Abstract

Disaster mitigation in Indonesia requires a coherent and adaptive institutional framework capable of addressing the country’s high vulnerability to natural hazards. The National Disaster Management Agency (BNPB), as the central authority for disaster management, faces persistent challenges in coordination, regulatory fragmentation, and institutional rigidity that undermine its capacity for effective mitigation. This article examines the need to reconstruct the legal and institutional architecture of BNPB to strengthen its preventive and risk reduction functions. Using a qualitative juridical-normative approach combined with policy analysis, the study explores the alignment between existing disaster laws, decentralization policies, and international disaster governance standards such as the Sendai Framework for Disaster Risk Reduction. The findings reveal that BNPB’s current legal mandate remains overly response-oriented, lacking clear authority and integration mechanisms with regional disaster agencies (BPBD) and sectoral institutions. Therefore, the paper proposes a reconstruction model emphasizing legal harmonization, institutional redesign, and collaborative governance among central and local actors. Such a transformation is expected to shift BNPB’s paradigm from reactive disaster response toward proactive, community-based, and sustainable disaster mitigation—anchored in legal certainty, institutional accountability, and resilience-oriented policy coherence.

Abstract

Natural disasters generate profound socio-economic disruptions that disproportionately affect vulnerable workers, including informal laborers, women, persons with disabilities, and low-income communities. Despite growing attention to disaster governance and social protection, existing frameworks remain fragmented and often lack an ethical foundation capable of integrating social justice, economic inclusion, and long-term resilience. This study aims to develop an integrative conceptual model grounded in Islamic ethics to support inclusive post-disaster recovery for vulnerable workers. Employing a normative-conceptual approach, the study analyzes relevant scholarly literature, the Sustainable Development Goals (SDGs 4, 5, and 8), and Islamic legal-ethical perspectives. The findings propose a framework that synthesizes three core Islamic ethical principles ‘adl (justice), ta‘āwun (mutual cooperation), and maṣlaḥah (public welfare) with four interrelated pillars: inclusive education, gender equality, decent work, and disaster resilience. The model demonstrates that inclusive education enhances adaptive capacity, gender equality promotes equitable participation and access, decent work facilitates sustainable livelihood recovery, and disaster resilience strengthens long-term socio-economic stability. Theoretically, this study advances the discourse on Islamic social protection by bridging Islamic ethical principles with contemporary development and disaster recovery agendas. Practically, it offers a culturally grounded and value-based framework for policymakers and humanitarian actors seeking to design more equitable, inclusive, and sustainable recovery strategies. The proposed model contributes to the development of ethically informed disaster governance that prioritizes human dignity, social protection, and economic inclusion for vulnerable populations.

Abstract

Koperasi Desa Merah Putih dan Badan Usaha Milik Desa (BUMDes) memiliki peran strategis dalam mendukung pencapaian Tujuan Pembangunan Berkelanjutan (SDGs) melalui penguatan ekonomi lokal dan pemberdayaan masyarakat. Kegiatan pengabdian kepada masyarakat ini bertujuan memperkuat kapasitas kelembagaan dan manajerial Koperasi Merah Putih serta BUMDes di Desa Arjowinangun, Kabupaten Pacitan. Metode yang digunakan adalah pendekatan partisipatif melalui identifikasi kebutuhan, penyuluhan hukum, pendampingan tata kelola kelembagaan, penyusunan rencana bisnis, dan evaluasi kegiatan. Hasil pengabdian menunjukkan adanya peningkatan pemahaman peserta mengenai tata kelola koperasi dan BUMDes, kemampuan menyusun rencana bisnis, serta penguatan kolaborasi antara pemerintah desa, masyarakat, dan lembaga ekonomi desa. Selain itu, kegiatan ini meningkatkan kesadaran pemangku kepentingan terhadap penerapan prinsip-prinsip SDGs dalam perencanaan pembangunan desa. Temuan ini menunjukkan bahwa penguatan kelembagaan melalui pendampingan partisipatif dapat mendukung tata kelola lembaga ekonomi desa yang lebih efektif dan berkelanjutan serta menjadi praktik yang berpotensi direplikasi pada desa lain dengan karakteristik serupa.

Abstract

The epistemological foundation of legal education has long been dominated by positivistic thought, strongly influenced by thinkers such as Hans Kelsen and H.L.A. Hart, emphasizing legal certainty, formal logic, and the mechanical application of rules. While this paradigm has been effective in cultivating technical competence and doctrinal precision, it has simultaneously marginalized the moral, philosophical, and social dimensions of law as a living and dynamic system. Consequently, legal education often produces graduates who are procedurally skilled yet insufficiently responsive to substantive justice and humanitarian concerns. This study aims to reconstruct the epistemology of legal education by shifting from a rigid positivist framework toward a humanistic paradigm that integrates ethical consciousness, critical reflection, and social responsibility. Using a normative-philosophical approach supported by conceptual analysis of classical and contemporary legal theories, including critiques advanced by Ronald Dworkin and Jürgen Habermas, this research examines how the dominance of positivism has constrained legal reasoning and distanced law from its emancipatory purpose. The findings reveal that formalistic and text-centered approaches in legal education limit students’ capacity to engage with justice in its broader social and moral contexts. Therefore, this study proposes an epistemic reconstruction centered on dialogical learning, intersubjective understanding, and contextual engagement with social realities. By situating law within ethical, cultural, and societal frameworks, this humanistic model envisions legal education not merely as a mechanism for producing technically proficient jurists, but as a transformative process that nurtures reflective, compassionate, and socially responsible legal thinkers committed to the realization of substantive justice.

Abstract

This research examines the effectiveness of e-court implementation as an electronic judicial service at the Magetan District Court, employing an empirical legal research method with statutory and sociological approaches, complemented by interview data, observations and literature studies. The findings indicate that e-court enhances accessibility, accelerates service delivery and reduces litigation costs. However, its effectiveness remains sub-optimal due to a high dependence on Legal Aid Post (Posbakum) officers and low digital literacy among the public. This study recommends the reinforcement of technology socialization and the formulation of more structured service standards to support a simple, speedy and low-cost judicial system.
