Abstract

Tanah Pusako Tinggi di dalam Adat Minangkabau merupakan bagian dari harta pusako tinggi yang diwarisi secara turun temurun dari Niniak kepada Mamak dan dari Mamak kepada Kamanakan. Pembagian tanah pusako tinggi dikenal dengan istilah Ganggam Bauntuak yang berarti diturunkan berdasarkan pertalian darah seketurunan ibu dan dikuasai dengan hak kolektif bersama dalam suatu kaum. Penguasaan dan pengelolaan tanah pusako tinggi beresiko menimbulkan sengketa yang terjadi di dalam ataupun diluar kaum. Berkaitan dengan ini, Kerapatan Adat Nagari berperan sebagai lembaga peradilan adat untuk menyelesaikan berbagai persengketaan yang diajukan oleh masyarakat nagari melalui jalan musyawarah untuk mencapai mufakat perdamaian. Penelitian ini mengkaji bagaimana mekanisme penyelesaian sengketa harato pusako tinggi oleh lembaga Kerapatan Adat Nagari Limau Purut dan bagaimana tinjauan Fiqh Siyasah Dusturiyah terhadap putusan dari Kerapatan Adat Nagari Limau Purut dalam menyelesaikan sengketa harato pusako tinggi. Metode penelitian yang digunakan adalah Yuridis Sosiologis dengan jenis Kualitatif. Berdasarkan hasil penelitian diambil kesimpulan bahwa penyebab terjadinya sengketa tanah pusako tinggi antara pihak A Cs sebagai penggugat dengan pihak BH Cs sebagai tergugat adalah karena adanya pengajuan permohonan untuk pengeluaran surat kepemilikan tanah atas nama BH Cs kepada KAN Limau Purut diatas tanah yang sudah dihibahkan oleh leluhur dari pihak penggugat A Cs. Pihak A Cs merasa hibah tersebut tidak sah karena tidak adanya pembuktian yang kuat menurut kesaksian kaumnya, sementara itu pihat tergugat A Cs melampirkan bukti surat tebus gadai dan hibah sebagai pembelaan diri. Mekanisme penyelesaian sengketa ini dilaksanakan sesuai dengan ketentuan adat bajanjang naiak batanggo turun dengan upaya putusan perdamaian berdasarkan adaik basandi syara’, syara’ basandi kitabullah yang mengacu pada konsep Islam fiqh siyasah dusturiyah dalam pengambilan putusan berpedoman dengan kaidah-kaidah Siyasah Dusturiyah yakni merundingkan, mengaktualisasikan, dan memberlakukan putusan.

Abstract

Islam teaches to muamalah correctly in accordance with the shari'ah that is taught. There are several systems of mu'amalat cooperation known as muzara'ah, mukhabarah, ijarah, musaqah and syirkah. In the current economic system, the concept of profit sharing is widely used by the community with modifications that can be made freely by the parties in the business. Profit sharing is a cooperative relationship between two or more people in terms of capital, skills, or trust in a particular business with profit sharing based on a ratio. Meukek District is an area that still has a lot of nutmeg plants, although not as much as in the past. The owner of the nutmeg plantation handed over his garden to someone who was trusted to take care of his garden, because the garden owner did not have time to manage the garden. The handover of the garden was based on the results of deliberation between the two parties, which later the results from the garden were divided into two. The purpose of this study was to determine the profit-sharing system for nutmeg management in Meukek District. The research approach used by the author in the discussion of this thesis is a qualitative approach. Data collection techniques used are observation, interviews and documentation. The profit-sharing system for the management of nutmeg in the Meukek Sub-district The agreement is carried out only orally, not in writing by means of mutual consultation regarding the revenue-sharing system from the agreed management of nutmeg. The duration of the cooperation depends on the mutual agreement between the garden owner and the cultivator. The distribution of the results is done in the form of money instead of nutmeg, after the nutmeg is harvested, the tenant sells it first and then the money from the sale of the nutmeg is then distributed between the owner and the cultivator. If a loss occurs, it will be shared between the owner and the cultivator. The Fiqh Mu'amalah review of the profit-sharing system in the management of nutmeg in Meukek District has met the requirements and harmony in terms of distribution of results in accordance with the contract, implementation, and distribution results that do not harm one party and on the basis of mutual assistance in its implementation.

Abstract

The need for food production is inseparable from the efforts of consumers who want food to last longer, thus triggering food producers to compete to make the food according to the wishes of consumers in a way that is not justified by laws and regulations, but this method will cause various diseases, even death. BPOM has a basis for law enforcement against criminal acts of food production according to the provisions of Article 6 Paragraph (1) and Article 7 Paragraph (2) of Law Number 8 of 1981 concerning criminal procedural law. The questions in this thesis are how is the law enforcement of food production crimes carried out by BPOM Banda Aceh, and what are the inhibiting and supporting factors for food production crimes. This study uses field research and uses qualitative research methods with an empirical juridical approach and applies two forms of data collection methods, namely interviews and documents. The results of the study showed that law enforcement was carried out by BPOM Banda Aceh, namely based on evidence from testing results, the process was submitting evidence to the prosecutor's office, destroying evidence, imposing administrative sanctions, BPOM obstacle factor was the lack of investigators, investigators did not have much authority in detention, requests from consumers, food producers do it repeatedly, while the supporting factors for BPOM investigators are having a laboratory car, cooperative actors. From the explanation above, the authors can conclude that law enforcement by BPOM investigators is still not optimal and still has obstacles.

Abstract

This research aims to examine the implementation of the qardhul hasan contract at Bank Aceh Syariah. To obtain data, the author used a qualitative research method, with an empirical juridical approach where the main source was obtained from interviews with stakeholders. Meanwhile, secondary data was obtained from reading sources such as books, journals, articles and other sources related to this research topic. The research results show that one of the financing schemes with a qardhul hasan agreement is intended for super micro businesses, where the maximum financing amount is IDR 10,000,000.00. Super micro financing is different from other financing schemes, where the creditor does not require collateral (collateral) for the debtor. Apart from that, Bank Aceh Syariah Banda Aceh Branch with a maximum financing agreement period of 3 years. In qardhul hasan financing, the administration fee charged to the customer is 1% of the financing amount. In general, the author can conclude that this financing scheme is in accordance with DSN-MUI Fatwa No.19/DSN-MUI/IX/2001, however based on Muamalah Fiqh it is permissible because the use of non-halal fund income is one of the sources of funds in its implementation.

Abstract

The legal perspective on interfaith marriage in Indonesia, particularly between Muslims and adherents of other religions, is predominantly influenced by Islamic legal norms. The legal regulations have been established in Articles 40 and 44 of the Compilation of Islamic Law. Fundamentally, these regulations prohibit marriage between Muslims and non-Muslim religious adherents. However, the legal construction in Indonesia tends to be non-binding, as opportunities for interfaith marriage practices persist. The Marriage Law Number 1 of 1974, which serves as the foundational legal framework for marriage in Indonesia, has not explicitly prescribed either permission or prohibition. This is substantiated by the prevalence of marriage practices between Muslim men or women and individuals from other religious backgrounds. The dichotomy between legal practices and legal norms consequently leads to a lack of legal certainty regarding its regulation in Indonesia. Therefore, this manuscript comprehensively elucidates interfaith marriage from Islamic legal perspectives, positive legal frameworks, and its practical legal implementation within the Indonesian context.

Abstract

Sistem demokrasi yang diterapkan di Indonesia memberikan ruang yang seluas-luasnya bagi masyarakat untuk turut serta membangun negara sesuai dengan tata pemerintahan yang baik. Luasnya kesempatan tersebut terangkum dalam syarat-syarat untuk terlibat langsung sebagai pemimpin atau wakil rakyat. Termasuk di dalamnya hak mantan narapidana untuk mengambil peran politik dengan berbagai batasan yang diatur oleh undang-undang untuk mengawasi keberlanjutan tanggung jawab mantan narapidana dalam mengambil hak politik. Dengan pendekatan analisis normatif, penelitian ini menguraikan tentang hak-hak politik bagi mantan narapidana khususnya dalam Putusan Mahkamah Konstitusi Nomor 03-03/PHU.DPD-XXII/2024. Hak politik yang diberikan oleh undang-undang kepada mantan narapidana merupakan masa jeda politik. Penelitian ini juga lebih jauh mengupas tentang masa jeda politik bagi mantan narapidana dari perspektif hak politik Islam. Menganalisis syarat-syarat yang dikemukakan oleh para fuqoha khususnya syarat untuk berlaku adil dan berakhlak mulia. Parameter etika moral merupakan modal seorang pemimpin dalam mengemban tanggung jawab sebagai pejabat publik.

Abstract

The Corona virus has changed aspects of married life. Divorce is currently booming because of the Covid 19 virus. Divorce occurs due to several factors, in general the trigger for divorce cases to increase is due to the Covid-19 pandemic. Covid-19 has had a significant impact on all aspects of life, including the divorce application that occurred at the Lhokseumawe Syar'iyah Court. This study aims to determine and analyze the increase in divorce requests during the Covid-19 Pandemic at the Lhokseumawe Syar'iyah Court and the factors causing the divorce, as well as the judge's efforts to reduce the occurrence of divorces affected by Covid-19 at the Lhokseumawe Syar'iyah Court. This study uses a qualitative approach with the type of field research. While the data collected in the form of primary and secondary data, the data obtained using direct interview techniques and documentation. To make it easier to check the data, in checking the validity of the data, the researcher uses the triangulation method. From this research, the writer gets several conclusions. The results of the study found that during the Covid-19 pandemic divorce cases at the Lhokseumawe Syar'iyah Court experienced an increase, but the cause of the divorce could not be stated specifically the impact that occurred due to the Covid-19 pandemic or these causes had occurred before the pandemic. . Divorce cases during the COVID-19 pandemic were caused by several factors and the dominant factors were economic factors, there was no harmony or constant bickering resulting in domestic violence, leaving one side behind, as well as the judge's efforts to reduce divorces affected by COVID-19. 19 at the Lhokseumawe Syar'iyah Court, namely through mediation.

Abstract

This study analyzes the Ndarohi custom as a customary sanction imposed on the perpetrators of a fight. The Ndarohi custom is a tradition that has been passed down from generation to generation in the Kute Pasekh Pekhmate community, Lawe Alas District, Southeast Aceh Regency. The Kute Pasekh community believes that the Ndarohi custom is able to reunite the perpetrators of a fight as a family by imposing customary sanctions in the Ndarodi tradition. The focus of this study is how the traditional Kute Pasekh community maintains the Ndarohi custom in resolving fights amidst the strong current of modernization of criminal case resolution through litigation. The purpose of the study was to determine the practice of the Ndarohi custom in resolving fight cases, and to preserve the Ndarohi custom in the modern era. This study uses a qualitative descriptive method, data obtained through field interviews and literature. The results of the study show that sanctions for resolving disputes in fight cases are resolved according to the Ndrohi custom through a deliberation process. Then the party found guilty is charged with medical expenses for the victim and is given a sanction in the form of money and one goat, according to the decision from the results of the deliberation by Sakhak Bekhempat. Sanctions in the Ndarohi custom have various types according to the quality of the crime committed by the perpetrator. Fights that cause physical harm, not bleeding, are subject to the Nucupi custom sanction or the mbabe nakan sekhimah sope sekhanting sanction; all medical costs are borne by the perpetrator of the customary crime. While criminal acts of fighting that result in bleeding wounds are subject to the sanction of drawing error and a fine in accordance with the written customary provisions. The Kute Pasekh community still strongly adheres to the Ndarohi custom in resolving customary criminal disputes. In addition to being a hereditary tradition, it is also effective in uniting the relationship of the customary community to obtain eternal peace.

Abstract

Aceh, as a region with special autonomy to implement Islamic law, holds the authority to enforce jināyah (criminal) law, as stipulated in Qanun Aceh Number 6 of 2014 concerning Jināyah Law. Notably, Article 67 of the Qanun provides special treatment for children who commit jarīmah (criminal acts), including the limitation of ‘uqūbah (punishment) to a maximum of one-third of the adult sentence, and rehabilitative alternatives such as returning the child to their parents or placement in a rehabilitation institution. However, implementation in the Mahkamah Syar‘iyyah (Sharia Court) of Banda Aceh reveals inconsistencies in judicial decisions and a lack of standardized technical procedures, partly due to the absence of sufficient implementing regulations, as noted in paragraph (2) of the article. This study aims to evaluate the application of Article 67 by the Mahkamah Syar‘iyyah of Banda Aceh and assess its alignment with the principles of siyāsah qaḍā’iyyah (judicial policy). The research adopts a qualitative methodology using a normative juridical approach and case studies of two jināyah verdicts involving children from 2021 and 2022. The findings indicate that the court has made efforts to implement the article; however, the forms of ‘uqūbah applied vary, ranging from limited imprisonment to rehabilitation. This reflects a flexible implementation adapted to the social and psychological conditions of the child. While the decisions generally align with child protection principles, consistency remains a significant challenge. This study highlights Article 67 as a potential meeting point between Islamic law and the national juvenile justice system.

Abstract

The availability of clean water is a fundamental right of the community that service providers, including community-based management systems such as bore wells, must fulfil. The management of clean water in the Tiongkok Neuhen residential complex faces various issues, indicating that the protection of consumer rights has not been optimal. This study aims to analyze consumer protection in the provision of clean water services through bore wells in the complex, viewed from the perspective of Law Number 8 of 1999 on Consumer Protection and the theory of maslahah in Islamic law. This research employs a descriptive qualitative method with an empirical juridical approach. Data were obtained through field observations and direct interviews with residents and management, then analyzed by comparing practices in the field with positive legal norms and Islamic principles. The results show that the management system still experiences problems such as unequal water distribution, slow handling of equipment damage, and some residents failing to pay their contributions. From the perspective of positive law, this reflects the incomplete fulfillment of consumers’ rights to comfort. Meanwhile, according to the theory of maslahah, the management has not fully embodied the principles of justice and collective welfare. Nevertheless, the existing system still has the potential to be developed into a fair and sustainable community-based service model through institutional strengthening, clear internal regulations, and consumer rights education grounded in Islamic values.
