Abstract

This study analyzes the legal position of testimonium de auditu witnesses in itsbat nikah cases at the Mahkamah Syar’iyah Bireuen. Normatively, Indonesian civil procedure law through Article 171 HIR and Article 1907 of the Civil Code requires witnesses to provide testimony based on direct knowledge, thereby rejecting hearsay as valid evidence. However, in practice, especially in itsbat nikah cases where direct witnesses are often unavailable, judges frequently face demands to consider such testimony. Using a normative-empirical approach, this research combines legal analysis of statutory provisions and jurisprudence with field data from case studies and interviews with judges. The findings reveal that the Mahkamah Syar’iyah Bireuen consistently does not treat testimonium de auditu as primary evidence, but only as complementary proof that must be supported by other evidence such as documents or direct witness testimony. The implication is a balance between legal certainty and substantive justice, ensuring protection for women and children from unregistered marriages while maintaining procedural safeguards.

Abstract

The Aceh customary courts play a pivotal role in resolving societal conflicts, particularly those not addressed by the formal justice system. The formal system often remains inaccessible due to remote locations, high costs, and the complexities of judicial administration, posing significant challenges for communities, especially in Kota Lhokseumawe. This study examines two key issues: the authority of gampong customary courts in addressing customary criminal cases and the resolution models employed by these courts to reduce such cases in Kota Lhokseumawe. Using a descriptive qualitative method based on field research with a normative-empirical juridical approach, this study reveals that the authority of gampong customary courts represents a form of local wisdom that remains highly relevant in Indonesia, particularly in regions with strong customary traditions like Kota Lhokseumawe. This authority is confined to 18 types of cases as stipulated in Article 13 of Aceh Qanun No. 9 of 2008 on the Development of Customary Life and Customs and Aceh Governor Regulation No. 60 of 2013 on the Settlement of Customary Disputes. Through deliberation (musyawarah) and consensus (mufakat), these courts effectively restore social harmony and resolve conflicts peacefully. However, challenges such as the formalization and documentation of customary decisions, training for customary leaders in formal legal procedures, and the inconsistent application of customary law persist. Addressing these challenges is essential to ensure that customary courts continue to contribute to maintaining social order and justice at the local level.

Abstract

Criminal acts committed by youth motorcycle gangs have become a serious concern in many cities across Indonesia, including Lhokseumawe. Over recent years, Lhokseumawe has faced numerous criminal cases linked to these gangs, such as brawls, slashings, and muggings that disrupt public safety and road users. Despite various measures implemented by the Lhokseumawe City Government and Forkompimda, including curfews and night raids by Satpol PP, WH, and the Police, these efforts have yielded limited results. Many apprehended gang members repeatedly return to criminal activities, highlighting the ineffectiveness of current strategies. A new policy model is urgently needed to address this issue and ensure community safety. This research aims to propose a new preventive policy for the Lhokseumawe City Government. Using an empirical juridical method with a qualitative approach, the study examines field data and existing regulations. Laws governing juvenile involvement in motorcycle gangs include the 1945 Constitution, the Criminal Code, and laws on child protection and juvenile justice. Key factors driving gang involvement include lack of parental guidance, negative social environments, and restricted educational opportunities. Effective handling requires a dual approach: prevention through education, patrols, and social outreach, alongside repressive and rehabilitative measures to help reintegrate affected youth into society.

Abstract

Main hakim sendiri merupakan tindakan untuk menghukum suatu pihak tanpa melewati proses yang sesuai hukum seperti pemukulan terhadap pelaku kejahatan yang dilakukan oleh suatu masyarakat. Main hakim sendiri selain merupakan perbuatan yang melawan hukum juga bertentangan dengan ajaran agama Islam. Dalam rangka pelaksanaan syariat Islam di Aceh dan mewujudkan kehidupan masyarakat adat yang bersendikan syariat Islam, perlu dilakukan telaah dan kajian yang mendalam tentang tindakan main hakim sendiri dalam kedudukan hukum adat dan hukum Islam. Dalam perspektif hukum adat, tindakan main hakim sendiri terhadap pelanggar syari’at Islam merupan tindakan melawan hukum dan bertentangan dengan asas-asas hukum adat dan hukum Islam. Tindakan main hakim sendiri termasuk dalam bentuk sanksi adat yang bertentangan dengan syari’at Islam. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Dalam perspektif hukum pidana Islam, tindakan main hakim sendiri termasuk perbuatan zalim yang bisa merugikan orang lain, dimana orang yang melakukan tindakan main hakim sendiri bisa digolongkan dalam tindak pidana pembunuhan (‘amdu, syibhul ‘amd, atau khata’) atau tindak pidana penganiayaan dengan melihat pada jenis perbuatan yang dilakukannya terhadap pelanggar syari’at Islam.

Abstract

This article explores the legal status of khitbah (engagement) conducted through social media platforms, particularly Facebook, in light of Shafi”˜i jurisprudence. In classical Islamic law, khitbah represents a preliminary stage of marriage, intended to establish mutual understanding and commitment prior to the solemnization of the marriage contract (”˜aqd al-nikāḥ). Traditionally, this practice has been carried out in face-to-face settings, mediated by families and community norms. However, the rapid development of communication technology has reconfigured modes of social interaction among Muslims, including those related to religiously significant practices such as khitbah. The study employs a qualitative library research approach, drawing upon primary Shafi”˜i fiqh sources such as MughnÄ« al-Muḥtāj (al-Khaá¹­Ä«b al-ShirbÄ«nÄ«), I”˜Änat al-ṬālibÄ«n (al-Shaṭā), and al-Fiqh al-IslāmÄ« wa Adillatuh (al-ZuḥaylÄ«), alongside contemporary scholarly debates in Islamic family law and digital communication studies. The findings demonstrate that a khitbah performed through social media is legally valid, since the principle al-kitābah ka-l-khiṭāb that written communication is equivalent to spoken communication is well established in Islamic jurisprudence. Thus, proposals made through text messages, social media posts, or digital calls fulfill the requirement of explicit (á¹£arīḥ) or indirect (ta”˜rīḍ) expression of intent. Nonetheless, while the legality of such practice is affirmed, ethical and social concerns remain paramount. The potential for deception, anonymity, and digital intimacy presents significant challenges that demand moral vigilance. Islamic ethics emphasizes safeguarding honor (”˜ird) and preventing harm (dharar), necessitating caution in applying classical rulings to modern contexts. The study concludes that social media-based khitbah reflects the adaptability of Islamic jurisprudence to new technological realities, while also underlining the importance of ethical discipline in digital religious practices.

Abstract

Introduction: Dispute resolution through customary courts in Aceh has long been conducted by community leader (keuchik, tuha peut, and imeum meunasah) through mediation based on deliberation, consensus, and the restoration of social harmony. In the modern legal context, this living and predominantly oral mechanism faces challenges when interacting with the formal legal system, which requires written procedures, documentary evidence, and stronger institutional accountability. Purposes of the Research: This study aims to analyze how formalization and documentation transform Aceh’s customary dispute resolution system, and to explain the challenges, opportunities, and institutional model required to integrate customary mediation with the national legal framework without weakening local wisdom. Methods of the Research: The research employs an empirical juridical method with a socio-legal approach. Data were collected through literature review, observations of mediation stages and interactions in selected gampong, and in-depth interviews with experienced customary leaders, representatives of the Aceh Customary Assembly (Majelis Adat Aceh), law enforcement officials, and community members involved in customary mediation. Results of the Research: The findings reveal that Aceh has established a regulatory framework supporting customary justice through Qanun Number 9/2008, Qanun Number 10/2008, and Qanun Number 8/2019, accompanied by growing documentation practices such as written minutes and peace agreements. Formalization strengthens procedural certainty, accountability, and coordination with formal justice, but it also faces tensions arising from differences in legal culture, local customary variations, limited administrative capacity, overlapping authority, and the absence of executory legal force for customary settlements. The novelty of this study lies in formulating a flexible model of customary mediation that standardizes core procedural and documentary elements while preserving deliberation, consensus, kinship, and locally rooted sanctions as the substance of Acehnese customary justice.

Abstract

Penelitian ini mengkaji secara kritis hubungan antara hukum Islam dan hukum positif Indonesia dalam pemberian hak waris bagi anak yang lahir di luar pernikahan (anak zina), dengan fokus pada analisis Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Permasalahan utama yang diangkat adalah ketegangan normatif antara ketentuan fikih yang menafikan hubungan nasab antara anak zina dan ayah biologisnya sehingga menggugurkan hak waris dengan putusan Mahkamah Konstitusiah yang mengakui hak-hak keperdataan anak luar nikah berdasarkan pembuktian ilmiah seperti tes DNA. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode studi kepustakaan, melalui telaah terhadap putusan Mahkamah Konstitusi dan sumber-sumber fikih klasik seperti Bidayatul Mujtahid, Mausu’atul Fiqhiyyah, dan Fiqh al-Islami wa Adillatuhu, serta literatur hukum nasional dan internasional. Hasil kajian menunjukkan bahwa mayoritas ulama empat mazhab bersepakat anak zina tidak berhak mewarisi dari ayah biologisnya karena tidak adanya hubungan nasab syar’i yang sah, sementara Putusan Mahkamah Konstitusi menekankan perlindungan hak anak dan asas keadilan substantif yang melampaui bentuk formal pernikahan. Putusan tersebut dinilai sebagai upaya progresif dalam menjamin non-diskriminasi terhadap anak, namun juga memunculkan kritik karena dianggap menyentuh ranah tasyri’ ilahi dan berpotensi mengaburkan batas antara pernikahan sah dan hubungan zina. Penelitian ini menyimpulkan bahwa reformulasi hukum yang menyangkut nilai-nilai dasar syariat harus dilakukan secara hati-hati, dengan mempertimbangkan prinsip keadilan ilahiah dan maqashid al-syari’ah.
