employs a normative research methodology. Primary, secondary, and tertiary legal materials are used in the issue method, which combines a legal and conceptual approach. The study's findings demonstrate that the legal ramifications of a fiduciary guarantee loss arrangement do not absolve the debtor of making the outstanding credit installment payments to creditors. According to the study's findings, fiduciary assurances in credit agreements are essential for providing creditors with legal protection. since the debtor is the object of the guarantees. This implies that should the debtor fail to fulfill their obligations under the credit agreement with fiduciary assurances, in order to ensure the interests of creditors are protected by the law, when attempting to reach a settlement, creditors may seek executorial seizure of the debtor's assets.

Abstract

Analyzing the connection between default and the freedom of contract concept in Indonesian treaty law is the goal of this study. As long as it doesn't go against the law, reasonable standards, or public order, the freedom of contract concept gives the parties the opportunity to negotiate terms that suit their interests. However, in practice, there are often defaults that cause disputes and cause problems regarding the protection of the rights of the parties. This study examines how default is seen in relation to contract freedom and the degree to which the law offers parties fairness and clarity using a normative juridical technique that combines a conceptual and legislative approach. The study's findings demonstrate that contractual flexibility is constrained by legal standards that govern the legal ramifications of default. Thus, in order to prevent misuse of the concept of freedom of contract and to ensure that the agreement's goal is still accomplished, the protection of the parties' rights must be balanced.
