Abstract: This journal entitle the Function Punish In Economics Development, what at one blow become the main problem studied. With this step will be able to be known the economic area demand at law area which can be made by a worthwhile input to support the economic growth. This article is inclusive of research punish the convergent normatif at substance punish the primary and sekunder. Problems studied by through legislation approach (statue approach) and approach analyse the concept punish the (analitical conseptual approach). internal issue Formula this study is: 1) How relation of among law economicly 2) How function punish in economic development? Pursuant to inferential bibliography research that: 1) Between law and economic have the such correlation sliver between both. In microeconomic context, what its scope include; cover the business transaction from all economic perpetrator, stand in need of the law order which must have to be obeyed by the parties 2) Function And role punish very strategic in development in economic area. Extant law of regulation function to guide, to giving sanction guidance, and appliance for the merekayasa of social and economic life. Abstract

This study explains in detail the question of fair meaning in polygamy marriages. So far, the meaning of fair is always different from everyone. Therefore, there is a need for a comprehensive study to decipher the issue of the meaning of scientific fairness. Substantive justice in Islam is always associated with the maker of the syara' (Allah). In relation to polygamy, The fair is a condition for a man to be allowed to do polygamy. justice aspects in polygamy is not an easy thing to do. Islam does not forbid or encourage let alone rule polygamy, this is because polygamy is a behavior that has existed since the time of ignorance and then tightened requirements in Islam. Islam is very strict in giving conditions until it is almost said not to be, because the argument contained in the Al Qur'an, maybe on fair terms but followed by another verse which says that "will not be able to act justly despite trying as much as possible" Although in the end the scholars agreed that it was fair qualitatively humans will not be able to, so ,in the end the scholars agree that what is meant is the minimum limit that can be done to do justice, namely turn time, income and shelter

Abstract

Abstract: the Waqf is one of the productive efforts of an increase in welfare of society as a collective. In a community group, for example, if it turns out that many members of the community who need help, then it can be used productively endowments to help them, for with endowments productive can be obtained access to the funding sources so that generated sufficient capital. The funds obtained through productive endowments can be used as a source of capital so that it can then be used for fertilization of capital on an ongoing basis. On this occasion, the author wished to discuss the development of the following regulasinya, wakaf efforts in improving the economic empowerment of the community through endowments produkti. The methods used in this article is a qualitative approach to the library, where the focus is aimed against any reference about the Waqf and its development. The approach used is qualitative, which is a research procedure that describes the behavior of certain people, events, or places in detail and depth. While this type of research is literature. Namely, research that relies on reading sources, texts, and various information in the form of reading. In a different reference library research is research that is done to solve a problem that is based on a critical study of library materials and related research results presented in new ways.

Abstract

Abstrak: Kemiskinan adalah masalah serius yang dihadapi oleh negara Indonesia, walaupun Banyak upaya telah dilakukan oleh pemerintah namun tingkat kemiskinannya masih sangat tinggi, dalam upaya pengentasan kemiskinan diperlukan sinergi filantropi zakat. Penelitian ini mendiskripsikan bagaimana kontribusi filantropi zakat dalam upaya pengentasan kemiskinan yang ada di Indonesia. Penelitian ini dilaksanakan dengan pendekatan kualitatif, dan pengumpulan data meggunakan teknik observasi non partisipasi dan dokumentasi. Penelitian ini menunjukkan bahwa filantropi zakat terhadap keluarga miskin baik yang berupa karitas maupun pemberdayaan, serta penyediaan sumber-sumber produksi mempunyai kontribusi terhadap peningkatan kesejahteraan umat di Indonesia.

Abstract

Jurisprudence books divide the concept of marriage into two groups, First, the group that is permissible for marriage. Second, the group that is not allowed or forbidden to be married (mah}ram). The concept is based on the presence or absence of blood relations between the bride and groom. So in the fiqh study mah}ram is divided into three in general namely mah}ram bi nasab, mah}ram bi mus}aharah and mah} ram bi roudlo`. However, there is a relationship where the scholars disagree, namely whether a male adulterer has an affair with a daughter resulting from adultery ?. This is interesting to study considering that both fiqh books and laws in Indonesia have stated that children born outside a legal marriage (both adultery and siri) only have a nasab relationship (mah}ram) with the mother and family of the mother . To answer the problem of whether a male adulterer has a relationship with a daughter of adultery and may or may not get married, the writer will examine the criteria of mah}ram contained in the books of fiqh. After obtaining data about the forms of security, it is then analyzed using the legal excavation method in the form of qiyas. In the qiyas methodology there are stages to finding `illat law. The technique of determining `illat can be done by using two common methods, namely using the theorem naqli and` aqli. So that the 'illat law emerges 'illat similarity between cells of genetic material contained in sperm and milk so as to make both of them a major influence on the mental and physical health of a child born or breastfed that is inherited from the genetic cells of his parents. From these findings, it can be concluded that the marriage between biological father and daughter resulting from adultery is prohibited.

Abstract

Fiqh selalu menarik perhatian masyarakat, baik kalangan ahli maupun awam karena fungsinya sebagai hukum yang hidup di masyarakat. Kebutuhan akan fiqh ini ternyata menjadi pemicu sebuah fenomena akhir-akhir ini tentang perdebatan hukum Islam di media sosial yang kian miris ketika sudah mengarah pada justifikasi benar atau salah dan dilakukan oleh orang yang tidak berkompeten di bidang hukum Islam. Fenomena ini termati karena kurang mendalamnya pengetahuan fiqh yang dimiliki oleh mereka yang berdebat dan kurangnya kesadaran mereka akan keniscayaan perbedaan dalam dunia hukum Islam. Hal inilah yang mendorong untuk dilakukan sebuah kajian dengan fokus tujuan pada bagaimana faktor penyebab fiqh selalu ikhtila>f dan bagaimana penerapan fiqh di tengah ikhtilaf fiqh madhhab yang ada. Dengan menngunakan model penelitian kepustakaan dan dengan analisa kualitatif dengan model berfikir desriptif-analitis, disimpulkan bahwa: Pertama, faktor penyebab fiqh selalu ikhtila>f adalah aspek teoritis dan aspek praktis yang ada dalam fiqh itu sendiri. Kedua, di tengah ikhtila>f madhhab hanya fiqh yang sesuai dengan kondisi lingkungan dan masyarakat yang dapat menjadi hukum yang hidup dan efektif di masyarakat sehingga tidak memberatkan masyarakat secara umum dan tidak menimbulkan dampak sentimen antar golongan. Hal ini sesuai dengan asas penerapan hukum Islam berupa penciptaan keringanan (takhfi>f), kemudahan (taysi>r) dan penolakan bahaya serta kerusakan yang kesemuanya secara nyata dan jelas berorientasi pada maqa>s}id shari>’ah dan mas}lah}at.

Abstract

Religion, at least, consists of five dimensions: ritual, mystical, ideological, intellectual and social. The ritual dimension is related to religious ceremonies, some rites that are considered sacred such as prayer, mass or worship. The mystical dimension shows religious experience which includes at least three aspects: attention, cognitive systems, beliefs and fear. The ideological dimension refers to a series of beliefs that explain the existence of humans dealing with God and other creatures. The intellectual dimension shows the level of understanding of people towards their religious doctrine. The social dimension is the manifestation of religious teachings in social life. As for the other hand, culture is a complex whole, social heritage or tradition, ways, rules and ways of human life, human adjustments to the natural surroundings and ways to solve problems, the results of human intelligence and the results of association or human association. Abstract

Tradisi adalah segala hal yang diwariskan dari masa lalu kemasa sekarang. Beberapa catatan sejarah menuliskan bagaimana tradisi yang saat ini dilestarikan oleh masyarakat adalah hasil dari percampuran kebudayaan dimasa lalu, budaya dari agama-agama besar yang mendominasi keyakinan masyarakat Jawa, Hindu-Budha. Salah satunya adalah tradisi ruwah. Dalam tradisi ruwah mengajarkan pentingnya kerja sama, gotong royong dan berbagi dengan sesama. Tradisi ruwah desa yang menjadi kebanggaan warga dusun Ngendut adalah tradisi sebagai rasa syukur dan persembahan kepada alam, tuhan terutama kepada danyang dusun yang telah memberi limpahan hasil bumi, kesehatan dan kemakmuran. Tradisi ruwah desa diawali dengan tahlil dan yasin malam hari sebelumnya, lalu esok harinya dibuka dengan kenduri yang dilaksanakan dimakam dusun, dilanjutkan dengan pertunjukan wayang kulit sebagai inti dari tradisi ruwah desa yang dilakukan dipemakaman juga. Acara ruwah desa ditutup dengan pertunjukan wayang kulit dimalam harinya, yang dilaksankan didepan rumah kepala dusun atau dirumah warga lain sesuai dengan kesepakatan. Masyarakat dusun Ngendut sering kali disebut masyarakat abangan yang konotasinya mengarah kepada orang-orang dengan pengetahuan agama rendah dan sering kali melakukan kebiasaan bertentangan dengan agama. Diantara masyarakat yang memuja dan ngalap berkah dari danyang desa, muncul kelompok minoritas yang berusaha merubah praktik tradisi agar lebih islami. Meski dihadapkan dengan penentang dari kelompok mayoritas, orang-orang ini tetap pada pendirian dan berusaha melakukan langkah adaptif. Perjuangan kelompok minoritas ini mulai menujukkan hasil saat ini, meski dalam skala kecil.

Abstract

This research departs on academic anxiety related to the rationale of determining marriage age requirements in the statute, which is not regulated in classical fiqh. The main issues to be examined are concerning: (1) Determination of marriage age requirements according to Islamic law (2) Equalization of male and female marriage ages according to Islamic law (3) Correlation of equal marriage age with marriage maqashid. The results of the study concluded that; (1) Determination of the age requirement of marriage, however it is not discussed in classical fiqh, but has an academic foundation in accordance with Islamic law; (2) Equalization of male and female marriage age is in accordance with the principle of equality (al-musawah) in Islamic law; (3) Equalization of marriage age has a positive correlation in realizing maqashid marriage.

Abstract

Kajian terhadap pemikiran Tasawuf Said Aqil Siroj dilatarbelakangi oleh konsep tasawuf yang ditawarkan Siroj yang tidak semata-mata hanya terfokus kepada laku spiritual semata. Di satu sisi, Siroj membenarkan bahwa objek esensial dalam tasawuf adalah persoalan hati manusia (qalb) yang bersifat immaterial, namun demikian, tidak pasif terhadap kenyataan hidup. Bahkan Siroj mengkaitkan konsep tasawuf dengan sikap kebangsaan. Dalam hal ini tasawuf tidak bisa diturunkan derajatnya hanya semata-mata pada perbuatan yang secara lahiriah dinilai sebagai kebajikan seperti bersedekah ataupun kebajikan sosial lainnya. Kajian ini menunjukkan bahwa kajian tasawuf dalam pemikiran Siroj mampu dijadikan sebagai pendekatan yang mampu melahirkan pemahaman keIslaman yang moderat serta bentuk dakwah yang mengedepankan perkataan yang mulia (qaulan kariman), perkataan yang baik (qaulan ma’rufa), perkataan yang pantas (qaulan maisura), perkataan yang lemah lembut (qaulan layyina), perkataan yang berbekas pada jiwa (qaulan baligha), dan perkataan yang berbobot (qaulan tsaqila), serta tidak semata-mata merujuk secara paten terhadap ayat-ayat jihad yang seringkali hanya dipahami sebagai perang mengangkat senjata, padahal jihad pada masa nabi merupakan satu wujud dan manifestasi yang luas termasuk di dalamnya adalah pembebasan rakyat, penghapusan diskriminasi dan perlindungan terhadap hak-hak rakyat demi terbangunnya sebuah tatanan masyarakat yang beradab.
