Abstract

Sasak women grapple with a legal conundrum stemming from the coexistence of multiple marriage legal frameworks encompassing fiqh, adat, and state law. This intricate legal pluralism dynamically shapes the legal consciousness of Sasak women as they navigate the selection of legal avenues to secure legality and address their marital legal challenges. This study pursues two primary objectives: firstly, to examine the intricate interplay among fiqh, adat, and state marriage law concerning the provision of legal certainty and protection for Sasak women; secondly, to probe into the manifestations of legal consciousness arising from the plural marriage legal frameworks. Data were collected through document analysis, literature review, and in-depth interviews with selected Sasak women. The findings illuminate a dynamic interplay among fiqh, adat, and state marriage law across various marital facets, including prenuptial considerations, minimum marriage age, marriage prerequisites and pillars, marriage contracts, residency, polygamy, divorce, and reconciliation. Moreover, the study identifies three distinct forms of legal consciousness emerging among Sasak women: ‘before the law’ when confronting fiqh, ‘with the law’ when embracing formal legal mechanisms to address marital issues, and ‘against the law’ when eschewing formal legal provisions. In conclusion, state marriage laws are more progressive in providing legal certainty and protection for women but lacking criminal sanctions/fines weakens their position compared to religious law (fiqh) and customs (adat). Ultimately, this shapes the legal consciousness of Sasak women in diverse ways.

Abstract

Ideally, waqf can be managed productively and developed into an Islamic institution that can improve people's welfare. In reality, together with zakat, waqf can be an instrument in poverty alleviation. Productive management of zakat cannot be separated from the media used in carrying out waqf. However, the practice that occurs in the field, especially in Paokmotong Village, Masbagik, East Lombok Regency, based on the results of initial observations conducted by researchers, waqf management is still around religious issues, considering that this has become a habit for the people of Lombok in particular. So, when there is waqf land, its management is often more for the needs of places of worship or the like. In fact, if developed, this could be an instrument in alleviating poverty like zakat.

Abstract

Abstract: Tradisi begibung merupakan kegiatan makan bersama dalam satu wadah, telah menjadi bagian penting dari budaya Masyarakat Sasak, mencerminkan nilai-nilai sosial dan religious yang kuat. Penelitian ini bertujuan untuk melihat bagaimana tradis begibung pada Masyarakat Sasak di Dusun Tanggak Kabupaten Lombok Tengah masih dipertahankan, serta untuk menemukan bentuk nilai-nilai Pendidikan agama Islam yang terkandung dalam tradisi begibung pada masyarakat Sasak di Dusun Tanggak Kabupaten Lombok Tengah. Penelitian ini merupakan penelitian kualitatif deskriptif. Pengambilan data menggunakan teknik observasi, wawancara dan dokumentasi. Teknik analisis data yang digunakan adalah pengumpulan data, reduksi data, penyajian data, dan penarikan Kesimpulan. Sedangkan teknik pengecekan keabsahan data menggunakan triangulasi sumber, triangulasi Teknik, dan triangulasi waktu. Hasil penelitian menunjukkan bahwa tradisi begibung berperan dalam memenuhi empat fungsi utama dalam struktur sosial Masyarakat Sasak di Dusun Tanggak sehingga tetap dipertahankan hingga saat ini, yaitu adaptation, goal attainment, integration, dan latency/pattern maintenance. Hasil penelitian juga menunjukkan bahwa tradisi begibung mengandung tiga nilai utama Pendidikan Islam yaitu nilai I’tiqodiyah (keimanan), nilai khuluqiyah (akhlak), dan nilai amaliyah (amal perbuatan). Abstract

This study focuses on exploring the social engagement experiences of Sangkhom Islam Wittaya School and Lenterahati Islamic Boarding School as a manifestation of their social responsibility in the surrounding communities. Using a qualitative case study approach, the research employed three data collection techniques: in-depth interviews, observation, and document analysis, followed by qualitative analysis. The findings indicate that both institutions share similarities in the content and procedures of their social programs. These include regular programs in religious education, economic empowerment, healthcare, and basic infrastructure improvement, as well as their proactive involvement in disaster relief as part of their incidental programs. The community has expressed positive appreciation for the social programs implemented by both Sangkhom Islam Wittaya School and Lenterahati Islamic Boarding School, with a strong desire for the continuation of such initiatives. This study underscores the ability of these pesantren to adapt and align with public expectations within mutually beneficial collaborations

Abstract

This research is motivated by the researcher's attention to the phenomenon of underage marriage in Jelantik Village, Jonggat District, Central Lombok Regency. Based on data in 2019 the number of underage marriages reached 9 people and in 2020 the number of underage marriages reached 3 people, in addition, from the marriage registration data above, currently, there are 3 underage marriage couples who have a marriage certificate and 9 couples others do not have a marriage certificate. The focus studied in this thesis is (1) what are the factors causing the phenomenon of underage marriage in Jelantik Village, Jonggat District, Central Lombok Regency? (2) what are the impacts of the phenomenon of underage marriage in Jelantik Village, Jonggat District, Central Lombok Regency? (3) how is the phenomenon of underage marriage from the perspective of al-maslahah mursalah in Jelantik Village, Jonggat District, Central Lombok Regency? This type of research uses qualitative research and uses an empirical juridical approach and a sociological approach; the data collection methods used are observation, interviews, and documentation. While the analytical method used is a qualitative analysis method. The results of this study indicate that (1) the factors causing the phenomenon of underage marriage in Jelantik Village, Jonggat District, Central Lombok Regency include: (a) low education factors; (b) cultural or environmental factors; (c) social media factors, ( d) the factor of getting pregnant out of wedlock (married by assent). (2) the impact of the phenomenon of underage marriage in Jelantik Village, Jonggat District, Central Lombok Regency, namely, positive and negative impacts. (3) the phenomenon of underage marriage from the perspective of al-maslahah mursalah in Jelantik Village, Jonggat District, Central Lombok Regency, al-maslahah mursalah can be an option in exploring and finding legal arguments such as filing a marriage dispensation for marriage registration, administratively it will provide benefits for people in marriage and can be registered legally formally by VAT. Maslahah is the goal of Islamic law; thus, where there is goodness, there is a benefit. In addition, not all underage marriages cause harm, as the researchers found in this thesis, namely, pregnant out of wedlock (MBA) and can no longer be separated so if they are not married, it will cause bigger problems. Based on this description, it can be understood that underage marriage from the perspective of al-maslahah mursalah provides a solution by way of a marriage dispensation in order to realize the benefits of underage marriage and for the sake of creating welfare for the community.

Abstract

Perkawinan di bawah usia 19 tahun dianggap tidak sah menurut hukum positif Indonesia karena tidak memenuhi syarat legalitas. Pasal 7 ayat (2) Undang-Undang No. 16 Tahun 2019 dan Pasal 7 ayat (3) huruf (e) Kompilasi Hukum Islam memberikan ruang legalisasi melalui mekanisme dispensasi kawin maupun isbat nikah. Ketentuan tersebut kerap dimanfaatkan sebagai solusi alternatif untuk melegalisasi perkawinan anak, sekaligus menimbulkan problematika hukum yang bersumber dari disharmoni regulasi serta perbedaan praktik dan implementasinya di masyarakat. Penelitian ini mengkaji faktor-faktor penyebab terjadinya perkawinan anak di wilayah hukum Lombok Tengah serta menganalisis praktik legalisasi yang dilakukan pasca lahirnya Undang-Undang No. 16 Tahun 2019. Fokus kajian juga diarahkan pada tinjauan hukum terhadap mekanisme legalisasi tersebut, guna menilai keselarasannya dengan regulasi yang berlaku.Penelitian ini merupakan penelitian lapangan (field research) dengan desain deskriptif kualitatif dan pendekatan hukum normatif empiris. Data yang digunakan meliputi data primer dari observasi dan wawancara dengan pelaku serta aparat terkait, serta data sekunder berupa dokumen resmi dan literatur hukum. Pengumpulan data dilakukan melalui observasi, wawancara terstruktur, dan dokumentasi. Analisis data mencakup reduksi, penyajian, dan penarikan kesimpulan, dengan validitas dijaga melalui triangulasi dan referensi yang memadai. Perkawinan anak di Lombok Tengah dipengaruhi oleh faktor pendidikan, keterbatasan ekonomi, pengaruh sosial, budaya dan media serta lemahnya pengawasan orang tua. Legalisasi perkawinan anak melalui dispensasi kawin dan isbat nikah di Pengadilan Agama Praya pasca lahirnya Undang-Undang No. 16 Tahun 2019 mencerminkan dinamika sosial dan kebutuhan kepastian hukum, dengan prosedur hukum yang terstruktur dan pertimbangan hakim yang berorientasi pada kemaslahatan. Ketidakharmonisan antara Undang-Undang Perkawinan, Kompilasi Hukum Islam, Undang-Undang Perlindungan Anak, dan PERMA menimbulkan ketidakpastian hukum dan potensi ketidakadilan bagi anak, sehingga mendesak penyempurnaan regulasi demi menjaga supremasi hukum dan perlindungan terbaik bagi anak.

Abstract

Fazlur Rahman is one of the modern Muslim thinkers who plays an important rolein the reconstruction of Islamic thought, especially in responding to the challenges ofmodernity. He argues that Islam is not a static teaching, but rather a dynamic valuesystem that must always develop in accordance with the changing times. One of Rahman'smain criticisms of the Islamic world is the tendency to understand the Qur'an and Sunnahliterally without considering their historical and social context. He offers a double movementmethodology, an approach that traces the original meaning of the text in its historicalcontext, then applies it to modern conditions. This approach allows Islam to remainrelevant without losing its essence. In addition to the interpretation methodology, Rahmanalso contributed to the reform of Islamic education, the integration of science with religion,and the reconstruction of Islamic law based on the principle of maqasid al-shariah. Heemphasized the importance of reopening the door of ijtihad so that Muslims do not getcaught up in taqlid, namely the attitude of accepting Islamic law dogmatically withoutcritical evaluation. Rahman also criticized Islamic fundamentalism which tends to rejectmodernity absolutely, as well as radical secularism which seeks to eliminate the spiritualaspect of human life. According to him, Muslims must be able to adopt the positive aspectsof modernity, such as the development of science and technology, without sacrificingIslamic values. With a more rational and contextual approach, Rahman provides afoundation for Islamic renewal that is not only based on tradition, but also open to thedevelopment of the times. His thoughts offer solutions to various global challenges faced by Muslims, including inlegal, social, and economic aspects. Thus, modernity is not a threat to Islam, but ratheran opportunity to strengthen Islamic values in the lives of contemporary society.
