Abstract

The Constitutional Court sets presidential threshold as an open legal policy or open law policy for legislators. In other words, presidential threshold as stipulated in Act Number 7 of 2017 on General Elections, especially in the article 222, does not contradict to the Constitution of the Republic of Indonesia 1945 and its accordance with efforts to maintain government stability. Although this decision left two constitutional judges dissenting opinion since it was issued, the decision is relevant to the fiqh siya>sah construct concerning the need to maintain government stability through determining sufficient conditions in the selection process for the head of state. Borrowing Norman Fairclough's Critical Discourse Analysis (CDA) approach, the decision is in accordance to the fiqh siya>sah dictum for two reasons. First, there is a religious dogma which states that a head of state must come from the strongest clan through prophet tradition (al-hadis) states, al-aimmatu min-quraysyin. Second, in the fiqh siya>sah tradition, any policy can be formulated as long as the benefit of the people can be achieved. The stipulation of strict prerequisites is not intended to obstruct the right of a mukallaf to be elected as head of state, but aims to achieve other interests that are greater and benefit society, in the form of advocating for the rights of the state, ensuring a sense of security, and the realization of religious values in social life.

Abstract

Paragraph 1, article 6 KHI and fiqih madzhab hanafiyyah both state the mandatory approval of the prospective bride. The similarity between the two raises the proposition that the article on women's consent in the KHI is relevant to the hanafiyyah school of thought. But in reality, the logical formulation sequence of the hanafiyyah version of the agreement law is built on the basic understanding that women have rights rather than their guardians so that guardians have no rights in marriage, seemingly incompatible with the Islamic Law Compilation. This encourages the importance of the hadith study on women's consent. Through a literature review (library research) with a comparative analytical descriptive model, it is concluded; First, the hadith for women's consent is understood by hanafiyyah that women are more entitled than their guardians to the agreement, contract and other things. In other languages, guardians do not have rights over their daughters so that guardians are not a condition or harmonious in marriage. Second, there is no relevance between KHI and fiqih madzhab hanafiyyah, because in the legal construction between the two is different, where women's approval of their marriage in the hanafiyyah school is based on the basic stipulation that the guardian does not have the authority to approve or marry so that the guardian is not needed in marriage, while KHI states that women only have the authority to approve their marriage while still giving marriage authority to the guardian of marriage.

Abstract

Marriage at a young age is a phenomenon in some Indonesian society, especially in rural areas or traditional societies, although this kind of marriage is rarely known because it is closed. This fact is due to several reasons which make this young marriage sustainable; including economic, social and cultural factors. In cultural factors, people often associate with elements of religion or the understanding held by society. The problem that arises is that there is no benefit that is obtained if underage marriages are still carried out. The methods used in this article is a qualitative approach to the library, where the focus is aimed against any reference about the religion, culture and islamic boarding school. The approach used is qualitative, which is a research procedure that describes the behavior of certain people, events, or places in detail and depth. While this type of research is literature. Namely, research that relies on reading sources, texts, and various information in the form of reading. In a different reference library research is research that is done to solve a problem that is based on a critical study of library materials and related research results presented in new ways.

Abstract

The psychological approach in Islamic studies has a significant role in explaining the external symptoms of religious people. Armed with psychological theories, it will be easy to know the level of religion a person understands, lives and practices. This paper aims to explain and analyze Islamic psychology based on a historical approach and analyze western psychology schools using an Islamic psychological approach. This study refers to the history of Islamic psychology from the 19th century to the modern era at this time, and also how the development of religious psychology. The results in this article are that humans have the potential to do good from the aspects of will, freedom, feelings, and thoughts to reveal the meaning of life based on monotheistic values ??so that humans are able to develop the potential and quality of Islamic life, namely by integrating the pyramid relationship between lust, intellect, and heart into the human psychological context based on the teachings of revelation that will give birth to a creative life as ordered by God in the Koran.

Abstract

Abstract: Inheritance is a complex problem that sometimes many people do not know the parts and the amount of distribution in order to divide and distribute inheritance. To complete the distribution of the inheritance, many fuqoha 'practice interpreting the verses of the Koran in order to give laws to parts of the inheritance that are not explicitly stated in the Koran and Hadith, for example in this article are part of the inheritance of the grandchildren. women who are not listed in the text but then the Fuqoha 'equate their share with the inheritance of the daughter.

Abstract

Abstrak: Abu> Hurairah merupakan rija>l al-h}adis yang paling fenomenal. Dia merupakan sahabat yang paling banyak meriwayatkan hadis dengan jumlah 5374. Kendati kuantitas hadis yang diriwayatkan oleh Abu> Hurairah paling banyak namun kualitasnya dipertanyakan oleh sebagian orang. Bermula dari permasalahan tersebut dapat dipahami, bahwa yang menjadi salah satu persoalan mendasar dalam studi hadis, yaitu masalah rija>l al-h}adis. Sebab rija>l al-h}adis akan menentukan derajat hadis, sebagai hadis s}ah}i>h, h}asan atau d}ai>f. Sementara, rija>l al-h}adis tidak memiliki kompetensi yang sama saat menerima, menghafal dan mencatat hadis. Apalagi dalam beberapa keterangan dijelaskan bahwa kepandaian baca dan tulis para sahabat di masa Rasu>l Alla>h sangat terbatas. Hal yang banyak dilakukan oleh sahabat saat menerima hadis dari Rasu>l Alla>h saat itu hanyalah menghafal, memahami, memelihara serta menyampaikannya kepada orang lain. Untuk itu, dalam artikel ini akan dibahas tentang seorang rija>l al-h}adis, Abu> Hurairah yang tergolong sahabat Rasu>l Alla>h yang fenomenal, karena meriwayatkan hadis terbanyak dibandingkan dengan sahabat Rasu>l Alla>h yang lainnya. Padahal dari segi masa berkumpulnya dengan Rasu>l Alla>h, Abu> Hurairah tergolong sangat singkat bila dibandingkan dengan Sayyidah A<<<<<isyah yang terkenal sebagai umm al- mu’mini>n. Inilah yang menimbulkan kontroversi tentang hadis yang diriwayatkan oleh Abu> Hurairah. Agar pembaca memperoleh pemahaman yang komprehensif terkait Abu> Hurairah akan penulis tuangkan pikiran penulis ini dalam sebuah artikel yang berjudul kontroversi dan kritik terhadap hadis riwayat Abu> Hurairah. Kata Kunci: Kontroversi, Kritik, Hadis, dan Abu> Hurairah Abstract: Abu> Hurairah is the most phenomenal rija>l al-h}adis. He is the friend who narrated the most hadis with the number of 5374. Although the quantity of hadis narrated by Abu> Hurairah is the highest, the quality is questioned by some people. Starting from this problem it can be understood, that which is one of the fundamental problems in the study of hadis, namely the problem rija>l al-h}adis. Because rija>l al-h}adis will determine the degree of hadis, as a hadis s}ah}i>h, h}asan or d}ai>f. Meanwhile, rija>l al-h}adis does not have the same competence when receiving, memorizing and recording hadis. Moreover, in several statements it was explained that the reading and writing skills of the friends during the Rasu>l Alla>h era were very limited. what many friends did when receiving hadith from Rasu>l Alla>h at that time was only memorizing, understanding, maintaining and conveying it to others. For this reason, this article will discuss about a rija>l al-h}adis, Abu> Hurairah who is a phenomenal friend of Rasu>l Alla>h, because he narrated the most hadiths compared to other Rasu>l Alla>h friends. In fact, in terms of the period of his association with Rasu>l Alla>h, Abu> Hurairah was very short when compared to Sayyidah A<isyah who was known as umm al-mu'mini>n. This has caused controversy about the hadis narrated by Abu> Hurairah. In order for the reader to gain a comprehensive understanding of Abu> Hurairah, the writer will write his thoughts in an article entitled controversy and criticism of the hadis narrated by Abu> Hurairah. Abstract

Supervision and registration of marriage is something that is urgent for the sake of being recognized and legislated by the state because it is a very important event. The Indonesian nation has been hit by covid 19 since March 2020 until now it has not ended, this virus is a pandemic category so it is not certain when it will end, spreading throughout the world. The research used the interview method conducted by researchers to Jombang District KUA officers in December 2020 regarding the activities of the KUA Jombang sub-district in the covid 19 pandemic season. The results of this study were the Jombang District Religious Affairs Office still carrying out the task of registering marriage but by using a breakthrough in online registration. according to the specified address, in the supervision of the implementation of the marriage contract council accompanied by Imamuddin in their respective village areas virtually by using video calls and active marriage registration without any rejection of marriage registration. The KUA of Jombang sub-district has also decided to lock down, namely closing the office and imposing WFH (work from home), where work is done from home. This was done in order to anticipate and reduce the spread of the Covid 19 virus because its impact is very dangerous for the safety of life. As the data collected by the Covid 19 cluster in Jombang sub-district in March-June 2020, Jombang sub-district experienced a red zone in the spread of covid 19, so a breakthrough was needed in the form of policies that provided errors and safety for Jombang sub-district residents in terms of administrative services for recording and implementing marriage contracts. This is done based on maqashid sharia, namely hifd an-Nafs, which is to protect life / soul and also in the form of syad ad-dzariah to prevent mafsadah / damage. The existence of the KUA policy of Jombang sub-district without prejudice to the implementation of the Decree of the Minister of Religion number 298 of 2003 concerning supervision and supervision and registration of marriages.

Abstract

Abstract: The study aims to analyze roles of the agents of change in Islamic society development in Kampung Wisata Bisnis Tegalwaru Ciampea Bogor by Yayasan Kuantum. The literary study uses library research model. The study concludes that roles implemented by Yayasan Kuantum Indonesia as the agent of change are as follows: (1) Facilitative role, by actively becoming the subject which socializes ideas about KWBT to Tegalwaru citizens, committing deals of cooperation in stating the benefit share from the visit, and engaging them as parts of the KWBT programs’ participants; (2) Educational roles, by awakening the awareness of Tegalwaru small enterprises to be willing to implement change in their own lives, delivering insights and trainings of entrepreneurship, delivering marketing training by using online medias; (3) Representative roles, by seeking the required resources, legalizing the establishment of programs, setting corporations with various external foundations, developing networks with people outside Tegalwaru, using social media roles, websites, television broadcasts, and YouTube videos for the requirements of publication in KWBT and promoting the products of Tegalwaru small enterprises. (4) technical roles, by gathering internal and external potentials through KWBT programs, moreover, Yayasan Kuantum also conducts management to program implementation, and the financial management inside.

Abstract

The purpose of this research is to find out the pakistani constitutional system in terms of tate institutions and fiqh siyasah. The method used is library reaserch with two approaches, namely conseptual approach and historical approach. The results of the research of the concept of Pakistani state regulation fiqh siyasah perspective in the era: (1) In general the state of Pakistan can be said to be a country with a weak democracies system, this is motivated by the unstable system of government and constitutional system since Pakistan's independence in 1947. In addition, the cause of the instability of the country is the violence and feud between three social forces, namely Hindus who are the majority in India, indian Muslims who are minorities and The British as invaders with modern political and technological forces that developed in the country of pakistan. (2) The establishment of the Indian Muslim League, Muhammad Ali Jinnah initiated the theory of "two nations" and formally presented the demands of a Muslim homeland separate from India. In a 1940 resolution the Muslim League conveyed the establishment of an independent and fully sovereign Pakistani state. (3) On 15 August 1947 Pakistan was born as a fully sovereign state for Indian Muslims. Islam and Muslims in Pakistan have made a real contribution in the development of civilization in the Islamic world. Pakistan is a country that takes Islam as a source of law has become a phenomenon in the study of the relationship of the country and religion in Islam.

Abstract

Abstract: Adhan, which is a sign of the entry of prayer time, is usually held at the beginning of time. Different things happened in Datar, Putukrejo, Loceret, Nganjuk, East Java where the call to prayer was not done at the beginning of time, but according to the schedule set by the local kiai or village kiai. In line with that, this article is the result of studies that have been carried out at that location using qualitative research methods and data collection techniques, namely through interviews and observations. Meanwhile, the data analysis used is descriptive inductive analysis method with conclusion drawing approach. Based on the explanation of the research that has been carried out, it is concluded that the village Kiai in determining the adhan's schedule by integrating the fiqh prayer time with local wisdom in order to obtain harmony. The purpose of determining the schedule for the call to prayer is to form the character of the importance of congregational prayers in the life of the congregation they lead.
