Abstract

This article describes the implementation of lecturer service in providing material on the importance of understanding Islamic Inheritance Law according to the Compilation of Islamic Law for Orphans and Duafa in the Muhammadiyah Tembilahan orphanage. The urgency of this activity is carried out to add insight into the right to inheritance distribution according to the Compilation of Islamic Law. The partner's problem is that there are still many orphans and poor children who do not comprehensively understand their rights in getting a share of the inheritance. Therefore, the purpose of this activity is to provide understanding to them so that later they get their rights in accordance with the applicable rules according to the compilation of Islamic law. The implementation of this activity used lecture and discussion methods. There were 35 participants who participated in this activity. This activity was welcomed enthusiastically by the partners. The indicators of the success of this service activity are evidenced by several children who feel satisfied and happy with this activity. Furthermore, it is recommended to carry out similar activities on an ongoing basis to improve and hone their ability to understand Islamic inheritance law in order to realize a harmonious and blessed life in the world and the hereafter.

Abstract

The intent of this article is to explain how to conduct a mortgage charging auction. Normative juridical research—research conducted by looking at the subject of books or secondary information—is the method used. This method makes it possible to regard mortgage rights as a type of collateral. However, it is not clear whether the collateral stems from an agreement. Basically, mortgage laws state that mortgage grants must meet the conditions of a legal agreement. In contract law, sanctions against actual guarantees can be exercised in three ways: public auction via public execution, public auction via judicial apartments, and private sale.

Abstract

Penelitian ini merupakan studi literatur yang bertujuan untuk menganalisis peran konkret pengawas proyek dalam pelaksanaan perjanjian pemborongan bangunan serta mengidentifikasi tantangan dan hambatan yang dihadapi oleh pengawas proyek dalam menjalankan tugasnya guna memastikan kesuksesan pelaksanaan proyek. Metode penelitian yang digunakan adalah studi literatur dengan mengumpulkan dan menganalisis sumber-sumber yang relevan, termasuk peraturan hukum, buku, jurnal, dan publikasi terkait. Hasil penelitian menunjukkan bahwa peran pengawas proyek memiliki peran sentral dalam memastikan pelaksanaan proyek pemborongan bangunan berjalan sesuai rencana dan spesifikasi teknis. Pengawas proyek memiliki tugas memantau, mengendalikan mutu, mengawasi keselamatan kerja, menyelesaikan permasalahan, dan melakukan dokumentasi serta pelaporan secara akurat. Namun, penelitian juga mengungkapkan beberapa tantangan dan hambatan yang dihadapi oleh pengawas proyek, seperti keterbatasan sumber daya, ketidakpatuhan kontraktor, perubahan perencanaan, koordinasi yang kompleks, dan ketidakpastian lingkungan dan cuaca. Ketentuan hukum yang berlaku, seperti Undang-Undang No. 2 Tahun 2017 tentang Jasa Konstruksi, menjadi panduan dalam mengatasi tantangan ini. Penelitian ini menyimpulkan bahwa peran pengawas proyek sangat penting untuk mencapai kesuksesan pelaksanaan proyek pemborongan bangunan. Dalam menghadapi tantangan dan hambatan, pengawas proyek harus mengacu pada ketentuan hukum yang berlaku dan menggunakan pendekatan yang efektif dalam pemantauan, pengendalian mutu, serta penanganan permasalahan. Diharapkan hasil penelitian ini dapat memberikan wawasan bagi para praktisi dan pihak terkait dalam meningkatkan efisiensi dan kualitas pelaksanaan proyek konstruksi.

Abstract

The government has carried out reforms in many ways through the land reform program which regulates land ownership and the legal relationship between the landowner and the object of the land, in order to create a society that has a prosperous and productive life in advancing a national community economy and food security. One of these efforts is the prohibition of land ownership, especially agricultural land which has been regulated in a composition of law article 10 paragraph 1 of the UUPA. With this article, the government expects the owner of the land or land to work on it himself. So that productivity can run optimally, with people who have been educated regularly and have high discipline. However, in fact, in the field in some villages, there are still many people who control absentee land and the community interprets all forms of rules regarding absentee land ownership is very ineffective. Therefore, the author conducted this study with the aim of finding out what causes the occurrence of absentee land ownership and why absentee land ownership is prohibited in Indonesia. Where this research uses a literature method where the reference sources come from books, journals, previous articles. So as to produce a study in which the cause of absentee land ownership in Indonesia are based on several factors, namely public awereness factor that are still too low, community knowladge that is still weak, culture, legal factors, facilities, law enforcement and economy. In addition, the ban on absentee land ownership is carried out to prevent land ownership without a cultivation process so that the agricultural land becomes scrub and abandoned.

Abstract

Land reform in Indonesia has its ups and downs and in its implementation there are also challenges even though the LoGA has been passed so that the land reform program cannot run smoothly and without obstacles so that this land reform can no longer be carried out in an open and joint way but through a process that is done little by little . In the process of making this journal, the author uses the library research method, which concludes from this journal that the challenges faced in the implementation of land reform include (1) economic and political conditions that are not well established and qualified, (2) strong awareness has not grown between groups. elites, (3) narrow and unequal land ownership, (4) lots of land conflicts and (5) destruction of natural resources. In addition, the role of the government in implementing this land reform is (1) carrying out economic development aimed at justice and people's prosperity, (2) resolving all forms of land conflicts so that ownership rights do not overlap, (3) play an active role in the process of improving natural resources that have been damaged, (4) implementing agrarian law reform, (5) providing free land certificates to the community to realize the agrarian reform program, and apart from that the community must also play an active role in the process of implementing land reform by reporting land to the land office so that rights are protected. ownership of the land.

Abstract

Penelitian ini bertujuan untuk menganalisis kepemilikan tanah absentee dan pola penggarapannya di Kabupaten Indragiri Hilir. Berdasarkan PP Nomor 224 Tahun 1961 tentang Pelaksanaan Pembagian Tanah dan Pemberian Ganti Kerugian, Pasal 13 ayat (1), serta PP Nomor 41 Tahun 1964, terdapat larangan terhadap kepemilikan tanah secara absentee. Tanah absentee merujuk pada tanah yang lokasinya jauh dari tempat tinggal pemiliknya. Umumnya, individu yang tinggal di kawasan perkotaan memiliki tanah di wilayah pedesaan yang kemudian dikelola oleh petani penyewa melalui sistem bagi hasil. Namun, praktik kepemilikan tanah secara absentee masih banyak ditemukan, sehingga implementasi larangan ini belum dapat dilaksanakan secara efektif. Kondisi ini mencerminkan bahwa peraturan mengenai tanah absentee belum sepenuhnya diterapkan sesuai dengan ketentuan hukum yang berlaku. Penelitian ini menggunakan pendekatan studi kepustakaan dengan mengacu pada berbagai sumber, seperti buku, jurnal, dan dokumen lainnya yang relevan. Fokus penelitian ini adalah untuk mengidentifikasi permasalahan terkait kepemilikan tanah absentee serta pola penggarapannya di Kabupaten Indragiri Hilir. Hasil kajian ini diharapkan dapat memberikan pemahaman lebih mendalam mengenai dinamika pengelolaan tanah absentee dan efektivitas regulasi yang ada dalam mengatasi permasalahan tersebut.

Abstract

Credit in the building contracting industry plays an important role in achieving project success and protecting the interests of banks and related parties. Careful credit evaluation, use of appropriate collateral, effective credit management, and the bank's active role in supervising project progress are key factors in building contractor loans. In addition, effective dispute resolution, attention to risk factors, and integration of environmental aspects are also important in maintaining the smooth running of building contracts. By complying with applicable legal regulations, banks can carry out credit activities in a trusted manner, protect the interests of related parties, and ensure the economic and environmental sustainability of projects.

Abstract

Penelitian ini mengkaji kerangka hukum dan mekanisme akad Murabahah dalam perbankan syariah, dengan menekankan kepatuhan terhadap prinsip-prinsip syariah. Penelitian ini menyoroti pentingnya transparansi harga, kepatuhan pada hukum Islam, serta potensi tantangan akibat ketidaksesuaian regulasi. Dengan pendekatan yuridis normatif, studi ini meninjau regulasi utama seperti Fatwa DSN-MUI Nomor 04/DSN-MUI/IV/2000 dan PBI Nomor 07/46/PBI/2005, serta analisis konseptual dan perbandingan praktik Murabahah di bank syariah Indonesia. Hasil penelitian memberikan wawasan tentang peningkatan efektivitas akad Murabahah, memastikan kepatuhan syariah, dan mendorong pembangunan ekonomi yang berkelanjutan sesuai dengan kerangka syariah.

Abstract

This research aims to analyze and criticize the substance of the annulment of marriage agreements (Case Study of the Decision in Case Number 598 PK/Pdt/2016) and the judge's considerations in handing down the decision in case Number 598 PK/Pdt/2016. This research uses normative legal research methods or library legal research. The nature of the research is descriptive analytical. This type of research uses secondary data obtained from primary legal materials, secondary legal materials and tertiary legal materials. Data analysis uses qualitative analysis. The results of the research show that the judicial review of the annulment of the marriage agreement (Case Study of Case Decision Number 598 PK/Pdt/2016) which in its decision annulled the Cassation Decision Number 503 K/Pdt/2015 and declared the Marriage Agreement Deed Number 200 dated July 8 1994 between the Petitioners null and void. Judicial Review with the Respondent Judicial Review is a correct and appropriate decision and should be carried out, referring to the formality of making a deed which is not in accordance with the provisions of Article 29 of the Marriage Law. The legal consideration of the Panel of Judges in handing down its decision was because the previous judge's interpretation of the provisions of Article 29 paragraph (1) of the Marriage Law, that a marriage agreement executed before a Notary had met the formal requirements was too broad, thus changing the meaning of the article. The judge seemed to equate an "agreement" in general with a "marriage agreement", even though the provisions of this article are imperative (must be implemented).

Abstract

Forest and land fires (Karhutla) are recurring ecological disasters in vulnerable regions such as Indragiri Hilir Regency. One of the main triggers is the lack of public awareness regarding land ownership legality and weak legal literacy in land administration. This study aims to enhance community legal awareness through legal education activities on the importance of land registration administration and law-based land management as a preventive measure against Karhutla. The method employed is a qualitative participatory approach through field observation, discussion, and evaluation during a community service program in Teluk Dalam Village, Kuala Indragiri District. Participants included village officials, community leaders, and land users. The findings show increased understanding among participants regarding land registration procedures, legal sanctions for land burning, and the importance of legality in securing land rights. The interactive discussions also revealed a shift in public attitude towards traditional land clearing by burning. This study concludes that community-based legal education is an effective approach to developing sustainable legal awareness in fire-prone areas.
