Abstract

This research examines the effectiveness of law enforcement against tin smuggling crimes in Bangka from the perspective of national criminal law. Tin smuggling has become a serious problem affecting state revenues, environmental sustainability, and socio-economic stability in tin-producing regions. Through a juridical-empirical approach, this research analyzes the implementation of law enforcement against tin smuggling and identifies factors that hinder its effectiveness. Data were obtained through interviews with law enforcement officials, legal document studies, and field observations. The results show that law enforcement against tin smuggling in Bangka has not been optimal due to limited resources, weak inter-agency coordination, and the complexity of smuggling networks. This research also finds that existing legislation is not yet comprehensive in addressing the specificity of tin smuggling crimes. Recommended countermeasures include strengthening coordination between law enforcement agencies, optimizing surveillance at smuggling routes, and updating regulations to be more responsive to the dynamics of tin smuggling.

Abstract

Abstract

The World Trade Organization (WTO) agreements have a broad and complex impact on its member countries, especially regarding trade policy and global economic justice. Legal challenges in implementing these agreements, including harmonization between national and international law, as well as domestic political and economic dynamics, add to the complexity of their implementation. In addition, the WTO agreements also offer significant opportunities for member countries, such as wider market access and increased foreign investment. This study aims to analyze the long-term impact of the WTO agreements on trade policy, economic justice, and sustainable development in its member countries. This study uses a qualitative approach, with data obtained from various relevant sources such as research results and previous studies, which are then processed and analyzed in depth. The results show that the WTO agreements significantly shape the direction of member countries' future trade policies, with a greater impact felt by developing countries. Global economic injustice has emerged as one of the consequences of the implementation of these agreements, where developed countries are better able to utilize WTO provisions. On the other hand, the environmental and social impacts of implementing the WTO agreements are concerns that require better integration into trade policy. Projections of future challenges suggest that the WTO must continue to adapt to global changes to remain relevant and effective. Overall, this study highlights the need for a balance between trade liberalization and the protection of social and environmental values within the WTO framework.

Abstract

Transnational environmental crimes are among the most complex and destructive forms of cross-border criminality, including wildlife trafficking, illegal trade of endangered species, transboundary pollution, and unlawful exploitation of natural resources by state and non-state actors. These offenses have yet to gain explicit recognition as core international crimes, despite their severe impacts on ecosystems, geopolitical stability, and local communities. This article examines the urgent need to incorporate transnational environmental crimes into international criminal law and emphasizes a victim-centered environmental justice approach to restore the rights and sustainability of affected communities. Using normative and comparative legal analysis, it advocates recognizing ecocide and cross-border environmental offenses as serious violations of ecological justice and human rights. The study further explores how victim protection frameworks can extend to Indigenous communities, future generations, and non-human entities, offering guidance for Indonesia in building a more responsive, transnational, and victim-oriented environmental criminal justice system.

Abstract

This study critically examines the issue of embezzlement in the private sector, a form of white-collar crime that continues to pose significant threats to corporate integrity, investor trust, and economic stability. Despite its prevalence and damaging consequences, legal responses remain fragmented both at the level of national legislation and international legal harmonization. Using a normative legal method with statutory, conceptual, comparative, and futuristic approaches, this research systematically analyzes the underlying legal and institutional deficiencies and formulates reform-oriented recommendations. Drawing on statutes, case law, academic doctrines, and cross-jurisdictional practices, the study identifies key regulatory gaps: the absence of a consistent legal definition of private sector embezzlement, weak enforcement mechanisms, and insufficient corporate accountability provisions. Comparative insights from jurisdictions such as the United States, Germany, and Singapore highlight the effectiveness of integrated models combining criminal sanctions, internal compliance obligations, and external oversight. In light of these findings, the study proposes targeted reforms in Indonesian corporate law particularly to clarify corporate criminal liability, mandate real-time internal controls, and establish independent ethics committees. These proposals are intended to guide lawmakers, regulatory bodies, and corporate policymakers toward developing more effective enforcement mechanisms and corporate governance structures. Ultimately, the study underscores that embezzlement is not merely a legal infraction but a systemic governance failure requiring coordinated legal, institutional, and ethical responses across national and international levels.

Abstract

Children are a national asset whose existence is crucial to ensuring the survival of a nation. Therefore, to support this goal, the future of children and their livelihood security must be considered from all aspects, from economics to education to health, and most importantly, legal protection. Legal protection is paramount because today many children are involved in criminal acts, resulting in their status changing to children in conflict with the law, and many are sentenced to prison in Child Development Institutions. This has the potential to threaten the continuity of children's access to educational rights. It must be understood that fostering in a foster institution does not necessarily break the chain of recurrence of criminal acts by children, and placement of children in foster institutions also has the potential to increase the state's financial burden and may lead to overcapacity in society. Therefore, Indonesia is slowly trying to implement a double-track criminal justice system to accommodate the interests of children in conflict with the law so that their rights are still fulfilled. As an analysis of this system, the author attempted to conduct research on the Sungailiat District Court Decision Number 1/Pid.Sus-Anak/2025/PN Pgp. Using a normative legal research method, the author attempts to examine the application of two criminal justice systems in handling juvenile cases. Through a literature review of the collected legal materials, the author found that implementing two criminal justice systems in handling juvenile cases is not easy. Many factors must be ensured for the success of these two criminal justice systems. The child's age as a tool to identify children who may be subject to imprisonment or other criminal penalties, analysis of the community guidance research report, criminal threats against children, a description of the public prosecutor's demands outlining sanctions for the action, the availability of supporting facilities and the budget for implementing the action against the child. Each component supports each other, and if one component is not met, the two-track criminalization formulation cannot be implemented. And this occurs in case handling.Sungailiat District Court Decision Number 1/Pid.Sus-Anak/2025/PN Pgp which ultimately cannot apply the decision to take action against the child even though the conditions for the child to be subject to action have been fulfilled in terms of the actions and the threat of punishment imposed on the child.

Abstract

This study investigates the implementation and challenges of spiritual guidance programs within the Pangkalpinang Class IIA Correctional Institution, as outlined in Law Number 22 of 2022 on Penitentiaries. Using a mixed juridical and empirical approach, including interviews and observations, the research analyzes various aspects of spiritual guidance, identifies prevailing challenges, and proposes strategies to improve program effectiveness. The findings reveal significant efforts in providing religious facilities and spiritual guidance, yet challenges persist, such as low inmate participation and a shortage of specialized personnel in spiritual guidance. To address these issues, collaboration with the Ministry of Religious Affairs of the Bangka Belitung Islands Province is proposed to enhance program quality. The study concludes that fostering inter-institutional cooperation is crucial to ensuring the fulfillment of inmates' religious rights and facilitating their rehabilitation and reintegration into society.

Abstract

Indonesia, as a nation of law, faces challenges in integrating the restorative justice approach into the resolution of minor criminal offenses. This approach is considered more humane as it prioritizes the restoration of harm to victims and the accountability of offenders rather than mere punishment. This study aims to identify the main obstacles in the implementation of restorative justice, particularly in cases of minor criminal offenses, and to provide recommendations for improving its effectiveness. The research method employs a normative approach with an analysis of legal documents and related literature. The results of the study show that although restorative justice has been adopted in several policies, such as Attorney General Regulation Number 15 of 2020 and Police Regulations, its implementation is still hindered by regulatory factors, the capacity of law enforcement, public perception, limited resources, and local cultural dynamics. The conclusion of this study emphasizes the importance of integrated legal policy reform, continuous training for law enforcement, and public education about the benefits of this approach. By overcoming these obstacles, restorative justice has the potential to be an effective and inclusive solution in reforming Indonesia's criminal justice system.
