Abstract

Business licensing is very necessary in achieving the performance of providers or providers of quality public services for Regional Development so that the Regional Government is responsible and responsive to the needs of the community in fulfilling and equitable economic and political equality. However, due to the Covid-19 Pandemic in Indonesia, all sectors were affected. This research focuses on knowing the role of the Investment Service and One Stop Integrated Services in granting building permits as a target for local revenue during the Covid-19 pandemic. There has been a decrease in the number of applicants for building permits to build up to 50%. The Target of Original Regional Income before the Covid-19 pandemic was 52 billion, when the Covid-19 pandemic the target of Regional Original Income had been reduced by 50%, accounting for 26 billion. The target of Regional Original Income in June has been reached up to 40%. This is in achieving the target of Regional Original Income that will be focused on the budget for purchasing medical devices and the development budget for 2020 will be abolished for a moment, only urgent development can be implemented.Keywords: Role, Building Construction Permit, Regional Original Income.

Abstract

The issue of land does not necessarily concern registration, waiver of rights, or double certificates. Still, it concerns land ownership, which is why many people do not understand that many people exercise waivers to people outside the district. This problem also occurs in tanara village, tanara district, Serang regency, where many local people do not know about this ban, the purpose of this writing is the result of a form of socialization of absente land regulation in tanara village by direct counseling method to the community representing in tanara village office. As for the results of the discussion and the analysis of the absente land, most of the tanara people do not understand the meaning of absente land. The prohibition of absentee land is regulated in article 9 of the Agrarian Basic Law and also article 3, paragraphs 5 and 6 of Government Regulation No. 224 of 1961, which explains that if it is proven that land ownership is absent, the state will take over or revoke its rights and will be distributed to the community following applicable regulations.   Sosialisasi Peraturan Larangan Tanah Absente di Desa Tanara, Kabupaten Serang, Banten Masalah tanah tidak selalu menyangkut pendaftaran, pelepasan hak, sertifikat ganda tetapi menyangkut kepemilikan tanah, itulah sebabnya banyak orang tidak mengerti sehingga banyak orang tidak mengerti sehingga banyak orang melakukan pembebasan kepada orang-orang di luar kabupaten. Permasalahan ini juga terjadi di desa tanara kecamatan tanara kabupaten serang dimana masyarakat setempat banyak yang tidak mengetahui tentang pelarangan ini, tujuan dari penulisan ini adalah hasil dari suatu bentuk sosialisasi pengaturan tanah absente di desa tanara dengan metode penyuluhan langsung ke perwakilan masyarakat di kantor desa tanara. Adapun dari hasil pembahasan dan juga analisis tanah absente, sebagian besar masyarakat tanara belum memahami pengertian tanah absente. Larangan tanah absentee diatur dalam pasal 9 Undang-Undang Dasar Agraria dan juga pasal 3 ayat 5 dan 6 Peraturan Pemerintah No. 224 Tahun 1961 yang menjelaskan bahwa jika terbukti tidak ada pemilikan tanah, maka negara mengambil alih atau dicabut haknya dan akan dibagikan kepada masyarakat sesuai dengan ketentuan yang berlaku

Abstract

Masalah: Sebagai negara hukum, Indonesia menjunjung tinggi perlindungan dan penegakan hukum itu sendiri. Kehadiran negara dalam memberikan perlindungan hukum amat diperlukan dalam konteks agrarian terkhusus penyediaan lahan dalam menunjang pembangunan Proyek Strategis Nasional. Tidak jarang bahwa kendati telah terdapat mekanisme dan ketentuan dalam pelaksanaan pengadaan tanah tetap terjadi konflik agrarian. Hal ini menyebabkan penerapan secara teoritik dan praktik asas tujuan hukum berupa kepastian, kemanfaatan, dan keadilan menjadi dipertanyakan. Penelitian ini mengkaji secara yuridis-normatif mengenai implementasi teoritik dan praktik asas tujuan hukum penyediaan lahan dalam menunjang pembangunan di Tanah Air. Tujuan: Dari uraian tersebut, penulis ingin mengkaji lebih lanjut implementasi teoritik dan praktik asas tujuan hukum pada penyelenggaraan pengadaan tanah untuk kepentingan umum dalam proyek strategis nasional. Metodologi: Penelitian ini merupakan penelitian yuridis normative dengan menggunakan pendekatan peraturan perundang-undangan (statuary approach) dan pendekatan konseptual (conceptual approach) Temuan/Hasil Penelitian: Hasil penelitian ini menunjukan kendati dalam tatanan teoritik berdasarkan asas dan prinsip yang terkandung dalam regulasi mencerminkan pemeunhan seluruh asas tujuan hukum, namun dalam tatanan praktik asas kemanfaatan dan keadilan masih menjadi bias sehingga diperlukan pengukuran terkait dengan opportunity cost atas kemanfaatan masyarakat luas dibanding pihak yang melepaskan hak atas tanah. Abstract

Indonesia, which is in the middle of the world, could become a place where transnational crime, in this case human smuggling, takes place. With this position, Indonesia could become a place where illegal immigrants or people who are being smuggled end up. A systematic literature review (SLR) will be used to gather data to figure out what the problems are in this study. Systematic Literature Review (SLR) is the process of finding, choosing, and critically evaluating research results to answer well-formed questions. One way to deal with the problem of people sneaking into Indonesian waters is through international law enforcement. Because international law enforcement can protect the human rights of people who are smuggling immigrants, it can also keep Indonesian waters safe and secure. Indonesia is working through domestic legislation to address the problem of people smuggling. The effort consists of two parts, namely, prevention efforts and repressive efforts. The Indonesian government should play a more active role in dealing with illegal immigrants through the Directorate General of Immigration and not just passively wait for UNHCR and IOM.

Abstract

Problem: Family life is the foundation of society where individuals unite in love and responsibility to create a safe environment for the development of children. In this context, the role of parents is very important, because it has a big impact on children's physical, emotional, and social aspects. In this discussion, the importance of the role of parents in shaping children's futures will be explored. Children have special needs and protections under criminal law, with specific age limits defining their status as minors. Crimes against minors, such as sexual abuse, are a serious problem because children are still vulnerable and less able to protect themselves. The case of sexual abuse by a biological father against a biological child in the decision of the District Court of the Republic of Indonesia resulted in criminal sanctions based on the child protection law. This punishment reflects legal efforts to protect children's rights and provide appropriate sanctions to perpetrators. Purpose: The aim of this research is to understand how criminal sanctions are applied to perpetrators of sexual abuse by biological fathers of underage biological children based on the Child Protection Law. Abstract

Tanah yang dibutuhkan oleh manusia pada era sekarang tidak terlepas dari berbagai macam kepentingan yang berakibat kepada terjadinya politik pertanahan. Kebijakan negara dalam membuat sebuah regulasi tidak terlepas dari kepentingan terutama dengan adanya desentralisasi dari pusat ke daerah sehingga terbentuknya undang-undang nomor 32 Tahun 2004 tentang otonomi daerah. Akibat kewenangan pusat yang diambil daerah terkait pertanahan membawa berbagai macam permasalahan terutama konversi atau alih fungsi lahan pertanian menjadi non pertanian di setiap daerah yang alasan dari konversi tersebut untuk meningkatkan pendapatan asli daerah. Penulisan ini menggunakan metode penelitian hukum normatif yang bersumber dari berbagai macam perundangundangan terkait pertanahan dan kewenangan pemerintah daerah dalam hal pertanahan. Politik hukum dalam pertanahan yang terjadi akibat tidak adanya keseragaman peraturan yang terjadi antara pusat dan daerah yang mengarah kepada kebijakan yang lebih mementingkan kepentingan pemerintah daerah terutama untuk meningkatkan pendapatan asli daerah tanpa melihat akibat daripada konversi lahan pertanian menjadi non pertanian yang berujung kepada krisis pangan bagi masyarakat. Land needed by humans in the current era cannot be separated from various kinds of interests that result in the occurrence of land politics. State policy in making a regulation cannot be differentiated from the interests, especially with the decentralization from central to regional so that the constitution of law number 32 of 2004 on regional autonomy.As a outcome of central authority led by state-linked areas bring a mixture of troubles, particularly the conversion or transition of farming estate to non-agricultural in each area, which is the intellect of the changeover to increase local revenue. This writing uses normative legal research methods that are sourced from various laws related to the land and the authority of the local government in terms of land. Legal politics in the land that occurs due to the absence of uniformity of regulations that occur between the center and the region that leads to policies that are more concerned with the interests of local governments, especially to increase local revenues without seeing the consequences of the conversion of agricultural land to non-agricultural that led to the food crisis for the community.

Abstract

Perkembangan teknologi blockchain yang terintegrasi dengan Artificial Intelligence (AI) melalui mekanisme Non-Fungible Token (NFT) telah melahirkan bentuk baru kekayaan intelektual digital yang menimbulkan kompleksitas hukum tersendiri, khususnya dalam perlindungan Hak Kekayaan Intelektual (HKI). Penelitian ini bertujuan untuk menganalisis kerangka hukum integrasi AI–NFT serta implikasinya terhadap perlindungan hak cipta, kepemilikan digital, dan mekanisme penyelesaian sengketa HKI di Indonesia dalam perspektif hukum nasional dan internasional. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan hukum, yang didukung oleh studi kepustakaan terhadap peraturan perundang-undangan, doktrin hukum, laporan lembaga internasional, serta studi kasus pelanggaran hak cipta dalam ekosistem NFT. Hasil penelitian menunjukkan bahwa hukum positif Indonesia belum sepenuhnya mampu mengakomodasi karya yang dihasilkan oleh AI karena sistem perlindungan hak cipta masih berorientasi pada pencipta manusia. NFT tidak menciptakan hak cipta baru, melainkan berfungsi sebagai alat pembuktian kepemilikan digital yang memiliki nilai evidensial tinggi dalam sengketa hukum. Penelitian ini menyimpulkan bahwa diperlukan harmonisasi regulasi nasional dengan standar internasional serta pengembangan kerangka hukum adaptif berbasis teknologi guna mewujudkan perlindungan HKI digital yang efektif dan berkeadilan di era blockchain.

Abstract

To compare private data protection regulations in Indonesia and the Philippines and understand dispute resolution related to private data cases in the two countries. This research method uses literature review studies derived from books and journals or articles that have been published. The research findings reveal a comparison between the Private Data Protection Act in Indonesia and the Philippines. It is noted that the Philippines already has an independent supervisory body, whereas Indonesia does not, despite the establishment of such an institution being regulated by the Private Data Protection Act number 27 of 2022. Additionally, the study aims to understand the dispute resolution mechanisms in case of private data theft in both Indonesia and the Philippines. This study compares the regulations of the Private Data Protection Act in Indonesia and the Philippines, focusing particularly on the establishment of an essential independent supervisory body that needs to be formed in Indonesia. Subsequently, the case resolution mechanisms through Alternative Dispute Resolution can be considered to eliminate practices that tend to be slow, complex, and expensive, as well as to stop corrupt practices in the courts, ensuring that the Indonesian community feels secure and protected. No specific research has been found that compares the regulations on Private Data Protection in Indonesia and the Philippines. This includes the establishment of an independent supervisory body to aid law enforcement authorities in identifying perpetrators of private data theft, providing education, and addressing public inquiries about private data. Additionally, the resolution of cases involving private data theft through alternative dispute resolution is deemed superior to the judicial route due to the frequent practices of being slow, complex, expensive, and corrupt, which can erode or even eliminate the trust of the Indonesian public in law enforcement authorities.

Abstract

This study explores the legal and policy dimensions influencing security, economic development, and education in the Indonesia-Malaysia border region, identifying key challenges and offering policy recommendations. Using a qualitative methodology and NVIVO 12+ software for data analysis, the research examines legislation documents, government reports, and policy frameworks to uncover significant gaps. The study reveals critical deficiencies, including underfunded educational institutions, inadequate healthcare facilities, and insufficient infrastructure, which hinder both human development and economic growth. For instance, many border villages face infrastructural deficits such as unpaved roads and unreliable electricity, limiting access to education and curbing local economic opportunities. The research also highlights the fragmentation of legal and policy frameworks, which often prioritize national security and macroeconomic goals over local needs, exacerbating socio-economic inequalities. Inadequate security measures further undermine regional stability, facilitating transnational crimes such as human trafficking and illegal trade. The study emphasizes the interconnectedness of education, infrastructure, security, and economic development, underscoring how deficiencies in one area adversely affect the others. This paper offers novel insights into border governance, proposing an integrated policy approach that aligns legal, economic, and educational objectives to foster sustainable development, enhance security, and promote regional cooperation. The findings provide valuable implications for policymakers seeking to improve governance in border regions facing similar socio-political challenges.

Abstract

Courses related to procedural law are practicum courses with Course Learning Outcomes (CLO)/ Capaian Pembelajaran Mata Kuliah (CPMK) students who can simulate trials in court. In this case, the moot courtroom's urgency is to provide an infrastructure for students to conduct moot trials. One of the practicum courses is the Constitutional Court's Judicial Procedural Law. Students who take this course must be competent and able to practice in the objective realm of justice. However, based on the observation and tracing results, the service activities' partners do not have a moot courtroom in the constitutional court, so they cannot carry out moot court in the course. Digital/virtual space, known as Metaverse, is a solution for procuring infrastructure for the constitutional court's moot courtroom. The results of this service show that the Metaverse Moot Court of the Constitutional Court is an appropriate technology-based product that is the only quick solution to the absence and limitations of the Constitutional Court's moot courtroom at Partner universities. Partners do not need to spend millions to billions of Rupiahs to procure facilities and infrastructure for the Constitutional Court's moot courtroom. In addition, this product is a solution to time constraints, considering that the campus has operational hours while students are still required to be proficient in practicing proceedings at the Constitutional Court. Finally, the virtual reality technology product implemented in this pseudo-courtroom provides an immersive experience like the real atmosphere in the courtroom. It makes students more excited and increases motivation to practice the trial.
