Abstract

In Indonesia, the rules governing that can bring a legal case to the Constitutional Court often unclear and unevenly applied. This creates challenges for individuals and communities trying to protect their constitutional rights. In this article, we take a critical look at these obstacles by examining the Court’s past decisions. We show how the current legal framework overlooks issues of collective harm and structural inequalities, particularly affecting marginalized groups. To better understand these issues, we compare Indonesia’s approach to those of India, South Africa, and the United States, seeking out more inclusive models of judicial decision-making. Our findings show that Indonesia’s focus on specific interpretations of direct and personal harm limits the judiciary’s ability to meet its constitutional responsibilities. The paper draws on insights from other countries as well as Indonesia’s own legal traditions, such as adat (customary law) and musyawarah (deliberation), to propose a more inclusive and culturally sensitive approach to legal standing. We recommend several specific reforms, including rethinking existing laws, creating clearer judicial guidelines, and providing targeted judicial training for judges to improve access to constitutional justice for everyone.

Abstract

The rapid expansion of the digital economy has challenged traditional notions of consumer protection, which historically relied on reactive and positivist legal principles. Increasing data commodification, the pervasive role of algorithms, and structural power asymmetries expose the inadequacy of existing legal doctrines to safeguard fairness in digital transactions. This study seeks to address a critical research gap by reconceptualizing consumer protection law through the lens of algorithmic justice and participatory digital rights. Employing a normative legal methodology combined with comparative and critical approaches, the research analyzes doctrinal evolution across jurisdictions such as the European Union, Brazil, and Indonesia. The findings reveal three major shifts. First, consumer law must move beyond post-transaction liability toward proactive models of oversight, including algorithm audits and design-based compliance. Second, legal doctrines should redefine the consumer as a relational subject embedded in data-driven ecosystems, rather than a rational and autonomous actor. Third, consumer rights need to be embedded within constitutional and ethical frameworks to ensure long-term enforceability and democratic legitimacy. The study contributes theoretically by advancing an interdisciplinary paradigm of consumer law that integrates digital fairness, equity, and human dignity. Practically, it offers strategic directions for regulators and policymakers in designing responsive frameworks that anticipate risks, enhance accountability, and strengthen consumer agency in the digital era.

Abstract

Latar Belakang: Kualitas Layanan adalah cara melayani, membantu menyiapkan, mengurus, menyelesaikan keperluan, kebutuhan seseorang atau sekelompok orang. Kepuasan pasien diartikan sebagai interaksi antara harapan dan pengalaman sesudah memakai jasa atau pelayanan diberikan.. Tujuan penelitian untuk mengetahui Hubungan kualitas layanan terhadap kepuasan pasien di Unit Rawat Jalan Puskesmas Mehalaan Tahun 2022. Metode: Rancangan penelitian yang digunakan Cross Sectional Study, dengan total sampel sebanyak 166 responden. Teknik Sampling yang digunakan pada penelitian kuantitatif ini ialah Purposive Sampling. Penelitian ini juga menggunakan analisis jalur (Path Analysis). Hasil: Penelitian menunjukan bahwa Kualitas layanan berHubungan positif signifikan secara langsung terhadap kepuasan pasien di unit rawat jalan Puskesmas Mehalaan tahun 2022 (0,000>0,05), Kualitas layanan tidak berHubungan positif signifikan secara langsung terhadap minat kembali di unit rawat jalan Puskesmas Mehalaan tahun 2022 (0,853>0,05), Kepuasan pasien berHubungan positif signifikan secara langsung terhadap minat kembali di unit rawat jalan Puskesmas Mehalaan tahun 2022 (0,013<0,05). Kesimpulan: (1) Penegakkan diagnosis berHubungan terhadap Kepuasan pasien (2) Ketersediaan obat berHubungan terhadap Kepuasan pasien (3) Kebersihan ruangan berHubungan terhadap Kepuasan pasien (4) kesopanan dan keramahan berHubungan terhadap Kepuasan pasien (5) pelayanan cepat tanggap berHubungan terhadap Kepuasan Pasien.

Abstract

The regulation of national laws in Indonesia faces significant challenges due to overlapping rules and regulatory inflation, which hinder legal certainty and economic efficiency. To address this issue, the government has adopted two primary approaches to regulatory reform: the Omnibus Law and Legal Codification. This study aims to analyze and compare the effectiveness of both approaches in Indonesian regulatory reform. The research employs a normative legal method with comparative analysis, utilizing data gathered from legal statutes, academic journals, and official documents. The findings indicate that the Omnibus Law is effective in addressing the need for rapid reform in dynamic sectors such as investment and labor, yet it poses risks of regulatory inconsistency, potentially leading to legal uncertainty. On the other hand, legal coding offers greater stability and consistency, though its implementation is slower and less adaptable to sectors requiring swift changes. This study's implications suggest that a selective approach is necessary, strategically applying the Omnibus Law to certain sectors while maintaining Legal Codification as the foundation for a more harmonious and sustainable legal system. This research provides recommendations for policymakers to enhance regulatory harmonization and consider the technical capacity of legal authorities in implementing reforms

Abstract

Ketidakseimbangan antara norma primer dan pengaturan teknis dalam peraturan perundang-undangan sering kali menyebabkan ketidakpastian hukum dan kesulitan dalam penerapan di lapangan. Norma primer yang terlalu abstrak atau pengaturan teknis yang terlalu rinci menghambat efektivitas hukum, menimbulkan interpretasi yang ambigu, serta mengurangi fleksibilitas dalam penerapannya. Penelitian ini bertujuan untuk mengembangkan pendekatan sistematis yang dapat digunakan dalam proses legislasi untuk menyeimbangkan kedua elemen tersebut. Dengan menggunakan metode yuridis normatif, penelitian ini menganalisis sejumlah peraturan yang ada dan mengidentifikasi ketidakseimbangan antara norma primer dan pengaturan teknis dalam legislasi. Hasil penelitian menunjukkan bahwa keseimbangan yang tepat antara norma primer dan pengaturan teknis mampu meningkatkan kepastian hukum dan memfasilitasi penegakan hukum yang lebih efektif. Pendekatan sistematis yang diusulkan dalam penelitian ini menawarkan kerangka kerja yang lebih terstruktur untuk menyaring materi muatan perundang-undangan, sehingga menghasilkan regulasi yang lebih adaptif, responsif, dan stabil di tengah dinamika sosial. Implikasi dari penelitian ini adalah perlunya reformasi dalam proses legislasi untuk meningkatkan kualitas dan konsistensi peraturan di berbagai yurisdiksi

Abstract

Kedudukan peraturan lembaga dalam hierarki perundang-undangan di Indonesia, sebagaimana diatur dalam Pasal 8 Undang-Undang No. 12 Tahun 2011, masih belum memiliki kejelasan yang cukup, yang menyebabkan ketidakpastian hukum dalam praktik. Tujuan penelitian ini adalah untuk menganalisis kedudukan yuridis peraturan lembaga dalam hierarki perundang-undangan serta dampaknya terhadap pelaksanaan hukum di Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta pengumpulan data dilakukan melalui studi kepustakaan yang mencakup peraturan perundang-undangan, putusan pengadilan, dan literatur terkait. Hasil penelitian menunjukkan bahwa peraturan lembaga sering kali berpotensi bertentangan dengan peraturan yang lebih tinggi, seperti undang-undang atau peraturan pemerintah, karena ketiadaan harmonisasi yang jelas. Hal ini menimbulkan konflik normatif dan menurunkan kepastian hukum. Penelitian ini merekomendasikan perlunya revisi Undang-Undang No. 12 Tahun 2011 untuk memasukkan pedoman yang lebih rinci mengenai kedudukan peraturan lembaga serta mekanisme harmonisasi yang lebih jelas. Implikasi dari penelitian ini adalah pentingnya reformasi regulasi untuk meningkatkan kepastian dan konsistensi dalam pelaksanaan hukum di berbagai sektor di Indonesia.

Abstract

Food safety is a critical component of public health governance, particularly in large-scale food programs where inadequate hygiene and sanitation can increase the risk of foodborne disease. In Indonesia, the Free Nutritious Meal Program relies on catering services whose compliance with food hygiene standards is essential to protect beneficiaries, especially school-aged children. This study examines the legal and institutional supervision of catering hygiene and sanitation within the program from a constitutional and health law perspective. Using normative juridical research supported by a socio-legal approach, the study operationally analyzes statutory regulations, policy frameworks, and institutional practices through library research and document analysis of national laws, technical regulations, and international food safety standards. Qualitative interpretative analysis was employed to evaluate regulatory effectiveness, supervisory mechanisms, and governance challenges. The findings reveal that Indonesia possesses a relatively comprehensive food safety regulatory framework; however, the effectiveness of supervision remains constrained by limited institutional capacity, fragmented inter-agency coordination, and inconsistent compliance among food service providers. This study identifies a persistent gap between regulatory norms and practical enforcement, emphasizing the need for integrated regulatory enforcement, risk-based supervision, and stronger institutional collaboration. The research contributes to health law scholarship by strengthening the conceptual understanding of food safety governance in public food programs. Limitations include reliance on normative and policy analyses without direct field observation, suggesting the need for future empirical studies of implementation practices at local operational levels
