Abstract

As a new expansion region, Central Papua Province faces serious challenges in providing the right to food, with the highest Prevalence of Insufficient Food Consumption (PKPK) nationally, which is 37.69% in 2024. This study examines the urgency of establishing food security regulations in Central Papua to guarantee the constitutional right to food and realize social justice. The method used is normative legal research with a regulatory and conceptual approach based on John Rawls’ social justice theory. The results of the study indicate that there is no substantive legal gap in regulating food security at the regional level, which has an impact on weak cross-sectoral coordination and marginalization of vulnerable groups, primarily indigenous peoples. The novelty of this study lies in the emphasis on using PKPK indicators as the basis for formulating data-based and participatory regulations. This study introduces the strengthening of the role of law as an instrument of social engineering, which not only regulates technically but also emphasizes the state’s responsibility in providing fundamental citizen rights. Establishing the Regional Regulation/Provincial Regulation on Food Security in Central Papua is an urgent constitutional step to realize fair, measurable, and sustainable food governance in the new autonomous region.

Abstract

The "No Viral No Justice" phenomenon indicates society's dependence on the pressure created by the virality of information on social media as a means to encourage law enforcement. In many cases, especially those involving violence, discrimination, or injustice against vulnerable groups, the spread of information via social media often becomes a primary motivator for law enforcement to take quicker action. This problem formulation is related to social media as a catalyst for social change in public oversight and the implications of social media in social engineering regarding law enforcement and social justice. This study uses a normative legal approach, case study data collection techniques, and data obtained from literature relevant to the research topic. The data presentation technique used is descriptive and thematic analysis. The use of social media for law enforcement oversight is an example of Social Engineering, where public pressure via social media aims to guide law enforcement agencies to expedite judicial processes and act more justly. The "No Viral No Justice" phenomenon demonstrates how social media can create urgent social pressure to ensure that justice is achieved, even when formal legal procedures take longer. In this context, social media acts as part of the Social Engineering mechanism, influencing the law to be more responsive to social justice demands. The implications of social media on law enforcement and social justice may include increased transparency and accountability, as well as impacts on social justice. With public pressure via social media, the law enforcement process can become faster, more transparent, responsive, and prevent abuse of power.

Abstract

This book is the latest work by Kerry J. Kennedy, a leading scholar on civic education and global education policy. In this book, Kennedy presents a comprehensive analysis of how civic education needs to be reformulated amidst a rapidly changing and uncertain global landscape. Disruption, which is the key word in this discussion, does not merely refer to the development of digital technology, but to structural changes involving economic, political, social and environmental fields. Kennedy sees that the younger generation is living in the "century of disruption", a time when stability is no longer the norm, and uncertainty is inevitable. Therefore, this book proposes an educational approach that prepares learners to survive and participate meaningfully in this changing world.

Abstract

Indonesia faces significant challenges in achieving sustainable development, particularly due to the negative environmental impacts of rapid economic growth, such as deforestation, air and water pollution, and the increase in greenhouse gas emissions. Green Bonds have great potential as a financial instrument to promote sustainable development in Indonesia. Indonesia is actively working to develop the market through key policies such as the Financial Services Authority Regulation (POJK) No. 51/POJK.03/2017, which regulates the issuance and offering of sustainable bonds, thus enhancing the suitability of green bonds to finance environmentally friendly projects. The research method used in this study is a normative legal approach with a focus on laws and regulations (UU) and a library research method. Through this approach, the study analyzes relevant regulations and existing literature to explore the potential and challenges Indonesia faces in implementing green bonds, particularly in the infrastructure investment sector. The implementation of green bond investments in Indonesia, especially in the infrastructure sector, is a strategic step in line with efforts to achieve sustainable development. To achieve this, Indonesia must also consider integrating green bonds into broader development policies. This includes developing strategies that combine economic, social, and environmental aspects in the planning and implementation of infrastructure projects.

Abstract

Perubahan teknologi digital dalam sektor transportasi online telah mengubah peran tukang becak dalam sistem transportasi tradisional, di mana mereka kini menghadapi persaingan ketat dengan moda transportasi berbasis aplikasi. Seiring dengan perkembangan ini, kebijakan hukum yang responsif dan inklusif bagi pekerja sektor informal, seperti tukang becak, sangat diperlukan untuk melindungi hak-hak mereka, termasuk hak atas pekerjaan yang layak dan perlindungan sosial. Penelitian ini untuk mengetahui implementasi kebijakan pemerintah dalam mendorong adaptasi teknologi pada profesi tukang becak dan kebijakan hukum dalam meningkatkan akses pendidikan untuk tukang becak di tengah era digital. Metode yang digunakan adalah metode penelitian literatur review dengan jenis penelitian hukum normatif dengan pendekatan kualitatif. Hasil penelitian ini adalah penerapan teknologi digital dalam sektor transportasi menuntut pemerintah untuk merumuskan kebijakan yang mendukung adaptasi tukang becak melalui pelatihan teknologi dan perlindungan sosial. Kebijakan ini harus memperhatikan aspek sosial budaya dan menyediakan evaluasi berkelanjutan untuk memastikan keberlanjutan profesi tukang becak di era digital.

Abstract

The problem of plastic waste in Southeast Asia has become a global environmental issue that imposes economic costs and threatens marine ecosystems. UNEP (2021) and World Bank (2021) identify Indonesia, the Philippines, Vietnam, and Thailand as major contributors to marine plastic leakage. Although several countries have adopted Extended Producer Responsibility (EPR) in national policy, implementation is weak and lacks regional harmonization. This study combines normative legal research with economic impact analysis using international datasets to identify regulatory gaps and evaluate the potential benefits of harmonized EPR across ASEAN. Results indicate that fragmented legal frameworks, limited monitoring capacity, and insufficient economic incentives undermine EPR effectiveness. Economic modeling estimates annual losses exceeding USD 6 billion from plastic leakage, costs borne by communities and governments. Scenario analysis suggests that harmonized legal standards and cost-internalization via EPR could reduce leakage by up to 40% while generating employment in circular-economy sectors. The findings underscore that legal-economic integration is essential: enforceable regional rules, transparent financial flows, and producer-funded mechanisms grounded in the polluter-pays principle are needed. The study recommends an ASEAN binding framework for EPR, standardized reporting and independent audits, and blended-finance instruments to bridge investment gaps and accelerate the transition to sustainable plastic economy.

Abstract

Digital transformation has created new forms of employment within the framework of the gig economy, one of which is online motorcycle taxi drivers (ojol). Despite their importance, these drivers lack defined legal status. As a result, they don’t receive labor protection equivalent to that of formal workers. This legal uncertainty has triggered various collective demands, including the provision of religious holiday allowances (THR), regulation of minimum fares, commission limits, and access to social security. This study aims to analyze the urgency of legal recognition for gig economy workers, identify forms of maladministration in the governance of digital labor, and propose regulatory reforms to strengthen legal protection for ojol drivers. The research used normative legal research with statutory and conceptual approaches. The results showed that partnership status unilaterally constructed by platforms creates a pseudo-partnership that contradicts the principles of worker protection. The state is considered negligent in regulating fare systems, supervising commissions, and providing adaptive legal protection. Therefore, regulation through specific legislation (lex specialis), judicial review of exclusive norms, and the application of soft law in the digital transport sector are necessary. Recognizing gig economy workers as legal subjects is essential for creating an inclusive, fair, constitutional labor system

Abstract

Anak dianggap sebagai seseorang yang belum memiliki legitimasi hukum dalam memberikan keputusan karena ketidakmampuan pada pola pikir yang dianggap belum dewasa. Akan tetapi anak memiliki hak sejak ia dilahirkan dan merupakan kehendak dilengkapi kekuatan (macht) yang dijamin dan dilindungi oleh sistem hukum atau tertib hukum. Tujuan pendidikan dan pemberdayaan ini adalah mengetahui media SAFEKids dalam eksistensi menjamin perlindungan hukum anak dan mengetahui Ibu-Ibu PKK dalam menjamin kesejahteraan anak dengan metode COCD (Community Organization or Community Development). Metode dan tahap pelaksanaan adalah observasi, perizinan, penyuluhan, pelatihan, implementasi program, pendampingan dan monitoring, serta evalusasi. SAFEKids adalah singakatan dari Supporting A Future of Excellence for Kids, yang merupakan course media berbasis website yang menjadi platform pendidikan dan pembelajaran dalam meningkatan kesadaran masyarakat tentang perlindungan hukum anak. SAFEKids sebagai media pendukung bertujuan dalam menjamin kesejahteraan anak berdasarkan hukum agar dapat menciptakan keadilan, kepastian, dan kebermanfaatan. Dengan memberdayakan Ibu-Ibu PKK dengan metode Community Organization or Community Development (COCD) yang didukung dengan media SAFEKids, kekerasan anak mengalami penurunan serta peningkatan kesadaran hukum akan kesejahteraan hak-hak anak menjadi terjamin

Abstract

The disharmony in the regulatory framework governing Bawaslu’s authority between the General Election and Regional Election regimes creates legal uncertainty and weakens the effectiveness of administrative violation enforcement, primarily due to the divergence between binding “decisions” and non-executory “recommendations.” This discrepancy undermines procedural justice and reduces the reliability of election oversight mechanisms intended to safeguard fairness and integrity. This study aims to analyze the normative inconsistency contained in Articles 139 and 140 of the Regional Election Law and to formulate a reconstruction model that strengthens Bawaslu’s authority in accordance with constitutional principles and contemporary electoral governance needs. Using normative juridical and conceptual approaches, this research examines statutory regulations, Constitutional Court Decision No. 104/PUU-XXIII/2025, and relevant scholarly literature. The findings reveal that the existing dualism of authority creates institutional subordination and obstructs effective administrative enforcement, thereby necessitating the strengthening of Bawaslu’s adjudicative powers supported by enforceable mechanisms and a structured administrative appeal system. Such reconstruction is essential to reinforce electoral integrity and to establish a coherent and just legal framework governing regional elections.

Abstract

Purpose: This study aims to analyze the failure of implementing the Regulatory Impact Assessment (RIA) in maintaining regulatory rationality within Indonesia’s fast-track legislation practices and to formulate a reform model grounded in Max Weber’s theory of rational-legal authority and the principles of good regulatory governance. Methodology: This research employs a normative juridical method using conceptual and statutory approaches. Legal materials were collected through library research and analyzed qualitatively using rational-legal reasoning to evaluate the effectiveness of the RIA mechanism in ensuring the quality of lawmaking processes. Findings: The study finds that RIA has not been substantively implemented in Indonesia’s fast-track legislative process, resulting in a shift from legal rationality to pragmatic political rationality. This condition has weakened legal legitimacy, caused policy overlaps, and eroded public trust in legislative institutions. The lack of public participation, transparency, and evidence-based analysis is identified as the main factor behind the ineffective implementation of RIA. Practical implications: The findings highlight the urgency of adaptive RIA reform through strengthened inter-agency coordination, the adoption of an open regulatory data system, and the establishment of an independent regulatory evaluation body. This model can serve as a practical framework for policymakers to ensure rational, transparent, and accountable legislative processes. Originality/value: This study offers an original contribution by integrating Weberian legal rationality theory into the reform design of RIA in Indonesia. It presents a novel conceptual framework for reinforcing legal legitimacy and regulatory quality through the institutionalization of RIA as a mechanism of rational-legal authority in a modern Rechtsstaat.
