Abstract

Masyarakat Indonesia dikatakan multikultural karena konsep ini mengedepankan budaya. Sehingga ketika mendengar istilah Islam Nusantara, maka akan berkaitan dengan pluralitas. Dalam Islam Nusantara, budaya merupakan bagian dari agama, di mana awal mula Islam dapat dengan mudah diterima di Indonesia salah satunya melalui akulturasi budaya, sehingga agama Islam terkesan merakyat dengan masyarakat Indonesia. Dalam pluralitas dan keberagamaan antara umat dan bangsa- bangsa dalam kerangka kesatuan manusia, filsafat ini mencetak peradaban Islam dengan ciri yang moderat, menyelaraskan antara kekhasan individual yang dimiliki oleh masing-masing umat dan bangsa, dengan keutamaan atau keburukan yang terjadi pada semua umat dan bangsa. Maka yang terjadi kemudian adalah rasa bangga terhadap kekhasan dan keutamaan yang dimiliki tanpa mengingkari kekhasan dan kelebihan yang lain. Sikap ini tampak dalam peradaban Islam.

Abstract

This article examines anal rape, one of the most often ignored by modern criminal jurists. There are two things studied, namely how Indonesian criminal law view penalties for rape perpetrators through anal (anal sex)? And what about jināyāh jurisprudence about punishment for rape perpetrators through anal (anal sex)? This article is a library research. The data obtained were analyzed by analytical descriptive method and content analysis. After that, it is computed based on the perspective of criminal law and fiqh law. The results of the study yielded two findings. First, in criminal law, anal sex rape is juridically categorized as obscene acts, so the perpetrator is only sentenced to a maximum of 9 years in prison, 3 years lighter than the threat of intra vaginal rape for 12 years. Secondly, in jināyāh jurisprudence, if based on jikhur ulama's jurisprudence, the penalty for anal sex rape perpetrators is ḥadd zina punishment and coupled with the penalty of payment of dowry to the victim, there is no difference with intra vaginal rape penalty. If based on the doctrine of al-Ḥanafiyyah cleric, then the punishment for the perpetrators of anal sex rape is ta'zīr penalty, but there is no penalty of dowry payment.---Artikel ini mengkaji tentang salah satu bentuk perkosaan, yang paling sering diabaikan oleh para ahli hukum pidana di abad modern ini, yaitu perkosaan melalui anus (anal sex). Ada dua hal yang dikaji, yaitu bagaimana pandangan hukum pidana Indonesia tentang hukuman bagi pelaku perkosaan melalui anus (anal sex)? Dan bagaimana pandangan fikih jināyāh tentang hukuman bagi pelaku perkosaan melalui anus (anal sex)? Artikel ini merupakan penelitian kepustakaan (library research). Data-yang diperoleh dianalisa berdasarkan metode deskriptif analitis dan content analysis. Setelah itu, dikomparasikan berdasarkan sudut pandang hukum pidana dan hukum fikih. Hasil studi menghasilkan dua temuan. Pertama, di dalam hukum pidana, perkosaan anal sex secara yuridis dikategorikan sebagai perbuatan cabul, sehingga pelakunya hanya diganjar hukuman maksimal 9 tahun penjara, 3 tahun lebih ringan dibandingkan dengan ancaman pidana perkosaan intra vaginal selama 12 tahun. Kedua, di dalam fikih jināyāh, jika mendasarkan pada fikih jumhur ulama, hukuman bagi pelaku perkosaan anal sex adalah hukuman ḥadd zina dan ditambah dengan hukuman pembayaran mahar kepada korban, tidak ada perbedaan dengan hukuman perkosaan intra vaginal. Jika mendasarkan pada doktrin ulama al-Ḥanafiyyah, maka hukuman bagi pelaku perkosaan anal sex adalah hukuman taʻzīr, namun tidak terdapat hukuman pembayaran mahar.

Abstract

This paper observes theological shift towards a personalized spirituality of Muslim religiosity in America. In the face of global resurgence of Islamic movement and its ambitious call towards purification, personalized form of Islam is strongly criticized to be deviant and a mere practice of heresy. Islamic mysticism or commonly known as Sufism gained more popularity in modern America for its stress on God’s mercy over exclusive legalism in understanding cosmic law and the divine consequences. Over the year, it has proven its catalytic role for a more peaceful interreligious understanding on account to reflexivity and cosmopolitan consciousness. Drawing from a recent scholarship by Ulrich Beck on individualized religion, this paper explores; process of individualization of religion in forming modern American religious experience and the socio-cultural relevance of Sufism in shaping contemporary religious relation of Islam in America. Data utilized in this research draws upon interviews and observational fieldworks in the East Coast America.

Abstract

The major problem of this article is how Abdurrahman Wahid’s ideas on developing pesantren education. It is elaborated into major sub-problems, namely the pesantren existence in the political frame of the New Order in the decades of 1970s and 1980s, Abdurrahman Wahid’s view on pesantren, and on the framework of developing pesantren education. This research is designed as qualitative one using hermeneutic and content analysis approaches. The findings of this research show that the phenomena of inability of pesantren in facing the New Order power, the policies of non pro-pesantren regime, and political suppression and systematical marginalization to pesantren done by the New Order regime in the decades of 1970s and 1980s became the factors that opened the way for the emergence of pesantren educational development ideas. Meanwhile, the common manifestations of the stagnant and apprehensive pesantren conditions were the internal factors encountered by pesantren at that time. To change these pesantren conditions, innovative ideas, namely “pesantren dynamicization” was introduced.---Masalah utama tulisan ini adalah bagaimana gagasan Abdurrahman Wahid tentang pengembangan pendidikan pesantren. Hal ini diuraikan menjadi sub-masalah utama, yaitu keberadaan pesantren dalam kerangka politik Orde Baru dalam dekade 1970-an dan 1980an, pandangan Abdurrahman Wahid tentang pesantren, dan dalam rangka pengembangan pendidikan pesantren. Penelitian ini dirancang secara kualitatif dengan menggunakan pendekatan analisis hermeneutik dan isi. Temuan penelitian ini menunjukkan bahwa fenomena ketidakmampuan pesantren dalam menghadapi kekuasaan Orde Baru, kebijakan rezim non pro-pesantren, dan penekanan politik dan marginalisasi sistemik terhadap pesantren yang dilakukan oleh rezim Orde Baru pada dekade 1970-an dan 1980 menjadi faktor yang membuka jalan bagi kemunculan gagasan pengembangan pendidikan pesantren. Sementara itu, manifestasi umum dari kondisi pesantren yang stagnan dan memprihatinkan adalah faktor internal yang dihadapi pesantren saat itu. Untuk mengubah kondisi pesantren ini, maka ide inovatif, yaitu “dinamika pesantren” diperkenalkan.

Abstract

Each prophet is given a miracle according to the needs and conditions of his people. If the previous prophet was sent by Allah SWT only for certain people, a certain period, and strengthened by materialistic miracles such as the staff of Moses and others, then scientific miracles are very relevant to the people and the present age. This is the greatest scientific miracle in the history of human life. Allah wants every piece of information conveyed by the Koran to materialize someday. When an event and event occurs in accordance with the Koran, the miracle is revealed. So this scientific miracle is always new every time. In the present era, the truth of Islamic science began to unfold. These scientific truths will one day attract humanity to acknowledge the greatness of the Almighty God. Abstract

Generasi muda Muslim yang hidup di Era revolusi industri nampaknya mengalami perubahan orientasi berfikir dalam proses implementasi nilai-nilai keislaman. Hal tersebut dapat terlihat dengan terbaginya generasi muslim menjadi dua kelompok tertentu. Kelompok pertama merupakan kelompok yang menolak segala perubahan dan stimulan kemodernan, hingga mengakibatkan maraknya diskriminasi HAM atas nama agama. Sedangkan kelompok muslim yang lain memiliki semangat perubahan tanpa Arah dan menjadikan Barat sebagai kiblat atas segala problematika kehidupan. Berkaca dari fenomena yang demikian penulis mencoba memberi respon dengan menjabarkan dua pemikiran tokoh Islam yakni, Abdurrahman Wahid dengan gagasan “Pesantren sebagai subkultur”, dan Fazlur Rahman dengan “Konsep Neomodernisme”. Kemudian, Penelitian ini menggunakan metode penelitian korelasional antara kedua gagasan tersebut, di mana gagasan Pesantren sebagai subkultur milik Abdurrahman wahid mengacu pada konsep islam tradisional autentik, dan nilai keislaman yang mampu menciptakan stimulan keislaman fleksibel. Sedangkan konsep neomodernisme yang diprakarsai oleh Fazlur Rahman mengacu pada stimulan pergerakan islam modern, namun tetap mempertahankan nalar kritis dalam setiap perubahan dan ideologi yang digencarkan. Dengan konklusi akhir, kedua gagasan tersebut diharapkan mampu memberikan refleksi terhadap islam rahmatan lil’alamin serta menangkal segala isu kemanusiaan dan modernisasi atas nama agama, namun tetap mempertahankan Hukum Islam secara universal.

Abstract

Abdullahi Ahmed an-Na'im is deeply influenced by the Islamic Reform Movement in Sudan pioneered by Mahmoud Mohamed Taha. Together with other Taha supporters, an-Na'im formed a sociopolitical community that became famous for Tahaism. This article wants to show how the relationship of the two minds is so close and how Islamic legal thought of an-Na'im is partially influenced by Taha. In terms of historical research methodology, it can be said that Taha is a history of idea for an-Na'im. This is because the thought of an-Na'im turns out to be the same as Taha in terms of the importance of the naskh, and differs in worship, mysticism, socialism, and public reason. Moreover, the underlying power of the theorem an-Na'im is not merely an individual, not of individual processes aware of its importance in the flow of thought, but rather of the collective goals of a group that underlie individual thought. Most of his thoughts cannot be properly understood as long as their relation to life or to the social implications of human life are not taken into account.---Abdullahi Ahmed an-Na‘im sangat terpengaruh oleh Gerakan Reformasi Islam di Sudan yang dipelopori oleh Mahmoud Mohamed Taha. Bersama sama dengan para pendukung Taha lainnya, an-Na‘im membentuk sebuah komunitas sosial politik yang kemudian terkenal dengan Tahaisme. Artikel ini ingin menunjukkan betapa hubungan pemikiran keduanya sangat dekat dan betapa pemikiran hukum Islam an-Na‘im sebagiannya dipengaruhi oleh Taha. Dalam istilah metodologi penelitian sejarah, dapat dikatakan bahwa Taha adalah history of idea bagi an-Na‘im. Hal ini karena pemikiran an-Na‘im ternyata sama dengan Taha dalam hal pentingnya naskh, dan berbeda dalam hal ibadah, tasawwuf, sosialisme, dan public reason. Selain itu, kekuatan yang mendasari sikap teoritis an-Na‘im bukan semata merupakan sesuatu yang individual semata, yakni tidak berasal dari proses individu menyadari kepentingannya dalam arus pemikiran, akan tetapi lebih berasal dari tujuan-tujuan kolektif suatu kelompok yang mendasari pemikiran individu. Sebagian besar pemikirannya tidak dapat dimengerti secara tepat selama kaitannya dengan kehidupan atau dengan implikasi sosial kehidupan manusia tidak diperhitungkan.

Abstract

When someone dress, other people easily judges about the culture or religion that others have. It invites differences of opinion in enforcing rules within an institution such as schools, campuses, and offices. On March 06, 2018 BBC News reported there was a ban on wearing the face mask (cadar) at a state Islamic university because the threat of radicalism which always gave birth to new people especially in the millennial era now.This is because for some people the face mask (cadar) is seen as a sign of the development of conservative Islam and shows one's identity. But it creates public unrest and some people feel uneasy about the sacralization in the dress. Researcher used library research methods by using descriptive-qualitative type by using primary sources, literature on the theory of desacralization and politic of identity and secondary sources is from several supporting literature. The results, desacralization in dressing is that a person does not contain sacred in clothes except when worship this is at a profane time that dressing has a good meaning with applicable state regulations. Desacralization in dress as politics of identity will be able to position his own identity without disturbing the identity of others.

Abstract

The essence of Islamic law is to attract the good (maslahat) of humans and reject the danger from it. Therefore, in addition to carrying out the shari'ah, humans are required to understand the aims and objectives of the shari'ah set. Departing from the above statement, this study will examine the efforts of Thahir ibnu ‘Asyur in developing concepts related to the science of maqasid al-shari'ah.The data of this research is library. The data collection method uses the documentation method, which is: collecting, then analyzing the data collected. After the data has been collected, data analysis is carried out by means of data reduction, presentation of data in narrative form, and drawing conclusions.This study concludes that the maqasid al-shari'ah, as stated by Thahir ibnu ‘Asyur, is the spirit of all human actions relating to the laws established by Islamic shari’ah, especially in dealing with a number of problems in this millennial era. In addition, said Thahir ibnu ‘Asyur, the main reason for the decline of fiqh is the neglect of scholars towards the study of maqasid which results in the distortion of shari'ah values themselves. The opinion of Thahir ibnu ‘Asyur above is supported by ‘Allal al-Fasi, one of the experts in contemporary maqasid al-shari’ah, who asserted that the main condition for success in dialoguing fiqh with contemporary reality is the rise or failure of scholars' responses to the study of maqasid. This is where the role of maqasid al-shari'ah as the spirit of each fiqh law finds its momentum. Its elastic characteristics, across space and time, are expected to be able to dialogue with problems that continue to emerge. These characteristics are able to adapt to every civilization that runs and play a role in arousing Islamic civilization that is lagging behind other civilizations.

Abstract

This article is a study of renewal thinking of KH Abdul Wahab Chasbullah towards the birth of NU. It uses historical approach/method. The result of the discussion stated that K.H. Abdul Wahab Chasbullah is a qualified kiai. He had studied at Pesantren Tambakberas, Jombang, Langitan Tuban, Mojosari Nganjuk, Cepaka, Bangkalan, Tebu Ireng untul Mecca in the early 20th century. In the early 20th century, modernist ideas of reform were appearing in Mecca. These renewal ideas fostered the idea of renewal within Abdul Wahab. Upon his return from Makkah, he established the study institute Taswirul Afkar with K.H. Mas Mansur, educational institution Nahdhatul Wathan with K.H. Ahmad Dahlan, and Nahdlatut Tujjar in cooperation with K.H. Hasyim Ash'ari. The establishment of these three institutions has reflected the thinking of K.H. Abd Wahab Chasbullah towards the birth of Nahdlatul Ulama (NU).---Artikel ini merupakan study tentang pemikiran pembaharuan K.H. Abdul Wahab Chasbullah terhadap lahirnya NU, menggunakan metode pendekatan sejarah. Hasil pembahasan menyatakan bahwa K.H. Abdul Wahab Chasbullah seorang kiai yang mumpuni. Ia pernah menuntut ilmu di Pesantren Tambakberas, Jombang, Langitan Tuban, Mojosari Nganjuk, Cepaka, Bangkalan, Tebu Ireng hingga ke tanah suci Makkah awal abad ke-20. Awal abad ke-20, ide-ide pembaharuan kaum modernis sedang berlangsung di Makkah. Ide-ide pembaharuan ini menumbuhkan gagasan pembaharuan dalam diri Abdul Wahab. Sepulangnya dari Makkah, ia mendirikan lembaga kajian Taswirul Afkar bersama K.H. Mas Mansur, lembaga pendidikan Nahdhatul Wathan bersama K.H. Ahmad Dahlan, dan koperasi Nahdlatut Tujjar bersama K.H. Hasyim Asy’ari. Berdirinya ketiga lembaga tersebut telah merefleksikan pemikiran pembaharuan K.H. Abd Wahab Chasbullah terhadap lahirnya Nahdlatul Ulama (NU).
