Abstract

This research discusses the preferential rights of creditors in the implementation of fiduciary security execution auctions in Indonesia, as well as the impact of the Constitutional Court decision No. 18/PUU-XVII/2019 on these rights. Prior to the decision, creditors could execute fiduciary security objects without going to court. However, the Constitutional Court's decision changed the mechanism by requiring the debtor's consent or a court decision. This research uses normative legal research methods with a case and statutory approach. The results show that the Constitutional Court's decision aims to protect debtors' rights from creditors' arbitrary actions, although it also creates legal uncertainty for creditors.

Abstract

The theory of legal protection aims to safeguard vulnerable communities both economically and juridically. In the pursuit of protecting human rights, the state seeks to maintain a harmonious relationship between government institutions and citizens, grounded in a balanced and functional distribution of state powers, where disputes are resolved through deliberation. This study focuses on the commitments and agreements established between banks and their credit clients. A descriptive qualitative approach was employed to explore this dynamic. The findings reveal key distinctions in the classification of collateral objects, categorized as either movable or immovable, highlighting five primary differentiations. First, these distinctions pertain to the form of collateral, distinguishing between fiduciary, pledge, and mortgage rights based on the nature of the collateral whether movable or immovable. Second, leveraging of collateral is contingent on the object type, influencing the method of delivery. Third, movable objects are delivered through physical transfer, while immovable objects require formal procedures, such as title transfer. Fourth, the expiration terms for collateral differ, with immovable objects typically having no expiration, while movable objects have an expiration clause. Finally, the concept of possession (bezit) is crucial, where the possessor of movable property is regarded as the owner, in contrast to immovable objects, where possession does not confer ownership.

Abstract

This study aims to determine the role of legal protection regulations, as this protection is a right granted to investors given the numerous risks involved in stock trading, which can affect stock offerings. When investors sell a large number of company shares, the stock value can decline. Every investment carries a different level of risk, and stocks, as a high-risk, high-return investment instrument in the capital market, are no exception. Rational investors aim for investments that offer maximum returns with a certain risk or specific returns with minimal risk, based on individual preferences. This study uses a normative juridical research method, based on legal norms with a literature study approach. This research is descriptive, and qualitative data analysis methods are applied. The results show that companies, as issuers, can be held liable through civil, criminal, and administrative liability. In cases where false information is provided, liability for manipulation may arise under Article 78 paragraph 1 or for omitting material facts necessary to prevent misleading investors.

Abstract

The development of digital commerce has changed the pattern of modern economic interaction by presenting fast, efficient, and cross-border transactions, but behind these conveniences consumers face new vulnerabilities. Information asymmetry, misuse of personal data, and weak protection standards in electronic transactions pose significant potential losses. Law Number 8 of 1999 concerning Consumer Protection (UUPK) provides normative guarantees for consumer rights, while Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) presents legal legitimacy for electronic contracts as well as protection from fraud and misuse of data. However, the two regulations are still partially operational and have not been fully harmonious in responding to the complexity of digital trade. This study uses normative juridical methods with legislative and conceptual approaches to analyze the integration of the UUPK and the ITE Law in the context of economic law. The results of the study show that regulatory disharmonization creates legal uncertainty for consumers and business actors, so harmonization is needed that is able to ensure certainty, justice, and efficiency. Regulatory integration is expected to strengthen the digital consumer protection system, encourage public trust, and create a healthy, fair, and globally competitive digital trade ecosystem. Thus, digital consumer protection is not only a juridical dimension, but also an important strategy in national economic development

Abstract

Pancasila is a way of life in society and nation and the implementation of the values of Pancasila is not yet optimal. It is hoped that through this writing, we will be able to understand the meaning of Pancasila values and be able to apply them to prisoners at Polrestabes better and to love their nation and state with Pancasila characteristics more. In a general context, the impact of violations of Pancasila Values can cause social, political and economic damage which ultimately affects the welfare of society. Therefore, it is important for every individual and society to maintain and commemorate Pancasila Values in everyday life. This writing research has had a positive impact on the prisoners themselves. The results of this writing research are the role of the Medan Police in implementing the application of Pancasila which is interconnected with the rule of law and restorative justice. The democratic values in Pancasila must also be implemented in prison institutions. Prisoners' participation in making decisions that affect their lives needs to be accommodated. Restorative Justice finds its footing in the basic philosophy of the fourth principle of Pancasila.

Abstract

Article 02 of Law No. 5 of 1960 concerning the Basic Agrarian Law states that ownership rights can be transferred. In hte process of transferring ownership, legal disputes are often unavoidable. One such legal issue related to the transfer of ownership is highlighted in the Supreme Court Decision No. 1206 K/Pdt/2020, in conjunction with the Makasar High Court Decision No. : 504/PDT/2018/PT MKS, and the Makasar District Court Decision No : 4/Pdt.G/2018/PN.Mks. The decisions indicate that the Defendants committed an unlawful act that harmed the Plaintiff, who was the heir. These rulings show discrepancies and conflicts in the court's verdicts. This thesis aims to explore the following issues: the legality of gifts between spouses under the Indonesian Civil Code and hte Compilation of Islamic Law, hte legal resolution of inheritance land transfers involving unlawful acts, and the judicial considerations in ruling on disputes involving unlawful acts in inheritance land transfers that harm the heirs (Case Study of Supreme Court Decision No. : 1206 K/Pdt/2020 dated June 3, 2020). The research method used in this thesis is normative juridical research, which is descriptive-analytic. It employs a normative juridical approach and secondary data sources, including primary, secondary, and tertiary legal materials. The data collection techniques include literature review and document analysis. The research uses qualitative analysis to examine the legal materials, followed by deductive reasoning to draw conclusions and provide answers to the research problems. The findings of this study reveal that hte legitimacy of gifting land between spouses during the marriage is prohibited under Article 1678 of the Civil Code, whereas, under Article 78 of the Compilation of Islamic Law, such gifts are not prohibited. Dispute resolution in land ownership transfers involving unlawful acts can be carried out through mediation or legal proceedings in court. The legal basis for the judge's consideration is Article 283 Rbg/163 HIR, where the Plaintiff successfully proved the claims in the lawsuit through a deed of gift and witness testimony. As a result, the court ruled that the disputed land was an inheritance from the Plaintiff's mother, and it was proven that the Defendants had committed unlawful acts. It is recommended that the parties clarify the legal status of the inheritance land by filing a petition with the Religious Court to prevent future inheritance disputes. Additionally, regional officials, such as the sub-district head, village head, and PPAT (land deed officials), should thoroughly investigate hte objects and family history of the gift applicant to ensure legal certainty in future gift transactions.

Abstract

Kajian ini bertujuan guna mengetahui fungsi penyedia jasa penilai untuk perbankan pada pemberian kredit serta tanggung jawab hukumnya jika melanggar hukum atau kode etik penilai serta wanprestasi sehingga menyebabkan kredit macet di bank. Penulis memakai dua jenis metode riset yang berbeda, termasuk mengumpulkan data studi sipil dari buku, artikel, surat kabar, majalah, dan peraturan perundang-undangan yang relevan dengan pokok bahasannya. Wawancara langsung dengan informan berpengetahuan diperlukan untuk melakukan penelitian lapangan. Hasil temuan analisis penelitian menunjukkan bahwa satu dari banyak tujuan pada sebuah cara melaksanakan evaluasi terhadap terjadinya kredit oleh bank adalah dengan menggunakan peran jasa penilai bagi perbankan perihal memberikan kredit selaku dasar. Oleh karena itu, Keputusan Menteri Keuangan No. 57/KMK.017/1996 menyatakan bahwa kegiatan utama badan usaha yang memberikan jasa penilai. Evaluasi dilakukan dengan menggunakan kaidah penilaian Standar Penilaian Indonesia (SPI). Debitu sebagai pihak yang dirugikan, debitur dapat mengajukan gugatan untuk menuntut ganti rugi dari penilai publik. Namun, dalam praktik peradilan, penilai publik berpotensi menghadapi hukuman pidana atas setiap tindakan ilegal yang mungkin telah dilakukan. Hukum Perbankan (UU No. 10 Tahun 1998 tentang Perubahan atas No. 7 Tahun 1992 hal Perbankan), Pasal 1 angka 22 huruf c, mengatakan jika pihak yang memberi pelayanan terhadap bank diantaranya evaluator. Hal ini mengacu pada penyiapan Perusahaan Jasa Penilai dalam Kebijakan Perkreditan di Bank. Sesuai Keputusan Bank Indonesia, setiap bank wajib mengevaluasi nasabahnya yang tergabung dalam dana cadangan sebagai bagian dari perhitungan rasio kecukupan modalnya. Penilai yang tidak memihak harus membuat penilaian agunan untuk pinjaman senilai lebih dari Rp 2 miliar.

Abstract

Abstract: The plaintiffs' lawsuit against the implementation of the mortgage execution auction occurred because the auction was sold at an unreasonable price. The sale of mortgage objects below market price is carried out if the object is not sold in the first sale, so the selling price must be lowered until the object is sold and the final sales value limit must not be below the liquidity value, as regulated in Article 49 of PMK Number 27 / PMK.06 / 2016 concerning Auction Implementation Guidelines. This study discusses three problems, namely: 1) Procedures for implementing mortgage execution auctions in default cases at the State Assets and Auction Service Office (KPKNL); 2) Legal protection for creditors and auction winners against debtor lawsuits regarding the implementation of mortgage execution auctions in default cases; and 3) Analysis of the judge's considerations on the decision of the Supreme Court of the Republic of Indonesia Number 1143 PK / PDT / 2022 concerning lawsuits for implementing mortgage execution auctions through public auctions.Keyword: Lawsuit, Execution of Mortgage Right Auction, State Property and Auction Service Office Abstrak: Gugatan para penggugat atas dilaksanakannya lelang eksekusi hak tanggungan, terjadi karena pelelangan tersebut dijual dengan harga yang tidak wajar. Penjualan objek hak tanggungan di bawah harga pasar dilakukan apabila dalam penjualan pertama objek tersebut tidak laku terjual, sehingga harga penjualannya harus diturunkan sampai objek tersebut terjual dan batas akhir nilai penjualan tidak boleh di bawah nilai likuiditas, sebagaimana diatur dalam Pasal 49 PMK Nomor 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang. Penelitian ini membahas tiga permasalahan, yaitu: 1) Prosedur pelaksanaan lelang eksekusi hak tanggungan dalam perkara wanprestasi pada Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL); 2) Perlindungan hukum bagi kreditur dan pemenang lelang terhadap gugatan debitur atas dilaksanakannya lelang eksekusi hak tanggungan dalam perkara wanprestasi; dan 3) Analisis pertimbangan hakim atas putusan Mahkamah Agung RI Nomor 1143 PK/PDT/2022 tentang gugatan pelaksanaan lelang eksekusi hak tanggungan melalui pelelangan umum.Kata kunci: Gugatan, Pelaksanaan Lelang Eksekusi Hak Tanggungan, Kantor Pelayanan Kekayaan Negara dan Lelang

Abstract

Abstract: Using financing facilities with the principles of Islamic law is a consumer's right from a financing institution. Therefore, the emergence of laws and regulations that regulate financing facilities can help the public in determining the financing facilities they want. The research method used in this writing is normative juridical research. The forms of research approach used in this research are the statutory approach and the case approach. Data sources in this research include primary, secondary legal materials and non-legal materials using library data collection techniques. To analyze all the legal materials that have been collected, this research uses qualitative data analysis. The absolute competence of the Religious Courts is only to adjudicate sharia economic cases based on "sharia economics" which are fully regulated in the explanation of Article 49 letter (i) of the Religious Courts Law and the MUI DSN Fatwa on sharia financial institutions and the MUI DSN Fatwa on murabahah financing. Likewise, financial institutions which in the research are financing companies with conventional cooperative legal entities, are expected not to commit unlawful acts such as disbursing murabahah financing which is not within their rights as regulated in statutory regulations. Keyword: Disputes, Conventional Cooperatives, Financing, Murabahah. Abstrak: Menggunakan fasilitas pembiayaan dengan prinsip-prinsip syariat Islam merupakan hak seorang konsumen dari lembaga pembiayaan. Oleh karena itu, munculnya undang-undang maupun peraturan perundang-undangan yang mengatur fasilitas pembiayaan dapat membantu masyarakat dalam menentukan fasilitas pembiayaan yang diinginkannya. Metode Penelitian yang dipakai dalam penulisan ini yaitu jenis penelitian yuridis normatif. Bentuk pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Sumber data dalam penelitian ini meliputi bahan hukum primer, sekunder dan bahan non-hukum dengan teknik pengumpulan data kepustakaan. Untuk menganalisis seluruh bahan hukum yang telah terkumpul, dalam penelitian ini menggunakan analisis data kualitatif. Kompetensi absolut Pengadilan Agama hanya mengadili perkara ekonomi syariah yang berdasarkan “ekonomi syariah” yang diatur sepenuhnya dalam penjelasan Pasal 49 huruf (i) UU  Peradilan Agama dan Fatwa DSN MUI tentang lembaga keuangan syariah maupun Fatwa DSN MUI tentang pembiayaan murabahah. Sama halnya dengan lembaga keuangan yang dalam penelitian adalah perusahaan pembiayaan berbadan hukum koperasi konvensional, diharapkan tidak melakukan perbuatan melanggar hukum seperti menyalurkan pembiayaan murabahah yang bukan menjadi haknya sebagaimana diatur di dalam peraturan perundang-undangan. Kata kunci: Sengketa, Koperasi Konvensional, Pembiayaan, Murabahah.
