Abstract

Parallel import has been an important issue in international trade. Business people have been buying genuine products from one country and selling them to another country that offers a higher price without the permission of the intellectual property owner. This practice is not always illegal because it is protected by the laws of some countries and it depends on the types of exhaustion theory that they have applied in their national law. This study will mainly discuss the various types of exhaution theory, how the theory effects parallel imports, and the application of the theory by the EU, WTO and WIPO. Therefore, by examining the indicated areas, this study aims to find the proper implementation of exhaustion theory and thus to provide appropriate recommendations for the practice.

Abstract

The shifting of global political-economy since early 1990s has been followed by the expansion of regional economy cooperation forum establishment, such as: NAFTA (North America Free Trade Area), EFTA (European Free Trade Area) and APEC (Asia Pacific Economic Cooperation). Indonesia, together with the other South East Asia countries who join ASEAN (Association of Southeast Asia), is also actively involved in engaging regional economy cooperation forums, such as: ASEAN-China FTA, ASEAN-India FTA, ASEAN-Jepang Economic Partnership, ASEAN Regional Economi Partnership (ARCEP). The establishment of those economic regionalism is apparently a strategy in responding economical globalization. Indonesia’s involvement in those regional economy cooperations has increased its national commitment, both in going through economical liberization as well as in building its national economy competitiveness. This research describes Indonesian political challanges in responding the dynamic changes of that global economy.

Abstract

The government of Indonesia enacted a policy banning the export of raw minerals in 2009, materialized in Law No. 04 of 2009 on Mineral and Coal Mining. The law mandated the raw minerals processing inside the country before they can be exported to other countries by the year 2014. This policy has drawn response from the government of Japan as one of the importing countries. Japan had threatened to report to the World Trade Organization regarding the issue because they complained that the policy violates the General Agreement on Tariffs and Trade. This study discusses how the policy is in the effort of Indonesia to develop its nation without any intention to harm any other countries. The justification of the enactment of the policy is mandated under the 1945 Constitution and the policy in essence does not deny the General Agreement on Tariffs and Trade. The enactment of the policy has affected the raw minerals export activity in Indonesia when export activity reached its peak in 2013 and also the last year raw material export was allowed. The policy might also have impacts on Japanese mining industries which relies on the import of raw minerals from Indonesia and those having investments in Indonesian mining industries. Japan at the end cancelled its intention to report Indonesia to the World Trade Organization and agreed to solve the dispute through bilateral solutions.BAHASA INDONESIA ABSTRAK: Pemerintah Indonesia memberlakukan kebijakan yang melarang ekspor mineral mentah pada tahun 2009 yang terwujud dalam Undang-Undang No. 04 Tahun 2009 tentang Pertambangan Mineral dan Batubara. Undang-Undang tersebut mengamanatkan pemrosesan mineral mentah di dalam negeri sebelum dapat diekspor ke negara lain mulai dari tahun 2014. Kebijakan ini telah menarik tanggapan dari pemerintah Jepang sebagai salah satu negara pengimpor. Jepang telah mengancam untuk melapor kepada Organisasi Perdagangan Dunia mengenai masalah ini karena mereka mengeluhkan bahwa kebijakan tersebut melanggar Persetujuan Umum tentang Tarif dan Perdagangan. Studi ini membahas bagaimana kebijakan tersebut adalah upaya Indonesia untuk mengembangkan negaranya tanpa ada niat untuk menyakiti negara lain. Pembenaran atas berlakunya kebijakan tersebut diamanatkan di bawah UUD 1945 dan pada intinya, kebijakan tersebut tidak menyalahi Persetujuan Umum tentang Tarif dan Pertambangan. Pemberlakuan kebijakan tersebut telah mempengaruhi aktivitas ekspor mineral mentah di Indonesia di mana kegiatan ekspor mineral mentah paling tinggi pada tahun 2013 yang merupakan tahun terakhir di mana mineral mentah diizinkan untuk diekspor. Kebijakan tersebut memiliki dampak yang mungkin terjadi bagi industri pertambangan Jepang yang mengandalkan impor mineral mentah dari Indonesia dan yang memiliki investasi di industri pertambangan Indonesia. Jepang pada akhirnya membatalkan niatnya untuk melaporkan Indonesia ke Organisasi Perdagangan Dunia dan sepakat untuk menyelesaikan perselisihan tersebut melalui solusi bilateral.

Abstract

This article tries to explain some thoughts on the importance of cultural factors in the study of International Relations (IR).  The mainstream theories of international relations since the end of the World War II have ignored the role of cultural factors in world politics. But, after the Cold War era in 1990s, culture began to enter the center of research on international relations.  After the Cold War ended, cultural factors become particularly prominent and began to gain more attention from the scholars of International Relations. There are at least three prominent theories which are increasingly taking into account the role of cultural factors in international relations, that is, Huntington’s “clash of civilization” theory, Nye’s “soft power” theory, and constructivism theory. In addition, since the 1990s, many studies conducted by IR scholars have focused on the relationship between culture and the foreign policy of a country. The emergence of international culturology as a sub-field of IR studies further confirms that culture is an important variable in international relations.

Abstract

As a neoliberal institution, European Union has succeded in integrating. However, after the treaty establishing a constitution for Europe was failed to be ratified, European Union is experiencing setback of legitimacy. European Union later imposed Lisbon Treaty that was arranged right after the failure of constitution treaty. Still, the implementation of Lisbon Treaty triggered some new issues due to its content that is more or less similar to the previous unratified treaty. One of the issues came from the migration policy. The rejection from some of the member countries explained the legitimacy crisis on the institution of European Union. This legitimacy crisis is surely a negative precedent for European Union as a neoliberal institution. As in neoliberal institutionalism, an institution is supposed to be an independent variable when a state decides to cooperate and integrate itself in an institution. This writing is aimed to review the neoliberal institutionalism of European Union in the problems of the migration policy implementation upon Lisbon Treaty.This research used qualitative method, with neoliberal institutionalism as its core theory. This research found that European Union as an institution lacks of consideration towards the condition of its member states in making regulations. This can be seen on how the migration regulation on Lisbon Treaty still could not be implemented uniformly on all the member states. Besides, the refusal of Estonia, Hungary and Slovakia upon this migration regulation strengthen the crisis of legitimacy in European Union as a neoliberal institutionalism.. The spesific finding upon this migration issues on Lisbon Treaty brought us to a conclusion that the neoliberal institutionalism in European Union needs to be examined due to the decadence of the institution’s legitimacy.

Abstract

This article explains the Saudi Arabian oil crisis of 2014-2016. In 2014, the Organization of Petroleum Exporting Countries (OPEC) had been expected to cut production to stabilize the market  and control the price of oil,but instead of reducing their own production, Saudi Arabia pushed OPEC to let the market control the price of of oil. This raised the question of why Saudi Arabia led the OPEC push to let the price decline. The purpose of this article is to understand the reasons behind Saudi Arabia’s efforts as prices plummeted fron 2014 until 2016. This paper explores Saudi Arabia as the de facto leader of OPEC using geopolitical purposes to influences the rest of OPEC and to weaken their opponents including Iran, Iraq and Russia.

Abstract

Monetary transactions are no longer limited to traditional patterns as electronic systems using internet technology can facilitate whenever and wherever transactions without any face-to-face interaction.  In terms of payment methods, this technology is developing and known as digital currency. Bitcoin is the digital currency with the largest market value. It is an electronic payment system based on a mathematical systems. The idea is to produce an independent currency that is not tied to a particular central authority and has very low transaction costs. Digital currency uses the concept of cryptography to provide basic security functions, such as ensuring that Bitcoin can only be spent by those who have it and it cannot be duplicated. The emergence of this currency has caused controversy in many countries because of its unregulated nature. This study examines Bitcoin and whether it is categorized as money based on the concept of money and how the three main international monetary institutions (IMF, WTO, World Bank) respond to its presence with a basic analysis using the concept of cyberpolitics. This study concludes that Bitcoin has not fully met the criteria as a currency and there are no specific rules yet regarding the existence of digital currency. BAHASA INDONESIA ABSTRAK: Berbicara Transaksi, saat ini tidak lagi hanya terbatas pada pola tradisional, melainkan sudah berkembang menjadi lebih jauh ketika Transaksi difasilitasi oleh system elektronik dengan menggunakan teknologi intrenet, sehingga kapanpun dan dimana pun transaksi dapat dilakukan tanpa bertatap muka langsung. Dalam hal metode pembayaran, teknologi ini juga berkembang. Baru-baru ini dikenal juga istilah mata uang digital. Salah satunya adalah Bitcoin. Ini adalah mata uang digital dengan nilai pasar terbesar. Ini adalah sistem pembayaran elektronik yang didasarkan pada sistem matematika. Idenya adalah untuk menghasilkan mata uang independen yang tidak terikat pada otoritas pusat tertentu, dengan biaya transaksi yang sangat rendah. Mata uang digital menggunakan konsep kriptografi untuk menyediakan fungsi keamanan dasar, seperti memastikan bahwa Bitcoin hanya dapat digunakan oleh mereka yang memilikinya dan tidak dapat diduplikasi. Munculnya mata uang ini menimbulkan kontroversi di banyak negara karena sifatnya yang tidak diatur. Studi ini meneliti Bitcoin apakah dikategorikan sebagai uang berdasarkan konsep uang dan bagaimana tiga lembaga moneter internasional utama (IMF, WTO, Bank Dunia) merespons kehadirannya dengan analisis dasar menggunakan konsep cyberpolitik. Akhir dari penelitian ini menyimpulkan bahwa Bitcoin belum sepenuhnya memenuhi kriteria sebagai mata uang dan tidak ada aturan khusus mengenai keberadaan mata uang digital.

Abstract

This paper attempts to investigate the reasons behind the negative sentiments directed towards Chinese Indonesians from an International Relations (IR) perspective. By tracing back the treatment of the New Order government towards ethnic Chinese, it was found that such demonization initially happened due to two politically motivated reasons. Firstly, as part of de-Soekarnoization done by the New Order, the Chinese were outcast because Chinese identity does not conform to the “Indonesian identity”, which was in essence, the Javanese identity. Secondly, the condition reflected the change in Indonesian foreign policy which drifted apart from People’s Republic of China (PRC) as the latter was suspected to be involved in September 30 Movement. Then, I argue that due to those reasons, coupled by systematic maltreatment from the New Order Government, Chinese Indonesians were constructed as the “others”, that is, as non-Indonesians. Such construct has been deeply embedded such that reconciliation attempts done by the Reformation Era government were not sufficient enough to stop ethnic discrimination towards Chinese Indonesians from happening even until the present.
