Abstract

This study explores the legislative frameworks governing drug rehabilitation and the reintegration of former drug addicts into society through a normative juridical analysis. The research examines how laws and policies influence the recovery journey, highlighting critical gaps in anti-discrimination measures, public health integration, and societal reintegration mechanisms. Comparative case studies from countries with progressive approaches, such as Portugal and Norway, illustrate effective models for aligning legal systems with public health strategies. The findings emphasize the need for legislative reforms that promote inclusivity, support long-term recovery, and foster societal acceptance. Recommendations include expanding anti-discrimination protections, incorporating restorative justice mechanisms, and enhancing interagency collaboration to ensure holistic rehabilitation programs. This research contributes to the discourse on aligning law and social policy to address the multifaceted challenges of drug addiction and reintegration.

Abstract

This study examines the legal mechanisms for the social reintegration of drug addicts, focusing on rehabilitation as a transformative approach to enabling individuals to re-enter society as productive citizens. Using a normative juridical analysis, the research explores the alignment of national legal frameworks with international human rights standards and evaluates the challenges in implementing rehabilitation-focused policies. Findings reveal that while laws and policies supporting rehabilitation exist, their effectiveness is hindered by societal stigma, inconsistent application, and resource limitations. The study emphasizes the need for policy alignment with international standards, expansion of community-based programs, public awareness campaigns, and strengthened monitoring systems. These measures are essential for creating a supportive legal and social environment conducive to the successful reintegration of drug addicts into society.

Abstract

The research investigates law's role in promoting transformative justice through social engineering, focusing on rehabilitation and reintegration processes of drug addicts into society. This study applies a normative-juridical approach to evaluate Indonesia's legal frameworks for their effectiveness in handling addiction as a public health issue. Comparative analyses with international models, such as the decriminalization in Portugal and harm reduction policies in the Netherlands, show what a change of heart in legal philosophy might achieve. The findings put forward the majors lacuna in the present legislation: undue punitive, lack of supportive infrastructure, and stigma among society. Recommendations offered by the study go on to include legislative reform for rehabilitation, supportive infrastructure development, public-private partnership for effective reintegration. This paper advocates for a compassionate justice system that embeds transformative justice principles into legal frameworks, promoting societal productivity and inclusivity.

Abstract

This paper provides a normative juridical analysis of Indonesia's carbon trading regulations, with a focus on environmental justice and fairness. It examines the legal framework established by Presidential Regulation No. 98 of 2021, which governs carbon pricing mechanisms, including carbon taxes and carbon credit trading. The analysis highlights key gaps in the regulation, particularly in terms of equitable benefit distribution and inclusion of vulnerable communities in decision-making processes. While Indonesia's carbon trading system aligns with global trends and its international obligations, significant improvements are needed to ensure that marginalized groups are not further disadvantaged. Recommendations include the redistribution of carbon trading revenues, enhanced public participation, stronger enforcement mechanisms, and alignment with international best practices.

Abstract

The paper will attempt to discuss illegal fishing in Indonesia from a legal framework and law enforcement perspective and its implications for the protection of maritime sovereignty. Based on this, the research will apply a normative juridical approach, studying in detail the laws, regulations, and practices of enforcement and the various challenges and opportunities arising out of them. Indnesia legal framework through the Fisheries Law no 45 of 2009 and the Presidential Decree no. 115 of 2015 set a good backbone regarding IUU fishing activities; still, poor enforcement is highly seen due to shortcomings in limited resources, corruption, fragmented jurisdiction, and less international cooperation. The paper analyses these discrepancies and assesses Indonesia's current legislation and the efforts carried out on tackling IUU in comparison to relevant international practices. It also gives some recommendations on how to strengthen the legal definition, mechanisms of enforcement, increasing resource allocations, and improvement in international cooperation. The result shows that integrated efforts with more transparency and accountability are needed in order to properly protect Indonesia's maritime sovereignty effectively.

Abstract

This research reviews labor law's role in the settlement of disputes in industrial relations within a normative juridical perspective in Indonesia. The research focuses on workers' rights and employers' obligations under Indonesia's labor legislation, mainly Undang-Undang No. 13 Tahun 2003 (the Labor Law). The study examines dispute resolution mechanisms, such as negotiation, mediation, and arbitration through the PHI, their effectiveness in protecting workers' rights, and how well employers adhere to the law. From the results, it is learned that negotiation and mediation are effective at the starting stage, but due to power imbalance and delayed processing in the judicial system, comprehensive settlements could not be achieved. Moreover, inconsistent court decisions, weak enforcement of workers' rights, and lack of adequate union representation remain critical. Concluding, the paper provides recommendations on how Indonesia can better settle labor disputes by strengthening mechanisms for mediation and arbitration, enhancing judicial capacity, and effective enforcement of workers' rights.

Abstract

The paper discusses civil liability for environmental damages in Indonesia, considering the carbon trading mechanisms role in promoting corporate responsibility. Hence, this research has adopted a normative approach, analyzing the existing juridical framework that governs environmental damage and discussing to what extent carbon markets, among other emissions trading systems or carbon taxes, can serve complementary functions of incentivizing corporations toward environmentally responsible behavior. The study identifies loopholes within Indonesia's legal system, particularly for the enforcement of environmental liability laws, and discusses how carbon trading could supplement these deficiencies through financial incentives for reducing emissions. The results show that while the mechanisms of carbon trading hold great potential to promote corporate responsibility, their effectiveness relies on robust market infrastructure, sound systems of monitoring and verification, and integration with existing policies on the environment. The study also finds that to enhance corporate environmental accountability in Indonesia, a combination between legal liability and market-driven incentives is essential.

Abstract

E-Government memberikan pelayanan publik terhadap masyarakat. Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Lubuk Linggau, telah menggunakan teknologi pelayanan perizinan online yaitu SICANTIK. Kendala yang dirasakan oleh pegawai, seperti gangguan yang terjadi akibat maintenance system mempengaruhi aktivitas pelayanan. Dilakukan analisis terhadap aplikasi SiCantik cloud pada DPMPTSP Kota Lubuklinggau. Memperhatikan faktor yang mempengaruhi kepuasan pemakai digunakan sebagai saran serta masukan untuk memperbaiki atau meningkatkan kualitas dan kinerja dari aplikasi tersebut secara maksimal. Metode Importance Performance Analysist (IPA) sebagai alat ukur yang digunakan untuk mengetahui tingkat kepuasan penggunaan aplikasi. Aplikasi diukur dengan tingkat kepentingan dan tingkat kinerja menggunakan 3 variabel sebagai indikator yaitu Kualitas Informasi, Kualitas Interaksi, dan Kemudahan terdapat 100 responden. Hasil pemetaan nilai gap yaitu sebesar 0,04 dimana nilai variabel Kemudahan sebesar  -0 07, variabel Kualitas Informasi 0,01, variabel Kualitas Interaksi -0,07. Kemudian dilakukan pemetaan setiap item pada diagram kartesius dengan sumbu X (performance) sebesar 3,81 dengan sumbu Y (importance) sebesar 3,85. Kepuasan terhadap kualitas layanan aplikasi SiCantik DPM-PTSP Kota Lubuklinggau dilihat dari kemudahan, kualitas informasi, dan kualitas Interaksi memiliki kinerja yang baik serta dapat memenuhi harapan pengguna. Hasil pemetaan diagram diperoleh 2 indikator yang perlu di tingkatkan, 7 indikator yang perlu dipertahankan oleh DPM-PTSP Kota Lubuklinggau. Terdapat 11 indikator yang tidak dianggap penting pada kuadran C dan D.Keyword: Analisis, Importance Performance Analysist, Kepuasan Pengguna
