Abstract

Some business people objected because of the uncertainty of the time for the settlement of default disputes in Court. Therefore, there is often a clause in the agreement for the waiver of Article 1266 and Article 1267 of the Civil Code to cancel the agreement without a court process. The main point of this research discusses the Legal Certainty of the Exclusion Clause of Article 1266 and Article 1267 of the Civil Code in Connection with the Cancellation of the Agreement Agreed by the Parties in the Notary Deed. This study aims to find out the existence of dispute resolution in the Court where the parties have agreed to waive the provisions of Article 1266 and Article 1267 of the Civil Code and the legal certainty of the waiver of the provisions of Article 1266 and Article 1267 of the Civil Code agreed upon by the parties in the Notary Deed. The method used in this study is normative juridical research, namely research on literature law or secondary data with sources of primary, secondary and tertiary legal materials. The research approach used is an analytical approach and the technique of collecting legal materials is carried out by inventorying positive legal rules, literature, books, journals and other sources of legal materials. The analysis technique of legal materials is carried out by carrying out grammatical, systematic, and legal construction methods. The results of the study show that the waiver of the provisions of Article 1266 and Article 1267 of the Civil Code in the Notary Deed that has been agreed upon by the parties, then at the stage of its implementation, there is one of the parties who objects to the waiver of Article 1266 and Article 1267 of the Civil Code in reality can file a lawsuit with the Court in connection with the waiver clause of Article 1266 and Article 1267 of the Civil Code, while the party in the position of the defendant who postulated in his execution that the plaintiff did not have legal standing/persona standi in judicio because he had agreed to waive Article 1266 and Article 1267 of the Civil Code, the reality was not considered by the Court. Article 1266 and Article 1267 of the Civil Code are suggested to be amended by adding an exception sentence in the form of "can be set aside as long as agreed by the parties".

Abstract

The Constitutional Court Decision Number 18/PUU-XVII/2019 has brought changes to the execution process in fiduciary guarantees, making the creditor's position change before the birth of the decision. The existence of requirements for creditors in executing fiduciary security objects and determining defaults has changed, resulting in creditors not being able to immediately execute fiduciary security objects. Abstract

Das sollen Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dilaksanakan atas akta jual beli Pejabat Pembuat Akta Tanah (PPAT). Namun Das sein masih terdapat proses jual beli tanah dilaksanakan dibawah tangan tidak melalui Pejabat Pembuat Akta Tanah (PPAT). Tujuan penelitian mengetahui keabsahan proses jual beli tanah yang dilakukan dibawah tangan berkaitan pada pendaftaran tanah dan kepastian hukum dari pendaftaran tanah atas proses jual beli tanah yang dilakukan dibawah tangan perihal pengalihan hak karena para pihak penjual telah tidak diketahui posisi keberadaanya. Metode yuridis normatif menggunakan data sekunder dan pendekatan peraturan perundang-undangan, kasus, dan analisis. Pengumpulan data diidentifikasi dengan analisis kualitatif dan ditarik kesimpulan logika deduktif. Hasil diketahui Penggugat selaku pembeli mengajukan gugatan dengan kasus terhadap Tergugat selaku penjual atas Putusan Nomor : 169/Pdt.G/2020/PN.Sel, Putusan Nomor : 222/Pdt.G/2019/PN.Ckr, Putusan Nomor : 154/Pdt.G/2022/PN.Smg menyatakan kebasahan jual beli tanah dibawah tangan berkaitan pendaftaran tanah dan kepastian hukum pendaftaran tanah atas proses jual beli dibawah tangan sah secara hukum.

Abstract

This research aims to analyze the legal consequences of terminating a lease agreement due to force majeure concerning payments that have been entirely made by the lessee, as well as legal protection for the lessee regarding the leased object that cannot be enjoyed due to force majeure. This study uses a normative legal research method to examine relevant laws and regulations, court decisions (Case Approach), and relevant legal concepts. The study results indicate that in a force majeure situation, the lessee generally cannot claim compensation based on the Civil Code. However, applying the concept of The Law of Restitution can provide fairer legal protection, requiring the lessor to return the value of benefits received if the leased object cannot be enjoyed. This research concludes that further regulation regarding force majeure in the Civil Code is necessary to provide legal certainty and justice for the parties in a lease agreement.

Abstract

Pasal 48 ayat (2) Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris mengatur bahwa perubahan isi akta dapat dilakukan jika diparaf oleh penghadap, saksi, dan Notaris. Namun, dalam praktiknya, sering terjadi akta otentik mengenai perjanjian sewa menyewa yang direnvoi sepihak oleh penyewa tanpa sepengetahuan pemberi sewa. Penelitian ini bertujuan untuk menganalisis akibat hukum dan kepastian hukum dari akta notaris yang direnvoi sepihak tersebut. Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif, yaitu penelitian hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Adapun pendekatan penelitian yang dipergunakan Pendekatan Perundang-Undangan, Pendekatan Konseptual, Pendekatan Analitis, Pendekatan Kasus dan teknik pengumpulan bahan hukum dilakukan dengan cara mengidentifikasi dan menginventarisasi aturan hukum positif, literatur buku, jurnal dan sumber bahan hukum lainnya. Untuk teknik analisa bahan hukum dilakukan dengan penafsiran gramatikal, penafsiran Sistematis, dan metode konstruksi hukum. Hasil penelitian menunjukkan bahwa akibat hukum dari akta notaris yang direnvoi sepihak adalah hilangnya kekuatan pembuktian absolut akta tersebut, yang berubah menjadi akta di bawah tangan. Hal ini menyebabkan akta tersebut dapat disangkal oleh salah satu pihak, sehingga pemberi sewa berhak meminta pembatalan akta melalui pengadilan.Kepastian hukum terkait akta notaris yang direnvoi sepihak juga terancam, karena akta tersebut dapat dibatalkan demi hukum. Pemberi sewa yang dirugikan dapat menuntut pembatalan berdasarkan pelanggaran syarat formal dalam pembuatan akta notaris. Penelitian ini menyarankan perlunya revisi Pasal 48 dan Pasal 51 UUJN untuk menambahkan sanksi pidana dan administratif bagi Notaris yang melanggar ketentuan mengenai renvoi.

Abstract

The credit agreement is a main agreement that can be followed by additional agreements. If the debtor defaults, the creditor can settle by transferring the receivables by Cessie. Credit agreements often occur where the debtor borrows collateral belonging to another person or third party in the form of a land certificate and then that person acts as the provider of mortgage rights to guarantee repayment of the debtor's debt. The involvement of a third party in a guarantee agreement often results in losses if the debtor fails to pay. The problem in this research is how to transfer receivables in Cessie by the creditor in the event that the debtor fails to pay against third party mortgage guarantees and what form of legal protection exists for third parties as providers of mortgage rights regarding the transfer of receivables in Cessie by creditors in the event that the debtor fails to pay. The theories used in this research are legal protection theory and contract theory.From the research results, the transfer of receivables by Cessie by the creditor in the event that the debtor fails to pay the third party mortgage guarantee does not comply with the applicable provisions as regulated in Article 613 of the Civil Code and Law of the Republic of Indonesia Number 4 of 1996 concerning Mortgage Rights. Form legal protection for third parties by filing a lawsuit before or during the execution process. The government, stakeholders and related parties are expected to make changes to Law of the Republic of Indonesia Number 4 of 1996 concerning Mortgage Rights over Land and Objects related to Land, by accommodating third party protection which is explicitly regulated in guaranteeing rights to land, these regulations do not clearly regulate the rights and obligations of third parties so they cannot provide legal protection for collateral owners.

Abstract

Pembahasan mengenai tanggungjawab hukum  PPAT  dalam  pembuatan  akta pemberian hak tanggungan yang diketahui kemudian tidak terpenuhi syarat formil. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Tanggung jawab Hukum PPAT dalam pembuatan Akta Hak Tanggungan yang tidak terpenuhi syarat formilnya bahwa sesuai dengan Pasal 55 PERKABAN No. 1 Tahun 2006, dalam pelaksanaan tugas dan jabatannya untuk pembuatan akta, PPAT bertanggung jawab secara pribadi terhadap setiap akta yang dibuatnya, dikaitkan dengan Pasal 23 UUHT, apabila PPAT melanggar atau lalai dapat dikenakan sanksi administratif. Apabila terdapat gugatan dari para pihak, dapat dimintakan pertanggungjawaban dalam bentuk perdata, pidana maupun administratif.
