Abstract

The gender role gap in the justice restoration process is an urgent issue that needs attention, especially in the framework of women's empowerment. Restorative justice centers on repairing relationships and restoring social balance after violations or injustices. However, in practice, especially in the Restorative Justice House of Wadah Babaikan, Rantau Badauh District, Barito Kuala Regency, South Kalimantan, women often face significant obstacles that hinder their full participation in this process. These obstacles include the low knowledge of human resources about Restorative Justice/Mediation as an alternative to dispute resolution, which impacts women's confidence and institutions in increasing the role of women in resolving legal cases peacefully, so intervention is needed to improve competence. The method used in this activity is a workshop on mediation, law, and techniques in conflict reconciliation. This workshop had a significant impact on improving the competence of resolving legal issues in their respective villages in the administrative area, as seen in the results of the post-test that knowledge and understanding related to the resolution of legal problems through mediation increased and built the confidence and competence/ability of village women in Rantau Badauh District to behave and behave in involvement during the justice restoration process in their respective areas.

Abstract

The purpose of this study is to examine the existing regulations related to the role of the South Kalimantan Regional Government in developing a system to assist local communities in managing and utilizing wetland plants in an economically valuable and environmentally sustainable manner, based on regional autonomy policies under Law No. 23/2014 on Regional Government and its amendments. Currently, the South Kalimantan Provincial Regulation No. 7/2023 on Creative Economy Development serves as the reference for fostering business actors in South Kalimantan, which only provides general provisions on creative economy development with an emphasis on environmental sustainability and local wisdom. However, there is no specific regulation that provides legal certainty and protection for the management and utilization of wetland plants, including local crafts based on these resources. This study employs a normative legal research method, which involves a process of finding legal rules, principles, or doctrines to address the legal issue of regulatory gaps. This research is prescriptive in nature, aiming to answer the legal issue raised by using arguments, theories, and new concepts as a prescription for solving the problem, thereby providing concrete recommendations for the development of regulations related to the management and utilization of wetland plants in South Kalimantan.   Tujuan dari penelitian ini adalah untuk mengetahui regulasi yang ada terkait peran Pemerintah Daerah Kalimantan Selatan dalam membentuk sistem untuk membantu masyarakat lokal dalam pengelolaan dan pemanfaatan tanaman lahan basah yang bernilai ekonomis dan berwawasan lingkungan, berdasarkan kebijakan otonomi daerah dalam Undang-Undang No. 23 Tahun 2014 tentang Pemerintahan Daerah beserta perubahannya. Saat ini, acuan pembinaan pelaku usaha di Kalimantan Selatan adalah Peraturan Daerah Provinsi Kalimantan Selatan Nomor 7 Tahun 2023 tentang Pengembangan Ekonomi Kreatif, yang hanya mengatur secara umum tentang ekonomi kreatif dengan pengembangan yang berwawasan lingkungan dan kearifan lokal. Namun, belum ada peraturan khusus yang memberikan kepastian dan perlindungan hukum secara spesifik terkait pengelolaan dan pemanfaatan tanaman lahan basah, termasuk kerajinan lokal yang berbasis pada sumber daya tersebut. Penelitian ini menggunakan metode penelitian hukum normatif untuk menemukan regulasi, prinsip hukum, atau doktrin hukum yang relevan guna menjawab isu hukum yang dihadapi, yaitu kekosongan hukum. Dengan sifat preskriptif, penelitian ini bertujuan memberikan solusi melalui argumentasi, teori, dan konsep baru untuk mengatasi masalah hukum yang ada., sehingga memberikan rekomendasi konkret untuk pengembangan regulasi terkait pengelolaan dan pemanfaatan tanaman lahan basah di Kalimantan Selatan.
