Abstract

This research responds to the debate regarding the legal status of Regional Companies (Regional Companies) and the legal position of regional heads in their management. With a legal deconstruction approach, this study aims to find the fundamental meaning of the formation of a legal entity of a Regional Company, which is expected to provide legal certainty for local governments, communities, and third parties who want to collaborate. The method used is normative legal research with a focus on the discovery of law in concreto, which requires the analysis of previous legal norms. This study includes observations of the management of Regional Companies to understand the dynamics of the relationship between the legal status of Regional Companies, regional heads, and the principles of the welfare state in the context of economic development. The resulting legal arguments are expected to explain the dilemma of the legal status of Regional Companies which lie between public and private law, as well as their impact on the institutional, financial, and responsibility of regional heads. The analysis process is carried out by the method of systematizing legal materials in a descriptive manner, explicit explanations, and prescriptive improvements through legal interpretation.

Abstract

Cooperatives and Village-Owned Enterprises (BUMDes) are two economic institutional entities that have a strategic role in realizing the welfare of village communities. In the midst of the challenges of rural development and the need to strengthen the institutions of people's businesses, the idea of institutional integration between cooperatives and BUMDes emerged as an alternative to an inclusive and sustainable business model. However, the difference in juridical character between the two raises legal problems that have not been explicitly regulated in the national legal system. This study aims to analyze the juridical aspects of the institutional integration of cooperatives and BUMDes, using a normative legal approach through the study of laws and regulations, legal doctrines, and the results of previous research. The results of the study show that despite the opportunity for institutional synergy, structural integration between the two still faces normative constraints, especially related to differences in legal regimes, financial accountability, and asset ownership. Therefore, legal reconstruction is needed through regulatory harmonization, both in the form of functional cooperation based on cooperation agreements, as well as the formulation of new regulations that allow the integration of village business institutions legally and effectively. This study is expected to contribute to the development of a legal system that supports community-based village economic transformation.

Abstract

Pendaftaran tanah sistematis lengkap (PTSL) merupakan kegiatan yang penting bagi masyarakat untuk memperoleh sertifikat ha katas tanah dengan cara yang terjangkau. Namun dalam kenyataannya masih ada masyarakat di Kelurahan Manulai II yang belum sadar dan belum mendaftarkan tanahnya. Oleh karena itu Permasalahan yang ditangani dalam kegiatan ini terkait permasalahan kesadaran hukum dan pengetahuan masyarakat terkait pendaftaran tanah sistematis lengkap (PTSL). Berdasarkan permasalahan tersebut maka diselenggarakan kegiatan penyuluhan hukum tentang PTSL di Kelurahan Manulai II. Kegiatan ini bertujuan untuk meningkatkan kesadaran hukum masyarakat dan meningkatkan pengetahuan masyarakat terkait PTSL. Dalam kegiatan tersebut tim pengabdian kepada masyarakat menyampaikan informasi-informasi terkait PTSL yakni pengertian yuridis mengenai pendaftaran tanah dan PTSL, dasar hukum PTSL, objek PTSL, manfaat masyarakat mengikuti PTSL, pembiayaan dalam PTSL, dan tahapan pelaksanaan PTSL yang terdiri dari 12 tahapan. Kegiatan ini disambut baik oleh masyarakat Kelurahan Manulai II dengan turut hadir dan berpartisipasi dalam diskusi.
