Abstract

The Papuan People’s Assembly (MRP) has the constitutional authority to provide input in the selection of regional leaders as a means of protecting the rights of the indigenous Papuan people (OAP). However, the implementation of this authority poses a unique challenge in regions with Muslim minorities, which are characterized by religious and ethnic pluralism as well as local political dynamics. This study aims to analyze the role of the MRP in the election of regional leaders through the perspective of maqāṣid al-syarī‘ah as an inclusive ethical framework for public policy. This study employs a qualitative approach with a literature review design and descriptive analysis of legal texts, legal literature, political literature, and contemporary concepts of maqāṣid. The research findings indicate that the principles of maqāṣid, particularly the protection of life, mind, and the public welfare, are relevant for evaluating the ethical considerations of the MRP without turning it into an instrument of religious exclusivism. The contribution of this study lies in the development of maqāṣid al-syarī‘ah as an interfaith ethical framework in regional leadership governance and the strengthening of the MRP’s normative legitimacy within the context of Papuan pluralism. This study concludes that the maqāṣid approach is capable of bridging Papuan customary values and democratic principles to promote justice, inclusivity, and social harmony.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi metode penetapan hukum secara lafdziyah dan maknawiyah serta implementasinya terhadap larangan khamar. Penelitian ini merupakan penelitian pustaka dengan pendekatan hukum Islam dan pengumpulan data melalui studi literatur yang relevan. Hasil penelitian menunjukkan bahwa metode lafdziyah dan maknawiyah keduanya sangat penting untuk menetapkan hukum Islam. Metode lafdziyah adalah cara terpenting untuk memahami hukum yang terkandung dalam suatu dalil karena memahami maksud ayat langsung dapat dicapai dengan hanya melihat teksnya. Metode maknawiyah menginterpretasikan dalil berdasarkan konteks, situasi, dan kondisi ketika muncul (azbabun nuzul). Metode ini dapat dipelajari melalui kajian historis, sosiologis, antropologis, atau bahkan psikologis. Dalam penetapan hukum Islam, metode maknawiyah digunakan baik melalui kiyas, maslahat mursalah, atau "urf." Oleh karena itu, pemahaman maknawiyah dapat merespon perubahan dan menjawab masalah hukum Islam di masa kini. Dalam memahami hukum Islam yang lebih responsif, metode lafdziyah perlu dibarengi dengan metode maknawiyah sebagai upaya ijtihad terhadap masalah-masalah hukum yang kompleks dan situasional. Implementasinya pada larangan khamar yaitu dilakukan melalui pemahaman secara lafdziyah bahwa khamar dan sejenisnya sudah mutlak diharamkan meskipun tidak dilakukan penafsiran secara maknawiyah.

Abstract

The flexibility of Islamic law in responding to the dynamics of social life can be achieved through the concept of ‘urf, or customary practice. This study aims to analyze the continuity of Islamic law and community culture regarding the implementation of the principle of al-‘adah al-muhakkamah in relation to the philosophy of Siri’ na Pace, which represents the local wisdom of the Bugis-Makassar people in South Sulawesi. This research is a literature review employing a qualitative method with normative and sociological approaches. Data analysis was conducted using descriptive qualitative methods by integrating normative Islamic legal texts with the values alive in society (Siri’ na Pacce). The results indicate that the principle of al-‘adah al-muhakkamah remains a robust method for formulating Islamic law responsive to societal dynamics, provided that such cultural practices do not conflict with Islamic sharia. Its implementation within the philosophy of Siri’ na Pacce (a sense of shame and empathy), deeply rooted in Bugis-Makassar society, extends beyond mere values; it serves as a guiding principle for life that prioritizes honesty, responsibility, and social solidarity. This philosophy can be harmonized with Islamic law as a foundation for resolving issues such as silariang or passampo siri’ cases, provided that the values it contains align with the principles of maqashid al-shari’ah. This study concludes that the synergy between Islamic law and local wisdom, through the principle of al-‘adah al-muhakkamah, can establish a legal framework that is dynamic, responsive, fair, and grounded in local wisdom.
