Abstract

The purpose of this paper is to analyze an implementation of neutrality principles at sea in time of armed conflict. It because the law of neutrality at sea has not progressed and seem stagnant since 1907 on the Hague Convention. Indeed, the UN Charter and UNCLOS 1982 set up significant developments on international law. On the other hand, there still found a lack of rules available in particular area, therefore international community provide San Remo Manual 1994. The San Remo Manual created based on the Hague Convention of 1907, the UN Charter, UNCLOS 1982, other international treaties and customary international law. To conclude, that the law of neutrality at sea should respected the sovereignty of neutral countries

Abstract

In practice, the application of the complementarity principle in the Rome Statute remains unclear, particularly with respect to the prioritization of national penal law jurisdiction. This paper willdiscuss the relevance of the complementarity principle to the development of a national criminal justice system and to the investigation and prosecution of the most serious crimes provided for in the Statute. It was concluded that the complementarity principle should be used to unravel the twisted development of the national criminal justice system in accordance with the provisions of international law. We need to establish our national criminal justice system as the main and foremost forum (hence, willing and able) in the process of investigating and prosecuting the most serious crimes on earth. Dalam praktik, aplikasi Asas Pelengkap (the complementarity principle) dalam Statuta Roma masihbelum jelas, khususnya terkait dengan pengutamaan (prioritization) yurisdiksi hukum pidana nasional. Oleh karena itu, tulisan ini akan membahas relevansi asas tersebut terhadap pembangunan sistem hukum pidana nasional dan terhadap penyelidikan dan penuntutan kejahatan paling serius yang diatur dalam Statuta. Disimpulkan bahwa Asas Pelengkap harus Mahkamah digunakan sebagai pengurai benang kusutpembangunan sistem hukum pidana nasional Indonesia sesuai dengan ketentuan hukum internasional supaya menjadi forum utama (mau dan mampu) dalam proses penyelidikan dan penuntutan kejahatan paling serius di muka bumi.

Abstract

Litigation model on criminal justice process can’t give satisfy and justice to offender and victim crime, so must be reform. Criminal Justice System is a network of criminal justice by using criminal law as ultimate material. The resolution of criminal cases at the time in Indonesia based on KUHAP (Act No. 8/1981) is recognized as litigation model. On KUHAP, non litigation model on criminal cases resolution is unknown, but based data research in Central Java, we are concluding that criminal cases resolution through non litigation model can be enable in Indonesia. For offender and victim, they can look for by way and place other. Non litigation model of criminal cases resolution can answer weakness on litigation model and show that existence of justice in many room; and according to pluralism in our constitutional, this model ought to accommodate in criminal justice system.

Abstract

In order to application of judicial principle is simple, fast and low cost is to reduce accumulation of cases in the Supreme Court especially at the level of Cassation. Along with the increasing number of incoming cases, and was sentenced in the District Court and Court of Appeal, the amount of the proposed decision legal remedy of Cassation to the Supreme Court also increased and began to be a serious problem. For that we need to do some research on role of Judiciary in Legal action restrictions in order to reduce the accumulation of civil cases. Penerapan asas peradilan yang sederhana, cepat dan biaya ringan bertujuan untuk mengurangi penumpukkan perkara di Mahkamah Agung, terutama pada tingkat Kasasi. Seiring dengan makin meningkatnya jumlah perkara yang masuk, dan diputus di PN dan PT, jumlah putusan yang diajukan upaya hukum Kasasi ke MA juga semakin meningkat dan mulai menjadi masalah serius. Untuk itu perlu dilakukan suatu penelitian tentang Peran Lembaga Peradilan dalam Pembatasan Upaya Hukum dalam rangka mengurangi penumpukkan perkara perdata.

Abstract

This paper reviews the major changes of intellectual property condition in Indonesia after 2001. In that year, Indonesia, which has become a member of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) since 1994, was ready to meet its commitment under TRIPS. To do so, Indonesiahas made changes in the areas of legislation, administration, court proceedings, and law enforcement. The paper also discusses problematic issues surrounded the implementation of such changes in Indonesia. Tulisan ini melihat kembali perubahan-perubahan besar dalam bidang hak kekayaan intelektual di Indonesia setelah tahun 2001. Pada tahun tersebut, Indonesia, yang telah menjadi anggota Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) sejak 1994, siap untuk memenuhi komitmennya dalam TRIPS. Untuk memenuhi komitmen tersebut, Indonesia telah membuat perubahan-perubahan dalam bidang legislatif, administratif, tata cara pengadilan dan penegakan hukum. Tulisan ini juga membahas permasalahan di seputar pelaksanaan perubahan-perubahan tersebut.

Abstract

Even though States have undertaken more actions to protect the victims and punish the perpetrators in domestic violence cases, not enough attention is being paid to the unequal socio-economic position of women. This writing will analyse ways and means that may lead to the abolition of discrimination against women.  Walaupun Negara telah berupaya menghukum pelaku kekerasan dalam rumahtangga dan melindungi korbannya, perhatian terhadap posisi sosio-ekonomi wanita masih belum cukup diberikan. Tulisan ini akan menganalisis upaya-upaya yang dapat dilakukan untuk mengakhiri tindakan diskriminatif terhadap hak-hak wanita.

Abstract

AbstractMigrant workers are often discriminated against in almost every aspect of life. Discrimination against them is due to irrational dislike of them and also negative perception towards them. It is alleged that migrant workers contribute to the crimes hike in Malaysia. Using doctrinal research methodology, this article discusses direct and perceptive discrimination against them. This article concludes that physical discriminations are mostly happened because ineffective enforcement of the law, abuse of powers and human-trafficking problem. Besides, migrant workers have not being major contributor to crime hike. Malaysia should introduce comprehensive migration law and strengthen the monitoring of recruitment agencies.

Abstract

This study aims to analyse the factors that has caused the damage and the extinction of the cultural heritages in the city of Yogyakarta, among which are the constraints that arise in providing legal protection of cultural heritage objects and the concept of strong legal protection at the local government level. This study mainly oversees the weaknesses in the legal protection of cultural heritages in Yogyakarta, as it has resulted in lack of regulations protecting the status and surroundings of these heritages. Research results show that the legal protection towards cultural heritages in Yogyakarta remains weak. Studi ini bertujuan untuk menganalisis faktor-faktor yang menyebabkan kerusakan dan kemusnahan cagar budaya di Kota Yogyakarta, antara lain adalah hambatan yang timbul dalam memberi perlindungan hukum terhadap objek cagar budaya dan konsep perlindungan hukum terhadap objek tersebut dalam tingkat pemerintahan daerah. Studi ini secara garis besar meneliti kelemahan-kelemahan dalam perlindungan hukum terhadap objek cagar budaya di Kota Yogyakarta yang dirasa masih sangat kurang dalam membuat peraturan-peraturan daerah untuk melindungi status dan lingkungan dari cagar budaya di daerahnya. Dari hasil penelitian dapat disimpulkan bahwa perlindungan hukum terhadap benda cagar budaya di Kota Yogyakarta masih lemah.

Abstract

The pacta sunt servanda is one of universally recognized legal principles by which its existence has been known. Its mere relevance is related to treaty since this principle determines that agreed stipulations concluded among parties become legally binding and cause rights and duties to be fulfilled in good faith manner. As it is recognized and accepted among parties to the treaty, it becomes integral part of the law of the treaty particularly of the law of international treaty. The preamble and Article 26 of the 1969 Vienna Convention on the Law of Treaty and the 1986 Vienna Convention reiterate its legal existence as the guiding principle to make and to implement international treaty. In the Indonesian legal system, the existence of that principle inspires the formation of Article 1338 of Indonesian Civil Code and of Article 4 (1) the Law Number 24 of 2000. It can be concluded firmly that the existence of the pacta sunt servanda has formed and evolved as a legal system including the international law legal system today.

Abstract

The principle of freedom of contract established for much types of contract. This principle concerned onhow parties state their mind freely into the contract clauses. The primordial concept of freedom of contractwas reduced based on Indonesian judiciary practice. This normative research of law tries to analyse theconcept alteration of meaning and implementation of freedom of contract in Indonesian Judiciary practice.The Supreme Court of Indonesia through its precedent provides broader authority to the Judges in orderto supervise and remedy the unbalance stand of parties on a contract they state which causes one or moreconsiderations cannot be or make difficulties to perform. The result of this research show us that freedomof contract principle is confined by proportionality, appropriateness, and justice principles toward partiesin a contract stated.
