Abstract

ABSTRAKArtikel ini mengkaji hubungan antara politik hukum dan kesehatanmasyarakat di Indonesia, dengan fokus pada dampak kebijakan hukum terhadapsistem kesehatan nasional. Penelitian ini menggunakan pendekatan yuridis normatifdan empiris untuk menganalisis berbagai kebijakan kesehatan dan implementasinyadalam konteks Indonesia.Hasil penelitian menunjukkan bahwa politik hukum memiliki pengaruhsignifikan terhadap kesehatan masyarakat Indonesia. Berbagai produk hukum telahdihasilkan untuk mengatur sistem kesehatan nasional, namun implementasinyamasih menghadapi berbagai tantangan, seperti kesenjangan infrastruktur kesehatan,keterbatasan anggaran, dan koordinasi antar lembaga yang belum optimal.Upaya reformasi kebijakan kesehatan yang disarankan mencakup penguatansistem kesehatan primer, peningkatan anggaran kesehatan, pemerataan fasilitaskesehatan, dan pengembangan sumber daya manusia kesehatan. Keberhasilanimplementasi kebijakan kesehatan juga bergantung pada koordinasi antarpemangku kepentingan, konsistensi implementasi, dukungan anggaran yangmemadai, serta monitoring dan evaluasi berkelanjutan.Kata Kunci: Politik hukum, kesehatan masyarakat, kebijakan kesehatan,Indonesia, sistem kesehatan nasional

Abstract

The crime of maltreatment is a deliberate act that causes injury, pain or even death to a person. However, efforts to resolve minor persecution crimes can be done through Restorative Justice. Restorative Justice can be done through mediation of victims of persecution. This research formulates the problem of knowing how the legal arrangements by the Prosecutor's Office on Restorative Justice and knowing how the efforts and obstacles to overcoming persecution crimes based on Restorative Justice by the North Padang Lawas State Attorney's Office. This research method is through empirical juridical research with field studies at the North Padang Lawas State Attorney's Office related to countermeasures against criminal acts of persecution based on Restorative Justice. The data collection technique used by the author in this research is Field Research, which includes data sourced from interviews with the Public Prosecutor at the North Padang Lawas State Attorney's Office. Data analysis used in this research is qualitative analysis. The process of applying Restorative Justice in the crime of persecution in the North Padang Lawas District Attorney's Office is carried out by means of the Public Prosecutor offering peace efforts to the victim and suspect. Based on cases that meet the criteria for Restorative Justice, the State Attorney's Office will write to the High Prosecutor's Office and the Deputy Attorney General's Office for General Crimes to seek approval for Restorative Justice. The North Padang Lawas District Attorney's Office prioritizes peace between victims and perpetrators in resolving cases of light maltreatment by involving the families of both parties, such as community leaders, without any pressure, coercion, or intimidation from the Public Prosecutor who acts as a facilitator.

Abstract

Corporate criminal liability has become a pivotal issue in modern criminal law, particularly in response to the increasing prevalence of crimes committed by legal entities. This article provides a comparative analysis of the corporate criminal liability systems in Indonesia and the United States, focusing on the legal foundations, models of liability, and enforcement practices. The United States adopts the principle of vicarious liability, allowing corporations to be held accountable for the acts of their employees performed within the scope of employment. In contrast, Indonesia employs a more fragmented approach through sectoral laws, without a unified criminal liability doctrine for corporations. The study reveals that while Indonesia has begun to recognize corporate liability, it still faces significant challenges in legal harmonization and effective enforcement. This comparison aims to contribute to the development of a more comprehensive and adaptive corporate criminal liability system in Indonesia, in line with international best practices.

Abstract

Corruption is an unlawful act to enrich or obtain one-sided benefits, corruption has rules that have specific characteristics, both regarding formal (procedural) and material (substance) criminal law, law enforcement of corruption in Indonesia depends on the Criminal Justice System itself, from investigation then prosecution, and examination in court and the implementation of the punishment. The formulation of the problem in this study is how the pattern of law enforcement against corruption in the perspective of criminal law in Indonesia, and how efforts and criticism of the eradication of corruption in Indonesia. This research method is descriptive and normative juridical approach, with legal materials as secondary data. relating to law enforcement against criminal acts of corruption in the Indonesian criminal justice system. the criminal justice system in Indonesia is not yet competent in handling criminal acts of corruption because instead of subsidizing, corruption cases in Indonesia are increasing. this is because the four criminal justice systems in Indonesia lack coordination and supervision, and the sanctions given are still considered not optimal so that they have not caused a deterrent effect on the perpetrators and the effect of public satisfaction.
