Abstract

Village Government is a miniature of the state and the front door after the family to build Human Resources (HR). One of the aims of the state is to provide service functions to the community.  Tompokersan village, Lumajang has implemented technology in its certificate-making services. The existing services are less effective because letter submitting still uses Google Forms. The service has several weaknesses, namely does not have a queue mechanism for submitting certificates, cannot prevent unauthorized users, submission data is not integrated, does not have AI-based customer service such as chatbots, and RT/RW heads carry out manual approval. This is considered less effective and has not been fully digitized. This makes the governance of Tompokersan Village less good. Tompokersan village requires a web and mobile-based information system that can solve these problems. Several certificates are usually made by the village, including a business certificate, a domicile certificate, a certificate of not being married, a certificate of being unable to pay, a death certificate, a birth certificate, and other certificates. This service aims to realize innovative governance in the Tompokersan village.  The results of the dissemination of Digital Services can solve partner problems, namely reducing queues at the sub-district office, validation by RT and RW heads can be done digitally, sub-district officers can easily record and report, and the public can participate in monitoring the status of letters that have been submitted via the mobile application.

Abstract

This qualitative study explores the role of community service in enhancing access to justice through free legal aid programs in Region E, an area marked by socioeconomic disparities and limited legal resources. Using semi-structured interviews with 15 legal practitioners and 20 beneficiaries, along with documentary analysis of program reports from 2020 to 2025, the research investigates how these initiatives empower marginalized populations and address systemic barriers. The findings reveal three key themes: (1) empowerment through increased legal literacy, enabling beneficiaries to better understand and assert their rights; (2) building trust between communities and formal legal institutions by providing accessible, culturally sensitive services; and (3) persistent challenges including funding shortages, staffing limitations, and infrastructural constraints such as poor internet connectivity. The study highlights that free legal services not only resolve individual legal issues but also contribute to broader social awareness and collective empowerment. However, the sustainability and scalability of these programs depend on stronger institutional support and innovative approaches, such as digital outreach and partnerships with local authorities. This research contributes to the discourse on grassroots legal empowerment by providing empirical insights from a rural context often underrepresented in justice studies. The findings offer practical recommendations for policymakers, NGOs, and legal professionals aiming to improve justice accessibility through community-driven efforts. Ultimately, the study underscores the critical importance of community service initiatives in bridging justice gaps and fostering inclusive legal systems.

Abstract

Penyuluhan hukum mengenai judi online di Kota Karawang bertujuan untuk meningkatkan pemahaman generasi muda terhadap aspek hukum dan dampak psikologis dari aktivitas perjudian daring. Judi online merupakan bentuk pelanggaran hukum yang diatur dalam Pasal 303 dan 303 bis KUHP, yang menetapkan sanksi pidana bagi pelaku maupun pihak yang memfasilitasinya. Selain konsekuensi hukum, judi online juga berdampak negatif terhadap kesehatan mental, termasuk kecanduan, stres, dan depresi akibat tekanan finansial. Pelatihan kesadaran hukum ini dilakukan dengan metode interaktif, seminar, dan diskusi kelompok, yang berhasil meningkatkan pemahaman peserta terhadap regulasi perjudian serta strategi pencegahannya. Hasil evaluasi menunjukkan peningkatan signifikan dalam kesadaran hukum peserta, dari 30% sebelum pelatihan menjadi 85% setelahnya. Selain itu, pelatihan ini juga menyoroti pentingnya literasi digital sebagai upaya pencegahan serta peran masyarakat dalam mengurangi angka keterlibatan generasi muda dalam judi online. Meskipun program ini memberikan hasil positif, tantangan seperti kurangnya pengawasan orang tua dan lemahnya regulasi terhadap situs judi daring masih perlu diatasi melalui kolaborasi antara pemerintah, institusi pendidikan, dan komunitas.

Abstract

This study investigates the role of community legal assistance, focusing on free legal clinics and legal socialization initiatives, in supporting the recovery and restoration of rights for women victims of violence in Indonesia’s coastal regions. Employing a qualitative research methodology, the research analyzes field data, organizational reports, statutory frameworks, and direct interviews with stakeholders involved in legal advocacy. Results reveal that socio-legal interventions—especially targeted legal empowerment actions integrating psychosocial support with accessible legal services—have significantly improved women’s legal knowledge and helped many to secure protection orders, initiate police reports, and access community-based support networks. Nonetheless, cultural barriers, limited funding, and geographical constraints remain major challenges. The findings support policy recommendations for sustainable legal outreach in marginalized communities and underscore the importance of multi-sectoral partnerships to ensure effective rights restoration in coastal zones of Indonesia.

Abstract

The Qanun Aceh serves as a legal instrument mandating the conversion of all conventional financial institutions into Islamic-based financial entities, as part of the comprehensive implementation of sharia law in the financial sector. This study employs a qualitative-descriptive method, drawing on a juridical and Islamic economic approach, supported by field observations and interviews with banking customers and practitioners. The findings indicate that the implementation of the Qanun has been structurally well-executed, as reflected in the transformation of banking contracts (akad) and services in accordance with sharia principles. The effectiveness of the implementation is evident in the growing public trust and increased utilisation of Islamic financial products. However, efficiency remains a challenge, particularly in terms of financial literacy, human resource capacity, and comprehension of Sharia-compliant contracts. The socio-economic implications of the Qanun's implementation include the reinforcement of Islamic economic justice values, increased Islamic financial inclusion, and the potential empowerment of the Muslim community's economy. This research recommends strengthening Islamic financial literacy and enhancing collaboration among government authorities, banking institutions, and religious scholars to ensure the sustainable and holistic enforcement of the Qanun.

Abstract

This research delves into the discourse related to village restorative justice and customary law in the Province of Jambi in the context of the diversity of authority shifts between modern legal approaches and existing legal traditions. The research background refers to conceptual differences and perspectives on dispute resolution between the state and customary law. To examine the relationship between the concept of restorative justice and customary justice, this study employs a qualitative approach by conducting in-depth interviews with representatives from the prosecution, community leaders, as well as traditional leaders in several restorative villages in the Province of Jambi. The literature review involves a profound understanding of restorative justice, customary justice, and the interaction between state law and customary law. The research findings highlight the conflicts and convergences between the restorative justice approach and the existence of customary justice. Conflicts arise in the interpretation of rights, obligations, and authority held by each system. However, this research also reveals the potential synergy between these two approaches in resolving disputes with a more holistic and contextual approach. The findings of this research indicate the importance of dialogue and collaboration between the state and customary law in developing initiatives such as village restorative justice. In the context of the Province of Jambi, wise integration of state and customary law can bring benefits for the preservation of cultural values as well as the fulfillment of individual and community rights.

Abstract

This study aims to deeply analyze the status, function, and legal implications of the President of the Republic of Indonesia's right to abolish, particularly in the context of criminal and constitutional law. Abolition, as an instrument of pardon, amnesty, and abolition (GNA), enshrined in Article 14 of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), is the prerogative of the head of state to abolish a criminal offense or halt the prosecution of a person suspected of or having committed a crime, before the trial process is complete. The strength of this right lies in its character as an instrument of judicial discretion that transcends judicial decisions, and its implementation must take into account the considerations of the House of Representatives (DPR). The study focuses on the case study of Thomas Trikasih Lembong (Tom Lembong), who, in the public narrative, has been linked to potential involvement in controversial cases. This case was chosen as a model to test the limits of the use of abolition in Indonesia. Normatively, the use of abolition in Indonesia is rare compared to pardons and amnesties, making it a gray area in constitutional practice. This study uses a juridical-normative and philosophical approach, enriched with a qualitative analysis of the relevant legal framework and constitutional law doctrine. From the perspective of Maqashid Syari'ah (Objectives of Islamic Law), abolition is analyzed based on its purpose in preserving the five basic pillars (al-Kulliyat al-Khams): preserving religion (hifz ad-din), preserving the soul (hifz an-nafs), preserving reason (hifz al-'aql), preserving descendants (hifz an-nasl), and preserving property (hifz al-mal). The appropriate use of abolition should contribute to the achievement of substantial justice and the protection of greater public interests, going beyond mere formal legal certainty. Meanwhile, from the perspective of Legal Benefit (Rechtssicherheit and Zweckmässigkeit), this study examines the extent to which the application of abolition, particularly in sensitive cases such as those involving public figures or economic interests, can provide sociological benefits, namely restoring order, preventing greater harm, or supporting national stability, without sacrificing the public's sense of justice. The study's findings indicate that although abolition is a legitimate prerogative, its use must be based on the ultra petita principles of justice and the pressing public interest, in line with the values of Maqasid Sharia and the principle of expediency. A balance between legal certainty, justice, and expediency is key to legitimizing the exercise of the president's right to abolition.
