Abstract

The rapid evolution of Islamic financial products has raised critical questions about the legal validity and practical enforceability of Sharia credit cards within Indonesia’s dual legal system. This study seeks to rethink the legal validity of Sharia credit cards by moving beyond the fiqh-based legitimacy of Fatwa No. 54/DSN-MUI/X/2006 to examine their implementation under Indonesia’s positive law, regulatory oversight, and the objectives of maqāṣid al-sharī‘ah. Employing a qualitative legal content analysis, the research identifies six potentially relevant contracts kafālah, wakālah, ḥawālah, murābaḥah, qardh, and ijārah and critically assesses why the DSN-MUI ultimately operationalized only three: qardh, kafālah, and ijārah. The study argues that this tri-contract structure provides normative coherence but remains legally contingent on its harmonization with the Otoritas Jasa Keuangan (OJK) and Bank Indonesia (BI) regulations governing multi-contract products. Findings reveal that while the fatwa aligns with maqāṣid al-sharī‘ah protecting wealth (ḥifẓ al-māl) and promoting justice (‘adl) by eliminating riba its enforceability under civil contract law, particularly regarding ta‘wīḍ (compensation) and gharāmah (late penalty), remains ambiguous. Comparative insights from Malaysia and the Middle East underscore the need for a regulatory framework that integrates fatwa-based legality within codified financial law. Consequently, this “rethinking” offers a new analytical framework normative, structural, and positive legal validity to bridge the gap between Sharī‘ah doctrine and enforceable Islamic financial governance in Indonesia.

Abstract

Penerapan pemberdayaan ekonomi umat dengan hadirnya eco-pesantren sebagai ketahanan ekonomi mengakibatkan krisis lingkungan di perekonomian Indonesia, hal ini dapat diatasi berupa pengelolaan lingkungan melalui lembaga pendidikan sebagai fondasi untuk mengembangkan perekonomian yang baik. Tujuan penelitian ini untuk mewujudkan lingkungan pesantren yang sehat dan alami melalui pengelolaan lingkunan hidup di Pondok Pesantren Salafi Abdussalam Kabupaten Kubu Raya. Metode penelitian yang digunakan adalah metode kualitatif dengan menganalisis pemberdayaan ekonomi melalui para santri untuk menciptakan santriprenuer. Hasil penelitian yang diperoleh dengan adanya penerapan ecopesantren dalam pengelolaan lingkungan hidup alami dan sehat dapat membantu finansial maupun pembangunan pesantren. Dalam bentuk penerapan eco-pesantren dapat bekerja sama dengan pemerintah dengan mengadakan workshop, seminar, pelatihan skill serta pemberian dana guna membangun di lingkungan pesantren sistematis. Diharapkannya pemerintah dapat terus membantu pesantren yang masih kekurangan dalam financial secara lebih merata hingga ke pondok pesantren khususnya memberdayakan para santri dalam mengelola lingkungan hidup sebagai masa depan ekonomi negara cerah. Selain itu, dapat dilakukannya pengawasan dan pemantauan secara berkala di setiap pesantren yang dibina, sehingga dapat di ketahui keberhasilan atau kegagalan dari program eco-pesantren yang di bina oleh Pemerintah.

Abstract

The purpose of this research was to show how to facilitate students’ higher-order thinking skills (HOTS) in reading activities in English for Islamic Studies class and acknowledge students’ opinions on the activity. This was descriptive qualitative research, and its data were collected through observation and interview. Then the data were analyzed using interactive data analysis: data collection, data reduction, data display, and conclusion. The findings showed that the effort to facilitate students’ higher-order thinking skills (HOTS) is by proposing not only lower-level questions but also higher-level questions. To prevent the overuse of lower-level questions or higher-level questions, the lecturer employs the question-answer relationships (QAR) framework of the reading phase. The interview with students indicated that the students thought that the activity benefits them. Besides, the creative response questions in the post-reading phase enabled them to optimize their mind (schemata) proposing a solution to the problems found in the passage without feeling afraid of making mistakes as there is no wrong or right answer to such questions.

Abstract

Money politics has become a recurring issue and has become widespread in society. Money politics can take the form of cash donations and direct assistance, such as the distribution of basic necessities or souvenirs such as t-shirts or headscarves, commonly encountered during compaigns or before elections. The objects of money politics are generally target at lower-middle class citizens. This research aims to build a theoretical and conceptual understanding of money politics and its dangers to democracy. This study uses normative approach through legislation and relevant literature. The result show that money politics has become ingrained in society due to the lack of religious values held by the public and officials, as well as weak oversight of elections organizers. Money politics poses a real threat to democracy and can become a bridge to the emergence of corruption. Therefore serious enforcement of regulations prohibiting money politics is necessary, while still adhering to the values contained in Pancasila, while Indonesian law is fundamentally sound, the legal image has been tarnished by the behavior of unprofessional and irresponsible individuals.

Abstract

Socio-cultural issues are often interesting and unique with various problems occurring, such as deviations and divisions for the digital native generation with hedonism life without seeing the good and bad effects or factors that occur. This article aims to examine the values contained in the Saprahan tradition in terms of Islamic education and the relevance of the constitution in the 1945 Constitution, namely building the unity of the nation, the state experiencing the era of modernism. On the other hand, the authors use pierre bourdieu's theory of habitus that shapes the values and structure of people's social life. This study, with the work of collecting data, records, documents included in the library research technique analyzed using content analysis. The results of this study show that local wisdom has an adaptive ability in dealing with problems faced by human life. So that the authors argue that there are values and norms from local wisdom in the Saprahan tradition as a form of kinship in the community's cultural space. As with the Saprahan tradition, there is wejangan as diversity in the learning process by instilling the value of togetherness, unity, equality, mutual respect, eliminating ego, and strengthening the relationship between religions, ethnicities, groups, which maintains integrity and unity in the symbol of the Republic of Indonesia.

Abstract

Corruption among public officials continues to pose a serious threat to the integrity and sustainability of democratic governance in Indonesia. This study examines the restriction of public officials’ authority, particularly through political term limits and the revocation of political rights for convicted officials, as a preventive strategy against corruption. Employing a normative legal research method and document analysis, the study analyzes Indonesian laws, policies, and case data from regional heads between 2004 and 2019. The findings reveal recurring patterns of power abuse and highlight the social and institutional consequences of corruption. The study also identifies challenges in implementing anti-corruption policies, emphasizing the need for systemic reforms to enhance transparency and accountability. The results suggest that political term limits can reduce opportunities for previously corrupt individuals to regain office and help restore public confidence in governmental institutions. The study concludes that effectively combating corruption requires coordinated efforts among government bodies, civil society, and law enforcement agencies to implement policies that reinforce integrity and institutional accountability.
