Abstract

Making a living is one of the important things in domestic life. Therefore, rules relating to livelihood problems need to be studied. But in this livelihood problem there is a difference of opinion between Imam Shafi'i and Ibn Hazm regarding the matter of livelihood for an elderly wife. The purpose of the nushuz is the attitude of defiance or dishonesty of the wife towards her husband. The verses of the Qur'an which explain explicitly and clearly about the failure or failure of living for an incompetent wife do not exist. However, the two Imams above have their respective arguments in punishing the matter. Based on this the authors are interested in expressing differences of opinion between the two Imams above. The results of this study are: Imam Shafi'i argues that if the wife of Hussein then his right to earn a living will be killed, unless the wife has returned from his Hussein. While Ibn Hazm argues that whether a wife is nushuz or not, he will still earn a living. This research can be concluded that the difference of opinion between the two priests above is caused by differences in the methods and legal basis used as a basis in establishing the law of a problem by the two priests. Imam Shafi'i in stipulating the law regarding the above problem is based on ijma 'jumhur ulama which states that nushuz is one of the reasons that can make a living. Whereas Ibn Hazm is based on the meaning of Dhahr from al-Qur'an's an-Nisa verse 34 and the Prophet's Hadith narrated by Muslims. Therefore, the authors suggest that husband and wife must truly understand their rights and obligations towards their partners, so as to create a peaceful and peaceful home life.

Abstract

This study aims to determine the effort of improving the quality of employee’s performance at CV Cucurutuku Ceria Sosgul Malang. The research approach used a qualitative method where the informants in this study were the employees of the sales counter, Coordinators and HR of CV Cucurutuku Ceria Sosgul Malang who are the planner of the improvement program and targets. The Data collection was carried out through interviews, observation, documentation and field data collection. The data analysis techniques use descriptive analysis, such as: data reduction, data presentation and conclusions. The results of this study indicate that the efforts made by CV Cucurutuku Ceria Sosgul Malang to improve the quality of employee’s performance show: 1) through training or programmatic training related to technical matters such as: how to produce, service sales transactions and financial reporting. 2) Conducting employee discipline development such as: discipline for work attendance, services, and working hours. These are contained in standard operational procedures (SOPs) written in company’s regulations.

Abstract

Basically, the right to drop the divorce is in the hands of the husband, but as the leader of the husband's household it is not justified to commit violence against the wife, especially in terms of the wife's mentality because according to Islamic Fiqh, if the husband has dropped the word talak against the wife, it is said that he has fallen divorce. In this study, the authors took the formulation of the problem, namely: How is the Islamic concept of talak pledge, what is the concept of KHI about the talak pledge and how is the view of the Cukir ulama about the application of the talak pledge in front of the religious court. in front of a religious court or outside a religious court hearing, as well as their opinion on the imposition of divorce according to KHI. In order for this research to run in accordance with the objectives expected by the researcher, in this study the researcher used a qualitative approach with the type of field research research. Based on the available data, it can be analyzed that the Cukir ulama still adhere to classical fiqh, they do not agree with the obligation to pledge divorce in front of a religious court, they argue that divorce can fall anywhere without having to be in front of a religious court. The conclusion of this research is that according to the ulama Cukir talak it can fall anywhere, they take this opinion based on the alquran, classical fiqh, as well as their thoughts, experiences and knowledge.

Abstract

Background. Dropshipping is a tangible form of the development of buying and selling mechanisms that follow technological developments. The Dropshipping mechanism makes it easy for people who want to start entrepreneurship, even without capital, the mechanism is simple, only as a third party who acts as a liaison, as well as a mechanism that does not require the seller to stock up on goods first like the Reseller mechanism, encouraging public interest to use the mechanism. even well-known online buying and selling sites include this mechanism. Then how is this buying and selling mechanism in Islamic law?, with the hadith that prohibits buying and selling goods that do not exist. Aim. This article examines the Dropshipping mechanism in the perspective of Hadith. Methods. This research is a qualitative library research. Results. Hadith explicitly prohibits buying and selling of goods that are not owned, but it is different from buying and selling orders or greetings. The dropshipping buying and selling mechanism is actually a sale and purchase of greetings, but with a slightly different mechanism. This mechanism is actually not in the category of selling something that is not owned, but there must be a clear contract between the dropshipper and the supplier.

Abstract

Latar Belakang. Pengembangan da’wah di era Revolusi Digital 4.0 tidak lagi menggunakan metode kuliah tetapi berbasis internet (e-da’wah). Da’i perlu merespons dengan meningkatkan kompetensi, sehingga dapat melaksanakan peran dengan benar dan tidak dapat digantikan oleh teknologi. Formulasi kompetensi berkhotbah yang ada masih didasarkan pada asumsi Jenderal Da’wah tanpa memasukkan konteks era digital. Tujuan. Mengembangkan konsep kompetensi Da’i dalam asumsi era digital. Untuk menjadi referensi bagi Da’i atau lembaga Da’wah dalam meningkatkan kualitas Da’i. Metode. Penelitian menggunakan pendekatan kualitatif deduktif dan penelitian kepustakaan yang menggunakan konsep kompetensi Da’i yang ada untuk dioperasionalkan di era 4.0. Hasil. Ada kebutuhan untuk penyesuaian dengan kompetensi dasar Da’i dengan karakter era digital dalam aspek spiritualitas, moralitas, penguasaan ilmu agama, ilmu sosial, kompetensi pengambilan data, keterampilan teknis menggunakan perangkat digital atau kemampuan untuk berkolaborasi dengan para ahli teknologi informasi untuk membuat alat e-da’wah.

Abstract

Background. Islamic banking faces the challenges of developing an increasingly complex and risky external and internal situation in business. Islamic banking needs to implement risk management, which will have an impact on both banks and banking supervisory authorities. Aim. This research was conducted to determine how the an operational steps of Murabahah financing, to find out the obstacles associated with Murabahah financing and how the risk management of Islamic banking was in overcoming the constraints that occurred both internal or external constraints on Murabahah financing. Methods. This research uses a normative legal research method, which is carried out by conducting library research on a various relevant legal materials, both through a primary legal materials, which are obtained from a number of laws and regulations. Results. The results of this study indicate that Murabahah financing in Islamic banking is the financing that is most in demand by the public with a low indene of a risks, however, the risks management is still used to further minimize the occurrence of a greater risks.

Abstract

This study examines employee job satisfaction through authentic leadership practices, organizational-trust in leader and interaction between the two. The study was conducted at the STAI At-Tahdzib Jombang and took 23 educator and adminsitration staff randomly as sample of the study. The data were analyzed by simple regression analysis, multiple regression analysis and moderate regression analysis. The analysis shows authentic leadership has a positive effect on job satisfaction. The positive influence of authentic leadership on job satisfaction is lost when multiple and interacts with organizational-trust in leader. Organizational-trust in leader has a positive effect on job satisfaction. The positive effect of organizational-trust in leader on job satisfaction does not disappear when multiple and interacts with authentic leadership. Organizational-trust in leader has no effect of strengthening or weakening the influence of authentic leadership on job satisfaction. The interaction between authentic leadership and trust in organizational leadership has no effect on job satisfaction.

Abstract

Latar Belakang. Penentuan harga barang saling menjatuhkan harga antar para penjual demi berebut pembeli. Tujuan. Studi bertujuan untuk mengetahui hukum dari penentuan harga di Pasar Tegalgubug Kecamatan Arjawinangun Kabupaten Cirebon, Jawa Barat, Indonesia. Metode. Studi merupakan kajian literatur dan lapangan dengan menggunakan tinjauan hukum ekonomi Islam dalam membaca fenomena yang terjadi di Pasar Tegalgubug. Hasil. Hasil kajian menunjukkan bahwa terdapat dua pendapat hukum yang berbeda dalam menilai praktik penetapan harga yang terjadi di Tegalgubug menurut perspektif Islam yaitu: Pertama, mereka yang membolehkan penentuan harga beralasan bahwa hal tersebut untuk menjaga kestabilan harga pasar. Kedua, mereka yang melarang adanya penentuan harga yang dilakukan oleh pemerintah atau otoritas lain karena pedaganglah yang lebih berhak untuk menentukan harga.

Abstract

Background. The management of waqf in Sumpang Mango village is the same as the management of waqf in general Indonesia. The waqf in this village is accommodated by the KUA of Pitu Riawa and the village government of Sumpang Mango. Aim. This study aims to examine and determine the strategic description of the management and utilization of waqf land in the village of Sumpang Mango. Methods. The method used in this research is field research with a qualitative approach. Results. The results obtained from this research are that the management of waqf in Sumpang Mango village is already semi-professional and administrative issues are quite good. What needs to be emphasized is the socialization of waqf from the KUA Pitu Riawa or other parties.
