Abstract

The Constitutional Court is the Guardian of Family Rights. This is reflected in decisions relating to family rights. This study examined four decisions, 46/PUU-VIII/2010, 69/PUU-XIII/2015, 13/PUU-XV/2017, and 22/PUU-XV/2017. This study describes and examines the decisions of the Constitutional Court in relation to family rights. In addition, this study also aims to analyze the role of the Constitutional Court as the Guardian of Family Rights. This research is classified as library research with a conceptual approach. The results of this study, the Constitutional Court is the Guardian of Family Rights. The Constitutional Court stood on the judicial activism paradigm in the udicial review of family rights. Second, the Constitutional Court guarantees the fulfillment of family rights through its decision. Third, the Constitutional Court guarantees and improves family conditions through its decisions. This is because the family is the basic foundation of the nation and state. It is through the family that real human development is carried out.

Abstract

This study aims to analyze and describe the harmonization of labour law in the ASEAN region, especially Indonesia, Singapore and Vietnam in support of the ASEAN Mutual Recognition Arrangement. This research was conducted by using a normative juridical research method, with a statute approach. The study found that in welcoming the ASEAN Economic Community 2025 as a follow-up to the 2015 ASEAN Economic Community which has ended, the ASEAN member states have agreed to create a regional free market that aims to improve the living standards of the ASEAN community which has implications for the moral awareness of ASEAN member states that must unite in their territory in a free market. The reality of the implementation of the ASEAN Economic Community 2025, specifically regarding the free market for professional services in the region, the ASEAN member states have not moved seriously to implement it, each of the ASEAN member states is still using its country's positive regulations/laws which may lead to a free labour market process in the territory of their respective countries. The harmonization of regulations relating to foreign workers in each positive law of the ASEAN member states is very urgent and necessary, both formal and immaterial form in supporting ASEAN Mutual Recognition Arrangements. So that the vision and purpose of the establishment of the 2015 ASEAN Economic Community which is then followed by the 2025 ASEAN Economic Community are to create a free market and improve the competitiveness of human resources and the quality of human resources so that the creation of an integrated economic area can be achieved.

Abstract

As a mega cultural country that has hundreds of ethnic groups and languages, it is a fact that there is diversity in Indonesia which is a reflection of legal pluralism. This uniqueness must be used especially in concretizing customary law in national law. Building customary law is a necessity because customary law in Indonesia comes from the values of life in the community itself. One of the indigenous peoples who still firmly apply their customary law is the Baduy tribe. Settlement of all conflicts or matters in the Baduy tribal community with the aim of restoring the balance of Indigenous Peoples (restitutio in integrum). the focus of this study is on how to resolve cases in the Baduy tribal community. The method used in this study with empirical juridical supported by primary data in the form of observation and interviews with Indigenous leaders in the Baduy tribe. The criminal law currently in force is positivistic, the resolution of cases is generally resolved with a normative that results in full imprisonment. The settlement of cases with the Baduy customary law community applies simple, fast and cheap principles and can bring substantive justice. The method used is penance or mutual forgiveness so that it will bring peace to the parties. Soit is urgent to include and concretize the values of customary law in national law, so that customary law receptions in national law contribute to national law.

Abstract

The existence of exploitation of forest resources that are dangerous for the survival of the forest is illegal logging activities carried out without going through a selection or selective logging process and permission from the government. So related to this, this scientific article discusses the "Authority of Illegal Logging Timber Auctions," using normative juridical research methods. The normative juridical research approach is a legal research with a literature approach that is carried out by conducting research on library materials or mere secondary data. As for what is studied in this scientific article is about the mechanism of auctioning confiscated wood from illegal logging outside the conservation forest of Jambi Province. So based on this, it is obtained data that related to the auction of confiscated wood from illegal logging outside the conservation forest of Jambi Province, those who have authority in cases of confiscated wood are the forestry service and investigators/public prosecutors. However, there are also contradictions in the rule of law related to the auction of illegal logging results, namely between Article 23 number (1) of the Minister of Finance Regulation Number 213/PMK.06/2020 and Article 4 Number 2 of the Minister of Forestry Regulation Number P. 47/Menhut-II/2009 regarding the Amendment to Regulation of the Minister of Forestry Number P.48/Menhut/2006.

Abstract

Based on article 29 of Law Nomor 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition, it is explained that the acquisition of shares that have an asset value and or sales value exceeding a certain amount as regulated in Article 5 of Government Regulation Nomor 57 of 2010 is required to carry out a notification to KPPU no later than 30 working days after it is legally effective. However, it was found that through the KPPU decision Nomor17/KPPU-M/2020, it was stated that PT Saratoga Investama Sedaya has been proven to have violated Article 29 of Law Nomor 5 of 1999 in conjunction with Article 5 PP Nomor 57 of 2010. This study aims to find out how to prove the elements of a violation of late notification of share takeover by PT Saratoga Investama Sedaya. This research method is a normative juridical method. The results of this research are that the Commission Council stated that the takeover of shares by the Reported Party did not have the potential to cause monopolistic practices and/or unfair business competition. Because there is no change in market power and there is no vertical integration. However, the Reported party had to bear a fine of Rp. 1 billion because it was stated that he had violated Article 29 of Law Nomor 5 of 1999 in conjunction with Article 5 of PP Nomor 57 of 2010.

Abstract

A sense of justice is an abstract human conception of a desired or proper harmony between order and peace. Legal awareness is often associated with legal suitability, legal design, and legal validity. Legal awareness is the perception of value contained in humans about existing laws. Compliance comes from the word obedience and means obedience, obedience, obedience. To obey means to bow, obey, obey. Obedience means submission, and obedience is the state of submission to something or someone. Compliance, therefore, is the condition that the general public follows the rules of the game (the law). A society's legal culture also recognizes that our society, in its legal consciousness, has laws as rules of the game for living together and as a basis for solving problems arising from the risks of living together. However, from a material point of view, it is very difficult to build a legal culture in this country. This situation is affected by several factors, including: 1) legal factors; 2) law enforcement factors; 3) institutions and facilities; 4) community factors; and 5) cultural factors.

Abstract

Artikel ini membahas mengenai perdagangan karbon (carbon trading) sebagai suatu bentuk mekanisme berbasis pasar dalam upaya mitigasi dan adaptasi terhadap dampak perubahan iklim. Dengan merujuk pada Paris Agreement to the UNFCCC 2015 sebagai instrumen hukum internasional terkait perdagangan karbon, didapati bahwa belum terdapat aturan yang secara eksplisit mengatur mengenai mekanisme penetapan harga karbon (carbon pricing) secara global. Hal tersebut berdampak pada persaingan pasar yang tidak sehat, terutama antara negara-negara maju dan negara berkembang. Selain itu, mekanisme perdagangan karbon dalam Paris Agreement menggunakan sistem kerjasama sukarela yang juga menyerahkan target penurunan emisi pada masing-masing negara, sehingga rentan terhadap rendahnya partisipasi negara dalam penurunan emisi GRK global. Hal inilah yang kemudian memunculkan pertanyaan : apakah perdagangan karbon benar-benar efektif untuk menekan laju perubahan iklim global? Adapun solusi yang ditawarkan adalah melalui pembentukan instrumen hukum internasional baru yang mengikat secara hukum bagi negara-negara pihak serta memuat ketentuan mengenai mekanisme penetapan carbon pricing secara global.

Abstract

One of concepts of sovereignty or the highest power adopted by the 1945 Constitution of the Republic of Indonesia is the concept of people's sovereignty. This is found in Article 1 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. As a concept that originates from outside, of course this concept receives diverse views from various groups. This is understandable because any concept is definitely not value-free. It is influenced by various factors such as religion, ideology, politics, history, and so on. Besides that, ethnicity as a concept in the life of the state, of course influences other fields, including in the formation of laws and regulations. Therefore, the purpose of this research is to find out the concept of people's wealth which is adhered to by the 1945 Constitution of the Republic of Indonesia. In addition, this research is also intended to develop the concept of ethnicity which is adhered to in the formation of laws and regulations in Indonesia. The result of the research is that the People's Sovereignty adhered to by the 1945 Constitution of the Republic of Indonesia is limited by the power of God. This is different from the concept of the original version of the people's area. Where the people's choice is absolutely in the hands of the people. This departs from the understanding of a country that is neutral from religion. Meanwhile, the consequence of the concept of ethnicity that is adhered to in the formation of laws and regulations is that each formation of statutory regulations is limited by the provisions of God Almighty. So that deliberations or voting can be carried out when there is no explicit regulation by the provisions of the Law of God Almighty.

Abstract

Media massa dan wartawan merupakan dua sumber daya yang saling berhubungan. Perusahaan media massa tidak profesional berdampak negatif terhadap kehidupan pers. Media massa dan wartawan bagaikan dua mata pisau sehingga bisa dijadikan alat untuk kepentingan tertentu, bahkan melanggar hukum. Media massa dan wartawan yang tidak mengedepankan kode etik jurnalistik mencoreng profesi jurnalis, dan cenderung melanggar hukum sehingga muncul stigma negatif di tengah masyarakat terhadap profesi wartawan. Adapun rumusan masalah dalam penelitian ini adalah bagaimana problematika pendirian perusahaan pers serta urgensi verifikasi media massa dan uji kompetensi wartawan, yang dihubungkan dengan prinsip kemerdekaan pers dan Undang-Undang Pers. Penelitian disajikan menggunakan metode yuridis empiris dengan pendekatan penelitian bersifat kualitatif. Berdasarkan hasil penelitian, terdapat celah hukum pada peraturan terkait pendirian media massa. Bahkan UU Nomor 40 Tahun 1999 tentang Pers sendiri membuka ruang kepada siapa saja untuk mendirikan perusahaan pers, namun tidak mewajibkan untuk meningkatkan kapasitas. UU Pers juga tidak mengatur syarat pendidikan bagi wartawan, melainkan hal tersebut diserahkan kepada perusahaan pers. Regulasi pers terkait verifikasi media massa dan uji kompetensi wartawan hanya berlaku bagi yang mendaftar di Dewan Pers. Kondisi tersebut menyebabkan pertumbuhan media massa, khususnya media siber tidak terkendali, bahkan aktivitas wartawan yang tidak profesional cenderung melanggar prinsip-prinsip kemerdekaan pers.

Abstract

Tidak sedikit masyarakat Indonesia memilih bekerja di sektor informal, salah satunya menjadi pekerja rumah tangga. Sektor informal, pekerja rumah tangga selama ini belum ada payung hukum khusus yang mengatur terkait dengan hubungan kerja pekerja rumah tangga. Pada tahun 2004, rezim pemerintahan yang memegang kekuasaan sudah membuat Rancangan Undang-Undang Perlindungan Pekerja Rumah Tangga, namun sampai saat ini belum disahkan. Penelitian ini untuk mengetahui problem hukum perlindungan pekerja rumah tangga. Jenis penelitian yang digunakan adalah penelitian yuridis normatif dengan menggunakan data primer dan data sekunder, dengan teknik penarikan kesimpulannya menggunakan teknik induktif. Hasil penelitian menunjukan bahwa pekerja rumah tangga tidak diatur dalam Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, namun perlindungan pekerja rumah tangga diatur dalam Undang-undang Nomor 23 tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga, sehingga perluperaturan khusus yang mengatur tentang perlindungan dalam hubungan kerja pekerja rumah tangga mulai dari barometer cara perekrutan, pihak penyalur, pihak pemberi kerja, pihak pekerja, jam kerja, pelatihan kerja, menentukan beban kerja, upah, pengawasan, dan sanksi untuk para pihak yang melanggar.
