Abstract

The problem that drives this research is first, customs and marriage ceremonies will still exist in a cultured society, although within the limits of time and space will undergo changes. Second, customs and marriage ceremonies are cultural elements that are lived from time to time, and inclusive and strong values and norms regulate and direct the behavior of each individual in a society. The approach chosen is a variation between approaches in normative research and empirical research so that historical, conceptual, philosophical, and case approaches are chosen. The customary law of marriage in the Abui Tribe is one of the ancestral cultural products of the Abui Tribe that must be maintained and maintained properly to preserve the continuity of noble cultural values as a local wisdom loaded with messages of virtue. This study aims to see the implementation of customary law procedures for customary marriage of the Abui Tribe and the values contained in customary marriage of the Abui Tribe. Hopefully, this research can contribute to marriage law in a constitutional system based on local wisdom.

Abstract

Customary land has a very important meaning in the lives of indigenous peoples of Indonesia, including in the context of the Dheko Lega ceremony in Ngoranale Village, Bajawa District, Ngada Regency, East Nusa Tenggara. In the Bajawa indigenous people, land is not only understood as an economic asset, but also as a symbol of identity, ancestral heritage, spiritual connections, and sources of livelihood that are deeply rooted in social and cultural structures. The Dheko Lega ceremony is an important customary ritual carried out to transfer customary responsibilities and land management rights from the mother's family to the father's family, especially in situations where there are no daughters in the father's family. One of the important elements of this ceremony is the handover of land as a form of legitimacy for the status of customarily adopted children. If this ceremony is carried out without the handing over of the land, it will arise due to customary law, including the invalidity of the ceremony, the loss of inheritance rights and land rights, as well as the potential for social conflicts and customary sanctions. Therefore, customary land has a strategic position in maintaining the continuity of kinship, cultural preservation, and social order of the Bajawa indigenous people, so that respect for all customary elements in Dheko Lega is an absolute must

Abstract

Land registration is an important activity that needs to be adhered to by the community because through land registration a certificate of land rights will be issued. The certificate is a proof tool that can provide protection and certainty to the land and the community as landowners. Land registration can also be carried out in all regions of the Republic of Indonesia. However, in certain areas there are still people who have not participated in registering their land. This can lead to agrarian conflicts because there is no proof of ownership / control over the land. The lack of land registration is also still found in the lives of people in Patawang Village, Umalulu District, East Sumba Regency. In response to these problems, it is necessary to conduct socialisation on land registration in Patawang Village. The aim is to increase the participation of the Patawang Village community towards land registration and encourage legal protection of land. The method used in this PKM is socialisation accompanied by discussion and questions and answers. In this activity, the PKM team conveyed information related to the legal basis of land registration, the definition of land registration, the importance of land registration, land registration organisers, the principles of land registration, land registration objects, land registration requirements, land registration stages, and the land registration system in Indonesia. Through socialisation activities, the community has an adequate understanding of land registration so that it can increase community participation in following land registration and realising legal protection of land.

Abstract

Land disputes are a common problem in rural areas that still rely on customary land inheritance without formal ownership documents. This study examines the mechanism of land dispute resolution based on local wisdom in South Pura Village, Pulau Pura District, Alor Regency, focusing on Tengtokung (diving ritual) as a form of alternative dispute resolution recognized by the local community. Referring to Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, this research adopts an empirical juridical method with statutory and legal anthropology approaches, as well as case studies of two land disputes that occurred in 2017 and 2019. Primary data were obtained through interviews with traditional leaders, village officials, and disputing parties, while secondary data were collected from literature studies. The results show that Tengtokung is conducted through a series of customary ceremonies involving community leaders, religious figures, and the families of the disputing parties, with outcomes considered final and fair by both sides. The strengths of this mechanism include its speed, low cost, confidentiality, and focus on restoring social relationships. However, its weaknesses lie in the absence of formal legal recognition and its reliance on the good faith of the parties, which may lead to future disputes. This study recommends strengthening the synergy between customary mechanisms and the national legal system to ensure legal certainty while preserving the community’s social harmony.

Abstract

Peraturan desa menjadi salah satu peroblema hukum dibidang ketatanegaraan karena dalam pembuatan/penyusunan peraturan desa banyak pihak terkait yang harus berperan dan bekerjasama untuk bersama-sama menyusun peraturan desa terutama pemerintah desa beserta perangkat desa lainnya serta warga masyarakat desa. Peraturan desa yang dibuat/diterbitkan tanpa melibatkan warga desa setempat pada dasarnya tetap memunyai kekuatan hukum yang kuat, namun terkadang sulit diterima oleh masyarakat akibatnya pelaksanaan peraturan desa tidak terlaksana secara efektif dan terkadang mengundang protes dari masyarakat desa setempat. Fenomena terkait peraturan desa yang tidak melibatkan masyarakat desa setempat dalam proses penyusunannya seringkali menjadi suatu persoalan yang dihadapi oleh masyarakat desa khususnya di Desa Bitefa Kabupaten Timor Tengah Utara. Oleh karena itu peran tim pelaksana pengabdian kepada masyarakat diperlukan agar dapat memberikan sosialisasi/pelatihan terkait pembuatan peraturan desa sebagai produk hukum desa yang menjadi landasan dalam penyelenggaraan pemerintahan desa. Tujuan pengabdian kepada masyarakat ini adalah mensosialisasikan tentang pembuatan peraturan desa kepada perangkat desa dan masyarakat desa agar tidak terjadi kekeliruan dalam pembuatannya. Metode pengabdian kepada masyarakat yang digunakan adalah dengan 2 tahapan yakni sosialisasi dan pelatihan pembuatan peraturan desa. Luaran pengabdian kepada masyarakat adalah publikasi pada jurnal nasional.

Abstract

Pendaftaran tanah sistematis lengkap (PTSL) merupakan kegiatan yang penting bagi masyarakat untuk memperoleh sertifikat ha katas tanah dengan cara yang terjangkau. Namun dalam kenyataannya masih ada masyarakat di Kelurahan Manulai II yang belum sadar dan belum mendaftarkan tanahnya. Oleh karena itu Permasalahan yang ditangani dalam kegiatan ini terkait permasalahan kesadaran hukum dan pengetahuan masyarakat terkait pendaftaran tanah sistematis lengkap (PTSL). Berdasarkan permasalahan tersebut maka diselenggarakan kegiatan penyuluhan hukum tentang PTSL di Kelurahan Manulai II. Kegiatan ini bertujuan untuk meningkatkan kesadaran hukum masyarakat dan meningkatkan pengetahuan masyarakat terkait PTSL. Dalam kegiatan tersebut tim pengabdian kepada masyarakat menyampaikan informasi-informasi terkait PTSL yakni pengertian yuridis mengenai pendaftaran tanah dan PTSL, dasar hukum PTSL, objek PTSL, manfaat masyarakat mengikuti PTSL, pembiayaan dalam PTSL, dan tahapan pelaksanaan PTSL yang terdiri dari 12 tahapan. Kegiatan ini disambut baik oleh masyarakat Kelurahan Manulai II dengan turut hadir dan berpartisipasi dalam diskusi.

Abstract

Sapu Lu'e Lawo is a set of woven traditional clothes for men and women in the Bajawa indigenous community. This weave has Geographical Indication characteristics as one of the communal intellectual property. Geographical Indication is a sign indicating the area of origin of an item and or product which due to geographical environmental factors including natural factors, human factors, or a combination of both factors gives a certain reputation, quality, and characteristics to the goods and/or products produced. The main problem of this research is how the geographical indication of the Lu'e Lawo broom weave and how the form of legal protection. This type of research is Sociological Jurisprudence that relies on document studies as well as empirical studies through observation methods and in-depth interviews with weavers and leaders. The results of the study found that there is an element of geographical indication in the weaving of Sapu Lu'e Lawo which is a combination of natural factors, human factors and a combination of both factors contained in the shape, motif, color, material and value message in the ritual of making it, so it requires legal protection in accordance with applicable laws and regulations. The conclusion is that Sapu Lu'e Lawo is a set of woven traditional clothing in the Bajawa customary law community that contains the quality, characteristics and reputation as a geographical indication that must be protected. It is recommended that the local government make policies that facilitate weavers' access to the availability of natural materials such as encouraging the expansion of new plantations to support the economy as well as preserving the living values of the Bajawa indigenous people.

Abstract

Kewenangan yang dimiliki oleh pemerintah desa dalam membentuk peraturan desa, selain kewenangan yang diliki oleh desa, dalam penyelenggaraan pemerintahan di desa harus berdasar pada peraturan yang ditetapkan bersama. Penyuluhan yang dilakukan di Desa Nian dengan pertimbangan bahwa jika dilihat dari perkembangan pembentukan peraturan desa masih banyak kendala yang dihadapai yaitu keterbatasan Sumber Daya Manusia. Tujuan Pengabdian adalah memberikan pemahaman hukum tentang pembentukan peraturan desa di Desa Nian, Kecamatan Miomaffo Tengah, Kabupaten Timor Tengah Utara. Metode Pengabdian yang digunakan adalah penyuluhan hukum kepada masyarakat khususnya kepada pemerintah Desa Nian dan BPD Desa Nian. Hasil/Temuan Pelaksanaan kegiatan tersebut diketahui bahwa banyak masalah-masalah dalam kapasitas pembentukan peraturan desa, hal ini berdampak pada penyelenggaraan pemerintahan yang hanya berdasar pada managemen pemerintah biasa, tanpa ada terobosan dalam pemebentukan peraturan desa yang menjadi dasar dalam berinovasi dalam pengembangan pembangunan Desa Nian. Kata kunci: Peraturan Desa, Penyuluhan, Pembentukan.

Abstract

This study aims to examine and analyse the existence of Woloara customary land law and to examine and analyse the use and utilisation of land by the Woloara indigenous community based on Woloara customary land law. This study is an empirical legal study using three approaches, namely the legislation approach, legal sociology, and legal history. Based on the research conducted, it is known that Woloara customary land law contains important elements, namely commands, permissions, prohibitions, and sanctions, which are also closely related to respect for Embu Mamo (ancestors) and Nggae (God). In the context of this study, the indicators used to analyse the existence of customary land law, particularly among the Woloara indigenous community, are divided into three main aspects, namely: objects, values, and sustainability. Woloara customary land law is still valid and exists in community life, particularly in the use and utilisation of land. This is marked by the permissions, commands, prohibitions, and sanctions created by the Embu Mamo in ancient times, which are still recognised, obeyed, and enforced in community life. This is also evident from the continued use of the same objects, values that are generally unchanged, and sustainability that has shown that elements of customary land law continue to be applied in land use and utilisation activities. Furthermore, based on the results of the study, it is known that customary land law serves as a guideline in the implementation of land use and utilisation, which results in various types of land use and utilisation, namely land use and utilisation based on subject, land use and utilisation based on land type, land use and utilisation based on area function, land use and utilisation based on type of activity, and land use and utilisation based on social status.
