Abstract

The escalation of natural resource exploitation often places local communities in a vulnerable position, leading to persistent socio-environmental conflicts. This study aims to analyze the implementation of legal protections for local communities within the context of natural resource utilization and to identify the structural barriers that hinder environmental justice. Using a qualitative descriptive method through a comprehensive documentary study, this research examines various legal frameworks, scholarly discourses, and judicial precedents. The findings reveal a significant "implementation gap" between statutory mandates and grassroots reality. While the law theoretically provides safeguards through mechanisms such as Environmental Impact Assessments (AMDAL) and the recognition of customary rights, these are often undermined by pro-investment policies, such as the Omnibus Law on Job Creation, which simplify licensing at the expense of public participation. Furthermore, bureaucratic hurdles in recognizing indigenous land tenure continue to marginalize local inhabitants. The study concludes that legal protection remains formalistic rather than substantive. To achieve genuine environmental justice, there is an urgent need to strengthen Anti-SLAPP regulations, simplify the recognition of customary forests, and shift the legal paradigm from state-centric developmentalism to a community-centered approach that prioritizes distributive and procedural justice. Abstract

This study examines the role of law in governing financial technology (fintech) innovation while ensuring effective risk management in rapidly evolving digital financial ecosystems. As fintech disrupts traditional financial services through technologies such as blockchain, artificial intelligence, and digital payments, regulatory frameworks face increasing pressure to balance innovation with consumer protection and systemic stability. This paper analyzes how legal systems respond to fintech developments by exploring regulatory approaches, including principles-based regulation, regulatory sandboxes, and cross-border legal harmonization. It highlights key risks associated with fintech, such as data privacy concerns, cybersecurity threats, financial fraud, and regulatory arbitrage, and evaluates how legal instruments mitigate these challenges. Furthermore, the study discusses the role of law in fostering trust, promoting responsible innovation, and ensuring financial inclusion. Using a qualitative approach, the research draws on comparative legal analysis and recent policy developments across emerging and developed markets. The findings suggest that adaptive, flexible, and technology-neutral legal frameworks are essential to support innovation while maintaining financial stability and public confidence. Ultimately, the paper underscores the importance of dynamic legal governance in shaping a sustainable and resilient fintech ecosystem.

Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis prinsip keadilan dalam perdagangan internasional melalui evaluasi ketentuan mengikat dalam Agreement on Reciprocal Trade (ART) antara Indonesia dan Amerika Serikat. Fokus utama penelitian ini adalah mengkaji sejauh mana ketentuan dalam perjanjian tersebut mencerminkan keadilan substantif, keseimbangan kepentingan, serta perlindungan terhadap masyarakat domestik. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, dokumen perjanjian internasional, serta literatur ilmiah dalam kurun waktu 5 - 10 tahun terakhir. Hasil penelitian menunjukkan bahwa meskipun ART secara formal mengedepankan prinsip kesetaraan (formal equality), dalam praktiknya terdapat ketimpangan struktural antara Indonesia sebagai negara berkembang dan Amerika Serikat sebagai negara maju. Ketimpangan tersebut berdampak pada sektor UMKM, tenaga kerja, serta keterbatasan ruang kebijakan nasional. Jika dibandingkan dengan kerangka World Trade Organization (WTO) dan perjanjian perdagangan bebas lainnya seperti Regional Comprehensive Economic Partnership (RCEP), ART cenderung kurang mengakomodasi prinsip perlakuan khusus bagi negara berkembang. Oleh karena itu, diperlukan reformulasi klausul perjanjian dan penguatan posisi tawar Indonesia guna mewujudkan keadilan substantif dalam perdagangan internasional. Abstract

The rapid growth of fintech lending applications has significantly transformed access to financial services, especially in developing countries. These platforms provide fast, convenient, and accessible financial solutions; however, they also raise critical concerns regarding cybersecurity and data protection. This study aims to analyze the relationship between cybersecurity and public trust in digital lending applications through a qualitative literature review. Cybersecurity is a key determinant of trust, as users must share sensitive personal and financial information when accessing digital lending services. Empirical studies indicate that data breaches, unauthorized access, and misuse of personal data significantly reduce consumer trust. Conversely, strong cybersecurity mechanisms such as encryption, authentication systems, and regulatory compliance enhance trust and encourage adoption This paper finds that cybersecurity is not only a technical requirement but also a strategic factor in building sustainable trust relationships between users and fintech providers. Strengthening cybersecurity frameworks, improving regulatory enforcement, and increasing digital literacy are essential to fostering trust in digital lending ecosystems. The study contributes to the understanding of how cybersecurity influences trust and provides insights for policymakers and fintech providers in developing secure and reliable digital financial services.
