Abstract

Tindak pidana lalu lintas merupakan permasalahan yang signifikan di masyarakat saat ini. Dalam upaya mencapai keadilan yang lebih holistik, konsep keadilan restoratif muncul sebagai alternatif dalam penyelesaian sengketa tindak pidana lalu lintas di ruang publik. Penelitian ini bertujuan untuk menganalisis konsep keadilan restoratif yang dapat diterapkan dalam penyelesaian sengketa tindak pidana lalu lintas, khususnya yang melibatkan kecelakaan yang mengakibatkan korban meninggal dunia. Metode penelitian yang digunakan adalah pendekatan normatif dengan mengacu pada bahan hukum, peraturan perundang-undangan, dan studi literatur. Hasil penelitian menunjukkan bahwa konsep keadilan restoratif menawarkan pendekatan yang berfokus pada pemulihan hak-hak korban dan reintegrasi sosial pelaku. Dalam konsep ini, korban, pelaku, dan mediator memainkan peran yang penting. Korban memiliki kesempatan untuk menyampaikan pengalaman mereka, mengungkapkan kebutuhan dan harapan, serta berkontribusi dalam proses penyelesaian sengketa. Pelaku memiliki kesempatan untuk bertanggung jawab atas tindakan mereka, meminta maaf, dan mengambil langkah-langkah untuk memperbaiki dampak yang ditimbulkan. Mediator bertugas memfasilitasi dialog dan menciptakan lingkungan yang aman untuk negosiasi dan kesepakatan. Selain itu, penelitian ini mengidentifikasi beberapa solusi yang dapat diambil dalam penyelesaian pelanggaran lalu lintas yang menyebabkan orang lain meninggal dunia. Salah satu solusi yang disarankan adalah pembayaran ganti rugi kepada keluarga korban sebagai bentuk kompensasi materiil. Selain itu, penerapan sanksi rehabilitasi dan pendidikan tentang keselamatan berkendara juga menjadi penting dalam mencegah terjadinya pelanggaran lalu lintas di masa depan. Kesimpulannya, implementasi model keadilan restoratif dalam penyelesaian sengketa tindak pidana lalu lintas di ruang publik dapat memberikan manfaat yang signifikan dalam pemulihan hak-hak korban, reintegrasi sosial pelaku, dan pencegahan pelanggaran di masa depan. Namun, perlu memperhatikan faktor-faktor pendukung dan penghambat dalam implementasi, seperti dukungan institusi, kesadaran masyarakat, dan kerjasama antara berbagai pihak terkait.

Abstract

Penelitian ini menganalisis Peraturan Daerah Provinsi Kepulauan Bangka Belitung Nomor 19 Tahun 2017 tentang Penataan Usaha Perkebunan Kelapa Sawit melalui pendekatan Ekonomi Hukum yang dikemukakan oleh Richard Posner. Pendekatan ini menilai efektivitas dan efisiensi regulasi dengan mempertimbangkan alokasi sumber daya yang optimal dan kesejahteraan sosial. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris dengan teknik deskriptif-analitis. Hasil penelitian menunjukkan bahwa meskipun Perda ini memiliki tujuan yang baik dalam mengatur usaha perkebunan kelapa sawit, terdapat beberapa kelemahan dalam mekanisme penegakan dan regulasi yang dapat menghambat pencapaian tujuan tersebut. Penyempurnaan diperlukan untuk meningkatkan kepastian hukum, mengurangi biaya kepatuhan, dan mendorong inovasi dalam praktik perkebunan berkelanjutan. Dengan demikian, Perda ini diharapkan dapat lebih efektif dalam mendorong kesejahteraan sosial dan keberlanjutan lingkungan.

Abstract

Tax crimes have become a significant issue in Indonesia, as taxes are vital for the government's development efforts. Failure to comply with tax obligations not only impacts the state's revenue but also hinders the equitable distribution of welfare to society. The purpose to be achieved in this study is to find out related to the authority of PPNS in the seizure and blocking of suspect assets in order to recover losses in state revenue. The method used in this study is empirical juridical where the data obtained through primary data by interviewing the DGT Bangka Belitung region. In addition, secondary data is also used to add information and strengthen the analysis related to the research topic. The results showed that the recovery of State losses can be done by the DGT where the authority can be done by confiscation and blocking of assets. This mechanism is carried out with the aim that the country does not suffer considerable losses. Tax investigation collection is one of the actions that can reduce tax crimes so that the activities carried out must be carried out efficiently in accordance with applicable regulations

Abstract

The World Trade Organization (WTO) agreements have a broad and complex impact on its member countries, especially regarding trade policy and global economic justice. Legal challenges in implementing these agreements, including harmonization between national and international law, as well as domestic political and economic dynamics, add to the complexity of their implementation. In addition, the WTO agreements also offer significant opportunities for member countries, such as wider market access and increased foreign investment. This study aims to analyze the long-term impact of the WTO agreements on trade policy, economic justice, and sustainable development in its member countries. This study uses a qualitative approach, with data obtained from various relevant sources such as research results and previous studies, which are then processed and analyzed in depth. The results show that the WTO agreements significantly shape the direction of member countries' future trade policies, with a greater impact felt by developing countries. Global economic injustice has emerged as one of the consequences of the implementation of these agreements, where developed countries are better able to utilize WTO provisions. On the other hand, the environmental and social impacts of implementing the WTO agreements are concerns that require better integration into trade policy. Projections of future challenges suggest that the WTO must continue to adapt to global changes to remain relevant and effective. Overall, this study highlights the need for a balance between trade liberalization and the protection of social and environmental values ​​within the WTO framework.

Abstract

Transnational environmental crimes are among the most complex and destructive forms of cross-border criminality, including wildlife trafficking, illegal trade of endangered species, transboundary pollution, and unlawful exploitation of natural resources by state and non-state actors. These offenses have yet to gain explicit recognition as core international crimes, despite their severe impacts on ecosystems, geopolitical stability, and local communities. This article examines the urgent need to incorporate transnational environmental crimes into international criminal law and emphasizes a victim-centered environmental justice approach to restore the rights and sustainability of affected communities. Using normative and comparative legal analysis, it advocates recognizing ecocide and cross-border environmental offenses as serious violations of ecological justice and human rights. The study further explores how victim protection frameworks can extend to Indigenous communities, future generations, and non-human entities, offering guidance for Indonesia in building a more responsive, transnational, and victim-oriented environmental criminal justice system.

Abstract

This study investigates the implementation and challenges of spiritual guidance programs within the Pangkalpinang Class IIA Correctional Institution, as outlined in Law Number 22 of 2022 on Penitentiaries. Using a mixed juridical and empirical approach, including interviews and observations, the research analyzes various aspects of spiritual guidance, identifies prevailing challenges, and proposes strategies to improve program effectiveness. The findings reveal significant efforts in providing religious facilities and spiritual guidance, yet challenges persist, such as low inmate participation and a shortage of specialized personnel in spiritual guidance. To address these issues, collaboration with the Ministry of Religious Affairs of the Bangka Belitung Islands Province is proposed to enhance program quality. The study concludes that fostering inter-institutional cooperation is crucial to ensuring the fulfillment of inmates' religious rights and facilitating their rehabilitation and reintegration into society.

Abstract

Indonesia, as a nation of law, faces challenges in integrating the restorative justice approach into the resolution of minor criminal offenses. This approach is considered more humane as it prioritizes the restoration of harm to victims and the accountability of offenders rather than mere punishment. This study aims to identify the main obstacles in the implementation of restorative justice, particularly in cases of minor criminal offenses, and to provide recommendations for improving its effectiveness. The research method employs a normative approach with an analysis of legal documents and related literature. The results of the study show that although restorative justice has been adopted in several policies, such as Attorney General Regulation Number 15 of 2020 and Police Regulations, its implementation is still hindered by regulatory factors, the capacity of law enforcement, public perception, limited resources, and local cultural dynamics. The conclusion of this study emphasizes the importance of integrated legal policy reform, continuous training for law enforcement, and public education about the benefits of this approach. By overcoming these obstacles, restorative justice has the potential to be an effective and inclusive solution in reforming Indonesia's criminal justice system.

Abstract

This research examines legal protection against child sexual exploitation through Augmented Reality (AR) and Virtual Reality (VR) technologies, which are increasingly developing in the digital era. AR combines virtual elements with the real world, while VR creates a fully immersive environment. Both offer positive opportunities and serious risks, including new crime modes such as the creation of avatars or virtual models of children for sexual purposes, grooming in virtual spaces, and the distribution of immersive child pornography. Anonymity, the difficulty of age verification, the lack of digital literacy, and the forensic challenges of 3D content are significant obstacles to law enforcement. Existing regulations, including Law No. 17 of 2016 concerning Child Protection, Law No. 1 of 2024 concerning the Second Amendment to the ITE Law, and Law No. 12 of 2022 concerning the TPKS, have provided a strong legal basis, but do not specifically regulate AR/VR technology. A normative juridical research method with a statutory and conceptual approach is used to analyze existing norms, regulatory gaps, and their relevance to international standards such as the Budapest Convention and the Lanzarote Convention. The research findings emphasize the urgency of adaptive regulatory updates to technological developments, the implementation of cybersecurity standards, mandatory age verification, and strengthening the capacity of law enforcement officers in digital investigations and AR/VR forensics. Cross-border and cross-sector collaboration is needed to expedite notice and takedown mechanisms and close legal loopholes exploited by perpetrators. These efforts are expected to create a safe digital environment for children and increase the effectiveness of legal protection in the realm of immersive technology.
