Abstract

One of the authorities given to the Regional Government is waste management. The waste problem is a problem that is always hotly discussed in Indonesia and in cities around the world, because almost all districts and cities in Indonesia face this waste problem, as is the case in the Meranti Islands Regency, Riau Province. This research will describe the government's efforts to deal with waste in Tebing Tinggi District in 2020, and the research method used in this research is qualitative. The results of the research show that to date the efforts made by the Meranti Islands Regency government in dealing with the waste problem in 2020 have not been optimal due to very limited dam factors when compared with other districts or cities in the Riau Province region. Efforts made regarding waste handling and management are of course ineffective because there is a reduction in funding from the regional government. However, the department that carries out waste management continues to strive to provide the best. Keywords: Government Efforts, Waste Management, Handling

Abstract

Abstract

Banking customer default (wanprestasi) cases have increasingly dominated civil litigation in Indonesian district courts, particularly following the economic disruptions caused by the COVID-19 pandemic. While debtors frequently acknowledge contractual breach, courts are often confronted with non-juridical arguments based on economic hardship, creating a tension between strict contractual enforcement and the pursuit of substantive contractual justice. This study aims to analyze judicial reasoning in adjudicating banking customer default by examining Decision No. 22/Pdt.G.S/2023/PN Batam and assessing its conformity with the provisions of the Indonesian Civil Code. The research employs a normative juridical method using statutory and case approaches, relying on secondary legal materials including court decisions, statutory regulations, and legal doctrines. The findings reveal that the court consistently applied Articles 1239, 1243, and 1244 of the Civil Code, declaring the defendant in default due to failure to fulfill credit repayment obligations despite multiple formal warnings (somasi). Judicial reasoning was primarily grounded in written evidence and the debtor’s explicit acknowledgment of default, allowing the case to be resolved efficiently under the simplified lawsuit mechanism. The court ordered full repayment of the outstanding loan or, alternatively, authorized the auction of collateral through the State Assets and Auction Service Office (KPKNL). However, the analysis also indicates that the judgment predominantly emphasized legal certainty and contractual compliance while giving limited consideration to the debtor’s post-pandemic economic condition and request for installment relief. This study is significant as it demonstrates how simplified civil procedures reinforce creditor protection and procedural efficiency, yet simultaneously expose limitations in accommodating substantive contractual justice. The findings contribute to the development of default theory in banking law and provide critical insights for improving judicial responsiveness in contractual disputes involving socio-economic vulnerability.

Abstract

Purpose: This study examines whether information asymmetry in digital markets can be understood as a form of epistemic injustice and to assess how the consumer protection frameworks of Indonesia and the Philippines respond to this problem. Research Design and Methodology: This research employs the normative legal research method and comparative approach, with epistemic injustice as the main philosophical, analytical lens. To supplement the analysis, the study utilizes key primary law sources, namely Law No. 8 of 1999 and Government Regulation No. 80 of 2019 from Indonesia; and Republic Act No. 7394 and the Internet Transaction Act of 2023 from the Philippines. Findings and Discussion: Information asymmetry is comprehensively identified as a form of testimonial and hermeneutical injustice that undermines consumers’ capacity as knowers. Normative analysis conclusively shows that both countries are reliant on general legal norms, incapable of philosophically and normatively capturing information asymmetry in today’s markets. In addition, deficiencies are also found in recent regulations, where algorithmic opacity and complaint-handling mechanism remain unaddressed. Implications: The study implies the need for comprehensive reform and proposes that legal development should move beyond broad fairness principles to operationalize specific digital safeguards, and clearer disclosures, along with verifiability and platform accountability standards.

Abstract

This study aims to examine the adequacy of antitrust frameworks in Indonesia and the Philippines in addressing digital market dominance, particularly when benchmarked against the European Union’s Digital Markets Act (DMA). This objective is aimed at addressing the literature gap where existing studies have yet to systematically assess how ex-ante regulatory logic, as pioneered in the EU context, can be normatively adapted to the specific deficiencies of Southeast Asian antitrust frameworks. The research employs a normative legal method combined with a comparative approach, analyzing statutory regulations and relevant legal literature, including Indonesia’s Law No. 5 of 1999, the Philippine Competition Act, and the EU DMA. The findings reveal that both countries’ competition laws are inadequate in addressing the complexities of digital markets, particularly in relation to data control, network effects, algorithmic practices, and platform dependency. Indonesia’s framework is significantly outdated, while the Philippines’ law, although more recent, still lacks digital-specific provisions. Aside from normative deficiency identification, the benchmarking against DMA also reveals that the ex-ante approach is more suitable to address today’s digital platform dynamic, which leads this study to contribute a legal development model for both Indonesia and the Philippines, each tailored to their existing normative architecture
