Abstract

The silence of regulations pertaining to the protection and placement of Indonesian migrant workers shows that tha Indonesian nation’s Rechtsidee, the Pancasila, has not been manifested. We identify that the migrant workers are oblivious to the applicable regulations, not to mention the conflicts of law and their weak enforcement.Tidak berlakunya peraturan penempatan dan perlindungan TKI, belum mencerminkan cita hukum (rechtsidee) bangsa Indonesia sebagai nilai positif yang tertinggi yakni Pancasila khususnya sila kedua. Secara yuridis tidak sinkron secara vertikal maupun horisontal. Sedangkan secara sosiologis kurangnya tingkat kesadaran hukum TKI, kurangnya pengawasan dan penegakan hukum yang lemah.

Abstract

AbstractThis papers discusses the trend of custodial rights of underage children that fall to the fathers after divorce. The Legal Anthropology Study is conducted by interviewing 15 (ffteen) divorced couples wherein custody fell to the fathers. The tendency of granting custody to the fathers is motivated by several factors from the wives: affairs, ill temperaments, neglectful of children, animosity with the in­laws, and the desire to divorce quickly without the burden to care for children. Fathers accept the responsibility as the caregiver of children to show his economic capability; to easily oversee the development of children; to facilitate their daughters when they require custodians for their marriage as well as to provide affections. In caring for children, fathers are assisted by relatives.Intisari Tulisan ini membahas tren hak asuh anak di bawah umur pasca perceraian jatuh di tangan bapak. Studi Antropologi Hukum dilakukan dengan mewawancara 15 pasangan cerai dengan hak pengasuhan jatuh ke tangan bapak. Kecenderungan pengasuhan anak ke tangan bapak dilatarbelakangi faktor istri: selingkuh, tabiat buruk, penelantaran anak, bermusuhan pada mertua perempuan, ingin cepat bercerai tanpa beban mengasuh anak. Bapak menerima tanggung jawab sebagai pengasuh anak karena ingin menunjukkan bahwa ia mampu secara ekonomi; agar mudah mengawasi tumbuh kembang anak; memudahkan saat anak perempuannya nanti membutuhkan dirinya sebagai wali nikah serta ingin mencurahkan kasih sayang. Bapak mengasuh anak dengan bantuan kerabatnya.

Abstract

Community Based Correction is a type of coaching program for inmates as they live the rest of the sentence. They have been given the chance to return to society with a particular control or supervision. To implement the necessary operational program open prison five (5) basic principles, among others: the first principle prisoners should have the opportunity to obtain employment, the principle of the two prisoners must be selected first, third principle inmates should not be exploited, the fourth principle of security system should be a minimum, and The fifth principle of the transfer of responsibility for prisoners. Community Based Correction adalah jenis program pembinaan bagi narapidana sewaktu mereka menjalani sisa pidananya. Mereka diberi kesempatan untuk kembali ke tengah-tengah masyarakat dengan pengawasan atau supervisi tertentu. Untuk melaksanakan program operasional lapas terbuka diperlukan 5 (lima) prinsip dasar, antara lain: prinsip pertama narapidana harus memiliki kesempatan untuk memperoleh pekerjaan, prinsip kedua narapidana harus diseleksi terlebih dahulu, prinsip ketiga narapidana tidak boleh dieksploitasi, prinsip keempat sistem pengamanan harus minimum, dan prinsip kelima tanggung jawab pemindahan narapidana.

Abstract

The government’s intervention in wage policies started during the Old Order era with the enactment of Act Number 33 of 1947 on Accidents. During the New Order era the government expanded its intervention in wage policies by taking into effect Government Regulation Number 8 of 1981 on Wage Protection. Subsequently, during the Reformation era the government imposed further limitations to the administration of rules Private Law in matters of wage. As an impact of the socialisering process undertaken from period to period, the government has established various laws on wages intended to provide legal protection to workers. In other words, throughout those periods there has been a significant progress in terms of legal protection to workers in matters of wages. Campur tangan pemerintah di bidang pengupahan diawali pada era Orde Lama, yakni pada saat diundangkannya Undang-Undang Nomor 33 Tahun 1947 tentang Kecelakaan. Di era Orde Baru, peran pemerintah di bidang pengupahan semakin besar yaitu dengan ditetapkannya Peraturan Pemerintah Nomor 8 Tahun 1981 tentang Perlindungan Upah. Selanjutnya, di era reformasi pemerintah semakin membatasi ketentuan-ketentuan yang bersifat Hukum Privat di bidang pengupahan. Akibat socialisering process ialah di setiap periodisasi pemerintah telah menetapkan berbagai peraturan perundang-undangan di bidang pengupahan yang bertujuan untuk memberikan perlindungan hukum bagi pekerja/buruh. Dengan kata lain, di setiap periodisasi tersebut telah terjadi upaya peningkatan perlindungan hukum bagi pekerja/ buruh di bidang pengupahan.

Abstract

Even though Islamic law agrees with Javanese adat law in the type and status of inheritable property, we find a distinction in the matter of inheritance utilisation and distribution, heir groupings, and child portion. This article attempts to study the ontological aspects of inheritance laws of the two legal systems. Walaupun pada dasarnya hukum Islam dan hukum adat Jawa memiliki kesamaan terutama di jenis dan status harta warisan, ditemukan perbedaan dalam hal pemanfaatan dan pembagian harta waris, golongan ahli waris, serta bagian anak. Artikel ini mencoba membahas aspek ontologi hukum waris antara kedua sistem hukum tersebut.

Abstract

AbstractThe wage issue has always been a dilemma for workers and employers, if it did not solve that can lead disharmonis in industrial relations in Indonesia. The wage law based on principles of justice has always desired by parties. The Fairness in wages regulation  will be guided by the principles of good law. The balance of interests between workers and entrepreneurs are the basis of fairness in wages regulation . Justice and legal certainty must support each other to realize  an ideal of laws.  AbstrakMasalah upah yang selalu menjadi dilema bagi pekerja dan pengusaha, jika tidak ditanggulangi dengan regulasi yang dapat meminimalisir dua kepentingan yang selalu berbeda akan dapat menimbulkan disharmonis dalam hubungan industrial di Indonesia. Pengaturan upah yang berlandaskan prinsip keadilan selalu diinginkan oleh semua pihak. Keadilan dalam pengaturan upah  akan berpedoman pada asas-asas pengupahan yang baik. Keseimbangan kepentingan antara pekerja dengan pengusaha merupakan dasar keadilan dalam peraturan upah. Kepastian hukum dan  keadilan  harus saling mendukung    mewujudkan hukum yang ideal.

Abstract

This research was descriptive research. Secondary and primary data were analysed qualitatively. The result of the research shows that mostly, the application of adat law norm and principles appear in the domain of private, contract, marital, and inheritance law. The adat law norms which are frequently used as judge considerations are the right of spouse on the matrimonial property, the guardian of a child under his mother, and the status of ex-wife as the heir of her former husband. We also identify a number of adat law principles, which include the clear (terang), cash (tunai), real (konkret) and familiarity (kekeluargaan). Application of adat law is necessary owing to the normative legislative obligation. In practice, judges need to ensure that adat law norms are consistent with the applicable civil procedure. Penelitian ini bersifat deskriptif, yaitu melukiskan fakta obyek penelitian. Data primer dan sekunder dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa norma hukum adat yang dijadikan dasar pertimbangan putusan hakim adalah istri berhak atas harta bersama, anak kecil diasuh ibu yang bercerai, dan istri adalah ahli waris mendiang suaminya. Asas hukum adat yang mendasari putusan hakim mencakup asas terang, tunai, konkrit dan kekeluargaan. Alasan hakim menerapkan norma dan asas hukum adat dikarenakan kewajiban normatif dari undang-undang dan dalam upaya membentuk yurisprudensi. Namun, praktiknya tidak mudah sehingga hakim harus melakukan harmonisasi ke dalam hukum acara positif.

Happening phenomenon in law enforcement at current Indonesia is while justice progressively most moves over. Justice tend is ignored in law enforcement, eventually justice is fundamental and realities of laws. Even frequent being said justice is its heart of law, therefore while in law enforcement justice be ignored, law becomes not wherewith. Justice institute as institute foremost and castled deep enforcement episodic law functions as institute of place law to be kidded, commercialized and even commercial it’s called with jurisdiction mafia. That jurisdiction mafia takes shelter at turns back rule of law. To rule of law, justice and utility is sacrified. Abstract

AbstractEmployment law is a public law caused by sosialisering process. However, in the arrangement of employment relations can still be found the existence of provisions that are private in nature. This research aims to assess the standing of employment relations standpoint rule employment law studies and the standing of employment relations based on the nature of public and private law. Based on research, the position of employment relations based on rule employment law studies can be a heteronomous law and autonomous law or simultaneously in the form of heteronomous and autonomous law. While the position of employment relations based on the nature of the law can be public and private or at the same time is public and private. IntisariHukum Ketenagakerjaan merupakan hukum publik yang disebabkan oleh sosialisering proses. Akan tetapi dalam pengaturan hubungan kerja masih dapat ditemukan adanya ketentuan-ketentuan yang sifatnya privat. Penulisan ini bertujuan untuk mengkaji kedudukan hubungan kerja berdasarkan sudut pandang Ilmu Kaidah Hukum Ketenagakerjaan dan kedudukan hubungan kerja berdasarkan sifat hukum publik dan privat. Berdasarkan hasil kajian, kedudukan hubungan kerja berdasarkan ilmu kaidah hukum ketenagakerjaan dapat berupa kaidah hukum heteronom dan kaidah hukum otonom atau secara bersamaan berupa kaidah hukum heteronom dan otonom. Sedangkan kedudukan hubungan kerja berdasarkan sifat hukumnya dapat bersifat publik dan bersifat privat atau secara bersamaan bersifat publik dan privat.

Abstract

This study aims to analyse: (1) The function of the Administrative Court in providing protection against environmental sustainability; (2) Constraints of the implementation of the administrative court functions in resolving environmental disputes. The results showed that: The function of the Administrative Court in providing protection toward the environment is not optimal yet. Administrative Court Decisions has not provided environmental sustainability because judges tend to be formalistic procedural in using their consideration. This is due to the presence of a number of constraints which include: government decision restrictions in the field of environment that can be disputed in the administrative court, there is no use of the principle of sustainable development as the consideration for the judge in deciding the case, and the judges’ less understanding about environmental problems. Penelitian ini bertujuan untuk menganalisis: (1) fungsi PTUN dalam memberikan perlindungan terhadap kelestarian lingkungan; (2) kendala-kendala pelaksanaan fungsi PTUN dalam menyelesaikan sengketa lingkungan. Hasil penelitian menunjukkan bahwa fungsi PTUN dalam memberikan perlindungan terhadap kelestarian lingkungan adalah belum optimal. Putusan-putusan Pengadilan TUN belum memberikan perlindungan kelestarian lingkungan hidup, karena hakim cenderung bersifat prosedural formalistik dalam menggunakan pertimbangannya. Hal ini disebabkan terdapatnya sejumlah kendala yang meliputi: adanya pembatasan KTUN di bidang lingkungan yang dapat menjadi obyek sengketa di PTUN, belum digunakannya asas pembangunan berkelanjutan sebagai pertimbangan hakim untuk memutus perkara, dan pemahaman hakim yang kurang mengenai persoalan lingkungan hidup.
