Abstract

Pembaharuan hukum agraria itu hanya akan berhasil, apabila hukum agraria itu mengutamakan petani sebagai pilar utama pembangunan ekonomi nasional, dengan tidak mengabaikan kepentingan investor-investor dan pemodal-pemodal besar sebagai salah satu sumber pembiayaan pembangunan. Dalam menindak lanjuti politik pembaharuan hukum Agraria yang diatur dalam UUPA pemerintah telah mengeluarkan ketetapan yang dituangkan dalam Ketetapan MPR Nomor: IX/MPR/2001 tentang Pembaharuan Agraria dan Pengelolaan Sumber Daya Alam. Untuk mengatasi permasalahan-permasalahan yang nantinya akan menghambat pelaksanaan pembaharuan hukum agraria di Indonesia maka Pancasila dan UUD 1945 harus dijadikan landasan idiil dan landasan kosntitusional dalam setiap perbuatan hukum yang dilakukan oleh Negara, artinya peraturan atau kebijakan yang dikeluarkan dalam rangka pelaksanan pembaharuan hukum agraria harus didasarkan pada Pancasila dan UUD 1945. Tujuan landreform yang diselenggarakan di Indonesia secara khusus adalah untuk mempertinggi penghasilan dana taraf hidup petani penggarap, sebagai landasan dan prasyarat untuk menyelenggarakan pembangunan ekonomi menuju masyarakat yang adil dan makmur berdasarkan Pancasila. Untuk mencapai tujuan tersebut dilakukan dengan mengadakan pembagian yang adil atas sumber kehidupan atas rakyat tani berupa tanah dan pembagian hasil yang adil pula melaksanakan prinsip tanah untuk tani dan perlindungan terhadap ekonomi lemah.

Abstract

Implementasi program redistribusi bekas tanah perkebunan dilakukan dengan cara mediasi. Kemudian  pada tahun 2011dikeluarkanlah Surat Keputusan  Landreform dan Surat Keputusan Konsolidasi Tanah (land Consolidation) dimana SK Landreform berisi tentang jumlah luas tanah yang diredistribusi adalah 280 ha dan meminta untuk dikeluarkan Surat Keputusan  Redistribusi tanah tersebut, sedangkan SK Konsolidasi diputuskan dengan luas 25 ha. Kebijakan program redistribusi tanah adalah bagian dari reforma agraria dimana reforma agraria tidak hanya dipahami sebagai kebijakan untuk redistribusi tanah, yang disebut dengan asset reform, tetapi juga sebagai proses yang lebih luas seperti akses ke sumber dayaalam, keuangan/modal, teknologi, pasar, barang dan tenaga kerja, dan juga distribusi kekuatan politik atau disebut dengan acces reform.

Abstract

AbstrakDisahkannya PP Nomor 8 Tahun 2021 sebagai peraturan pelaksanaan UU Nomor 11 Tahun 2020 tentang Cipta Kerja yang melahirkan Perseroan Terbatas Usaha Mikro dan  Kecil sebagai etintas baru dalam dunia usaha di Indonesia, telah menunjukkan keseriusan Pemerintah Indonesia mendukung dan memberikan peluang sebesar-besarnya kepada Usaha Mikro dan Kecil untuk mengembangkan usahanya dan memberikan perlindungan hukum kepada badan hukum perorangan. Perseroan Terbatas Usaha Mikro dan Kecil dalam proses pendiriannya dapat dilakukan tanpa melalui perjanjian dan akta notaris dan hanya membuat surat pernyataan. Pendirian Perseroan Terbatas hanya melalui surat pernyataan tidak menjamin legalitas dokumen dan identitas pendiri. Legalitas Perseroan Terbatas akan diragukan dan beresiko karena bisa melakukan perbuatan melawan hukum, dan  konsekuensinya Perseroan Terbatas  sebagai badan hukum maka legalitas dokumen dan identitas pendiri harus dapat dipertanggungjawabkan. Sehingga dalam menjamin kepastian hukum dan perlindungan hukum, akta pendirian Pereroan Terbatas yang dibuat oleh Notaris tetap diperlukan untuk menjamin legalitas Perseroan Terbatas, keabsahan dokumen dan identitas pendiri walaupun hanya Perseroan Terbatas untuk Usaha Mikro Kecil.Kata Kunci: PT Perorangan, Usaha Mikro dan Kecil, Kepastian Hukum AbstractThe passing of Government Regulation Number 8 of 2021 as the implementing regulation of Law Number 11 of 2020 concerning Job Creation which gave birth to PT Micro and Small Enterprises as a new ethic in the business world in Indonesia, has shown the seriousness of the Indonesian Government to support and provide the greatest possible opportunity for Micro and Small Enterprises to develop their business and provide legal protection to individual legal entities. In the process of establishing a Limited Liability Company, Micro and Small Enterprises can be carried out without going through a notarial agreement and deed and only making a statement letter. The establishment of a Limited Liability Company only through a statement letter does not guarantee the legality of the documents and the identity of the founder. The legality of a Limited  Company will be doubted and at risk because it can commit acts against the law, and the consequence is that the Limited Company is a legal entity, the document legality and identity of the founder must be accounted for. So that in guaranteeing legal certainty and legal protection, a Limited Liability Company establishment deed made by a notary is still needed to guarantee the legality of the limited Company, document validity and the identity of the founder even though it is only Limited Liability Companies for Micro and Small Businesses.Keywords: Individual Limited  Companies, Micro and Small Enterprises, Legal Certainty

Abstract

ABSTRACT Problems faced by the government in the implementation of development include the issue of providing land for development itself, including the acquisition of land for toll road construction. because state land which is directly controlled by the state is limited or can be said to be almost nothing anymore. To acquire land for toll road development by the government by freeing people's land, both controlled by customary law, and other rights attached to it. In implementing Law Number 2 of 2012 as a juridical basis, the government carrying out land acquisition for toll road construction often creates problems both juridical and empirical.The legal concept of land acquisition for toll road development in the perspective of the right to control the state, must be returned to the nature of the public interest and the nature of the state's right to control for the greatest prosperity of the people by continuing to create development based on humanitarian principles, meaning that it must continue to prioritize and pay attention to private rights which constitute constitutional rights of the people. Keywords: Land Procurement, toll road construction   ABSTRAK Permasalahan yang dihadapi oleh pemerintah dalam pelaksanaan pembangunan diantaranya adalah masalah penyediaan tanah untuk pembangunan itu sendiri, termasuk pengadaan tanah untuk pembangunan jalan tol.  karena tanah negara yang dikuasai langsung oleh negara terbatas atau dapat dikatakan hampir tidak ada lagi. Untuk memperoleh tanah untuk pembangunan jalan tol oleh pemerintah dengan membebaskan tanah milik rakyat, baik yang dikuasai oleh hukum adat, maupun hak-hak lainnya yang melekat diatasnya. Dalam implementasinya Undang-Undang Nomor 2 Tahun 2012 sebagai landasan yuridis pemerintah melaksanakan pengadaan tanah untuk pembangunan jalan tol  sering menimbulkan permasalahan baik secara yuridis maupun empiris.Konsep hukum pengadaan tanah untuk pembangunan jalan tol dalam perspektif hak menguasai negara, harus dikembalikan pada hakekat kepentingan umum dan hakekat hak menguasai negara yaitu untuk sebesar-besar kemakmuran rakyat dengan tetap menciptakan pembangunan yang berlandaskan asas kemanusiaan artinya harus tetap  memprioritaskan dan memperhatikan hak privat yang merupakan hak konstitusional rakyat. Kata Kunci: Pengadaan Tanah, pembangunan jalan tol

Abstract

ABSTRACTLocal Government Act No. 23/2014 has established significant regulation changes by eliminating the majority of government’s affair authority in the field of energy and mineral resources including the authority to give Mining Business Permit that had been authorized by provincial local government, as regulated in Article (1) Section (3). The contradiction between Mineral and Coal Mining Act No.9/2009 and Local Government Act No. 23/2014 shows the horizontal disharmony that disputes between regulations in the same hierarchical level. This contradicting regulation in Mineral and Coal Mining Act No.9/2009 and Local Government Act No. 23/2014 is the inconsistency of regulation substance, which is the regulation that is hierarchically in the same level with one regulation more general than the other.  Keyword:  Mining Business Permit, inconsistencyABSTRAKUndang-undang Nomor 23 Tahun 2014 telah mengatur beberapa perubahan yang cukup mendasar yaitu dihapuskannya sebagian besar urusan pemerintahan di bidang energi dan sumber daya mineral termasuk pemberian ijin usaha pertambangan yang sekarang diserahkan pemerintah daerah propinsi sebagaimana diatur dalam pasal 14 ayat (1) dan (3). Inkonsistensi  antara Undang-undang  Nomor 9 Tahun 2009 tentang Pertambangan Mineral dan Batubara dan Undang-Undang Nomor 23 Tahun 2014 adalah disharmoni horizontal yaitu pertentangan antara peraturan perundang-undangan yang sederajat dalam hierarki. Abstract

Land is an important part of life in society. The occurrence of land problems that exist in the community is usually only done by litigation in handling the dispute process. This study aims to identify and analyze the development of land rights law. The development of the science of land rights law is related to the effectiveness of mediation in resolving land rights disputes to obtain a comprehensive picture of alternative dispute resolution. This type of research is a juridical-empirical research. Empirical juridical research is research on secondary data in the form of applicable legal aspects, then proceeds to primary data research in the form of research on real phenomena that occur in the field. The results of this study show that several cases related to land disputes have been successfully resolved by alternative land dispute resolution outside the trial, especially with mediation. Based on the research that has been done, it can be concluded that the effectiveness of mediation in alternative settlement of complete systematic land registration disputes (PTSL) in the village of Pengkoljagong, Jati District, Blora Regency, is very effective.

Abstract

Land is a basic human need that becomes a strategic capital for life. Today, Indonesia has a lot of agendas with agrarian reform. The question of land will never end. With the pattern of land acquisition for development in the public interest along with other land problems, a new body was presented. This body is known as the Land Bank. Land Bank is a special agency (sui generis) which is an Indonesian legal entity established by the central government that is given special authority to manage land. The purpose of the land bank is to create a just economy. As a country of law, there are legals that binding on the subject of land banks. Which legal hierarchy about the land bank. Then this land bank is a new one in Indonesia. Certainly a lot to learn and evaluate the performance of the Land bank agency. The new land bank was established in 2021. Therefore, it is felt to help manage the land bank of Indonesia by making comparisons with other countries, namely the United States. Then the formulation of the problem to be discussed is : (1) How is the arrangement of the establishment of land bank in Indonesia? (2) What are the similarities and differences between land banks in Indonesia and the United States?. Research methods in writing this thesis using the type of normative juridical research, meaning that the problems raised, discussed and described in this study focused on applying the rules or norms in positive law. Approach the problem using the legal approach, conceptual approach, comparative approach to legal materials consisting of primary legal materials, secondary and non-legal materials. The results of this thesis research, first, the regulation of land banks in Indonesia is regulated in the Constitution of Republic Indonesia 1945, UUPA, land procurement law for development for the public interest, job creation law, Government Regulation Number 64 of 2021 on Land Bank, Presidential Regulation Number 113 of 2021 on the structure and Organization of Land Bank. Second, the comparison between land banks in Indonesia and the United States certainly has similarities and differences. The equation is in terms of centralized regulation and the location of the land bank. Differences with the United States lie in regulations, types of land banks, parties to land banks, mechanisms for organizing land banks, and objectives.This study aims and the formulation of the problem is to find out and analyze the Implementation of Complete Systematic Land Registration (PTSL) in Payaman Village, Plemahan District, Kediri Regency, and to find out and analyze the Matters Affecting the Issuance of Multiple Certificates in PTSL in Payaman Village, Plemahan District, Kediri Regency, as well as to find out and analyze the legal consequences and forms of settlement of dual certificates as a result of complete systematic land registration in Payaman Village, Plemahan District, Kediri Regency. This legal research is an empirical legal research. data that Obtained, namely direct research in the field, namely through interviews, then processed and analyzed with descriptive methods using primary data and secondary data. The results of the research on the Implementation of Complete Systematic Land Registration (PTSL) in Payaman Village, Plemahan District, Kediri Regency were carried out through several stages, namely: Preparation, Counseling, Physical Data Collection, Determination of Land Sector, Implementation of Measurements, Measuring Drawings and Mapping of Land Sector, Collection of Juridical Data, Land Inspection, Announcement and Determination of Rights, Bookkeeping of Rights, Issuance and Submission of Certificates. Matters Influencing the Issuance of Multiple Certificates in PTSL in Payaman Village, Plemahan District, Kediri Regency. according to the author there are several factors or reasons for the occurrence of multiple certificates in the implementation of PTSL in Payaman Village, Palemahan District, Kediri Regency, namely: a) Double printed certificates when correcting NIB validation when the SU form is ready, b) Registration of village letter C using letter C of the land next to it c) When the measurement does not participate in witnessing and determining the boundaries of the land it owns, it only depends on the sub-district head who does not know the boundaries, d) Village officials or village officials participate in registering their siblings to become PTSL participants without any authorization from the applicant, e) The applicant hides that the original certificate is brought by his brother on the grounds that a certificate has not been issued which is assisted by village officials. Legal Consequences and Forms of Completion of Multiple Certificates As a result of Complete Systematic Land Registration in Payaman Village, Plemahan District, Kediri Regency resulted in the following: Causing legal uncertainty regarding the certificates they owned. Keywords: Dual Certificate, Village, PTSL.

Abstract

Abstract :  Entering the digital era in today's technological developments, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency, hereinafter referred to as ATR/BPN, has launched electronic land services. The electronic service in question concerns digital or electronic mortgage services. This was marked by the publication of Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 9 of 2019 concerning Electronic Integrated Mortgage Rights services, hereinafter referred to as Minister of Atr/Bpn Regulation No. 9 of 2019. And revoked and replaced with Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronic Integrated Mortgage ServicesProblem formulation 1) How to implement the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronically Integrated Mortgage Rights Services at the Blitar City Land Office. 2) What are the obstacles in managing mortgage rights (Ht-El) for individuals who are not financial institutions at the Blitar City Land Office. 3) What steps are taken by the Blitar City Land Agency to resolve these obstacles. The method in this research is empirical research with a sociological and legislative approach with data collection techniques using document studies, interviews.Results of research on the implementation of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronically Integrated Mortgage Rights Services at the Blitar City Land Office. At first it didn't work well because it was a new product that had been implemented at the Blitar City Land Office, in other words it didn't work effectively. What are the Obstacles in Managing Mortgage Rights (Ht-El) for Individuals and Not Financial Institutions at the Blitar City Land Office? That the main obstacle often experienced by Htel users and administrators is the IT system on HT-el or the HT-el application which is still often problematic and lacking. human resources at ATR BPN Blitar City. What steps have been taken by the Blitar City Land Agency in resolving these obstacles, including server repairs and training for Blitar City BPN Atr officials as well as outreach to the community and PPAT. Keywords : regulations, mortgage rights, electronics.

Abstract

Abstract: In the implementation of the Deliberation on the Form and/or Amount of Compensation in the Land Procurement of Dhoho Kediri International Airport, there are Rights Holders who disagree with the deliberations, the Rights Holders who disagree do not submit an Objection to the local District Court, until finally the Land Procurement Implementer makes an Application for Compensation Custody through the Court. The validity of the Compensation Custody through the Court is reviewed from Law Number 2 of 2012, as well as what are the legal consequences of the issuance of the Court Determination. This research uses a normative juridical method, which analyzes a legal problem using laws, books, journals, and other written works that have legal standing. The conclusion of this study is that the Court accepted the Consignment Application because the Right Holder who did not agree with the results of the deliberation on the amount of compensation did not file an objection to the District Court 14 days from the holding of the Deliberation on the Form and/or Amount of Compensation Agreement, and its existence could not be found. The validity is absolute, considering that the conditions of the Application have been fulfilled by the Land Acquisition Implementer. Regarding the legal consequences of the Court Determination, it is considered to be the termination of the legal relationship between the Right Holder and its land, it is considered to be handing over the right to its land to the State, and the nature of the Determination is final so it must be accepted and implemented by all parties. In the end, the Right Holder accepted the results of the Consignment and was also present in the execution of the object in question.
