Abstract

The existence of supermarkets that have penetrated into settlements is an attraction for the people of Pekanbaru City. However, the number of supermarkets is apparently not directly proportional to the attitude of businesses in fulfilling the obligation to report the number of workers. This study aims to identify barriers and explain the solution to the implementation of the obligations of business operators to report the number of workers in each semester ordered by the Pekanbaru City Regulation on Management of People's Markets, Shopping Centers and Supermarkets. This type of empirical legal research is used in this study, wherein a study that looks at law in society. By using data collection methods by observation, questionnaire, interview and literature review. From the results of the research conducted it can be concluded that business actors do not report the number of workers due to their ignorance of the Pekanbaru City Regional Regulation on Management of People's Markets, Shopping Centers and Supermarkets. Efforts that need to be done are related institutions need to synchronize perceptions and disseminate local regulations to business actors in order to carry out their labor reporting obligations and send letters to business actors regarding the deadline for submitting reports on the number of workers in each semester.

Abstract

Proses penegakan hukum merupakan rangkaian yang panjang dalam sistem peradilan pidana yang puncaknya pada putusan hakim. Putusan hakim merupakan pernyataan hakim secara lisan dan tulisan yang terbuka untuk umum dari suatu perkara apakah akan menjatuhkan pidana, bebas atau melepaskan berdasarkan berbagai pertimbangan hukumnya. Setiap orang dapat menilai putusan hakim berdasarkan perannya masing-masing tapi dengan tetap menghormati putusan itu. Terkadang putusan hakim dapat diterima oleh masyarakat namun juga ada yang menjadi polemik apalagi sudah mendapat sorotan publik. Kebanyakan yang mendapat sorotan publik karena dinilai kurang mencerminkan keadilan, tidak proporsional dan tidak dengan pertimbangan yang lengkap. Oleh sebab itu, tulisan ini menggali masalah tersebut dengan melihat dasar pertimbangan agar putusan hakim menjadi proporsional berdasarkan ide keseimbangan dengan menggunakan penelitian normatif. Hasilnya terlihat hakim cenderung kurang lengkap mempertimbangkan baik kepentingan korban, pelaku, masyarakat dan dampak sosial dari putusan itu. Untuk mengatasinya maka perlu meperhatikan ide keseimbangan antara legalitas formal dan hukum yang hidup di masyarakat, antara aspek kepastian hukum, kelenturan dan keadilan, dan keseimbangan antara kepentingan si pelaku dengan korban (masyarakat).

Abstract

Corona Virus Disease 2019 or COVID-19 has been determined by President Joko Widodo to become a National Disaster with Presidential Decree No. 12 of 2020 concerning Determination of Non-Disaster in the Spread of Corona Virus Disease 2019 (COVID-19) as a National Disaster in Jakarta on April 13, 2020. The President has issued Presidential Decree 11 of 2020 concerning Establishment of Community Health Emergency COVID-19. The spread of Corona Virus Disease 2019 (COVID-19) has had an impact on negative global economic growth, including engagement. Parties who cannot fulfill their achievements in an engagement because the covid-19 pandemic does not necessarily classify the condition of the covid-19 pandemic as a state of overmacht or force majeure. Must be assessed on a case by case basis in accordance with the circumstances and factual conditions that occur. Except if the parties in a contract agreed upon with the parties have described in detail about what is qualified as a force majeure.

Abstract

Forest fires are not a rare phenomenon in Indonesia, especially in Pelalawan Regency, Riau Province. In 2019 there was a forest fire in Pelalawan Regency covering an area of ​​827 Ha and was directly visited by President Joko Widodo on September 17, 2019. This study aims to explain law enforcement against forest fires in Pelalawan Regency, Riau Province based on Law Number 41 of 1999 concerning Forestry . The method used in this research is sociological law research. Based on Article 50 paragraph (3) letter d of Law Number 41 Year 1999 concerning Forestry, it is stated that everyone is prohibited from burning forests. However, in 2019 there were forest fires in Pelalawan District covering an area of ​​827 hectares. The implementation of Law No. 41/1999 on Forestry against forest fires in Pelalawan District has not gone as expected. Burning forests is a criminal act. Law enforcement against the crime of forest burning in Pelalawan Regency, namely based on Article 78 paragraph (3) of Law Number 41 of 1999 concerning Forestry, it is stated that anyone who deliberately burns forests can be punished with imprisonment of up to 15 years and a maximum fine. IDR 5,000,000,000. The Pelalawan Regency Government can take preventive measures to minimize the occurrence of forest fires by carrying out legal counseling to the community regarding the prohibition of burning forests and increasing the role of the community in preserving the surrounding forests.

Abstract

Sebagian wilayah Tanjungpinang merupakan kawasann perdagangan bebas dan pelabuhan bebas. Menempatkan sebagian wilayah tersebut mengakibatkan sulitnya melakukan pengawasan terhadap lalu lintas barang terutama barang kena cukai jenis rokok ditambah dalam hal penegakan hukum tindak pidana cukai tersebut belum ada yang di sampai kepengadilan.Rumusan masalah dalam penelitian ini yaitu bagaimana penegakan hukum tindak pidanacukai di perbatasan kawasan perdagangan dan pelabuhan bebas bintan. Metode yang digunakan dalam penelitian ini adalah metode yuridis Sosiologis. Atau yang dikenal dengan empiris. Berdasarkan penelitian ini dapat disimpulkan dalam penegakan hukum pemberian sanksi tindakan harus memperhatikan beberapa hal yang menjadi satu kesatuan yaitu ketidaktahuan orang akan barang yang dilarang, jumlah barang dalam hitungan sedikit dan bukan merupakan pengulangan tindak pidana yang sama. Pemberian kuota pembebasan cukai terhadap barang kena cukai jenis rokok untuk konsumsi masyarakat harus dijadikan pertimbangan terhadap urgensi hal tersebut.

Abstract

Each country is unique in running its system of government. One of these uniqueness is related to the executive's authority in the formation of laws, where even though the State both uses a presidential system of government, there are differences in authority. This difference can be seen in Indonesia and America, where even though these countries both use a presidential system of government, there are differences in executive authority. In order to understand the ratio legis, there are differences, even though the 2 (two) countries both use presidential government systems, this research was conducted. The formulation of the problems in this study are 1) the characteristics of the presidential government system and 2) the authority of the president as an executive in the formation of laws in the presidential system in Indonesia and the United States. This research is a legal research with a statutory approach, a conceptual approach, and a comparative approach.

Abstract

This research focuses on the implementation of Village Funds in Jambi Luar Kota Subdistrict, Muaro Jambi Regency in the preservation of customary villages, where villages are autonomous regions with the passing of Law Number 6 of 2014 concerning Villages. The Village Law also provides a breath of fresh air regarding the escape of customary villages, where the previous regulations have not yet brought back the customary village clearly and firmly, but with the emergence of the Village Law it is sufficient to accommodate the Village to continue to maintain and maintain the values ​​of local wisdom. This study uses a descriptive approach, with interview data collection techniques. The Village Adat Institution must be able to cover all aspects, both in terms of customary Village management, supervision of traditional villages, customary Village government to customary Village Regulations, with the presence of Customary Institutions and having a significant role in maintaining and maintaining local cultural values ​​amidst diversity. in society, being able to implement its role without injuring the law, religious values, diversity and so on, but accelerating the realization of an Independent Village without having to erode the original culture of Jambi Luar Kota Subdistrict. The results of this research show that the implementation has been proven proven by ratifying it. The customary institutions in Jambi Luar Kota Subdistrict, it's just not optimal, because the Customary Institution is still focused on internal organizations, customary village regulations and the procurement of Sombolis infentary which is considered one of the local cultural treasures.

Abstract

The criminal execution of paying replacement money becomes a problem when the prosecutor as the executor will carry out the execution. The facts on the ground show that many convicts do not pay replacement money. The problems of the Pekanbaru District Attorney's Office in carrying out the execution of replacement money for convicted criminal acts of corruption are: First, the convict does not pay the replacement money charged to him; and the convict does not have sufficient property to pay the replacement money. Second, there is no synergy between the Ministry of Finance and the Pekanbaru District Attorney if the convict does not pay the replacement money. The efforts of the Pekanbaru District Prosecutor's Office in Executing Replacement Money Against Corruption Convicts, namely asset tracing (asset tracking), and increasing synergy between the Ministry of Finance and the Pekanbaru District Attorney if the convict does not pay the replacement money.

Abstract

Lantigiang Island, uninhabited island covering an area of ​​5.6 hectares located in Jinato Village, Takabonerate District, Selayar Islands Regency, South Sulawesi. This island is reported to have been sold by Syamsul Alam, who claims to be the owner of the island, to Asdianti, a resident of the Selayar island for Rp. 900,000,000 (Nine Hundred Million Rupiah). Lantigiang Island is included in the Takabonerate National Park area and is a protected conservation area. The conservation area aims to conserve the forest and the life in it, including the diversity of plants and animals and their ecosystems so that their functions can be carried out optimally. According to the agrarian regime, conservation areas are not for sale in general. This writing is compiled through a normative juridical analysis method with a statue approach, a conceptual approach and a case approach. Based on these three methods, it is necessary to observe and analyze which party is most responsible for the buying and selling process of the island of Lantigiang.

Abstract

Status Indonesia sebagai Negara Kepulauan dalam UNCLOS 1982 memberikan hak sekaligus kewajiban. Salah satu kewajiban tersebut adalah menyediakan jalur navigasi untuk lintas damai yang berupa Alur Laut Kepulauan Indonesia (ALKI). Dalam perkembangannya Indonesia sebagai negara pantai juga memiliki kewajiban untuk mewujudkan good order at sea, terutama disepanjang ALKI. Tulisan ini melihat bagaimana peran Tentara Nasional Indonesia Angkatan Laut (TNI AL), khususnya Komando Armada II dalam melaksanakan pengamanan di ALKI II. Hasil pembahasan menunjukkan bahwa TNI AL memiliki dasar hukum yang memadai untuk melaksanakan perwujudan good order at sea. Selain itu Komando Armada II telah membuktikan komitmennya untuk mewujudkan good order at sea secara komprehensif, sistematis dan rutin di sepanjang ALKI II.
