Abstract

Pernikahan beda agama menjadi permasalahan yang cukup serius di negara Islam. Dikarenakan adanya penyimpangan terhadap syariat yang telah diturunkan oleh agama, akan tetapi di beberapa negara pernikahan beda agama seakan menjadi hal yang biasa dan bahkan pelaksanaannya didukung dengan peraturan. penelitian ini merupakan penelitian normative, deskriptif evaluative dan pendekatan yang digunakan adalah pendekatan perundang-perundangan, konseptual dan perbandingan pernikahan beda agama di negara Indonesia, Malaysia dan Brunei Darussalam. Hasil penelitian menunjukkan bahwa aturan pernikahan beda agama di Indonesia, Malaysia dan Brunei diatur di dalam undang-undang setiap negara dengan menyesuaikan kecenderungan yang terdapat di setiap negara, walaupun demikian praktek-praktek pernikahan beda agama tidak dapat dibenarkan dalam preservation of din perspective, karena pernikahan merupakan perintah agama yang ditujukan untuk menjaga agama itu sendiri, sehingga Ketika pernikahan beda agama dilakukan maka akan menghilangkan unsur-unsur yang terdapat dalam agama, dan apabila unsur-unsur tersebut telah hilang maka hilanglah penjagaan terhadap agama

Abstract

Islam is a religion adhered to by most of Lombok’s population. Lombok is an area rich in religious traditions. One of them in the Praya area is the ‘Nyiwak’ tradition. Nyiwak is a religious tradition of dhikr and tahlil carried out on the ninth day of a person’s death. This “Nyiwak” tradition applies to all levels of society regardless of the economic level of the family left behind. This tradition is difficult for the people of Praya to abandon because it is ingrained and has become a forum for friendship between communities. In addition, this tradition is also one of their ancestors’ legacies, which continues to be preserved to this day. Thus, some view it as a heresy (bid’ah). Therefore, this research aims to analyze the Nyiwak tradition based on an Islamic law perspective. This research was a descriptive analysis research, where the researcher tried to describe the concept of the Nyiwak tradition in Praya globally and then analyzed it based on Islamic law. Data was collected through participant observation by being one of the congregation readers of Yasin, dhikr, and Tahlil at the forum. The research results obtained two views about Islamic law’s “Nyiwak” tradition. Firstly, the research revealed that it was not based on the Sunnah of the Prophet or Bid’ah Dholalah. Secondly, this tradition was Bid’ah Mahmudah or praiseworthy, because it contained good habits to bring one’s soul closer to Allah SWT.

Abstract

Abstract : The development of Islamic Economy in several Asian countries through many processes, among them is the establishment of a Law or a Government Regulation. The development of Islamic economics in several Asian countries such as Indonesia, Malaysia, Singapore, Thailand and Brunei Darussalam, can be seen from the growth of Banking in each of these countries. The method used in this writing is the Writing Method Library Reseach. This study yielded some important points, that the development of Islamic economics in the countries that become the object of research, originated from the seriousness of the Muslims to establish sharia-based banking, because in the minds of minority Muslims, that they have the right to consume halal banking products and in accordance with their religious teachings. The aspirations of these Muslims are not only heard by the local government, but the government's attention is on their aspirations. In the end, as a proof of the concern, a regulation was issued concerning the opening of banking with profit sharing or non-interest system.Keywords : Islamic Economy,Sharia Banking

Abstract

Provisions in the transfer of property from people who died to those who were left behind, by the Fuqaha' are named as al-faraid, and or in Indonesia it is better known as Islamic inheritance law. The concept of justice in the distribution of inheritance is still a topic of discussion among the public. The zahir provisions of the Koranic texts that give men a larger share of inheritance than women and ignore equality pose a complicated problem faced by Muslims in various countries. This is because of the invisible Maslahah that is obtained by each heir. This study aims to analyze the concept of benefit in justice contained in Islamic inheritance law to answer contradictory arguments in determining benefit in the form of justice in Islamic inheritance law. This research is a literature review/research with documentation as a data collection method. Philosophical and normative approaches are being used in analyzing data, especially Islamic legal norms which are sourced from the Koran and Hadith. The results of this study indicate that in the distribution of inheritance, Islam is very concerned and even prioritizes the principles of Maslahah and justice for each heir. There is no assumption that Islamic inheritance law does not apply fairly and leads to discrimination against women, because justice has been proven on the side of benefit in the practice of dividing Islamic inheritance.
