Abstract

Corporate criminal liability has become a pivotal issue in modern criminal law, particularly in response to the increasing prevalence of crimes committed by legal entities. This article provides a comparative analysis of the corporate criminal liability systems in Indonesia and the United States, focusing on the legal foundations, models of liability, and enforcement practices. The United States adopts the principle of vicarious liability, allowing corporations to be held accountable for the acts of their employees performed within the scope of employment. In contrast, Indonesia employs a more fragmented approach through sectoral laws, without a unified criminal liability doctrine for corporations. The study reveals that while Indonesia has begun to recognize corporate liability, it still faces significant challenges in legal harmonization and effective enforcement. This comparison aims to contribute to the development of a more comprehensive and adaptive corporate criminal liability system in Indonesia, in line with international best practices.

Abstract

The rapid development of information and communication technology has brought about various innovations, one of which is artificial intelligence (AI). However, despite its benefits, AI also has the potential to be misused as a means to commit crimes, particularly digital fraud. This study aims to analyze the criminal law aspects of the use of AI as a tool for fraud crimes from the perspective of the Electronic Information and Transactions Law (UU ITE). The method used is a normative juridical approach by reviewing relevant laws and regulations, legal literature, and case studies. The results of the study indicate that although the ITE Law does not explicitly regulate the use of AI, criminal provisions in articles related to electronic fraud can be applied to perpetrators who use AI to defraud. Furthermore, there is an urgency for policymakers to formulate more comprehensive regulations to anticipate AI-based digital crimes. This study recommends the need for national legal updates that are adaptive to technological advances, as well as increasing the capacity of law enforcement officials in detecting and handling cybercrimes involving AI

Abstract

Indonesia continues to face complex political and legal challenges. The developing political dynamics are a factor that influences the implementation of legal policies based on the principles of justice and the needs of the community. Efforts to improve law enforcement are carried out by accommodating the aspirations of the community, increasing the professionalism of law enforcement officials, and legal institutions. Legal politics is an activity to monitor law enforcement to achieve the goals of the state that has been set. This research aims to discuss the role of legal politics in the formation and enforcement of law in Indonesia. This study uses secondary data, obtained from the literature of journals on legal politics. Conclusion: the implementation of legal policies is sometimes still influenced by the interests of political elites, who use their power to enforce the law. However, this can be prevented by increasing public awareness to monitor law enforcement based on Pancasila values actively.

Abstract

Pengembangan metode penelitian hukum di Indonesia telah mengalami transformasi signifikan, yang mengarah pada penggunaan pendekatan yang lebih multidisipliner dan integratif. Seiring dengan perkembangan ilmu hukum, metode penelitian hukum tidak lagi terbatas pada pendekatan normatif, melainkan mulai melibatkan berbagai aspek sosial, ekonomi, dan budaya dalam penerapan hukum. Penggunaan teori-teori baru dan teknologi informasi dalam penelitian hukum juga turut mengubah paradigma penelitian ini, menciptakan ruang bagi penelitian berbasis data dan digitalisasi. Meski demikian, tantangan seperti keterbatasan sumber daya dan ketergantungan pada pendekatan tradisional masih menjadi hambatan utama dalam meningkatkan kualitas penelitian hukum. Penelitian ini bertujuan untuk mengeksplorasi perkembangan metode penelitian hukum di Indonesia, dengan fokus pada perubahan paradigma dan pengaruh globalisasi terhadap praktik hukum di Indonesia, serta untuk memberikan rekomendasi tentang cara meningkatkan kualitas dan relevansi metode penelitian hukum yang ada. Diharapkan, penelitian ini dapat berkontribusi dalam memperkaya pemahaman dan aplikasi hukum yang lebih efektif dan adaptif terhadap kebutuhan masyarakat Indonesia yang dinamis.
