Abstract

Penelitian ini menganalisis pembaruan hukum pidana di bidang kesehatan di Indonesia dengan fokus pada tantangan hukum dan urgensi reformasi regulasi yang lebih responsif dan humanis. Menggunakan pendekatan kualitatif dengan metode studi kepustakaan, penelitian ini menelaah regulasi yang berlaku, putusan pengadilan, serta studi kasus terkait malpraktik medis, peredaran obat palsu, dan pelanggaran hak pasien. Hasil penelitian menunjukkan bahwa sistem hukum saat ini masih menghadapi berbagai kendala, termasuk kriminalisasi berlebihan terhadap tenaga medis, lemahnya sanksi terhadap pelaku kejahatan farmasi, serta ketidaksesuaian regulasi dengan perkembangan teknologi medis. Dengan menggunakan analisis yuridis-normatif, penelitian ini mengidentifikasi kesenjangan dalam hukum pidana kesehatan dan merekomendasikan reformasi berbasis pendekatan yang lebih adaptif dan harmonisasi dengan standar internasional. Kesimpulan dari penelitian ini menegaskan pentingnya regulasi yang lebih efektif dan adil untuk melindungi masyarakat serta memberikan kepastian hukum bagi tenaga medis.

Abstract

This research employs a normative legal approach to critically analyze Indonesia's drug law enforcement, emphasizing the urgent need for rehabilitation over punitive measures for drug users. By examining existing legal frameworks and international conventions, the study highlights the misclassification of drug users as criminals rather than victims in need of support. The findings reveal that current policies disproportionately penalize users, often neglecting their human rights and the potential for rehabilitation. The research advocates for a paradigm shift in Indonesia's drug policy, proposing a balanced legal approach that prioritizes medical and social treatment for addicts. It underscores the importance of integrating rehabilitation into the legal framework, ensuring that drug users receive appropriate care rather than harsh penalties. This approach not only aligns with global standards but also addresses the growing prevalence of drug abuse in Indonesia. Ultimately, the study aims to influence policymakers to adopt more humane and effective strategies that protect the rights of drug users while combating drug-related crimes. By fostering a legal environment that supports rehabilitation, Indonesia can better address the complexities of drug abuse and promote public health.

Abstract

The most significant influence on the development of Indonesian law is legal philosophy. The term "Pancasila" refers to the entirety of regulations and laws, beginning with our constitution. All regulations that are not based on our constitution must establish Pancasila as the basis and foundation of the law. Indonesia's legal framework is known as Pancasila. Consequently, Pancasila is recognized as both a philosophy and a written law in Indonesia that encompasses living law. The issue is the extent to which legal philosophy influences the development of the legal system in Indonesia. Certainly, it is crucial to address this issue. The legal method was implemented by the authors to evaluate this issue with normative law. The authors' methodology was derived from numerous books that address comparable issues. The results of this research show that Legal philosophy is a critical component of Indonesian law, serving as both a guide for its development and a necessity. Legal philosophy contributes to the elucidation of the philosophical foundation of legal values, capable of achieving the ideals of justice and order in society in accordance with the reality of the applicable law

Abstract

 Copyright on songs is one component of intellectual property rights that is philosophically based on the theory of naturalism and the theory of interests. However, in the Indonesian context, it also needs to be understood through the Marhaenism approach which emphasizes social justice. The National Collective Management Institution which was established based on Government Regulation Number 56 of 2021 and Law Number 28 of 2014 is tasked with managing copyright licenses. However, its existence raises various problems, including the potential for monopoly, lack of transparency, and limited access for independent music creators. The purpose of this study is to determine how copyright regulations are implemented in Indonesia. Using normative legal methods and secondary data, this study proposes a hybrid licensing model that will reform the copyright licensing system in Indonesia by implementing a progressive and responsive legal approach. This model will allow creators to choose between collective licenses and individual licenses based on digital technology. This reform is expected to realize distributive justice, more adaptive legal protection, and respect for the moral and economic rights of creators in a balanced manner

Abstract

Pasien sering kali percaya bahwa penyakit yang dideritanya disebabkan oleh kelalaian tenaga medis dalam menjalankan tugasnya. Media massa, baik elektronik maupun cetak, semakin gencar menyoroti isu ini, sehingga penting untuk memastikan adanya persetujuan yang diberikan secara sadar. Teori kepastian hukum dalam persetujuan yang diberikan secara sadar memastikan bahwa tindakan medis yang dilakukan dengan persetujuan pasien didasarkan pada kerangka hukum yang jelas dan sah, sehingga memberikan perlindungan hukum bagi tenaga kesehatan. Persetujuan yang sah untuk tindakan medis harus memenuhi kriteria tertentu, termasuk penyediaan informasi yang lengkap dan benar, serta memastikan bahwa pasien mampu memberikan persetujuan. Kepastian hukum ini memungkinkan tenaga medis untuk melakukan tindakan medis dengan lebih aman dan percaya diri, karena mereka menyadari bahwa tindakan mereka didukung oleh dukungan hukum. Metode penelitian hukum normatif menggunakan pendekatan undang-undang dan pendekatan konseptual untuk kerangka penelitiannya. Hasil penelitian menunjukkan bahwa sebelum menerapkan tindakan untuk pasien, penting untuk menetapkan peraturan perundang-undangan yang memberikan perlindungan hukum yang jelas bagi tenaga kesehatan, sebagaimana yang dituangkan dalam Undang-Undang Nomor 36 Tahun 2014. Kewajiban ini tertuang dalam Pasal 1320 Kitab Undang-Undang Hukum Perdata, yang hingga kini belum sepenuhnya terlaksana sesuai dengan Undang-Undang. Persetujuan tindakan medis berfungsi untuk memberikan kepastian hukum kepada tenaga medis dalam melakukan tindakan medis terhadap pasien. Persetujuan tindakan medis juga berfungsi sebagai tindakan perlindungan terhadap tuntutan atau gugatan dari pasien atau keluarga pasien apabila tindakan medis yang dilakukan tidak memberikan hasil yang diharapkan.

Abstract

  This study analyzes the implementation of Government Regulation (PP) No. 28 of 2024 regarding the provision of contraceptives for students and adolescents, based on the perspective of medical personnel. As a derivative of Law No. 17 of 2023 Article 103 Paragraph 4, the regulation aims to protect adolescent reproductive health and reduce early pregnancy and sexually transmitted infections. This research used a normative juridical method and empirical approach through interviews with health professionals and legal experts, this study finds several key challenges. The result of this study is the implementation of Government Regulation No. 28 of 2024 concerning the provision of contraceptives for adolescents emphasizes the role of medical personnel in providing accurate and easy-to-understand reproductive health education. These include the absence of clear technical guidelines, lack of training for medical personnel in delivering reproductive health education, and resistance from communities due to perceived conflicts with moral and cultural values. Furthermore, the policy risks clashing with higher legal norms, such as the Marriage Law No. 1 of 1974 in conjunction with Law No. 16 of 2019, as it may be interpreted as encouraging premarital sexual activity. To overcome these challenges, the study recommends regulatory harmonization, improved coordination among stakeholders, and inclusive education strategies. Without such efforts, the policy’s effectiveness in achieving its goals remains uncertain.

Abstract

This research discusses the practice of covert sexual exploitation or white collar pimping perpetrated by certain individuals in Human Resource Development (HRD) against female doctors in remote areas. Using methods such as grooming, pseudo-mentoring, conditioning private meetings, and non-clinical requests, female doctors are manipulated into situations of unequal power. This study employs a qualitative-descriptive approach and normative legal analysis. It was found that HRD's involvement in facilitating unethical relationships between doctors and organizational leaders constitutes a violation of civil law and professional ethics. This article also examines the legal consequences for organizational leaders and other employees involved. These findings underscore the urgency of establishing an independent reporting system and organizational policies that protect female medical personnel in remote areas.

Abstract

Government Regulation Number 28 of 2024 focuses on aligning health policies with consumer protection in the digital era, especially in the context of telemedicine. This study analyzes the urgency of this regulation amidst the development of information technology that has changed the delivery of health services. Telemedicine offers easy access, especially in remote areas, but is also faced with challenges related to service quality, data security, and protection of consumer rights. With a normative legal approach, this study evaluates the norms in the PP and their impact on digital health practices. The results show that technological infrastructure, health worker competence, and clear regulations are very important to ensure the effectiveness of telemedicine. In addition, personal data protection is a crucial issue that needs to be regulated to maintain consumer trust. Challenges in the consistency of service standards and digital literacy of the community were also identified. Therefore, collaboration between the government, health service providers, and the community is needed to build an efficient and effective telemedicine ecosystem, which in turn can improve the quality of health services in Indonesia. This study is expected to contribute to the development of relevant and comprehensive policies in the field of digital health.

Abstract

Overcrowding at the Class IIA Banceuy Prison has resulted in serious violations of inmates’ human rights, including the rights to health, security, and a decent standard of living. This study aims to analyze the effectiveness of human rights-based correctional policies, such as assimilation programs, parole, and restorative justice, in responding to the impacts of overcrowding. Using a normative juridical approach and field data through observation and interviews, the study results indicate that these policies have had a positive impact, but their implementation remains hampered by complex administrative procedures, limited facilities, and a shortage of teachers and supervisors. Skills training programs have proven beneficial, but access remains limited. Collaboration with NGOs has helped provide counseling and health services, although they are not evenly distributed. This study recommends simplifying administrative procedures, increasing the budget for basic facilities, and expanding cross-sectoral collaboration, including with the business world and educational institutions. Furthermore, reform of penal policy through decriminalization and the widespread implementation of restorative justice is considered crucial to reducing the burden on prisons. The implications of this research underscore the need for a more humane, inclusive, and rights-oriented correctional approach to prisoners.

Abstract

The phenomenon of bullying against participants in the Medical Specialist Education Program within teaching hospital environments highlights structural inequalities and legal gaps in Indonesia’s advanced medical education system. This study aims to analyze legal issues concerning the protection of professional education for specialist Doctor participants from psychological violence and bullying, while proposing an ideal regulatory reformulation to safeguard their rights. Employing normative legal research methods with legislative, doctrinal, and responsive legal theory approaches, the study reveals that existing regulations such as Law Number. 20 of 2013 on Medical Education fail to provide explicit protections for professional education for specialist Doctor participants. Meanwhile, the Minister of Health’s Instructions remain merely administrative and lack legally binding force. Regulatory reform should clearly define professional education for specialist Doctor participants’ status within the national education system, specify the rights and obligations of program organizers and participants, establish an independent anti-bullying task force, and implement monitoring mechanisms and administrative sanctions. A victim-oriented, responsive regulatory framework would not only protect trainees’ rights but also enhance the quality of medical education and national healthcare services. The state must act promptly through progressive legislation to eradicate bullying practices and ensure a fair, humane educational environment for professional education for specialist Doctor participants.
