Abstract

This study aims to analyze the authority of the Regional Indonesian Broadcasting Commission (KPID) of Central Java in supervising television broadcasts of campaign advertisements for the 2024 General Election. The urgency of this research lies in the ongoing violations of broadcast neutrality, which have the potential to influence public opinion and undermine the quality of democracy. The method employed is normative juridical with a statutory approach, supported by interview data from KPID Central Java. The findings indicate that KPID’s authority complies with the eight principles of legality and has proven to be fairly effective through the fulfillment of five factors in broadcast law enforcement. This study differs from previous research as it specifically evaluates the role of KPID in the context of the 2024 Election and the challenges posed by contemporary broadcasting regulations. In conclusion, KPID’s supervision contributes to the creation of democratic and high-quality broadcasts, although institutional strengthening and regulatory support are still required. This research contributes to the development of broadcasting law studies while also providing recommendations for the government and KPI to reinforce both the authority and effectiveness of election broadcast supervision in the future. Penelitian ini bertujuan menganalisis kewenangan Komisi Penyiaran Indonesia Daerah (KPID) Jawa Tengah dalam pengawasan siaran iklan kampanye Pemilu 2024 di televisi. Urgensi penelitian didasarkan pada masih ditemukannya pelanggaran netralitas siaran yang berpotensi menggiring opini publik dan mengancam kualitas demokrasi. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan yang didukung data wawancara dengan KPID Jawa Tengah. Hasil penelitian menunjukkan bahwa kewenangan KPID telah memenuhi delapan prinsip legalitas hukum dan terbukti cukup efektif melalui pemenuhan lima faktor penegakan hukum penyiaran. Penelitian ini berbeda dari studi sebelumnya karena secara khusus mengevaluasi peran KPID dalam konteks Pemilu 2024 serta tantangan regulasi penyiaran kontemporer. Kesimpulannya, pengawasan KPID mendukung terciptanya siaran demokratis dan berkualitas, namun masih memerlukan penguatan kelembagaan dan dukungan regulasi. Penelitian ini berkontribusi pada pengembangan kajian hukum penyiaran sekaligus memberikan rekomendasi bagi pemerintah dan KPI untuk memperkuat kewenangan serta efektivitas pengawasan penyiaran Pemilu di masa mendatang.

Abstract

This study aims to examine the authority of the religious court in determining a wali adhal (a guardian who unjustifiably refuses to marry off a woman), with a case study on Decision Number 215/Pdt.P/2023/PA.Kdl. The research is grounded in the reality that, in practice, lineage guardians (wali nasab) are still found to refuse marriage without legitimate grounds under Islamic law, thereby obstructing women’s right to a lawful marriage. The study employs a normative juridical approach, analyzing court decisions alongside Islamic legal doctrines from the four schools of thought (mazhab). The findings reveal that the Kendal Religious Court has the authority to appoint a wali hakim (court-appointed guardian) as a substitute for a wali adhal, thereby ensuring legal protection for women and upholding the principles of justice and equality in marriage. The novelty of this research lies in its comprehensive analysis of judicial reasoning that integrates a normative approach, Islamic doctrinal perspectives, and substantive justice—an area rarely explored in prior studies. The study concludes that religious court rulings in wali adhal cases serve as a crucial instrument in safeguarding women’s constitutional right to marry and establish a legitimate family. It further recommends strengthening the role of religious courts in handling such cases and promoting legal awareness within society regarding the limits of a lineage guardian’s authority.   Penelitian ini bertujuan untuk mengkaji kewenangan pengadilan agama dalam menetapkan wali adhal dengan studi kasus pada Putusan Nomor 215/Pdt.P/2023/PA.Kdl. Latar belakang penelitian ini berangkat dari kenyataan bahwa dalam praktiknya masih ditemukan wali nasab yang menolak menikahkan perempuan tanpa alasan yang sah menurut hukum Islam, sehingga menghambat hak perempuan untuk menikah secara sah. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan analisis terhadap putusan pengadilan dan doktrin hukum Islam dari empat mazhab. Hasil penelitian menunjukkan bahwa Pengadilan Agama Kendal memiliki kewenangan untuk menetapkan wali hakim sebagai pengganti wali adhal, guna menjamin perlindungan hukum bagi perempuan serta menegakkan prinsip keadilan dan kesetaraan dalam pernikahan. Kebaruan dalam penelitian ini terletak pada analisis komprehensif terhadap pertimbangan hakim yang memadukan pendekatan normatif, doktrinal Islam, dan keadilan substansial, yang belum banyak dikaji dalam penelitian sebelumnya. Penelitian ini menyimpulkan bahwa putusan pengadilan agama dalam kasus wali adhal menjadi instrumen penting dalam menjaga hak konstitusional perempuan untuk menikah dan membentuk keluarga secara sah. Disarankan agar peran pengadilan agama diperkuat dalam menangani kasus-kasus serupa, serta perlunya sosialisasi hukum kepada masyarakat terkait batasan kewenangan wali nasab.

Abstract

The purpose of this study is to determine and analyze the effectiveness of the motor vehicle tax receivables collection program in Semarang City, as well as to determine and analyze the supporting and inhibiting factors for the effectiveness of the program. This research is a type of empirical juridical legal research with a statutory approach. The research specification uses descriptive analysis. The data in this study were obtained through interviews and literature studies and then analyzed qualitatively. The results of the study explain that the effectiveness of the motor vehicle tax receivables collection program in Semarang City is marked by an increase in motor vehicle tax revenue compared to the same month period last year and a significant increase in revenue before the program was implemented. Supporting factors for the effectiveness of the motor vehicle tax receivables collection program in Semarang City are cooperation with other agencies and optimizing the use of technology, inhibiting factors are a lack of public awareness and technical obstacles such as data differences between motor vehicle data and vehicle owners.   It is hoped that in the future, the collection program for motor vehicle tax receivables in Semarang City can continue to be improved by improving the data collection system for vehicles and vehicle owners to be more accurate, and increasing socialization to the public about the importance of paying taxes on time. In addition, increased coordination between related agencies is also expected to minimize technical obstacles that have been a hindrance. Thus, it is expected that motor vehicle tax revenue will be more optimal, and this program can run more effectively and efficiently.

Abstract

This study aims to analyze the existence, legal standing, and implementation of Government Regulation in Lieu of Law (Perppu) Number 2 of 2022 on Job Creation following the issuance of Constitutional Court Decision Number 91/PUU-XVIII/2020, which declared Law Number 11 of 2020 on Job Creation conditionally unconstitutional. The urgency of this research lies in the need for an in-depth juridical review of the legitimacy of the Perppu, which is deemed not to meet the “compelling urgency” requirements stipulated in Article 22 of the 1945 Constitution and Constitutional Court Decision Number 138/PUU-VII/2009, as well as its implications for the rule of law and public participation in the legislative process. This research employs a normative juridical method with a statutory approach and descriptive-analytical analysis of secondary data. The findings reveal that the Perppu’s legal standing is weak as it fails to meet all three criteria of compelling urgency, while its implementation encounters obstacles in terms of legal substance and legal culture, particularly regarding investor-oriented policies and the reduction of workers’ rights. The novelty of this research lies in its comprehensive analysis combining Hans Kelsen’s hierarchy of norms theory, Lawrence M. Friedman’s legal system theory, and Gustav Radbruch’s legal purpose theory to assess the legitimacy and effectiveness of the Perppu. It is concluded that the Perppu does not fully fulfill the elements of legal justice and legal benefit for civil society, although it still provides legal certainty for the government to accelerate national strategic projects. Penelitian ini bertujuan untuk menganalisis eksistensi, kedudukan hukum, dan implementasi Peraturan Pemerintah Pengganti Undang-Undang (Perppu) Nomor 2 Tahun 2022 tentang Cipta Kerja pasca dikeluarkannya Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 yang menyatakan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja inkonstitusional bersyarat. Urgensi penelitian ini terletak pada perlunya kajian yuridis mendalam terhadap legitimasi penerbitan Perppu yang dinilai tidak memenuhi syarat “hal ihwal kegentingan yang memaksa” sebagaimana diatur dalam Pasal 22 UUD 1945 dan Putusan MK Nomor 138/PUU-VII/2009, serta implikasinya terhadap prinsip negara hukum dan partisipasi publik dalam pembentukan peraturan perundang-undangan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan analisis deskriptif-analitis terhadap data sekunder. Hasil penelitian menunjukkan bahwa secara yuridis kedudukan Perppu Cipta Kerja lemah karena tidak memenuhi ketiga kriteria kegentingan yang memaksa, sementara implementasinya menghadapi hambatan pada aspek substansi hukum dan budaya hukum, khususnya terkait keberpihakan pada investor dan pengurangan hak-hak pekerja. Kebaruan penelitian ini terletak pada analisis komprehensif yang menggabungkan teori hierarki norma hukum Hans Kelsen, teori sistem hukum Lawrence M. Friedman, dan teori tujuan hukum Gustav Radbruch untuk menilai legitimasi dan efektivitas Perppu Cipta Kerja. Disimpulkan bahwa Perppu ini belum sepenuhnya memenuhi unsur keadilan dan kemanfaatan hukum bagi masyarakat sipil, meskipun masih memberikan kepastian hukum bagi pemerintah dalam mempercepat proyek strategis nasional.

Abstract

This study aims to analyze the normative conflict between general seizure (sita umum) and criminal seizure (sita pidana) in the settlement of bankruptcy assets, as well as to examine mechanisms for resolving such conflicts when assets of a bankrupt debtor under general seizure are also subject to criminal seizure. General seizure, carried out by the bankruptcy curator, is intended to collect and liquidate all assets of the bankrupt debtor to repay creditors fairly and proportionally. In contrast, criminal seizure, conducted by investigators, is aimed at confiscating assets related to a criminal offense, either as evidence or as proceeds of crime. The normative conflict arises when assets seized for bankruptcy settlement are also targeted in criminal proceedings. This clash is rooted in Article 31(2) of Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment, which stipulates that a bankruptcy declaration and general seizure nullify all prior seizures, and Article 39(2) of Law No. 8 of 1981 on the Criminal Procedure Code (KUHAP), which still permits the seizure of assets already under civil or bankruptcy seizure. Using a normative juridical method, the findings reveal that this inconsistency creates legal uncertainty, particularly in determining the priority of seizure enforcement, thereby hindering the settlement of bankruptcy assets and potentially causing losses to creditors. Therefore, this study recommends the establishment of a clear legal provision that explicitly prioritizes general seizure in cases of overlap with criminal seizure, in order to ensure legal certainty, safeguard creditors’ rights, and maintain a balanced approach with the objectives of criminal law enforcement.   Penelitian ini bertujuan menganalisis konflik norma antara sita umum dan sita pidana dalam proses pemberesan harta pailit, serta mengkaji mekanisme penyelesaiannya ketika aset debitur pailit yang telah berada dalam sita umum juga menjadi objek sita pidana. Sita umum yang dilakukan oleh kurator dalam kepailitan bertujuan mengumpulkan dan menjual seluruh aset debitur pailit untuk membayar utang kepada para kreditur secara adil dan proporsional. Sebaliknya, sita pidana yang dilakukan oleh penyidik ditujukan untuk menyita aset yang terkait dengan tindak pidana, baik sebagai alat bukti maupun hasil kejahatan. Konflik norma timbul ketika objek yang disita untuk pemberesan harta pailit juga menjadi sasaran sita dalam perkara pidana. Pertentangan ini berakar pada ketentuan Pasal 31 ayat (2) Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang, yang menyatakan bahwa putusan pailit dan sita umum menghapus seluruh sita sebelumnya, dengan Pasal 39 ayat (2) Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana (KUHAP), yang tetap memperbolehkan penyitaan terhadap objek yang telah berada dalam sita perdata maupun sita pailit. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menunjukkan bahwa pertentangan norma tersebut menimbulkan ketidakpastian hukum, khususnya terkait penentuan prioritas pelaksanaan sita, sehingga berimplikasi pada terhambatnya pemberesan harta pailit dan potensi kerugian bagi kreditur. Penelitian ini merekomendasikan adanya pengaturan yang secara tegas menetapkan prioritas sita umum dalam konteks tumpang tindih dengan sita pidana, guna menciptakan kepastian hukum, melindungi hak kreditur, dan tetap menjaga keseimbangan dengan kepentingan penegakan hukum pidana.

Abstract

This study aims to analyze the legal provisions on abortion and the legal protection for doctors in abortion cases involving rape victims, based on Law Number 17 of 2023 concerning Health. The research background is rooted in the normative conflict between the Indonesian Penal Code (KUHP), which absolutely prohibits abortion, and the Health Law, which provides exceptions under certain conditions, thereby creating legal uncertainty. Ensuring legal certainty for doctors is crucial so that they are not placed in a vulnerable position when performing their professional duties. This research applies a normative juridical method with a descriptive-analytical specification, using qualitative analysis through systematic, grammatical, and teleological interpretation of legal norms. The findings show that Article 428 paragraph (3) of Law No. 17/2023 establishes a new juridical foundation that explicitly protects doctors from criminal liability, provided that they meet administrative and professional requirements, such as a valid practice license, registration certificate (STR), implementation in accredited health facilities, informed consent, and reporting to the Health Office. The novelty of this research lies in its emphasis on legal protection for doctors through the latest regulation, which has not been widely examined in previous studies that focused more on ethical dilemmas or gestational age limits. The study concludes that legal protection for doctors in abortion cases due to rape constitutes a form of legal certainty as well as the fulfillment of victims’ rights, with recommendations for synchronizing gestational age limits across related regulations and strengthening technical guidelines by the government and professional organizations to ensure consistent implementation.   Penelitian ini bertujuan untuk menganalisis ketentuan hukum aborsi dan perlindungan hukum terhadap dokter dalam kasus aborsi akibat perkosaan berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Latar belakang penelitian didasari oleh konflik norma antara KUHP yang melarang aborsi secara mutlak dan Undang-Undang Kesehatan yang memberikan pengecualian dalam kondisi tertentu, sehingga menimbulkan ketidakpastian hukum. Pentingnya memberikan kepastian hukum bagi dokter agar tidak berada dalam posisi rentan ketika menjalankan kewajiban profesional. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi deskriptif-analitis, melalui analisis kualitatif dengan pendekatan interpretasi sistematis, gramatikal, dan teleologis terhadap norma hukum. Hasil penelitian menunjukkan bahwa Pasal 428 ayat (3) UU 17/2023 memberikan dasar yuridis baru yang secara eksplisit melindungi dokter dari ancaman pidana sepanjang memenuhi syarat administratif dan profesional, seperti izin praktik, STR, pelaksanaan di fasilitas kesehatan yang memenuhi standar, informed consent, serta pelaporan kepada Dinas Kesehatan. Novelty penelitian ini terletak pada penegasan perlindungan hukum bagi dokter melalui regulasi terbaru, yang belum banyak dikaji dalam penelitian terdahulu yang lebih menekankan aspek dilema etik atau batas usia kehamilan. Kesimpulan penelitian ini menegaskan bahwa perlindungan hukum terhadap dokter dalam kasus aborsi akibat perkosaan merupakan bentuk kepastian hukum sekaligus pemenuhan hak korban, dengan rekomendasi perlunya sinkronisasi batas usia kehamilan dalam regulasi terkait serta penguatan pedoman teknis oleh pemerintah dan organisasi profesi agar implementasi aturan lebih konsisten.

Abstract

This study aims to analyze the forms of legal liability that developers must fulfill toward buyers of land lots situated on legally problematic land and examine the legal protection measures available to buyers in addressing such issues. The research is motivated by developers' growing practice of land lot sales that often lack guarantees of legal certainty, particularly when the land object is subject to administrative or legal disputes. This study uses a normative and sociological approach to explore the relationship between developers’ legal obligations and consumer protection in property transactions. The findings indicate that developers are legally required to fulfill contractual performance and provide restitution or compensation in breach cases, as stipulated in the Civil Code and the Consumer Protection Law. On the other hand, buyers are entitled to seek remedies through litigation and non-litigation channels, including the Consumer Dispute Settlement Board (BPSK). Developers’ liability is repressive and preventive, emphasizing the need to ensure the legality and dispute-free status of the land object before marketing. The implications of this study highlight the importance of strengthening regulatory frameworks, enhancing government oversight, and promoting consumer legal literacy to achieve legal certainty and fairness in property transactions.   Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban hukum yang harus dipenuhi oleh developer terhadap pembeli kavling tanah pada objek yang bermasalah secara hukum, serta menelaah upaya perlindungan hukum yang dapat diberikan kepada pembeli dalam menghadapi permasalahan tersebut. Latar belakang penelitian ini didasarkan pada meningkatnya praktik jual beli kavling tanah oleh developer tanpa jaminan kepastian hukum, terutama ketika objek tanah masih berstatus sengketa administratif maupun yuridis. Penelitian menggunakan pendekatan normatif dan sosiologis untuk mengidentifikasi hubungan antara kewajiban hukum developer dan perlindungan hak-hak konsumen. Temuan menunjukkan bahwa developer berkewajiban memenuhi prestasi sesuai perjanjian pengikatan jual beli serta memberikan restitusi dan kompensasi apabila terjadi wanprestasi, sebagaimana diatur dalam Kitab Undang-Undang Hukum Perdata dan Undang-Undang Perlindungan Konsumen. Pembeli berhak menempuh upaya hukum melalui jalur litigasi maupun non-litigasi, termasuk Badan Penyelesaian Sengketa Konsumen (BPSK). Pertanggungjawaban hukum developer bersifat tidak hanya represif tetapi juga preventif, dengan memastikan legalitas dan bebas sengketa atas objek tanah sebelum dipasarkan. Implikasi penelitian ini menegaskan pentingnya penguatan regulasi, peningkatan pengawasan pemerintah, dan pemberdayaan konsumen melalui literasi hukum guna mewujudkan kepastian hukum serta keadilan dalam transaksi properti.
