Abstract

This study aims to analyze two main things: (1) the consistency of the Constitutional Court in deciding cases as reflected in the Constitutional Court Decision Number 29/PUU-XXI/2023, Constitutional Court Decision Number 51/PUU-XXI/2023, Constitutional Court Decision Number 55/PUU-XXI/2023, and Constitutional Court Decision Number 90/PUU-XXI/2023. (2) the legal consequences arising from the Constitutional Court Decision Number 90/PUU-XXI/2023.This study uses a normative legal method with a library research approach, which focuses on the study of the decisions of the Constitutional Court which are the objects of research. In addition, this study also examines various secondary legal sources such as books and scientific journals that are relevant to the topic. The results of the study show that: (1) The Constitutional Court rejected the application in Decisions Number 29, 51, and 55/PUU-XXI/2023 on the grounds that the case was part of an open legal policy. However, in Decision Number 90/PUU-XXI/2023, the Court granted part of the application on the grounds that there was an intolerable injustice, so that the principle of open legal policy was set aside. The difference in approach in these decisions reflects the inconsistency in the considerations of the Constitutional Court. (2) The legal consequences of Decision Number 90/PUU-XXI/2023 are final and binding, which requires a revision of the law by the DPR and the President as well as adjustments to regulations through the General Election Commission Regulation (PKPU). However, considering the principle of non-retroactivity in constitutional law and the complexity of the legislative process, this decision cannot be applied in the 2024 Election and will only apply in the 2029 Election.

Abstract

Penerapan Kurikulum Merdeka di SMA Negeri 9 Takalar. Penelitian ini bertujuan untuk mengetahui: (1)  Perencanaan pembelajaran kurikulum merdeka di SMA Negeri 9 Takalar (2) pelaksanaan pembelajaran Kurikulum Merdeka di SMA Negeri 9 Takalar (3) faktor pendukung dan penghambat dalam penerapan Kurikulum Merdeka di SMA Negeri 9 Takalar. Jenis penelitian ini adalah pendekatan deskriptif kualitatif dengan teknik pengumpulan data melalui observasi, wawancara dan dokumentasi. Penelitian ini menggunakan teknik pengecekan keabsahan data uji kredibilitas dengan trianglasi sumber, teknik, dan waktu. Hasil penelitian menunjukkan bahwa: (1) Perencanaan pembelajaran Kurikulum Merdeka di SMA Negeri 9 Takalar menunjukkan adanya komitmen dan kesiapan sekolah dalam menerapkan Kurikulum Merdeka. Hal ini dilihat dari proses perencanaan secara sistematis mulai dari pelatihan, pembuatan perangkat ajar, menyusun strategi dan metode pembelajaran, serta alat dan sumber belajar yang mendukung dalam pelaksanaan (2) Pelaksanaan pembelajaran Kurikulum Merdeka di SMA Negeri 9 Takalar sudah berjalan sesuai dengan prinsip kurikulum merdeka yaitu fleksibel dan berfokus pada muatan esensial (3) beberapa faktor yang menjadi pendukung dan penghambat dalam penerapan kurikulum merdeka, yaitu pendukung adanya komitmen guru dan kepala sekolah serta adanya kegiatan pelatihan. Penghambat beberapa guru belum memahami dengan baik mengenai Kurikulum Merdeka dan keterbatasan sarana dan prasarana penunjang pelaksanaan Kurikulum Merdeka.

Abstract

The purpose of this study is to examine the role of online game players in building intercultural tolerance through interactions in cyberspace. This study uses a qualitative approach with a phenomenological study type to explore the experiences of online game players in cross-cultural interactions. The research subjects consisted of seven players selected through purposive sampling, using snowball sampling until the data was saturated. Data collection techniques were through semi-structured interviews and participant observation, then data analysis used the interactive model of Miles and Huberman through the stages of reduction, presentation, and drawing conclusions. Data validity was ensured through triangulation of sources and methods, accompanied by member checking with participants. The results of the analysis show four main findings: (1) online games act as a means of social interaction as well as entertainment, (2) cross-cultural communication is a factor that can strengthen and hinder relationships, (3) the practice of tolerance is reflected in the ability to manage emotions, compromise, act as a mediator, and use humor, and (4) educational values are apparent in the form of increased language skills, empathy, patience, and appreciation for diversity. Although verbal and strategic conflicts often arise, the emerging resolution patterns show that digital space has strong potential as a medium for learning tolerance and cross-cultural collaboration.

Abstract

This study aims to analyze the innovation and creativity of traditional cobekan and tombstone business owners in Tampung Cinae, Barru Regency. This study uses a qualitative approach with a case study design. The research subject only involved one informant, namely the business owner named Hariswan, who was determined through purposive sampling techniques. Data collection techniques through semi-structured interviews and participatory observation in the field. Data analysis was conducted using the Miles & Huberman interactive model with source triangulation and member checking techniques to ensure the validity of the findings. The results of the study indicate four main themes: (1) Background and Development of the Business, which reflects motivation and changes in the production process from manual to the use of modern tools; (2) Innovation and Product Development, in the form of incremental innovation through the use of tools such as grinders and excavators; (3) Product Creativity, seen from the variety of designs, colors, and motifs that follow market tastes; and (4) Business Risks and Challenges, including constraints of weather, raw materials, and work tools that are overcome with adaptive strategies. These findings confirm that traditional business innovation is based on local cultural experiences and values and has important implications for the empowerment of rural MSMEs.
