Abstract

Act Number 11 of 2012 involving social work profession in dealing with children in conflict with the law (ABH). This paper will discuss the role of social worker as professional that will work closely with legal professional. Clarity of roles is expected to avoid collisions with each other due to the jobs involved have some similar roles and functions. Public prosecutor, community worker and social worker are expected to work in harmony in performing their duties. Undang-Undang Nomor 11 Tahun 2012 melibatkan profesi pekerjaan sosial dalam menangani Anak yang Berkonflik dengan Hukum (ABH). Tulisan ini akan membahas peranan pekerja sosial sebagai sebuah profesi yang akan bekerja sama dengan profesi hukum. Kejelasan peranan ini diharapkan tidak terjadi benturan satu sama lain karena profesi yang terlibat mempunyai peran dan fungsi masing-masing. Jaksa, pendamping kemasyarakatan dan pekerja sosial diharapkan dapat berjalan harmonis dalam melakukan tugasnya.

Abstract

In carrying out their health services obligations, midwifes need to comply with professional standards because failure to observe careful and diligent practice may be a ground for holding the midwife accountable. Injured patient reserves the right to file a lawsuit against the midwifes by invoking breach of contract or wrongful acts as the basis of liability. Therefore, in carrying out his/her profession, a midwife must comply with professional standards, standard operating procedures, and regulated code of conduct. This article will analyse matters pertinent to profession, malpractice, and their efforts to heal. Bidan dalam melaksanakan kewajiban pelayanan kesehatan harus berdasarkan pada standar profesi. Jika dalam melaksanakan kewajibannya bidan melakukan kesalahan, maka ia dapat dimintai pertanggungjawaban. Pasien sebagai pihak yang dirugikan dapat mengajukan pertanggungjawaban bidan melalui gugat berdasarkan wanprestasi atau perbuatan melawan hukum. Oleh karena itu, dalam melaksanakan profesinya, seorang bidan harus memenuhi ketentuan standar profesi, standar prosedur operasional dan kode etik yang telah diatur. Dalam tulisan ini akan dicoba untuk dikaji hal-hal yang berkaitan dengan profesi, malpraktik, dan pertanggungjawaban dalam upaya penyembuhan.

Abstract

The conception of “formal truth” in civil procedure is about to become a debate among academicians and practitioners because it is deemed no longer relevant to achieve justice. Modern paradigm begins to consider that this concept should be given similar interpretation with material truth theory adhered by criminal procedure. Konsep kebenaran formal dalam acara perdata mulai menjadi perdebatan di antara para akademisi dan praktisi karena dianggap sudah tidak lagi relevan dan jauh dari rasa keadilan. Paradigma saat ini mesti mulai mempertimbangkan bahwa konsep kebenaran formal harus diberi pengertian yang sama dengan konsep kebenaran material dalam acara pidana.

Abstract

In Indonesia, women’s participation, particularly in parliament, has been intensively discussed in 2002. The extensive discussions continued in 2003 especially after the enactment of General Election Law. The enactment of this law is significant since it contained a provision regarding thirty percent quota for women, a provision which never appeared in the previous legislation. This provision is intended to increase the number of women in the legislature. This is based on the fact that in Indonesia the number of women is higher than that of men. The lack of women in parliament is perhaps one of the causes why issues about women rarely became a priority in government policy making. The significant number of women in parliament could be a way to articulate women’s interests in government policy making. This paper will specifically examine the implementation of ‘thirty percent quotas for women’ to increase the number of women in the Indonesian parliament. It argues that even though there is an effort to increase the number of women in parliament through electoral quotas, such an effort is not sufficient to increase the number of women in parliament. Electoral quotas may gain better result if it combines with the change of political culture and the change of government policy. In doing so, other actors such as political parties and the government should be involved. Political parties and the government should be more gender sensitive (women friendly) in policy making.

Abstract

AbstractSince the issuance of Temporary People’s Consultative Assembly Decree - TAP MPRS No. XXIII/66 until the Reformation era, the participation of strategic multinational corporations is needed for the development. However, in doing their activities, there was a corporation who committed bribery whose criminal law jurisdiction is related to Anti-Bribery FCPA of America. Although the bribery beneficiaries were sentenced in Indonesia because of the locus and tempus delicti of the crime was in Indonesia, since such corporation was convicted first in the US, the corporation is no longer able to be prosecuted in Indonesia because of Ne Bis In Idem.IntisariSejak terbitnya TAP MPRS No. XXIII/66 hingga era Reformasi, partisipasi korporasi multinasional dalam pembangunan sangat strategis diperlukan. Akan tetapi dalam kegiatannya ada korporasi melakukan tindak penyuapan yang yurisdiksi hukum pidananya ada titik-taut dengan Anti-Bribery FCPA Amerika. Walaupun penerima suap sudah divonis di Indonesia karena locus dan tempus delicti adalah Indonesia, tetapi karena korporasi penyuap mendadak lebih dahulu diputus bersalah di Amerika, telah berimplikasi korporasi tersebut tidak dapat lagi diadili di Indonesia karena Ne Bis In Idem.

Abstract

Status of land that can be controlled by the local government is the right of use and the right of management. The right of management can be the object of Agreement on Build, Operate, and Transfer between the local government and the company. Then, the company gets the right of management through the Government Decision which is written up in to a form of Decree of Granting Rights. In the last term of the Agreement on Build, Operate, and Transfer, the land and the building with all support facilities submitted by company to the local government. Status tanah yang dapat dikuasai oleh pemerintah kabupaten/kota adalah hak pakai dan hak pengelolaan. Tanah yang berstatus hak pengelolaan pemerintah kabupaten/kota yang dapat menjadi objek Perjanjian Banguna Guna Serah dengan Perseroan Terbatas. Perseroan Terbatas mendapatkan hak guna bangunan atas tanah hak pengelolaan melalui Penetapan Pemerintah dalam bentuk Surat Keputusan Pemberian Hak. Pada akhir masa Perjanjian Banguna Guna Serah, tanah dan bangunan beserta sarana pendukungnya diserahkan oleh Perseroan Terbatas kepada pemerintah kabupaten/kota.

Abstract

Creating an Asian model of alternative dispute resolution which considers Asian cultures is important. A mere adoption of western standard will less likely accommodate Asian’s unique way of handling disputes. Culture-related problems can be avoided if international commercial mediation or arbitration is tuned in to cultural needs and expectations. Penyusunan model alternatif penyelesaian sengketa gaya Asia yang mengakomodasi budaya setempat penting untuk dilakukan. Penerapan standar barat tidak selamanya cocok dengan cara unik orang Asia dalam memandang suatu sengketa. Konflik kultural dapat dihindari apabila mediasi atau arbitrase bisnis internasional disesuaikan dengan kebutuhan budaya setempat.

Abstract

This paper is an attempt to discuss some issues concerning of business settlement via Online Dispute Resolution (ODR), Online Arbitrate Agreement, Online Arbitrate Procedure, Online Arbitrate Judgment, and examining the practice of the ODR in Indonesia. This description is an attempt to give comprehensive view about ODR and how the law will be used to mediate the civil dispute using the Internet media and alternative possibility resolve civil conflict in the Indonesian society. In the future, this discussion will open a new way in facilitating Indonesian people, especially that are seeking the justice provision, in the resolving their dispute using via the ODR.

Abstract

Islamic law is integrated into but stands independently from Indonesia’s national law. It is integrated in the sense that its substance has been absorbed into the legal systems through laws and other legal rulings and binds all Indonesian citizens. It is independent however, in the sense that its substance governs the internal conduct of Muslims. Islamic law has strengthened the Unitary State of the Republic of Indonesia, especially after the amendments of the 1945 Constitution, whose legal system is not onlybased on the idea of a rechtsstaat or rule of law, but is also based upon elements of religious laws. Hukum Islam dalam sistem hukum nasional Indonesia bersifat integratif dan mandiri. Integratif berarti materi atau substansi hukumnya masuk menjadi bagian produk peraturan perundang-undangan, bersifatmengikat (imperatif) untuk seluruh warga negara. Bersifat mandiri, manakala materi atau substansihukumnya bersifat mengatur secara interen kalangan umat Islam. Hukum Islam menguatkan NegaraKesatuan Republik Indonesia terutama pasca amandamen UUD tahun 1945, sistem hukumnya tidak hanya berlandaskan pada prinsip negara hukum rechtsstaat ataupun the rule of law, tetapi juga berlandaskan pada unsur-unsur dari hukum agama.

Abstract

The state has failed to ensure legal protection for investigated suspects from violence committed by the police. Perpetrators of violence in Banyumas Police Resort were left untouched by law. This human rights violations continue to take place because they enjoy protection from their direct supervisors and police institutions.Hasil penelitian menunjukkan bahwa negara telah gagal memberi perlindungan hukum kepada tersangka dalam penyidikan dari kekerasan yang dilakukan oleh polisi. Pelaku kekerasan (penyidik) selama ini di Polres Banyumas tidak tersentuh hukum. Pelanggaran HAM ini terus berlangsung karena adanya pemberian perlindungan kepada mereka, baik dari atasan langsung maupun institusi Polri.
